Abstract

The implementation of inheritance law must be based on the principles of order and justice in the process of transferring the property of the heirs to the heirs who are in one family. Therefore, in determining the distribution of inheritance, there are three legal perspectives used, namely Islamic inheritance law, civil inheritance law, and customary inheritance law, all of which prioritize the principle of balanced justice. This is so that the distribution of inheritance can be done fairly between the heirs. The approach in this study uses a normative juridical method, with a doctrinal approach that refers to laws and regulations. The source of this research comes from secondary data obtained through the study of legal materials and literature. This study aims to analyze the legal basis used in applying the principle of justice in the perspective of Islamic inheritance law, civil inheritance law, and customary inheritance law in Indonesia. In Indonesia, there are three systems of inheritance law that apply, namely Islamic inheritance law, customary inheritance law, and civil inheritance law, which are accepted in Indonesian legal society. Based on the results of the research, the division of inheritance according to the three legal systems shows differences. First, according to Islamic inheritance law, the share of inheritance received by men is greater than that of women, which is 2:1, because men have a greater responsibility. Second, in civil inheritance law, the principle of justice is applied by dividing the inheritance equally between men and women in terms of rights and obligations. Third, in customary law, the distribution of inheritance varies depending on the customs of each region.

Abstract

Inheritance law is one part of civil law as a whole and is part of family law. The law of inheritance is very closely related to the scope of human life, because every human being will definitely experience a legal event in the form of death. The legal consequences that subsequently arise with the occurrence of a person's death legal event, including how to manage and continue the rights and obligations of a person who has passed away. In the inheritance law, it has been determined who is the heir, and who is entitled to get the share of the inheritance, how much is their share, how the provisions for its division are, and various matters related to the distribution of inheritance are also regulated. The law of inheritance is a law that regulates the transfer of property and material rights from an individual who has passed away to his heirs in accordance with Islamic law.

Abstract

Imprisonment is a normal form of sanction applied in the modern legal system. However, its existence is often debated from the perspective of Islamic law and customary law, which have different approaches to upholding justice in redressing violations. This research aims to analyze the concept of imprisonment in Islamic law and customary law, including its normative, philosophical basis and application in society. In Islamic law, the main emphasis is on restorative justice through hudud, qisas, and ta'zir, while customary law places more emphasis on resolutions based on deliberation, peace, and restoration of social relations. This research uses qualitative methods with a normative and sociological approach, and combines analysis of Islamic doctrine, customary nuoma, and legal practices in Indonesia. The results of this research show that imprisonment is not actually regulated in Islamic law or traditional customary law, but its existence can be adjusted as a form of ta'zir or dynamic adaptation of customary law. However, the application of imprisonment must still consider the values ​​of justice, humanity and local wisdom. It is hoped that this research can contribute to the development of criminal law that is harmonious with Islamic values ​​and customs in Indonesia.

Abstract

Based on the Civil Code, an illegitimate child who is not recognized by his father or mother is considered to have no legal relationship with his parents. However, if the illegitimate child is recognized and the recognition is accompanied by legalization, the child has the right to inherit the inheritance of the parents who recognize him, in accordance with the provisions of the distribution of inheritance regulated by law. According to Article 43 paragraph (1) of Marriage Law Number 1 of 1974, an illegitimate child who is not recognized still has a civil relationship with his mother and his mother's family. The rights of an illegitimate child who have been recognized and certified to the inheritance are the same as those of the legal child, making him an heir of an equal position. In civil law, the division of inheritance is regulated based on the applicable category of heirs.

Abstract

The Candi Kembar Batu, located in Muaro Jambi, is an ancient temple complex that represents the cultural and historical legacy of the ancient Jambi Kingdom. This article explores the history, architecture, and archaeological significance of the site, as well as its cultural values. The research method used includes a historical approach, analysis of archaeological data, and evaluation of the site’s architecture. Findings indicate that Candi Kembar Batu reflects a blend of Hindu-Buddhist influences and local Jambi traditions. The temple's unique design and its surroundings provide valuable insights into the religious, social, and cultural life of ancient communities in the region. The study also highlights the temple's potential role in the broader context of Southeast Asian religious architecture.

Abstract

Muaro Jambi Temple is one of Southeast Asia's largest cultural heritage sites, renowned for its historical, archaeological, and educational value. This study aims to explore various aspects of Muaro Jambi Temple, including its potential as a tourist destination, a source of historical learning, and its contribution to the local economy. Using a qualitative approach through literature analysis, the study identifies the relationship between cultural preservation, facility management, and the promotion of the temple complex. The findings reveal that Muaro Jambi Temple serves not only as a centre for cultural and religious tourism but also as an innovative educational resource for historical learning. Furthermore, environmental and facility management in the temple area play a crucial role in attracting tourists. However, challenges such as limited public awareness and insufficient promotion hinder the optimization of the site's potential. Therefore, collaboration among the government, academics, and local communities is essential to preserve and develop Muaro Jambi Temple as a sustainable cultural and educational hub.

Abstract

Gumpung Temple, as one of the historical sites of the Muaro Jambi Temple Complex, has an important value as a cultural heritage object that reflects the glory of past civilization in Jambi Province. This study aims to analyze the efforts to preserve Gumpung Temple from the perspective of cultural heritage and its potential as a tourism destination. The research method used is descriptive qualitative with a field study approach, in-depth interviews with related parties, and secondary data analysis. The results of the study indicate that efforts to preserve the temple face several challenges, such as structural damage due to natural factors, lack of awareness of the surrounding community, and limited funds and experts in restoration. However, the local government, in collaboration with the Cultural Heritage Conservation Center (BPCB), has implemented various programs such as periodic restoration, educational activities for the community and students, and promotion of culture-based tourism. Management of tourism based on cultural preservation is also one of the main strategies to make Gumpung Temple a leading tourist attraction, while maintaining conservation aspects. The results of this study also emphasize the importance of collaboration between the government, community, and private sector in supporting the sustainability of the preservation of this cultural heritage. In addition, the determination of Gumpung Temple as part of the world heritage site by UNESCO can be a strategic step to increase national and international attention to the preservation and development of culture-based tourism in Jambi Province. This study concludes that the preservation of Gumpung Temple as a cultural heritage object and tourism destination requires a holistic approach that integrates aspects of conservation, education, and empowerment of the local community economy. Thus, Gumpung Temple not only functions as a historical heritage but also as a tourism asset that provides sustainable economic and social benefits.

Abstract

This research discusses the strategy of distributing inheritance (tirkah) based on customary law in Jambi Province, which combines Malay traditional values with the principles of Islamic law. In Jambi Malay society, the division of inheritance is based on the philosophy of “Adat Bersendi Syara‘, Syara’ Bersendi Kitabullah”, which is the main guide to maintaining justice and social harmony. The process of division is usually carried out through deliberation involving family members, traditional leaders and ulama to reach consensus, while ensuring that individual rights are respected in accordance with customary law and Islamic teachings. This research identifies two main approaches to inheritance distribution: the collective system and the individual system. The collective system is applied to certain types of assets such as land and houses that are inherited jointly, while the individual system is applied to movable assets such as jewellery and vehicles. In this process, the Jambi Malay Customary Institution plays a key role as an arbiter to resolve inheritance conflicts while preserving traditional values. The results show that the division of inheritance in Jambi faces challenges, such as the influence of modernization and potential conflicts with formal law. Therefore, several strategies are proposed, including strengthening the role of customary institutions, organizing customary education, involving religious leaders, as well as facilitating deliberation to ensure this tradition remains sustainable.

Abstract

Regional autonomy is a new system of governance that emerged as a result of reform. This is a way to build and empower regions in accordance with the progress and conditions of society. Various aspects of democracy are currently developing in Indonesia. This strategy is used as a countermeasure against the economic and trust crises that have caused a shift in political power in Indonesia. Along with the implementation of regional autonomy in Indonesia, regional autonomy and its problems have become the subject of growing discussion. Although regional autonomy is an ideal idea for the Republic of Indonesia, it does not mean that it can be implemented without problems. Because our country is currently still in a transitional stage, the implementation of regional autonomy and its problems are still the subject of research for academics and government practitioners. In the book Regional Autonomy: Problems and Solutions in Indonesia, it is stated that the negative effects of regional autonomy are the emergence of conflicts between regional and central governments and opportunities for people at the regional level to commit various violations. In addition, there is a difference between areas that are still developing and those with high incomes. Undoubtedly, regional autonomy in Indonesia still faces many problems. Undoubtedly, these problems must be addressed and resolved so that the main objectives and noble values of regional autonomy can be achieved and realized properly.

Abstract

Guidance teachers, also known as counselors, are responsible for providing guidance and counseling to students in schools by paying attention to the growth of the student's personality and abilities both physically and spiritually. able to live independently and fulfill their various responsibilities as God's creatures along with individual, social, moral, religious, and cultural creatures. Counseling is an effort to help people through a process of personal interaction between counselors and clients to help them understand themselves, their environment, make decisions, and set goals, so that they feel happy and behave well. Guidance Counseling plays an important role in educational institutions because it functions as a supporter of the progress or decline of the quality of education. The role of guidance and counseling in improving the quality of education is not only limited to academic guidance but also personal, social, intellectual guidance, and the provision of values. School guidance and counseling is also called school counselors/psychologists, Counselors play an important role in the education system, and they are considered school psychologists. Their counseling must include and have the aim of improving and expanding the potential of students. They must also have the ability to interact with the community and have interpersonal skills. Good society and alternative options for students. Planning, supervision, evaluation and follow-up of extension activities are carried out by extension workers. Extension workers are also responsible for informing students about career paths and solving their problems. Extension workers are given full freedom by the Minister of Education to develop students' potential and provide effective guidance and extension.
