Abstract

Sharia investment through digital platforms in Indonesia. One of the Sharia investment platforms in the form of sukuk offerings is Lajnah Bisnis Syariah (LBS). The problem is that investments carried out at LBS experience many obstacles that are detrimental to investors. This is exacerbated by the absence of legal protection for investors in investor agreements with LBS. This research examines further the legal protection and regulations for LBS investors when facing problems with sukuk offerings that affect results and harm investors. The research method used is normative empirical. This qualitative data analysis method describes policies relating to legal protection for investors against risks associated with issuers experiencing problems with Sukuk. The findings of this research are that investors have the opportunity to understand better companies issuing sukuk, so they can reach better profit-sharing agreements and manage the risks associated with managing the business. The availability of information aims to reduce problems that may arise in sukuk offerings by issuers and increase capital market efficiency. This research concludes that PT Tri Buana Cemerlang investors offering sukuk through the Lajnah Bisnis Syariah (LBS) platform are protected by preventive legal mechanisms with problem resolution through non-litigation channels

Abstract

BASYARNAS decision should be final and binding, but it can still be canceled by the Religious Court if it is considered unfair or detrimental to one of the parties. However, in reality, decisions in the Religious Court are also often found to be weak, such as the lack of inclusion of legal basis or consideration of relevant aspects related to the decision. This research method is qualitative with the type of case study that uses a normative legal approach to examine the legal considerations used by the judge in deciding the case. The results showed that the cancellation of the BASYARNAS decision was granted because it was proven that there was deception by the Respondents against the Peace Deed, the determination of interest and fines which were considered unfounded. However, the legal basis used by the judge is still incomplete. Moreover, in terms of the lack of good faith in dispute resolution. The legal consequences of this annulment are the elimination of the provisions of the BASYARNAS-MUI JT Peace Decision Number xx/BASYARNAS-xxx/xxxx so that SHM number xxx cannot be executed because lawsuit Number xxxx/Pdt.G/xxxx/PA.xxx is declared lacking parties so it cannot be accepted, and Respondent II must renew the contract based on the clauses in the decision. Abstract

The Sharia banking market share is still stuck at the level of 7% of total national banking assets until the February 2024 period. Several strategic policies have been implemented by both regulators and Sharia banking players, but this has not yet increased the Sharia banking market share. Several other relevant studies inform that internal factors in the form of financial performance and macroeconomic conditions are one of the causes of the stagnant increase in the market share of sharia banking in Indonesia, so it is necessary to re-examine/analyze these factors. Furthermore, this research aims to analyze the influence of macroeconomic conditions as proxied by the inflation rate and BI rate as well as the financial performance of Sharia banks as proxied by the CAR and FDR ratios on the Market Share of Sharia Banks in Indonesia. The sample in this study was a total of sharia commercial banks and sharia business units with data regression analysis using the help of the Eviews version 12 program. The results of this research show that simultaneously the independent variables (inflation, BI rate, CAR and FDR) in this research have a significant influence on Market Share with a significance level of 5%. Overall, the results obtained show that the variables inflation, BI rate, CAR and FDR influence the Sharia banking Market Share with a significance level of 5%. Partially, inflation and FDR have no effect on the market share of sharia banking, but the BI rate and CAR have a significant effect on sharia banking in Indonesia.

Abstract

The aim of this research is to analyze the results of Islamic education research using a physics approach, analyze the learning of Islamic values through physics modules, and analyze students' Islamic character through a physics approach based on the integration of Islamic science. This research uses library research. Referring to the research objectives, findings, and results of the discussion in this research, it is concluded that the results of the analysis of Islamic education using a physics approach show that, first, the relationship between physics lessons and Islam, and second, the integration between Islam and physics contained in the verses of the Koran in textbooks. containing Islamic nuances with verses from the Koran and local wisdom can train students' religious character; third, students' understanding of the relationship between physics and Islamic education; fourth, learning Islamic values through physics modules can make students interested in studying physics, which is related to science. Islam, and fifth, the application of physics learning based on science-Islamic integration can improve students' learning outcomes and Islamic character. It is hoped that this research can make a positive contribution to more effective Islamic education in the realm of science integration as a foundation for the development of Islamic education in a multidisciplinary context.

Abstract

Throughout history, Ibn Qayyim al-Jawziyyah has been recognized as a Muslim intellectual figure who lived amidst the stagnation of thought, amidst the overwhelming scripturalism. Ibn Qayyim, however, unveiled this stagnation and scripturalism by unraveling the essence of human existence claimed by God Himself, namely the issue of the soul. Ibn Qayyim’s in-depth study of the soul is captured in his book titled Kitab al-Ruh. It is a document of knowledge that views the soul as a unique structure of human self compared to the body. This study examines Ibn Qayyim’s paradigm of the soul in its relevance to psychology. To what extent does Ibn Qayyim’s concept of the soul contribute to and intersect with the discourse of psychology.

Abstract

The background of this research is that the capital market is also able to provide real benefits for investors, where in the capital market, parties who have excess funds can meet with parties who need funds with certain agreements so that mutually beneficial reciprocity occurs, one of the parts is margin trading. Basically, no one wants disputes with other people. However, in a business relationship or an agreement, each party must anticipate the possibility of a dispute arising at any time in the future, especially in the world of capital markets, so what is the margin trading system like? and what is the role of the Alternative Dispute Resolution Institution (LAPS) in resolving margin trading disputes? on the capital market dispute itself. The type of research used in this study is library research, which is a study whose data sources are obtained from written sources, including books, laws, journals, encyclopedias, the internet, and other written works related to object under study. The approach used in this research is normative juridical, namely studying and testing secondary data in the form of positive law. This research yields, first, margin trading is capital for investors to gain greater profits through stocks that are rising in value when they themselves do not have enough funds to buy. In addition, they will also be charged interest on the loan. In the event of default or default, the consequence is that share ownership is automatically liquidated to cover losses. One of them is forced selling. Second, in the realm of civil law, there are several ways of resolving disputes which in general are through litigation (using formal court channels) and through alternative dispute resolution.
