Abstract

The village government is currently given lots of new authority and funding from both the central and regional governments. Such things aim to increase the progress of development and prosperity of village communities. Unfortunately, this does not necessarily make the village governments run according to existing laws. Worse, they do not necessarily make progress. Concerning the prosperity of villagers, since the enactment of Law Number 22 of 1999, major changes have happened to villages. They are no longer areas that are directly supervised by the regional government or merely administrative areas. But the village has transformed into an independent and separate autonomous force with the peculiarities of self-government. This paper uses the normative juridical research method. Results show that the lengthy tenure of village heads impacts the democratization process in the regions. It will result in the stagnation of development progress in the villages. These conditions certainly resulted in negative speculations about the consequences arising from violations of justice to the possibility of many legal violations due to the long Village Head office term

Abstract

Digital banks in Indonesia are growing rapidly. This phenomenon has given rise to legal disharmony in laws and regulations, considering that banks are institutions with many regulations (fully regulated). Legal disharmony occurs because of the many weaknesses in the current banking regulations, which still focus on the Banking Laws. Law Number 10 of 1998 concerning banking was formed specifically to regulate conventional banking transactions, while the concept of digital banks in its implementation utilizes technology. This difference creates a gap leading to a legal vacuum. By interpreting the articles of Law Number 10 of 1998 concerning banking using a textual approach (focusing on text), this study unveiled that, as the basis for regulating digital banks, this law was still extremely low, limited and no longer compatible with the development of digital banks. Therefore, it is necessary to establish regulations for digital banks to provide legal protection to realize the legal goal of creating justice and legal certainty for the current and future development of the digital banking industry.

Abstract

A notary is a public official who has the authority to create an authentic deed and has other authority. This statement is stated in Article 1 of Law No. 2 of 2014 concerning Amendment to Law No. 30 of 2004 concerning Notary positions (hereinafter referred to as Law No. 2 of 2014). But there many cases about notary create authentic deed without any regards to ethics and fact. This problem actually a gap from this research. Gap from Law in the book and law in the practices. This type of study uses normative legal research. This study used two approaches, namely Conceptual Approach and Statute Approach. The specifications of this study are descriptive of analysis and qualitatively analyzed methods. Notary is required to be responsible for the deed she made, Notary runs her profession often subject to articles 263, 264, and 266 Jo Article 55 of the Criminal Code. The Notary Office Act does not specifically regulate the protection of the notary's law in the process of examining false information. The process of examining the Honorary Assembly does not provide legal protection, because the Law does not clearly regulate the protection law for Notary in criminal cases.

Abstract

The abuse of minors is a serious crime that violates children's rights and has long-term impacts on the physical, emotional, and psychological well-being of victims. Legal protection for children who are victims of abuse requires an approach that focuses on protecting children and their recovery. This study aims to explore the practice of accompanying cases of sexual abuse of minors at the Klaten Police Department and to analyze the effectiveness of assistance in the criminal justice system. The research method used is an advocacy method with a focus on legal assistance. Assistance is carried out during the examination process, from consultation to assistance in making reports to the police. This research is expected to contribute to the development of policies and practices for better assistance in cases of sexual abuse of minors.

Abstract

Informed Consent is patient consent based on an explanation by a doctor at the hospital and is used in law and medicine to protect the public as a patient who receives health services based on information provided by the hospital through a dentist. Informed consent is mandated by law to protect patients and medical professionals, especially dentists. It offers patients the comfort they need to make their own decisions. For dentists, it aims to provide legal protection against the risk of imposition associated with deficiencies in medical action. This was normative research, which examines the law along with literature studies. It aimed to find out how to apply informed consent and to find out the legal protection related to informed consent for medical staff. In the Ministry of Health's Decision No. 290 of 2008 concerning the Legalization of Medical Actions, a doctor's complete explanation for the patient must include the diagnosis and implementation of the medical action, alternative actions and risks, possible complications, prognosis for the procedure, and financing. Patients can make an informed decision after receiving a thorough explanation as they have the freedom to refuse the recommended treatment and seek a second opinion. Legal protection for medical staff in Article 50 of Law No. 29/2004 Medical Practice and Article 57 of Law No.36/2014 regarding Health Workers.

Abstract

Forest conservation currently attracts the attention of numerous countries in the world, including Indonesia. This is because the world’s forests have experienced terrible damage, including due to deforestation. Principal policies are crucial to prevent the problem of forest deterioration. Thus, many countries apply policies with the paradigm of sustainable forest development. It is based on balancing the sustainability of the economic, ecologic, social, and cultural functions through non-centralistic forest resource management which values the society’s independence. In essence, this paradigm uses local wisdom as its basis. Some requirements must be fulfilled to reach the goals of the forest policies. One of them is society’s active participation in conserving the forests’ natural resources. Society's participation in environmental conservation is crucial, as they act as the determinants (subjects). Apart from that, they simultaneously experience the impact of the determined policies (object).

Abstract

Terrorism has become a global phenomenon, affecting not only those hurt or killed by acts of terrorism but also involving women as significant contributors to indoctrination worldwide, including in Indonesia and Uzbekistan. This research aims to explain the evolving roles of women in terrorism in Indonesia and Uzbekistan and how terrorists use cyber indoctrination to target women in these countries. The research was conducted in Indonesia and Uzbekistan using the classical-normative dogmatic juridical method with a library-based approach. Cyber indoctrination has proven highly effective in persuading women to join and take initiative in acts of terror. Women who become involved in terrorism due to exposure to pseudo-religious ideologies through cyber indoctrination have human rights and should be legally protected as victims of cyber indoctrination by terror groups. This article contributes to the recognition of women's rights as victims of cyber indoctrination and sheds light on the changing role of women in terrorism. It aims to raise awareness among society, governments, law enforcement agencies, and religious leaders about the strategies of pseudo-religious cyber indoctrination employed by terrorists. It encourages them to take preventive and repressive actions to combat terrorism and safeguard women from its allure.

Abstract

Penelitian ini bertujuan untuk mengkaji kebijakan Perum Perhutani KPH Saradan dalam mengadopsi kebijakan Pengelolaan Hutan Bersama Masyarakat (PHBM) sebagai kebijakan kehutanan dengan pendekatan baru, yaitu meningkatkan kesejahteraan masyarakat yang tinggal di sekitar hutan dan sekaligus melestarikan hutan. Penelitian ini merupakan penelitian non-doktrinal dengan pendekatan kualitatif, yaitu sesuatu dilihat dari sudut pandang orang yang diteliti (informan). Lokasi penelitian berada di wilayah kerja Perum Perhutani KPH Saradan. Jenis data dalam penelitian ini terdiri dari data primer dan data sekunder. Data primer diperoleh dari wawancara dengan responden yang diambil dengan metode purposive sampling dan dianalisis dengan analisis kualitatif. Berdasarkan hasil penelitian dan diskusi, dapat disimpulkan bahwa kebijakan PHBM memiliki tujuh tujuan, yaitu: perencanaan dan pelaksanaan kegiatan yang lebih fleksibel, peningkatan tanggung jawab Perum Perhutani (KPH Saradan) terhadap keberlanjutan fungsi dan manfaat hutan, peningkatan peran dan akses masyarakat desa hutan (MDH) dan pemangku kepentingan pengelolaan SDH, penyesuaian PHBM dengan pembangunan daerah, peningkatan sinergi dengan Pemerintah, peningkatan usaha produktif sehingga masyarakat mandiri dan mendukung peningkatan Indeks Pembangunan Manusia (IPM). Implementasi kebijakan PHBM dalam konsepnya adalah pengelolaan hutan bersama masyarakat, yaitu prinsip kerjasama, pengelolaan bersama, dan tanggung jawab bersama. Kebijakan dengan pendekatan kesejahteraan ini juga mengambil jalur kesediaan untuk berbagi hasil hutan kayu dan non-kayu dengan masyarakat Desa Hutan (MDH) yang sebelumnya telah dilakukan dan memiliki konsep pertanian di area hutan sehingga hutan dapat dimanfaatkan untuk kesejahteraan tanpa menyebabkan kerusakan hutan.   Kata Kunci: Kehutanan, Kebijakan, Saradan, Kesejahteraan   This study aims to examine the policies of Perum Perhutani KPH Saradan adopting the Community Forest Management (PHBM) policy as a forestry policy with a new approach, namely increasing the welfare of the people living around the forest and preserving forests on the other hand. This research is a non-doctrinal research with a qualitative approach, that is, something is seen from the point of view of the person being studied (informant). The research location is in the working area of Perum Perhutani KPH Saradan. The type of data in this study consists of primary data and secondary data. Primary data obtained from interviews with respondents from sampled with the purposive sampling method and analyzed with qualitative analysis. BerdaBased on the results of the research and discussion, it can be concluded that the PHBM policy has seven objectives, namely: more flexible planning and implementation of activities, increasing the responsibility of Perum Perhutani (KPH Saradan) for the sustainability of forest functions and benefits, increasing the role and access of forest village communities (MDH) and stakeholders. holders of SDH management, aligning PHBM with regional development, increasing synergy with the Government, increasing productive businesses so that the community is self-sufficient and supporting the improvement of the human development index (IPM). The implementation of the PHBM policy in its concept is community forestry, namely the principles of co-operation, co-management and co-responsibility. The policy with this welfare approach also takes the path of willingness to share timber and non-timber forest products with the Forest Village (MDH) community which was carried out previously and has the concept of agriculture in forest areas so that forests can be utilized for welfare without causing forest damage.   Keywords: Forestry, Policy, Saradan, Welfare.

Abstract

In 2019, presidential and legislative candidates were elected simultaneously on April 17, 2019. Likewise, students are given the right to choose the mind and critical spirit of problem formulations 1) What are the obstacles in implementing the 2019 simultaneous election according to Fakultas Syariah student Iain Ponorogo? 2) What are the factors of Fakultas Syariah student Iain Ponorogo so that they are interested in choosing the Presidential and Vice-Presidential candidate pair No. 1 and the candidate pair for President and Vice President No. 2? 3) What are the factors that make Falkutas Syariah student Iain Ponorogo in choosing a legislative candidate? This research is a qualitative research with the type of field research. Research results 1) The implementation of the 2019 general election students do not understand because the KPU does not provide socialization, unknown candidates, election violations, many KPPS officers have died which has been shown, the factor of the figure of the presidential and vice-presidential candidates is also their consideration in giving their voting rights, choosing candidates because they follow their parents. 3) The student factor chooses a candidate from if they know the candidate choosing from the vision and mission of the candidate, but if the candidate is not known to choose from a political party, he chooses because he gets basic food and money

Abstract

Berangkat dari permasalahan perlu adanya perhatian serius dari pemerintah terkait jaminan perlindungan tenaga kerja Indonesia di luar negeri melalui penegakan hukum sehingga dapat menepis anggapan bahwa hukum dimanfaatkan oleh oknum tidak bertanggungjawab untuk membuat pola aktivitas perbudakan modern akibat lemahnya penegakan hukum. Pengabdian kepada masayarakat ini bertujuan untuk: 1). Mendeskripsikan perlindungan hukum pekerja migran Indonesia saat ini; dan 2). Mendeskripsikan upaya penyelesaian problem yang menimpa para pekerja migran Indonesia di luar negeri. Hasil pengabdian kepada masyarakat dengan mitra Pimpinan Cabang Istimewa ‘Aisyiyah Hong Kong menunjukan bahwa terdapat permasalahan hukum yang hingga saat ini tengah dihadapi oleh masyarakat antara lain permasalahan belum optimalnya penyelesaian konflik yang dialami oleh pekerja migran Indonesia di luar negeri. Sebagai upaya membantu masyarakat untuk menghadapi persoalan hukum tersebut, maka diselenggarakan pengabdian kepada Masyarakat yang dilakukan secara langsung sebagai wadah untuk menyiapkan pekerja migran Indonesia yang memiliki kesadaran diri dan kepedulian kepada isu-isu hukum dan keadilan sosial. Melalui Pengabdian hukum ini, para Pekerja Migran Indoensia menjadi paham terkait hak-hak dan metode penyelesaian hukumjika terjadi konflik.   Abstract Counseling on Problems and Legal Protection of Indonesian Migrant Workers in Hong Kong. Starting from the problem, there needs to be serious attention from the government regarding guaranteeing the protection of Indonesian workers abroad through law enforcement so that it can dispel the notion that the law is being used by unbalanced individuals to create a modern pattern of freezing activities due to weak law enforcement. This community service aims to: 1). Describe the current legal protection of Indonesian migrant workers; and 2). Describe efforts to resolve problems affecting Indonesian migrant workers abroad. The results of community service with partners from the Special Branch Leader of 'Aisyiyah Hong Kong show that there are legal problems that are currently being faced by the community, among other problems that have not yet optimally resolved the conflicts experienced by Indonesian migrant workers abroad. As an effort to help the community face these legal problems, community service is carried out directly as a forum for preparing Indonesian migrant workers who have self-awareness and concern for legal and social justice issues. Through this legal service, Indonesian migrant workers become aware of their rights and methods of legal resolution if a conflict occurs.
