Abstract

The Indonesian National Army (TNI) is part of Indonesian society that is trained and educated to maintain the integrity of the Republic of Indonesia. TNI has a life guideline in carrying out its official life, namely Sapta Marga and the Soldier's Oath to improve discipline in the TNI's official life. However, TNI members are only ordinary people, not free from mistakes and actions related to crime. One of them is the crime of desertion during peacetime. The crime of desertion during peacetime is a crime committed by military members by mistake or intentionally being absent without permission for 30 days. This type and research is a qualitative analysis research using primary data in the form of interviews and secondary data in the form of primary legal materials, secondary legal materials and tertiary legal materials. The results of the research are to examine the problems and find answers regarding legal policies, law enforcement and future regulations regarding the crime of desertion during peacetime committed by military members in the regionlaw of TGKH Air Force Base. Abstract

The phenomenon of globalization has a very broad impact on the lives of individuals, communities and countries. The impact covers various aspects such as ideology, politics, economics, socio-culture, and defence and security. Globalization can be interpreted as a process of interaction, dependency, interconnectedness, and mutual influence between individuals, groups, and countries. In the context of globalization, the life experience, ideas, and information has become a standard that applies throughout the world. This is due to increasingly sophisticated technological advances, from communication to transportation. Therefore, globalization has changed the face of the modern world and influenced the way humans live and interact. One of the influences of the global era that is of concern to the author is the problem of online loans which feels has really disrupted people's lives in society and the facts show that there have been so many victims as a result of this system. Online loans are money lending facilities by financial service providers that operate online. Because the system is virtual, online loans do not require collateral. Online loans are an innovation in the field of financial technology that makes it easier for people to borrow money. Firmly, online loans is a money loan facilitated by a financial service provider that is integrated with information technology, starting from the application process, approval to disbursement of funds carried out online or via SMS or telephone confirmation. Therefore, what online loans needs to be aware of are; 1) Loans without license. Online loans that are unregulated or do not have a license from a valid financial authority may be considered illegal; 2) Loans with high interest rates; 3) Aggressive or unfair billing; 4) Concealment of important information; 5) Identity falsification or fraud. This research was conducted in Pandaan District, Pasuruan Regency, East Java. The research method used is normative juridical using secondary data generally from the library, along with case examples, supported by empirical research based on direct experience, experiments, and observations of realities that can be observed concretely.

Abstract

Terrorism has become a serious international threat, and air transportation, particularly aircraft hijacking, is a crucial medium for criminal acts. This study aims to examine the legal norms regarding the regulation and effectiveness of law enforcement for terrorism crimes in the context of aircraft hijacking in Indonesia. Indonesia has ratified the Tokyo Convention (1963), The Hague Convention (1970), and Montreal Convention (1971), and regulates them in Law No. 5 of 2018 concerning the Eradication of Criminal Acts of Terrorism and Law No. 1 of 2009 concerning Aviation. The results of the study indicate that aircraft hijacking inherently contains elements of violence and threats that are characteristic of terrorism. Although the legal framework is in place, law enforcement faces obstacles, particularly related to regulatory weaknesses and criminal sanctions in the Aviation Law that have not provided a maximum deterrent effect. Therefore, a revision of the law is needed to strengthen legal certainty and justice.

Abstract

The imposition of criminal penalties for the crime of child molestation should require the judge to consider the consequences arising from the act, both the psychological and psychological aspects of the victim, so that in his decision he can satisfy the sense of justice for the victim and the community. Seeing this reality, criminal law should provide appropriate sanctions for the perpetrators of the crime so that the supremacy of law is truly upheld and order is created in society. The research method used is normative juridical law. The results of the study are Legal responsibility for perpetrators of sexual violence against children that the first form of responsibility is of course, criminal responsibility carried out by adult perpetrators which can be seen in the provisions of Article 82 Paragraph (1) must be viewed as inseparable from Article 76E of Law Number 35 of 2014 concerning Amendments to Law Number 23 of 2002 concerning Child Protection. The form of legal protection against objects faced by objects and the implementation of Restitution from the perpetrator, that restitution is a form of material legal protection. The perpetrator of the crime or third party is responsible for replacing the loss by providing fair restitution to the victim of the crime, his family or dependents. Restitution includes the return of property or payment for damage or loss suffered and the restoration of rights

Abstract

Domestic violence (DV) is a crime that harms victims physically, psychologically, and socially, violating human rights as regulated in Law No. 23 of 2004 on the Elimination of Domestic Violence. This study analyzes the application of criminal sanctions in Verdict No. 622/Pid.Sus/2019/PN JKT.UTR, where the defendant was sentenced to three years in prison for physically abusing his mother. The study examines the case from a justice perspective using the Theory of Punishment, the Theory of Legal Effectiveness, and the Theory of Justice. Findings indicate that the imposed sanctions were primarily retributive, while preventive and restorative aspects were inadequately applied. The main barrier to achieving substantive justice in this case is the absence of mandatory rehabilitation for perpetrators and the lack of recovery mechanisms for victims. Additionally, the limited gender-sensitive training for law enforcement officials and restricted access to rehabilitation facilities exacerbates the issue. This study recommends revising Law No. 23 of 2004 to mandate rehabilitation for perpetrators, strengthening collaboration between courts and social institutions to support victim recovery, and enhancing legal education for society to prevent domestic violence.
