Abstract

The Indonesian capital market plays a pivotal role in mobilising long-term financing for corporations and providing investment opportunities to the public. However, persistent stock fraud cases undermine market integrity and investor confidence. This study aims to evaluate the effectiveness of the existing legal framework for investor protection against stock fraud, analyse its practical implementation, and recommend measures to strengthen both preventive and repressive mechanisms. Employing a normative legal research design with a qualitative approach, the study integrates statute, conceptual, and case approaches, focusing on Law No. 8 of 1995 on Capital Markets, OJK regulations, the Criminal Code, and notable cases such as PT Hanson International Tbk. The findings reveal that while the legal framework normatively aligns with the Legal Protection Theory, Justice Theory, and Legal Effectiveness Theory, substantial gaps remain between regulation and enforcement. Weak supervisory coordination, delayed intervention, lengthy judicial processes, and low investor legal literacy reduce effectiveness. Recommended reforms include adopting regtech and suptech, enhancing cross-agency data integration, implementing AI-based surveillance, establishing a specialised capital market court, and strengthening investor education. The study concludes that combining regulatory improvements, adaptive enforcement, and public legal empowerment is essential to safeguard investors, maintain market integrity, and promote sustainable economic growth.

Abstract

Penelitian ini menganalisis implementasi Peraturan Pemerintah Nomor 27 Tahun 2020 tentang Pengelolaan Sampah Spesifik, khususnya dalam konteks pengawasan perilaku masyarakat di Desa Yosowilangun, Kecamatan Manyar, Kabupaten Gresik. Perubahan pola konsumsi dan perkembangan teknologi telah meningkatkan volume dan keragaman sampah, termasuk limbah B3. Meskipun regulasi nasional telah ada, studi awal menunjukkan kesenjangan signifikan antara kebijakan dan implementasinya di lapangan, terutama terkait rendahnya kesadaran dan pemahaman masyarakat tentang klasifikasi serta pemilahan limbah spesifik dan B3. Menggunakan pendekatan kualitatif deskriptif, penelitian ini mengidentifikasi bahwa implementasi kebijakan belum optimal akibat kurangnya pemahaman masyarakat, lemahnya pengawasan aparatur desa dan petugas TPS, serta rendahnya partisipasi masyarakat. Faktor-faktor ini, sesuai teori Jan Marse, mencerminkan kelemahan pada aspek informasi, isi kebijakan, pembagian potensi, dan dukungan masyarakat. Temuan ini menyoroti perlunya strategi pengawasan yang terinstitusionalisasi, edukasi berkelanjutan, dan pemberdayaan masyarakat untuk mencapai efektivitas pengelolaan limbah spesifik. Penelitian ini memberikan kontribusi dalam memperluas pemahaman implementasi kebijakan lingkungan berbasis perilaku dan menawarkan rekomendasi praktis bagi pemerintah daerah.

Abstract

Justice collaborators, or "crown witnesses," have become essential in modern criminal justice systems, particularly in dismantling organized crime and uncovering complex murder cases. This study explores the legal protections afforded to justice collaborators in Indonesia through a doctrinal analysis of the Supreme Court Decision No. 1704 K/PID.SUS/2022, commonly known as the Richard Eliezer verdict. The objective is to critically examine the adequacy and application of legal safeguards provided to individuals who cooperate with law enforcement while implicated in serious crimes. Employing normative legal research methods and a statutory and case approach, the paper reveals discrepancies in the implementation of protections for justice collaborators. While the Indonesian Witness and Victim Protection Agency (LPSK) offers procedural protections, this analysis identifies significant gaps in enforcement, judicial interpretation, and institutional coordination. The findings underscore a need for stronger legislative frameworks and consistent judicial standards to uphold the rights and safety of justice collaborators. The implications extend to criminal law reform and the balancing of retributive justice with restorative mechanisms. This study contributes to the legal discourse on human rights protections in criminal procedure, particularly concerning vulnerable individuals assisting the justice system under duress or threat.

Abstract

The rights of justice collaborators (JCs) to obtain sentence reductions in murder cases remain inconsistently applied within Indonesia’s criminal justice system. This research addresses three core issues: the normative legal basis for JC rights, the consistency of judicial decisions in granting those rights, and the necessity for legal reform. Using a normative juridical approach supported by document analysis and expert interviews, the study examines Law No. 31/2014, SEMA No. 4/2011, and recent judicial decisions, including the high-profile cases of Richard Eliezer and Abdul Khoir. Findings reveal that while legal provisions exist, the absence of detailed indicators, formal mechanisms for status determination, and binding multi-institutional coordination leads to implementation gaps. Judicial discretion remains unchecked, resulting in unequal treatment of justice collaborators with similar contributions. The study concludes that a lex specialis law is urgently needed to standardize definitions, evaluation mechanisms, and inter-agency protection schemes. Recommendations include harmonization of technical norms, incorporation of JC recognition in verdicts, and alignment with UNCAC and UNTOC standards. This would strengthen legal certainty, uphold the principle of nulla poena sine lege, and enhance the effectiveness of the criminal justice system in addressing serious crimes through systemic cooperation.

Abstract

Undang-Undang Lalu Lintas dan Angkutan Jalan (UULAJ) mengatur bahwa kecelakaan lalu lintas merupakan tindak pidana yang memerlukan perhatian serius dari berbagai pihak. Angka kecelakaan yang terus meningkat memperburuk penanganan perkara ini, yang berdampak pada kesulitan aparat penegak hukum dalam menyelesaikan kasus dan memastikan pemenuhan hak-hak korban. Penelitian ini, yang bersifat hukum normatif, fokus pada analisis terhadap peraturan perundang-undangan, keputusan pengadilan, dan asas-asas yang terkandung dalam UULAJ. Penelitian ini bertujuan untuk mengkaji penerapan Restorative Justice (Keadilan Restoratif) oleh penegak hukum dalam penyelesaian perkara pidana kecelakaan lalu lintas, serta untuk mengevaluasi kesesuaian penerapan restorative justice dengan prinsip hukum positif Indonesia. Temuan penelitian ini menunjukkan bahwa penerapan keadilan restoratif dalam kasus kecelakaan lalu lintas memiliki potensi besar untuk menciptakan keadilan yang lebih manusiawi, sekaligus mendukung asas peradilan yang cepat, sederhana, dan murah.

Abstract

The purpose of this study was to determine whether the Ramp Check inspections conducted by the Malang PPP Technical Implementation Unit (UPT) on public transport vehicles were in accordance with Road Traffic and Transportation Law No. 22 of 2009. As mandated by law, the main objective was to determine the extent to which these inspections ensured vehicle safety and roadworthiness. Problems with human resources, equipment, and inter-agency cooperation are some of the issues revealed by this study's examination. Government Regulation No. 79 of 2013 and Ministerial Regulation No. 132 of 2015 provide a clear legal basis; however, the analysis concludes that the implementation of inspections at Malang Type B Terminal is not ideal. This report further details the existing regulatory obstacles and offers suggestions on how to strengthen the inspection system. It concludes with recommendations on how to address issues with operational processes and law enforcement to improve regulatory compliance. The ultimate goal of this study is to help improve the Ramp Check system, which will result in safer roads and better public transport in Malang

Abstract

This normative juridical study analyzes the supervision of public transportation in terminals as an implementation of the state's constitutional duty to provide safe and high-quality public services. The research examines the legal basis, authority, and supervisory mechanisms regulated by Law No. 22 of 2009 on Road Traffic and Transport and other relevant regulations. The analysis reveals that while the regulatory framework is comprehensive, the effectiveness of field supervision faces significant challenges. Primary issues include inconsistent law enforcement, limited resources, and insufficient inter-agency coordination, all of which impede the core objectives of supervision: safety and order. These findings recommend a necessary transformation in the supervisory approach, specifically through the digitalization of processes, strengthened sanctions, and enhanced synergy among authorities. These measures are critical for addressing legal and implementation gaps, ensuring legal certainty, and protecting the rights of public transport users

Abstract

Perdagangan ilegal satwa liar merupakan kejahatan lingkungan yang mengancam kelestarian biodiversitas di Indonesia. Bekantan (Nasalis larvatus), sebagai primata endemik Kalimantan yang dilindungi, menjadi sasaran penyelundupan karena tingginya nilai ekonomis. Penelitian ini bertujuan untuk menganalisis pertimbangan hukum hakim dalam menjatuhkan putusan serta bentuk pertanggungjawaban pidana pelaku penyelundupan hewan bekantan dalam Putusan Pengadilan Negeri Martapura No. 104/Pid.Sus/LH. Penelitian ini menerapkan metode yuridis normatif dengan pendekatan melalui peraturan perundang-undangan dan studi kasus. Sumber data primer berasal dari salinan putusan pengadilan, sementara data sekunder dikumpulkan dari berbagai literatur hukum, peraturan perundang-undangan, serta dokumen pendukung lainnya. Telaah yang digunakan yaitu telaah kasus dan perundang-undangan (Statute Approach). Hasil penelitian menunjukkan bahwa hakim mempertimbangkan secara cermat unsur kesengajaan, status hukum satwa bekantan, dan keterlibatan terdakwa. Bentuk pertanggungjawaban pidana yang dikenakan adalah pertanggungjawaban pidana individual berdasarkan asas kesalahan (schuld), namun belum mencerminkan prinsip keadilan ekologis secara menyeluruh. Penelitian ini diharapkan menjadi referensi dalam pengembangan hukum pidana lingkungan dan penegakan hukum terhadap penyelundupan satwa dilindungi di Indonesia.

Abstract

The drying of batik songkok raw materials in Rek Kerrek Village, Pamekasan Regency, is done by relying on sunlight. The time required is 3 days. When the weather is cloudy and rainy, the drying time is longer, namely 1 week and the batik color is dull. The batik process is still conventional with canting which is hand-drawn and motifs that rely on ancestral heritage. The process of batik with manual canting takes 2-3 days to 1 month per sheet. The problems faced are the long time for processing and drying batik so that production capacity, expensive batik prices and the competitiveness of batik products are still low. The objective of the PDB program is to provide technological innovations in the form of an infrared dry room drying machine to speed up the drying time of batik and an innovation in canting caps to speed up the batik processing time. This innovation increases production capacity, sales volume, and the competitiveness of batik products. The methods used are training, mentoring and practice of technological innovations for partners. The results of the program are: 1) the infrared dry room drying machine (partner-1) and the innovation in canting caps (partner-2) increase production capacity and quality, sales volume and the competitiveness of batik products. The infrared dry room dryer speeds up drying time to approximately 90 minutes. The batik process using a canting cap simplifies the process and reduces the completion time to 3 hours.

Abstract

Purpose: This study aims to analyze the influence of Business Reputation, Leadership, and Organizational Justice on Talent Management Strategies, Employee Retention, and MSME Performance Strategies, while examining the mediating roles of Talent Management Strategies and Employee Retention.. Research Methodology: A quantitative approach was employed using data from 189 MSMEs selected through purposive sampling. The data were analyzed using SPSS and Smart PLS 3 to test both direct and indirect relationships among variables. Results: Findings indicate that Business Reputation significantly affects Talent Management Strategies (p = 0.000), Employee Retention (p = 0.026), and MSME Performance (p = 0.000). Leadership shows no significant effect on any dependent variable, while Organizational Justice significantly influences Talent Management Strategies (p = 0.008) but not Employee Retention or MSME Performance. Indirectly, Talent Management Strategies mediate the effects of Business Reputation and Organizational Justice on Employee Retention, whereas Employee Retention does not mediate the effect of the main variables on performance. However, a combined mediation of Talent Management Strategies and Employee Retention significantly links Business Reputation to MSME Performance (p = 0.036). Novelty indicators reveal that business governance and ethics strongly represent Business Reputation, with loadings of 0.931 and 0.944. Conclusions: Business Reputation and Organizational Justice are key drivers of Talent Management Strategies and Employee Retention, whereas Leadership plays an insignificant role. Limitations: The study is limited to Indonesian MSMEs and cross-sectional data. Contribution: It contributes by emphasizing ethical governance and fairness as essential elements in improving MSME talent retention and performance.
