Abstract

This study analyzes the strategy of planting the Pancasila ideology to prevent terrorism and radicalism in State-Owned Enterprises (SOEs). Terrorism in Indonesia is often triggered by the spread of a radical ideology that targets various sectors, including state-owned enterprises, through intolerance, education, and social media. Using qualitative descriptive methods, data were obtained through interviews, observations, and document analysis, then systematically analyzed using the Miles and Huberman technique. The study results show that the factors that cause radicalism in SOEs include low literacy of Pancasila, weak internal supervision, and the influence of social media. The strategy is to instill Pancasila values through socialization, training, and tolerance campaigns involving BNPT, community organizations, and religious leaders. The conclusion of the study emphasizes that a holistic approach based on the Pancasila ideology can prevent radicalism, provided that there is a strong synergy between the government, SOEs, and the community in the implementation of this strategy.

Abstract

Almas filed a lawsuit to change the minimum age of presidential and vice presidential candidates from 40 years to 35 years. Almas believed that if it is not changed, it will be contrary to the Republic of Indonesia’s 1945 Constitution. This decision is controversial but has opened a rare opportunity for talented young people to ascend and hold presidential and vice-presidential positions via election, even when they are less than 40 years old. The Republic of Indonesia’s Constitutional Court judges partially accepted Almas' lawsuit, in which the age limit remains at least 40. However, it can be deviated if a person has had experience becoming a regional head (governor/regent/mayor). This research aims to analyze: (1) how Constitutional Court judges interpret the minimum age limit for presidential and vice-presidential candidates in the Indonesian constitutional system; and (2) how the Constitutional Court judges’ final authority, which is Decision No.90/PUU-XXI/2023 on the Minimum Age Limit for Presidential Candidates and Vice-Presidential Candidates is a controversial decision. Method: This study used a jurisprudence approach, which studied the judicial decision in court primary data. It was supported by secondary data, which were obtained through a literature review. It focused on the data of Decision No. 90/PUU-XXI/2023, the Indonesian Constitution, and the Election Law (2017). Findings: In this study, it was found that the Decision of the Constitutional Court No. 90/PUU-XXI/2023 on the Minimum Age Limit for Presidential and Vice-Presidential Candidates is controversial, considering how the judge decided it. Then, several judges were sentenced for the act of ethics violation by the Constitutional Court’s Honorary Assembly. Conclusion: The decision of the Constitutional Court is binding and final, even though it is controversial. Several judges were sentenced for committing a violation of ethics by the Constitutional Court’s Honorary Assembly. Even so, this decision also opened up an opportunity for talented but young people under 40 to become presidential or vice-presidential candidates in the election.Keywords: Reconstruction, Age Limit, Presidential Candidates, Vice-Presidential Candidates

Abstract

This study aims to determine IMA levels as a marker of oxidative stress that occurs in ectopic pregnancy and preeclampsia. The method of this study is screening using secondary data obtained from literature searches found in national and international journals, with the keywords 'Oxidative Stress' or 'IMA' and 'Pregnancy'. Articles are included in the inclusion criteria if they are published in national or international journals with topics in accordance with the research objectives in the period 2014 - 2024, full-text access, both in English and Indonesian. It was found that serum IMA levels were increased in preeclampsia and, In comparison to normal pregnancy, ectopic pregnancy. This literature study concludes that IMA can be a biomarker for pregnancy-related diseases, especially preeclampsia and ectopic pregnancy. Higher sensitivity and specificity results in preeclampsia compared to ectopic pregnancy, the IMA test is better used to identify preeclampsia compared to ectopic pregnancy.

Abstract

Background: In society, children have a highly vulnerable position, as their physical and mental condition is not yet strong and mature. There have lately been many cases of crimes against morality which involve children, especially the crime of sexual violence, including incest. Objective: This paper aims to analyze: (1) the law on child victims of incest applied at the Ternate City Police Force and (2) the obstacles in applying the law to protect child victims of incest at the Ternate City Police Force. Methods: This research was classic doctrinal research which employed a statute approach and a library approach. To collect data in this study, the researchers employed literature and legislation studies. Results: It was found that efforts provided for victims of underage sexual intercourse and rape in the criminal justice system are implemented through preventive and repressive approaches carried out by both the community and the government. Perpetrators of incest rape are charged with 3 legal regulations, namely the Sexual Violence Crime Law, the Criminal Code, and the Child Protection Law. The existing obstacle is that not many people understand the process of handling incest cases which should be punished more severely than ordinary rape.

Abstract

The concept of regional autonomy is explicitly regulated in Article 18 of the 1945 Constitution and several related laws and regulations which essentially provide authority and flexibility for provincial, district and city governments to regulate and manage their own government affairs according to the principles of autonomy and assignment tasks including the implementation of regional head elections carried out democratically. In the implementation of regional government, elected regional heads must also be able to realize the principles of democracy and must be able to run effective and responsive regional government to the needs of the community, must not deviate from moral norms and deviate from democratic principles. The problem in this study is How is the Legitimacy of Regional Heads in the Implementation of Regional Government in Accordance with the Principles of Democracy. This study uses an empirical legal method, namely in addition to reviewing data through literature, it also reviews data on events that actually occur through observation activities and so on. The purpose of this study is to analyze legislation and examine cases that have occurred in Indonesia regarding the legitimacy of regional heads in the implementation of regional government in accordance with democratic principles. The conclusion of this study is that based on the analysis of several laws regarding regional heads in the implementation of regional government and based on the analysis of cases of regional heads in leading regional government, they are not yet legitimate and are not in accordance with the principles of democracy

Abstract

The role of the Tidore Islands City government in realizing legal protection of geographical indications for Puta Dino Kayangan woven clothes in Tidore Islands City. Objective: This paper studies the role of the Tidore Islands city government in realizing legal protection of geographical indications for Puta Dino Kayangan woven fabrics in Tidore Islands City. The Puta Dino Kayangan woven fabric is a typical motif woven fabric from Tidore that has not uet been patented, thus requiring legal protection. Methods: This paper employed the empirical research method. The research location is focused on the Puta Dino Weaving House in Soasio Village, Tidore Islands City. Results: Puta Dino woven cloth is a typical Tidore craft product that should receive guidance as regulated in Article 70 of Law No. 20 of 2016 on Trademarks and Geographical Indications, which states that socialization and understanding of the protection of geographical indications and mapping and inventory of potential geographical indication products are carried out by the local Regional Government. Conclusion: This paper serves as an input or a reference material for local governments and related parties in efforts to realize the legal protection of geographical indications of Puta Dino Kayangan woven cloth, and also as input for the community and business actors about the importance of registering geographical indications.

Abstract

In this paper, the authors will analyze: (1) the details of the home ownership loan agreement in the Labuha Branch of Bank Syariah Indonesia (The Indonesian Sharia Bank/BSI) and (2) how to resolve the issue of default carried out one of the parties in the home ownership loan agreement in the Labuha Branch of BSI. Members of society who wish to own a home but lack funds may utilize the credit facilities provided by BSI by making a credit agreement (home ownership loan). It is one of the solutions for prospecting housing consumers to quickly have a house. This paper is urgent because the increasing Indonesian population leads to an increase in demand for housing. Banks like BSI can help society obtain house ownership loans amid the increasing house prices. This paper employed the normative empirical legal research method. Results showed that the agreement carried out by the debtor and creditor is already according to the applicable regulations. It was shown that there was an increase in the number of debtors who obtained home ownership loans from the Labuha Branch of BSI. In total, 83 debtors obtained such facilities from 2021 to 2023. In the case of problematic debtors, ten debtors experienced a default in the Labuha Branch of BSI from 2021 to 2023. In the case where debtors fail to carry out their obligations in paying installments or in repaying their debt, then the bank will sell the collateral object or the house.

Abstract

Indonesia held presidential, regional head, and legislative elections (elections) in 2019. Many Indonesians are apathetic towards elections. The problems in this research are: How can citizens guarantee their right to determine regional leaders through elections and what obstacles do citizens face in choosing democratic leaders who have integrity? This is normative legal research conducted by tracing the regulations related to the problem under study. Citizen guarantees in determining regional leaders through elections are regulated in Law no. 39 of 1999 concerning Human Rights, Article 23 paragraph (1); Article 43 paragraph (1); Article 1, paragraph 3); Articles 28D, E, and J of the 1945 Constitution; and Law no. 7 of 2017 concerning Elections.Keywords: Democracy, Guaranteed Elections, Regional Leaders, Citizens.

Abstract

This study aims to analyze the implementation of Electronic Medical Records (EMR) at Hidayah General Hospital Boyolali, focusing on the public perspective regarding patient privacy rights. The research employs a descriptive quantitative method with a survey approach. Data were collected through questionnaires filled out by 100 inpatients. The findings indicate that both the public perspective and patient privacy rights have a significant impact on the implementation of EMR. The public perspective contributes 39.4%, while patient privacy rights contribute 41.0%. Additionally, this study found that the level of EMR implementation is directly influenced by the public perspective (19.9%) and patient privacy rights (23.0%), as well as indirectly through electronic medical records (15.5% and 16.1%). These findings suggest that respecting patient privacy rights and understanding the public perspective are key factors in the successful implementation of EMR. The study recommends enhanced training for healthcare professionals, strengthening privacy policies, and developing feedback systems to improve healthcare service quality.

Abstract

The first objective of this study was to determine the extent of the role of the Karanganyar City Health Office in supervising traditional healers in Karanganyar City. The second is to find out what obstacles are faced and what efforts are made by the Karangnyar City Health Office to deal with these obstacles. This study uses an empirical juridical approach, namely a research conducted directly in the field at the Health Office in Karanganyar City which refers to written regulations / laws. From this research it is known that the Karanganyar Health Office has carried out its duties in accordance with the regulations even though there are various obstacles and they are trying to resolve these obstacles.
