Abstract

The growth and development of Small Medium Enterprises (SME) have various challenges that must be overcome. Financing is one of the most challenging issues to be funded. Traditional finance is a funding instrument that is somewhat difficult to penetrate for SME as they are not yet bankable and are in the stage of business initiation. This is resolved by the stipulation of POJK regulation Number 37/POJK.04/2018 which was amended to POJK Number 16/POJK.04/2021 and becomes alternative funding for SME in Indonesia. This study uses emipirical research method with a qualitatif study approach. Primary data was obtained based on interviews and secondary data using desk research. There are two products issued by Securities Crowdfunding Sharia: Shares and Sukuk. These two products must fulfill the requirements of sharia principles, which should not incorporate with syariah compliance. The result of this research is that the products in SCF Syariah do not violate Sharia Compliance. Four categories have been analyzed, and the results show that they do not contain four categories that violate Sharia Compliance.

Abstract

There are no clear provisions in the regulations that regulate the extent to which the delivery service is responsible for losses suffered by consumers for goods sent that are damaged or lost and the uncertainty of the obligations and fines imposed by the delivery service when it does not fulfill the promise of timely delivery becomes separate problem for consumers. This study aims to determine the accountability and efforts that can be made by consumers in the case of lost or damaged goods at PT. Tri Adi Together (Anteraja). This research is a normative juridical research using deductive thinking method. Data collection techniques were carried out by interviewing and library documents. This study uses a qualitative approach in analyzing the data that has been obtained: The results show (1) there are two forms of responsibility that have been carried out by PT. Tri Adi Bersama (Anteraja) in the case of lost or damaged goods, namely providing compensation to the owner of the goods and being responsible for unlawful acts committed by its employees. (2) There are efforts that can be made by consumers to demand the responsibility of PT. Tri Adi Bersama (Anteraja) for objects sent in the event of a loss, including efforts to pass the Consumer Dispute Settlement Agency (BPSK) with arbitration, conciliation and mediation as efforts made outside of court as well as filing lawsuits, examinations and verification as efforts through legal channels.

Abstract

Every citizen, including mental hospital patients, has the right to legal protection, as they are vulnerable to experiencing acts of violence by medical personnel. This study aims to analyze the legal protection for people with mental health conditions who once experienced acts of violence committed by medical personnel. This study used sociological research methods with a descriptive qualitative research approach. This study used primary and secondary sources of data. The authors collected data through observation and interviews. The data in this research were analyzed and then described as narrative texts. The results showed that people with mental health conditions could obtain legal protection from acts of violence committed by medical personnel if they truly experienced bad treatment. It ensures that people with mental health conditions obtain their rights as citizens to be equally treated before the law. In undergoing their tasks, medical personnel must follow the SOP (Standard Operating Procedures), which includes prioritizing patient safety and comfort to keep patients from rebelling when their illnesses recur.

Abstract

The Indonesian National Health Service (NHS) is part of Indonesia’s national social security system. Its implementation is full of problems, such as the rejection of patients, the NHS payment which is lower than the real health cost, sanctions, fines, etc. The Indonesian National Social Security System, especially the NHS services, was established by the state to give social protection to its citizens. The Black Swan Theory is based on the presumption that all swans are white, thus in this case, the Indonesian NHS is truly a program aimed to give social security in the health sector, just as the general conditions of social securities applied in other countries. This research studies this theory to explore the paradoxes which happen in the Indonesian NHS to find the black swan. In this case, the black swan is a paradoxical symbol regarding the regulations and the problems of the Indonesian NHS. This research uses the juridical-doctrinal or the normative method and is descriptive research with a qualitative approach. Based on the Black Swan theory, this research tries to find paradoxical, extreme, and unpredictable discrepancies in the Indonesian NHS. It is found that the Indonesian NHS is a black swan or unpredicted according to black swan theory. The objectives, practices, and regulations of this NHS are truly different from the NHS which is supposed to be given to the Indonesians. It transfers the government’s burden in establishing the health service and the rights of the citizens to the citizens, coupled with the threat of sanctions which is unknown in NHS. The applied Indonesian NHS has an extensive impact on hundreds of millions of Indonesian citizens.

Abstract

Artificial Intelligence is categorized into the domain of computer science focused on creating intelligent machines that function like humans. Artificial Intelligence supports institutions including Islamic Financial Services in learning, making decisions, and providing useful predictive analytics. The progress and promise that artificial intelligence has made and presented in finance have so far been remarkable, allowing for cheaper, faster, closer, more accessible, more lucrative, and more efficient finance especially during the pandemic Covid-19 when people are required to stay at home yet still doing a banking transaction. Despite the incredible progress and promise made possible by advances in financial artificial intelligence, it nevertheless presents some serious perils and limitations. Three categories of risks and limitations involve the rise of virtual threats and cyber conflicts in the financial system, society's behavioral changes, and legal amendments that cannot respond to technological developments, especially in developing countries. The main objective of this article is to evaluate the operations of the potential risks that may arise in the use of Artificial Intelligence in Islamic finance services, especially dealing with the legal arrangement that is supposed to be in line with business development. Indonesia is a country that adheres to civil law system, in which every legal arrangement is supposed to be based on written law. The lack of this legal system is where the speed of legal changes cannot keep up with the pace of technological development, which is present as a hinder to the development of Artificial Intelligence in the financial system. This article concludes that Artificial Intelligence will have a huge impact in the future on the Islamic Finance industry, but in the Indonesian context, it still needs various efforts to reduce the potential risk that eventually has a big impact on the progress of Islamic banks.

Abstract

The Indonesian Islamic nomocracy paradigm has a long history and a cultural relationship with the national struggle that coincides with political and religious orientations. The Islamic nomocracy is inseparable from the relationship between Islam and the state rather than being linked to Islamic doctrine and power. This research employed the normative sociological method. It used a philosophical approach from Barbour’s paradigm of the relationship between religion and science and Habermas’ thought on religion in public spaces. This research strives to analyze the Islamic nomocratic paradigm pattern prior to Indonesian independence as a crucial stage that influences the following eras, namely the post-independence era, the Old Order Era, the New Order Era, and the Post-Reformation era up to now. This research aims to find the basics and the development of the Islamic nomocracy in the Indonesian legal system. The roots of the Islamic nomocracy legal thought in Indonesia can be traced to the pre-independence era. In the development of Islamic kingdoms, there was a dialog and integration process between the Islamic nomocracy and the kingdom government. After the War of Java, the conflict and independence pattern was formed. Before Indonesian independence, the Islamic nomocracy thought developed into Pan Islamism which tended to be conical to legal formalization through the caliphate system. After Indonesia’s independence, some of the Islamic nomocracy legal thought recognized the state as one of the legal systems in Indonesia besides customary law and positive law. Then, Indonesia became a partly-Islamic Legal State with a constant up-and-down relationship with the state. The authors also completed this paper with perspectives of Spain and Russia as both have been ruled under Muslim governance.

Abstract

Divorce happens due to continuous disputes and fights due to economic reasons. This research aims to analyze the factors causing the increasing rate of divorce as well as its main causes amid the pandemic in Ternate City. This paper employed the normative juridical method which is a literary study that studies documents. Results showed that divorce is the last resort. Economic status is the factor that wives often use to file for a divorce, as husbands are no longer able to provide for the wife, causing family conflicts that lead to divorce. The second factor is the rampant cases of work termination. This has become one of the main causes of divorce amid the Covid-19 pandemic.

Abstract

There are many cases of water theft from the Regional Drinking Water Company, especially in Ternate City. Article 28 letter h Regional Government of Ternate City No. 28 of 2011 on the Drinking Water Service of the Ternate City Municipal Water Company prohibits taking drinking water directly from distribution pipes or service pipes without going through a water meter. This research to analyze legal efforts against criminal acts of theft of Drinking Water Company Ternate City water committed by customers and non-subscribers through criminal and social efforts. This empirical research uses a statutory approach and a case approach. The results showed legal prevention of criminal acts of water theft can be done through penal efforts emphasizing repressive efforts (suppression/ eradication/extermination) and non-penal efforts emphasizing social and community efforts (prevention/anticipation/control). It is expected that the combination of criminal sanctions and social sanctions is expected to reduce the rate of water theft.

Abstract

Pop-up advertisements have become prevalent on websites. When users click on the banner, they navigate a separate window; banner and pop-up advertisements contain attractive audio-visual and animated graphics. This intrusive advertising has not explicitly regulated Indonesia's current legislation, including Electronic Transaction and Information Law 11/2008 (ITE Law). Also, it is exempted in the Indonesian Pariwara Ethics, guidelines for advertising ethics and procedure in Indonesia. This study aimed to revisit consumers’ protection toward pop-up advertisements in Indonesia, with two main discussions. First, it discussed online consumers' perceptions of pop-up advertisements and the classification of their responses. Second, it enquired to what extent the legal and ethics protection for online consumers in Indonesia. By using empirical legal research, this study concluded that the ITE Law prohibits anyone from spreading online information with content that violates immorality and gambling, as it often contains in pop-up advertisements. Through the lens of business ethics, pop-up advertisements are new media and they should not be installed in such a way as to interfere with the freedom of internet users, given that pop-up advertisements do not reflect the ethics of honesty, trust, and advice in business. Abstract

Terrorism has become a global phenomenon, affecting not only those hurt or killed by acts of terrorism but also involving women as significant contributors to indoctrination worldwide, including in Indonesia and Uzbekistan. This research aims to explain the evolving roles of women in terrorism in Indonesia and Uzbekistan and how terrorists use cyber indoctrination to target women in these countries. The research was conducted in Indonesia and Uzbekistan using the classical-normative dogmatic juridical method with a library-based approach. Cyber indoctrination has proven highly effective in persuading women to join and take initiative in acts of terror. Women who become involved in terrorism due to exposure to pseudo-religious ideologies through cyber indoctrination have human rights and should be legally protected as victims of cyber indoctrination by terror groups. This article contributes to the recognition of women's rights as victims of cyber indoctrination and sheds light on the changing role of women in terrorism. It aims to raise awareness among society, governments, law enforcement agencies, and religious leaders about the strategies of pseudo-religious cyber indoctrination employed by terrorists. It encourages them to take preventive and repressive actions to combat terrorism and safeguard women from its allure.
