Abstract

The importance of the role of terminal operators in enforcing Minimum Service Standards (SPM) for public transportation in order to create safe, comfortable, and affordable transportation for the community. The issues raised are how SPM is implemented in type A terminals and how terminal operators play a role in enforcing these standards. The method used in this study is normative juridical with a legislative and conceptual approach. The results show that the implementation of SPM at terminals is not yet optimal, as indicated by the large number of facilities and infrastructure that do not meet standards, as well as a lack of awareness among operators and service users of the importance of service standards. Terminal operators play a role in supervision, provision of facilities, and education for service users, but face obstacles such as limited budgets, human resources, and policy synchronization between agencies. Therefore, it is necessary to strengthen regulations, increase human resource capacity, and collaborate between agencies in order to realize public transportation services that meet minimum standards

Abstract

This research is motivated by the widespread existence of shadow terminals that disrupt the order of public transportation, one of which is the Gadang Bumiayu Shadow Terminal in Malang City. The research problems focus on how the authority of terminal supervisors in handling shadow terminals and the supporting factors for the effectiveness of supervision. This study employs a socio-legal approach with empirical methods through interviews with terminal supervisors and literature review related to transportation regulations. The findings indicate that terminal supervisors hold the main authority to regulate, supervise, and control public transportation activities, including vehicle roadworthiness inspections, route enforcement, passenger boarding and alighting supervision, and initial law enforcement. However, this authority has not been fully effective due to limited personnel, lack of supporting facilities, weak inter-agency coordination, and low driver compliance. The effectiveness of supervision can be improved through terminal revitalization, regulatory harmonization between central and local governments, the use of digital technology, and multi-stakeholder collaboration. Thus, addressing shadow terminals requires not only law enforcement but also strengthening public transport governance that is responsive and service-oriented

Abstract

Corruption is an extraordinary crime that has far-reaching impacts on state finances, the legal system, and public trust. In combating corruption, the Corruption Eradication Commission (Komisi Pemberantasan Korupsi/KPK) and the Public Prosecutor’s Office (Kejaksaan) play strategic roles, particularly in the prosecution of corruption cases. However, the amendment of Law Number 30 of 2002 into Law Number 19 of 2019 on the Corruption Eradication Commission has brought significant changes to the institutional position and authority of the KPK, affecting its relationship with the Prosecutor’s Office. This study aims to analyze the policies of the KPK and the Prosecutor’s Office in regulating prosecutorial authority and to examine the implications of the amendment to the KPK Law for the effectiveness of corruption law enforcement in Indonesia. This research employs an empirical legal research method using statutory, conceptual, and empirical approaches through interviews, observation, and literature review. The findings indicate that the amendment to the KPK Law has strengthened coordination and oversight mechanisms, but at the same time has posed challenges to the independence and speed of prosecution. Therefore, the effectiveness of corruption eradication after the amendment largely depends on strengthening institutional synergy, clarifying the division of authority, and ensuring consistency in prosecutorial policies between the KPK and the Prosecutor’s Office.

Abstract

This study aims to analyze the President’s authority to grant abolition as regulated under Article 14 paragraph (2) of the 1945 Constitution of the Republic of Indonesia and to examine its implications for the rule of law and the principle of checks and balances within the Indonesian constitutional system. Abolition constitutes a distinctive form of state clemency because it terminates criminal prosecution prior to a final court judgment, thereby directly intersecting with judicial independence. This research employs a normative juridical method using statutory, conceptual, and case approaches, with the granting of abolition to Tom Lembong serving as a case study. The results show that, normatively, the President’s authority to grant abolition is constitutionally valid; however, the absence of comprehensive statutory regulation creates legal uncertainty and weakens normative safeguards. Furthermore, the findings reveal that the supervisory role of the House of Representatives tends to function procedurally rather than substantively, thereby reducing the effectiveness of the checks and balances mechanism. Accordingly, this study concludes that strengthening the normative framework and oversight mechanisms is essential to ensure that the exercise of abolition remains consistent with the rule of law, substantive justice, and the independence of Indonesia’s criminal justice system.

Abstract

This study examines the concept of restorative justice as an alternative approach to addressing cyberbullying crimes within the Indonesian criminal justice system. The rapid development of information technology has significantly transformed social interactions, while simultaneously giving rise to cyberbullying as a form of psychological violence conducted through digital media. Conventional criminal justice mechanisms that emphasize retributive punishment are often considered insufficient to address the complex social and psychological impacts experienced by victims. This research employs a normative legal research method using statutory and conceptual approaches by analyzing relevant laws, legal doctrines, and scholarly literature. The findings indicate that restorative justice has obtained normative recognition within the Indonesian legal framework through several regulations, including the Juvenile Criminal Justice System Law (Law No. 11 of 2012), National Police Regulation No. 6 of 2019, and Prosecutor Regulation No. 15 of 2020 concerning termination of prosecution based on restorative justice. Therefore, restorative justice offers a more holistic and constructive approach that emphasizes victim recovery, offender accountability, and the restoration of social harmony. This study recommends the development of specific legal regulations governing restorative justice in cybercrime cases and strengthening the capacity of law enforcement officials in digital technology and restorative mediation.

Abstract

Policy challenges include conflicts with other regulations, inconsistencies, multiple interpretations, and inoperability, along with lack of evidence. Public policy is related to decisions in allocating resources in order to utilize and provide benefits to society with the intervention of leaders and policy analysis. The policy that needs to be considered is the government's readiness policy in assisting and saving the community in urgency and emergency conditions. It is applied to NTPD 112 in Probolinggo City. This attracts the author to conduct research related to NTPD 112 which is aligned with the principles of public policy. This research is a descriptive qualitative research to examine the concept of excellent and quality public policy with a pilot call 112 service in Probolinggo City. Data and information were collected through interviews, observations, and literature studies. The Probolinggo City Government has formulated public policies on 112 emergency call services with the main principles of excellent policies, including policies for the public; irrevocable policies; great and good policies; policies with management; policies with moral values; policies with systems; policies are a gift to the community; policies are an honor; policies to glorify the community; and policies as learning.

Abstract

Penelitian ini bertujuan untuk menganalisis secara mendalam pertanggungjawaban pidana terdakwa dalam kasus kecelakaan lalu lintas fatal serta membedah ratio decidendi hakim dalam Putusan Mahkamah Agung Nomor 156 K/Pid/2024. Kasus ini menjadi krusial untuk dikaji karena melibatkan terdakwa Roni S. Yadu yang mengendarai sepeda motor di bawah pengaruh minuman beralkohol jenis “cap tikus”, yang mengakibatkan tabrakan maut menewaskan korban Hais Hoga di Jalan Trans Sulawesi . Metode penelitian yang diterapkan adalah yuridis normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan kasus guna menelaah struktur penalaran hukum hakim secara komprehensif. Hasil penelitian menunjukkan bahwa pertanggungjawaban pidana terdakwa didasarkan pada terpenuhinya unsur kesalahan dalam bentuk kealpaan berat (culpa lata), di mana terdakwa terbukti melanggar Pasal 310 ayat (4) UU No. 22 Tahun 2009 akibat pengabaian standar keselamatan publik secara sadar . Pertimbangan hakim dalam menguatkan pemidanaan pada tingkat kasasi menegaskan bahwa pengaruh alkohol tidak menghapuskan kemampuan bertanggung jawab melalui doktrin actio libera in causa, melainkan menjadi faktor determinan yang memperjelas adanya sikap batin yang tidak peduli terhadap nyawa manusia. Penelitian ini menyimpulkan bahwa penerapan teori sebab-akibat adekuat secara sah membuktikan hubungan langsung antara kelalaian berat terdakwa dengan kematian korban. Selain itu, hasil kajian memberikan implikasi penting bagi penegak hukum dalam menetapkan kualifikasi kesalahan pengemudi mabuk demi mewujudkan keadilan hukum yang preventif dan edukatif bagi masyarakat pengguna jalan raya.

Abstract

POLRI dalam rangka penegakan hukum dengan menjalankan tugas dan fungsinya untuk tujuan menciptakan keadilan dan kepastian hukum serta ketertiban dalam masyarakat yang merupakan wewenang yang diberikan undang-undang, terkadang mengalami perlawanan dari masyarakat itu sendiri, bentuk perlawanan yang dilakukan dengan menyerang, melukai anggota polisi dan merusak, membakar fasilitas milik POLRI seperti kejadian di Surabaya tahun 2025. Massa demo total ada 17 fasilitas Polri yang dirusak hingga dijarah massa. 17 Fasilitas polisi itu, terdiri atas 13 fasilitas dibakar dan 4 lainnya dirusak berat. Tujuan dari penelitian ini adalah 1) Untuk mengetahui bagaimana proses penegakan hukum tindak pidana pengerusakan terhadap fasilitas kepolisian republik Indonesia. 2) Untuk mengetahui bagimana implementasi dalam tindak pidana pengerusakan terhadap fasilitas kepolisian republik Indonesia. Metode yang digunakan dalam penelitian adalah analisis yuridis normatif dengan bahan hukum primer, sekunder dan tersier yang diperoleh dari dokumen atau arsip- arsip pendukung seperti undang-undang, peraturan pemerintah dan lainnya. Berdasarkan hasil penelitian menunjukkan bahwa faktor yang melatar belakangi tindak pidana pengerusakan terhadap fasilitas kepolisian adalah faktor internal berupa emosial dan kekecewaan . Faktor eksternal berupa faktor lingkungan yang buruk dan budaya dengan kurangnya pemahaman. Terdapat beberapa Pasal KUHP yang dapat dikenakan terhadap pelaku perusakan fasilitas kepolisian, yaitu : Pasal 170, 192, 193, 197, 200, 201 KUHP Jo Pasal 55 dan Pasal 56 KUHP. Namun, penerapan pasal-pasal tersebut belum memberikan efek jera.

Abstract

Pelaksanaan hukum pidana yang konsisten dan berkeadilan merupakan kebutuhan mendasar dalam menjaga ketertiban sosial, terutama terhadap tindak pidana pencurian yang hingga kini masih sering terjadi dan menimbulkan keresahan di masyarakat. Penelitian ini berfokus pada penerapan Pasal 362 KUHP serta analisis ratio decidendi hakim dalam Putusan Nomor 309/Pid.B/2024/PN.Gpr. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa penerapan hukum pidana materiil dalam putusan tersebut telah dilakukan secara tepat, karena seluruh unsur tindak pidana pencurian sebagaimana dirumuskan dalam Pasal 362 KUHP terbukti secara sah dan meyakinkan berdasarkan alat bukti yang diajukan di persidangan. Pertimbangan hakim juga memperhatikan modus operandi yang dilakukan secara sederhana tanpa unsur pemberatan serta motif perbuatan Terdakwa, yang turut memengaruhi berat ringannya pidana yang dijatuhkan. Ratio decidendi hakim mencerminkan adanya upaya untuk menyeimbangkan kepastian hukum dengan asas proporsionalitas pemidanaan, sehingga putusan tidak hanya berorientasi pada pembuktian formal semata, tetapi juga mempertimbangkan keadaan yang memberatkan dan meringankan. Namun demikian, pertimbangan tersebut masih dominan dalam kerangka yuridis formal dan belum sepenuhnya mengintegrasikan tujuan pemidanaan yang bersifat rehabilitatif dan restoratif. Dengan demikian, dapat disimpulkan bahwa putusan hakim telah tepat secara normatif, tetapi tetap terbuka ruang untuk penguatan dimensi keadilan substantif dalam praktik penjatuhan pidana.

Abstract

Penelitian ini bertujuan untuk menganalisis norma yuridis serta batasan kewenangan Kepolisian Negara Republik Indonesia dalam menangani konflik sosial dan membangun kepercayaan masyarakat berdasarkan Undang-Undang Nomor 2 Tahun 2002 tentang Kepolisian. Permasalahan yang dikaji meliputi bagaimana pengaturan kewenangan kepolisian dalam menangani konflik sosial serta bagaimana peran kewenangan tersebut dalam membangun kepercayaan masyarakat. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual, yang didukung oleh bahan hukum primer, sekunder, dan tersier. Hasil penelitian menunjukkan bahwa kewenangan kepolisian dalam menangani konflik sosial mencakup tindakan preventif, preemtif, dan represif yang harus dilaksanakan sesuai prinsip legalitas, proporsionalitas, akuntabilitas, serta penghormatan terhadap hak asasi manusia. Namun, dalam praktiknya masih terdapat kesenjangan antara norma hukum (das sollen) dengan implementasi di lapangan (das sein), khususnya dalam penggunaan diskresi kepolisian yang berpotensi menimbulkan penyalahgunaan wewenang dan tindakan represif yang berlebihan. Kondisi tersebut berdampak pada menurunnya tingkat kepercayaan masyarakat terhadap institusi kepolisian. Dalam upaya membangun kepercayaan masyarakat, kepolisian perlu mengedepankan pendekatan humanis, transparansi, profesionalisme, serta kepatuhan terhadap kode etik profesi. Selain itu, penguatan mekanisme pengawasan internal dan eksternal, penerapan sanksi yang tegas, serta pengembangan model pemolisian berbasis kemitraan dan teknologi menjadi langkah strategis dalam meningkatkan legitimasi dan kepercayaan publik terhadap Polri dalam kerangka negara hukum yang demokratis.
