Abstract

The global energy transition paradoxically has triggered massive nickel mining operations, severely threatening critical ecological vulnerabilities of small islands in Indonesia. This study aims to reconstruct the conventional anthropocentric Green Constitution paradigm by systematically integrating the Ecocracy doctrine and Rights of Nature. Utilizing a normative-juridical method with conceptual, statutory, and case approaches, this research analyzes various contemporary constitutional shifts. The study findings demonstrate that unregulated nickel extraction fundamentally destroys the ecological carrying capacity of vulnerable archipelagos. Crucially, Constitutional Court Decision Number 35/PUU-XXI/2023 functions as a monumental judicial resolution that firmly and implicitly recognizes nature as an independent legal subject holding absolute protection rights. In conclusion, this historic ruling establishes an erga omnes constitutional mandate for the state to immediately halt all destructive extractive mining operations within small island territories, effectively transforming Indonesia’s environmental law landscape from an exploitative framework into a highly progressive, strongly binding, and sovereign environmental ecocracy system.

Abstract

The criminalization of environmental activists through the application of the Electronic Information and Transactions Law reflects the tension between the protection of freedom of expression and the use of criminal law in the digital sphere. This study aims to analyze the application of hate speech provisions in the Daniel Tangkilisan case, evaluate the effectiveness of legal safeguards against lawsuits or criminal proceedings intended to suppress public participation in environmental matters, and formulate the direction of legal policy reform for the protection of environmental activists. This research employs normative legal research using statutory, case, and conceptual approaches. The analysis is conducted through a systematic and teleological interpretation of legislation, judicial decisions, and legal doctrines. The findings reveal divergent judicial paradigms between the Jepara District Court and the Semarang High Court in interpreting freedom of expression and public participation. The Jepara District Court adopted a formalistic approach, whereas the Semarang High Court applied a constitutional approach that recognized the protection of environmental defenders. The study further finds that the safeguards provided under the Environmental Protection and Management Law and the Supreme Court Regulation on the Adjudication of Environmental Cases remain ineffective due to the absence of procedural mechanisms within the criminal justice system. The novelty of this study lies in integrating the analysis of two judicial decisions arising from the same case with the formulation of an early-case screening model as a legal mechanism to protect public participation in the digital space. The findings contribute to the development of legal policies grounded in ecological democracy and the protection of citizens’ constitutional rights.

Abstract

Enforcement of environmental administrative law is something that is often found in every environmental problem in cases of environmental pollution by industry. Administrative law enforcement is considered the most important law enforcement effort. This is because administrative law enforcement is more aimed at efforts to prevent pollution and environmental damage. The research method used is an empirical legal research method that is descriptive in nature using a normative juridical approach. The source of this research is primary data obtained through interviews as well as secondary data, namely laws and regulations related to the object of research. The research results obtained are first, the enforcement of environmental law due to violations of environmental pollution due to waste disposal by the leather tanning industry in Garut Regency based on Legislation in the Environmental Sector is not optimal and the supervisory function is weak, resulting in various violations by the leather tanning industry is still found; and second, several factors in enforcing environmental law in Garut Regency towards the leather tanning industry for waste pollution, namely internal factors and external factors.

Abstract

This research aims to investigate the quality of learning at Bingkeng 01 Public Elementary School over the past five years, which has not been optimal, particularly in relation to the implementation of teachers' professional competence. Teachers' professional competence is considered crucial for ensuring mastery of subject matter and the expected quality of learning. Employing a qualitative approach with a descriptive method, this study collected data through interviews, observations, documentation studies, and triangulation. The findings revealed that the implementation of teachers' professional competence has been generally adequate; however, there is room for improvement in teachers' skills and motivation. Challenges in optimizing teachers' professional competence encompass additional responsibilities beyond teaching duties, insufficient support from teachers' professional organizations, and inadequate educational facilities. Efforts to overcome these obstacles involve balancing teachers' additional tasks, motivating support from school principals, involvement in teacher work groups, and providing relevant educational facilities. In conclusion, enhancing the implementation of teachers' professional competence requires a comprehensive strategy involving school principals, professional teacher organizations, and the provision of suitable educational facilities.

Abstract

Early reading ability is a fundamental literacy competence for grade I elementary school students. Preliminary observations at SDN 2 Sukorejo, SDN 4 Sukorejo, and SDN 2 Gandusari showed that reading instruction was still dominated by conventional practices, while several students experienced difficulty recognizing letters, blending syllables, distinguishing similar phonemes, and reading simple words fluently. This study examined the effect and effectiveness of speech recognition-based interactive learning media on students’ early reading ability. The research used a quantitative quasi-experimental method with a nonequivalent control group design. The sample consisted of 44 students: 32 students in the experimental group from SDN 2 Sukorejo and SDN 4 Sukorejo and 12 students in the control group from SDN 2 Gandusari. Data were collected through oral performance tests administered as pre-test and post-test, then analyzed using descriptive statistics, prerequisite tests, Independent Samples T-Test, and N-Gain. The findings showed that the experimental group obtained a higher post-test mean score than the control group. The t-test result indicated a significant difference with Sig. (2-tailed) = 0.000 < 0.05. The experimental group obtained an N-Gain of 0.470, categorized as moderate, while the control group obtained 0.178, categorized as low. Thus, speech recognition-based interactive media significantly and more effectively improved students’ early reading ability compared with conventional learning.
