Abstract

Indonesia is currently experiencing a very rapid technological advancement. Apart from conducting buying and selling transactions through the internet/digital media, people can also conduct businesses. Then, in this community service program, the authors discussed how to respond to this technological advancement. This is because, in this current millennial era, there is a risk for cyber-crimes and cyberbullying that is currently rampant in every existing social media to obtain money. The target of this socialization is the youth of the Paulan Village Karang Taruna (Youth Organization), Colomadu Regency, Karanganyar Regency, Central Java, Indonesia where almost all of them utilize the Internet in daily life. This community service utilized the descriptive method. The authors employed the legal counselling method as a method of analysis. This legal socialization activity was carried out through lectures, dialogs, discussions, as well as problem resolution related to legal awareness in utilizing the internet and social media with the theme “The Importance of Legal Awareness in Utilizing the Internet and Social Media”. Through this method, participants obtained materials on how to be wise in utilizing social media and the Internet. They are also trained to resolve cyber-crime-related legal issues. After participating in this event, it can be seen that the target of this socialization had a better understanding and knowledge on the Law on Electronic Information and Transaction. Apart from that, they also showed better attitudes in utilizing social media. Socialization should routinely be organized with different materials, while still discussing the importance of utilizing social media

Abstract

Vitamin D has a broad impact on the human body, including affecting the bones and the immune system. Vitamin D deficiency in pregnant women is a risk factor in several circumstances, such as preeclampsia, gestational diabetes, premature birth, and low birth weight babies. This study aimed to determine the vitamin D levels and their relationship to predisposing factors and estimated fetal weight in the third trimester of pregnancy. Eighteen pregnant women in their third trimester of pregnancy who received antenatal care in the Obstetric Clinic of Immanuel Hospital Bandung from January to December 2022 were used as subjects of this study. The inclusion criteria are third-trimester pregnant women, healthy, while the exclusion criteria are currently taking drugs that have side effects in pregnancy or having pregnancy disorders. Blood was taken to measure vitamin D levels, fetal weight was estimated with obstetric ultrasound, and the subjects filled in questionnaires about predisposing factors. The results showed ten pregnant women (56%) had vitamin D deficiency below 20 ng/mL in their third-trimester pregnancy. We found non-significant relationships (p>0.05) between predisposing factors (daily consumption of vitamin D, sun exposure, maternal age), estimated fetal weight, and vitamin D levels. This study concludes that 56% of pregnant women in their third trimester of pregnancy have vitamin D deficiency with no significant relationship with its predisposing factors and estimated fetal weight.

Abstract

In criminal law, restorative justice is a new thing. Previously, Islam had already known the term restorative justice in its criminal law (jinayah) with the term al-istiadah. Forms of application of al-istiadah include islah (peace) and al-'afwu (forgiveness). As something new, the implementation of restorative justice has resulted in reforms in the criminal justice system in Indonesia. In this study, the author tries to explain the benchmarks for implementing restorative justice in terms of the values of the mutual forgiveness approach (al 'afwu) for those who believe in Islam. This descriptive research uses normative legal research methods that prioritize secondary data and are analytical and descriptive in nature. The results of this study indicate a benchmark for the implementation of restorative justice as an alternative settlement of criminal cases using the Al 'Afwu approach in the context of resolving criminal cases for Muslims. The restorative justice system strives to fix or recover the impacts of a criminal act. But there needs to be the perpetrators’ efforts to return or fix the condition due to the impacts caused by the criminal actions they carried out.

AbstrakPemilihan umum dipilih oleh rakyat yang diusulkan oleh partai politik ataupun gabungan dari berbagai partai  pelaksanaan verifikasi pendaftaran dan pendataan partai politik yang dilakukan sejak bulan juli 2022. Partai politik yang lulus verifikasi sejumlah 18 partai, Partai politik yang telah lulus verifikasi tentunya akan mencari sosok calon calon perserta umum pemilihan. rumusan masalah 1). Bagiamana Peran Partai Politik Dalam Pemilihan Umum menurut Undang-undang No. 7 Tahun 2017 tentang Pemilihan Umum dan Undang-undang No 2 Tahun 2011 tentang Partai Poltik ? 2)Langkah strategi apa saja yang dilakukan partai politik dalam menentukan pilihan memenangkan calon calon perserta pemilihan umum? .  Metode penelitian kualitatif, jenis penelitian yang menggunakan normatif suatu peraturan terkait partai politik dan pemilihan umum. pendekatan penelitian melalui perbandingan peraturan. Hasil Penelitian 1)U undang-undang No. 2 Tahun 2011 parpol organisasi dari sekelompok orang yang memiliki kesamaan tujuan dan cita-cita dalam memperjuangkan kepentingan anggota politik, dalam rakyat pemerintahan. Sedangkan undang-undang No 7 Tahun 2017 Pemilihan umum dalam sistem ketatanegaraan dilaksanakan secara demokatis dan berintergritas. 2) langkah strategis Partai politik untuk menentukan bakal calon partai politik umum adalah memilih ; memilih calon calon dari tokoh negarawan atau sejarawan, memilih calon calon dari tokoh partai politik dan memilih calon calon dari artis, pengenalan calon calon perserta pemilihan umum melalui berbagai macam media sosial. Abstract

Pop-up ads are notifications on the smartphone window when opening a website or application, which are useful for attracting users when crossing the web. Legal and illegal online loans also utilize this feature in marketing their services. The Financial Services Authority has a vital role in eradicating these pop-up ads so as not to cause unrest in the community. The aim is to find out how the role of the Financial Services Authority in controlling the circulation of online loan pop-up ads and what the consequences are. This literature study research uses normative juridical research methods. The data combines primary, secondary, and tertiary legal sources, then processed through descriptive analysis to obtain detailed and structured results. The results show that pop-up ads for online loans, especially illegal ones, can bring unrest to the community. Therefore, people can be easily tempted to take out loans and end up badly when they cannot repay them. The reasons behind a person making a loan vary, such as attractive advertisements or urgent economic circumstances. The Financial Services Authority and other government agencies are working together to eradicate illegal online loans, one of which is blocking them so that only verified online loan pop-up ads remain. The hope is that the public does not need to worry about accessing online loans through pop-up ads because it can be ascertained that these loans are legal. This research concludes that online loan pop-up ads are still so troubling that the role of the Financial Services Authority and other government agencies needs to be improved. The Financial Services Authority must not be careless in eradicating them to create a healthy and safe economic environment for the community.

Abstract

One of the core foundations of the movement of Muhammadiyah (Indonesia's second-largest Muslim organization) is the theological strength of the al-Ma’un Qur’anic chapter which was taught by Ahmad Dahlan, Muhammadiyah’s founder. Dahlan interpreted al-Ma’un into three main activities, namely education, health, and charity of the poor. He also transformed religious understanding from mere sacred doctrines that are socially "soundless" into a cooperation that frees human beings. In this modern era, there is a need to relive the spirit of al-Ma'un, especially in the condition of life that is full of social injustice. In doing so, Muhammadiyah established the Lazismu institution which functions to channel donation and zakat (almsgiving) funds. This paper aims to analyze the concept of social philanthropy in Lazismu’s independence in the effort to fulfill the al Maun theology so that all the collected zakat funds can be channeled for social services and how this independence concept grows the Muslim society's trust in Lazismu as a social philanthropy institution of Muhammadiyah. Method: This paper employed the qualitative normative research method. Results: This paper found that to achieve independence, Lazismu established businesses to cover the costs of zakat distribution worker's wages. Thus, the obtained zakat may be channeled without having it cut to pay for amil’s rights. In this case, the money is obtained from businesses (amal usaha), which are productive business units. A side effect of Lazismu’s independence is that the community's trust in this organization with experience an increase as it channels 100% of its zakat funds to other groups of beneficiaries and does not take any to wage the amil.

Abstract

 This paper aims to analyze the implementation of restitution right fulfillment for children as sexual crime victims in the legal area of the North Maluku High Prosecutor’s Office, Indonesia and the challenges in fulfilling these rights. Restitution is compensation given to the victim by the perpetrator of the crime or a third party and is an effort to guarantee the rights of victims. There was an issue where restitution rights were seldom strived for by law enforcers. Another problem is that society lacks knowledge of the existence of restitution rights. This paper is urgent because it may provide information on why these issues exist and how to resolve them in order to give victims their rights. This was empirical research which employed the statute approach and the case approach. In this paper, the live case study was applied. Results showed that the restitution fulfillment of children as sexual crime victims in the North Maluku High Prosecutor’s Office was still suboptimum as there was only one case in 2022 where the general prosecutor strived to demand restitution. The restitution is regulated in Governmental Regulation No. 43 of 2017 and Guidelines Supreme Court No. 1 of 2021. Law enforcing apparatuses and social institutions need to organize an education program for society on restitution rights for children as sexual crime victims in the North Maluku Province to increase their awareness. The application for restitution should be strived for by law enforcers starting from the investigation stage as more time is available.

Abstract

Victims of sexual harassment against people with disabilities experience severe consequences. In addition to being vulnerable to prejudice or discrimination, this minority group also has difficulty in accessing adequate legal protection. The purpose of this article is to examine the legal protection provided to people with disabilities who are targets of sexual harassment in society. The research method used is a normative literature review that examines relevant laws, regulations, and practices. According to this study, although there are legal instruments such as Law Number 8 of 2016 concerning Persons with Disabilities and Law Number 12 of 2022 concerning Criminal Acts of Sexual Violence (TPKS), there are still a number of obstacles in implementing these laws effectively, such as lack of public awareness, limited access to legal infrastructure, and social stigma against individuals with disabilities. The results of this study highlight the need to improve the capacity of law enforcement, build accessible facilities, and educate the community to create a safe and supportive environment for people with disabilities. This article offers suggestions on tactics to improve legal protection and achieve social justice for victims of sexual disclosure who have disabilities.

Abstract

Pemberlakuan Surat Tanda Registrasi (STR) seumur hidup bagi tenaga kesehatan merupakan salah satu kebijakan baru yang diatur dalam Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan. Kebijakan ini bertujuan untuk menyederhanakan proses administrasi tenaga kesehatan, mengurangi beban finansial, serta meningkatkan efisiensi dalam praktik pelayanan kesehatan. Artikel ini meninjau kebijakan STR seumur hidup dengan menganalisis dasar hukum, implikasi praktis, dan tantangan implementasi, seperti sistem pengawasan dan pemeliharaan kompetensi tenaga kesehatan. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan analisis dokumen. Hasil kajian menunjukkan bahwa meskipun kebijakan STR seumur hidup memiliki potensi manfaat besar, keberhasilannya sangat bergantung pada pelaksanaan sistem evaluasi berkala yang efektif untuk menjaga profesionalisme tenaga kesehatan.

Abstract

Penyelesaian sengketa melalui mediasi telah menjadi fokus utama dalam konteks hukum acara tata usaha negara. Mediasi dianggap sebagai alternatif yang efektif dan efisien dalam penyelesaian sengketa administrasi negara, memberikan ruang bagi penyelesaian yang lebih cepat dan terstruktur. Tulisan ini bertujuan untuk melakukan analisis yuridis terkait penyelesaian sengketa melalui mediasi dalam konteks hukum acara tata usaha negara. Analisis ini akan mengkaji proses mediasi sebagai instrumen penyelesaian sengketa yang mampu memberikan solusi yang memuaskan bagi kedua belah pihak. Melalui pendekatan hukum, tulisan ini juga akan menguraikan landasan hukum serta aspek-aspek yang terkait dengan pelaksanaan mediasi dalam hukum acara tata usaha negara. Dalam hal ini, akan dianalisis prosedur, kelebihan, dan keterbatasan mediasi sebagai alat penyelesaian sengketa dalam konteks administrasi negara. Diharapkan analisis ini akan memberikan pemahaman mendalam mengenai peran mediasi dalam hukum acara tata usaha negara, serta memberikan sudut pandang yang lebih komprehensif terkait dengan efektivitas dan relevansinya dalam konteks penyelesaian sengketa administrasi negara. Implikasi terhadap penegakan hukum dan perlindungan hak-hak subjek hukum juga akan menjadi perhatian dalam tulisan ini.
