Abstract

Land is an asset that has an important meaning for every individual in society. Apart from having economic value that can be reserved as a source of human life support in the future, land also contains spiritual aspects in the environment and its survival. Land is a place of settlement, a place to carry out human activities, even after death it still needs land. Land in the plains of Indonesia is a source of livelihood for the community and income for those who earn income from agriculture. In the political aspect, land is the place, boundary, and location of the jurisdiction of the Indonesian population, while from the social aspect, land is a space for good relations between fellow Indonesians. The holder of the right to the surface of the earth (Landowner) is given the right to do something about the land that legally belongs to him. The term something that can, must or is prohibited to be done is the content of the right of the ruler. This is the criterion or benchmark for distinguishing between land tenure rights which are then regulated in land law or land regulations. The existing land regulations in Indonesia are regulated in Law Number 5 of 1960 concerning Basic Regulations on Agrarian Principles (hereinafter shortened to (UUPA)), providing affirmation of arrangements related to the surface of the earth in a juridical sense called land tenure rights. Land tenure includes the relationship between individuals, (individuals) legal entities, or communities as a collectivity with land that is haki resulting in the birth of rights and obligations. Agrarian land conflicts still often occur in various regions in Indonesia, especially on the issue of natural resource management with the assumption of increasing economic growth. Land issues between land rights holders dealing with the ruling government tend to change as a result of the ever-changing land configuration, resulting in a clash of interests that continues to grow so that a dispute resolution approach is needed that can provide justice and legal certainty for the community. This also happened in the eastern border area of Indonesia, namely Morotai Island Regency, North Maluku Province.

Abstract

Amicus Curiae is limited to providing opinions, and not taking action. The practice of amicus curiae is actually commonly used in countries that use the Common Law system and not the Civil Law system adopted by Indonesia. However, this does not mean that this practice has never been applied or practiced in Indonesia. In the Indonesian judiciary, amicus curiae has not been clearly regulated, but the legal basis for accepting the concept of amicus curiae in Indonesia is Article 5 Paragraph (1) of Law Number 48 of 2009 concerning Judicial Power. Therefore, it is interesting to examine the role of the amicus curiae in the judge's decision regarding the justice collaborator in the criminal case of premeditated murder. To answer these problems, normative legal research methods (normative juridical) are used with a statutory approach, case approach, conceptual approach and comparative approach, using secondary data obtained from primary, secondary and tertiary legal material sources. In this research, the role of the amicus curiae in the judge's decision on the justice collaborator in the criminal case of premeditated murder as regulated in Article 340 of the Criminal Code. Apart from that, the role of amicus curiae is also regulated in the Constitutional Court Regulations Article 14 Paragraph (4) Number 06/PMK/2005, Article 180 Paragraph (1) KUHAP, Article 183 KUHAP, Article 89 Paragraph (3) Law Number 39 of 1999 concerning Human Rights Humans, Circular Letter of the Supreme Court of the Republic of Indonesia (SEMA) Number 4 of 2011, even though they do not have clear regulations, in their application amicus curiae have never been prohibited by judges.

Abstract

Interviewing the respondents or informants. The method in this research is juridical empiric method. The result of this research shows that the legal regulation which influence the law enforcement towards Domestic Violence within the household is the Law No. 23 of 2004 on the eradication of Domestic Violence within the household. However, if before entering the litigation way, it is mediated in advance with the rule of Gampong and if a marriage is not recognized by the state so that the domestic violence is subjected to Article 351 of the Criminal Code. The law enforcer that influences the law enforcement against domestic violence within the household except the police, prosecutor, and court is (KPPPA). This institution also has an active role and is also involved to handle the domestic violence cases. Visumetrepertumis most important form of infrastructure and facilities and also becomes evidence in domestic violence cases. The societies who tend to be victims of domestic violence are women. The culture that influences law enforcement against domestic violence is patriarchal culture which strongly dominates in the household of the societies in Indonesia. As the Suggestion, in order to reach the realization of the effectiveness of law enforcement for domestic violence within the household so that the influenced factors should be better, especially for the State apparatus. They should conduct their duties properly.

Abstract

The flight information region adjustment agreement between Indonesia and Singapore, as the Realignment Flight Information Region Agreement, has been ratified by Presidential Regulation Number 109 of 2022 concerning Ratification of the Agreement between the Government of the Republic of Indonesia and the Government of the Republic of Singapore concerning the Adjustment of Boundaries between the Jakarta Flight Information Region and the Singapore Flight Information Region on September 5, 2022. The problem to be discussed is How are the regulations for ratification of boundary adjustments between Jakarta flight information regional and Singapore flight information regional based on laws and regulations in Indonesia? and What are the implications of ratifying the adjustment of the boundaries between Jakarta's regional flight information and Singapore's regional flight information with presidential regulation number 109 of 2022?. With the normative legal research method (normative legal research). The regulation of ratifying the adjustment of the boundaries between Jakarta's regional flight information and Singapore's regional flight information is regulated by Law Number 1 of 2009 concerning Aviation and its implementing regulations. This law also refers to the regulations of the International Civil Aviation Organization (ICAO), which is a global reference in the management of airspace and FIR as well as the Indonesia-Singapore Flight Information Region (FIR) Adjustment Agreement 2022. The implications of ratifying the adjustment of the boundaries between Jakarta's regional flight information and Singapore's regional flight information with presidential regulation number 109 of 2022 occur in the Implications in the political field, Implications in the Economic field and Implications in the field of national defense and security. The regulation of ratifying the adjustment of the boundaries between Jakarta's regional flight information and Singapore's regional flight information Indonesia must strengthen and maintain the FIR areas on maps A and B so that they are not managed again by Singapore. The implication of ratifying the adjustment of the boundaries between Jakarta's regional flight information and Singapore's regional flight information is that Indonesia must think about immediately regulating a Single Air Traffic Provider where all Indonesian airspace is regulated in one FIR (Flight Information Region). Abstract

The abuse of narcotics among the Indonesian National Armed Forces (TNI) personnel is a serious issue that can undermine the integrity and professionalism of the military. The Telegram Letter of the TNI Commander Number ST/398/2009 regarding the Dismissal of TNI Personnel Involved in Narcotics Abuse serves as a legal basis to address this problem. This study aims to analyze the implementation of the TNI Commander’s Telegram Letter Number ST/398/2009 in the dismissal of personnel involved in narcotics abuse, and its correlation with the values of the Sapta Marga, the Soldier’s Oath, and the 8 Obligations of TNI. This research uses a normative juridical approach with qualitative analysis, examining regulations, legal norms, and their application in the context of military discipline. The study findings indicate that the implementation of the TNI Commander’s Telegram Letter Number ST/398/2009 has been carried out fairly well, although there are still challenges in the enforcement of dismissals and discipline in the field. The values of Sapta Marga, the Soldier’s Oath, and the 8 Obligations of TNI are essential foundations in making dismissal decisions, as an effort to maintain the image and honor of the TNI.

Abstract

According to the 2023 world tuberculosis (TB) report, Indonesia ranks 2nd in the world with an estimated 1,060,000 cases. Transmission of TB germs through droplets that enter the airways. TB cadres play an important role in assisting TB patients undergoing treatment, especially drug-resistant TB. TB cadres also play a role in providing health information to TB patients to achieve optimal treatment and achieve treatment success. During their roles, TB cadres who are in contact with active pulmonary TB patients are very vulnerable to infection. The implementation of respiratory fit tests for TB cadres in Palembang is needed, so that TB cadres in Palembang do not contract TB germs. Through the TB cadre organization, namely the Sriwijaya Healthy Society, 15 TB cadres were given counseling on the proper use of respirators and in accordance with conducting a fit test first. Through individual simulations with respirator fit tests, appropriate application was obtained for all TB cadres in using appropriate respirators. Through this activity, it is hoped that TB cadres in the city of Palembang will be able to carry out their duties safely and comfortably.

Abstract

Upper respiratory tract infection (URTI) is a disease that is easily transmitted through the air and can be inhaled into the airway. Individuals with weakened immune systems are more susceptible to severe or recurrent URTI. Increased incidence and severity of URTI in patients can significantly affect their productivity, while in children, it can hinder their growth and development. Cough ethics are generally well practiced by health workers in professional settings. However, among the public, cough etiquette is often ignored, so airborne diseases such as URTI can easily spread. Therefore, it is necessary to conduct counseling on proper cough etiquette practices to prevent the spread of URTIs, especially in Sukamaju subdistrict, Palembang. In this counseling activity, which was attended by around 200 participants, it was revealed that previously, 90% of them did not have an understanding of proper cough etiquette. After the counseling and simulation of cough etiquette, 100% of the participants have understood and applied cough etiquette correctly. Through this community service, it is hoped that the community will continue to apply proper cough etiquette, so as to form a sustainable positive habit in preventing disease transmission, as well as improving the health and welfare of the local community.

Abstract

The increase in the number of deaths caused by traffic accidents usually occurs, partly because Indonesian people do not know how to provide the right first aid when the victim is found. However, the first aid given to the victim is often inappropriate, so education on the evacuation of first aid in traffic accidents is needed, which emergency victims from the beginning of the scene and during the journey to health facilities, to achieve a quality of life of the victim. The method used is public education carried out at SMAN I Ambawang, Kubu Raya Regency, West Kalimantan. The activity began with socialization regarding splint dressing, evacuation, and transportation education, then continued with a simulation held at SMA I Ambawang. The results of the evaluation of pre and post-test knowledge, as well as evaluation of pre and post-test skills. The results of the evaluation of pre-test knowledge obtained an average value of 40.48 while the average value of post-test knowledge was 92.04. The results of the evaluation of pre-test skills obtained an average of 30.55 while the average of post-test skills was 87.61. Community service on education and simulation of emergency assistance for PMR SMAN 1 Sungai Ambawang Kubu Raya can improve knowledge and skills of splint dressing, evacuation, and transportation in cases of injury Abstrak Peningkatan angka kematian yang disebabkan oleh kecelakaan lalu lintas biasanya terjadi salah satunya karena masyarakat Indonesia yang tidak mengetahui cara memberikan pertolongan pertama yang tepat saat korban ditemukan. Namun pertolongan pertama yang diberikan kepada korban sering tidak tepat sehingga perlu edukasi evakuasi pertolongan pertama pada kecelakaan lalu lintas yang merupakaan korban gawat darurat dari awal tempat kejadian dan selama perjalanan menuju sarana kesehatan, tercapainya kualitas hidup korban. Metode yang digunakan adalah pendidikan masyarakat dilaksanakan di SMAN I Ambawang Kabupaten Kubu Raya Kalimantan Barat. Kegiatan di awali dengan sosialisasi terlebih dahulu terkait edukasi balut bidai, evakuasi dan transportasi kemudian dilanjutkan dengan simulasi yang dilaksanakan di SMA I Ambawang. Hasil evaluasi pengetahuan pre dan post test, serta evaluasi keterampilan pre dan post test. Hasil evaluasi pengetahuan pre test didapatkan rerata nilai 40,48 sedangkan nilai pengetahuan post test reratanya 92,04. Hasil evaluasi keterampilan pre test didapatkan rerata 30,55 sedangan rerata keterampilan post test adalah 87,61. Pengabdian masyarakat tentang edukasi dan simulasi bantuan kegawatdaruratan bagi PMR SMAN 1 Sungai ambawang Kubu Raya dapat meningkatkan pengetahuan dan keterampilan balut bidai, evakuasi dan transportasi pada kasus cedera

Abstract

Purpose – This study investigates the impact of green behavior innovation on competitive advantage within Batik SME family businesses, focusing on the influence of emotional intelligence, spiritual intelligence, and green creativity on driving green innovation behavior. Methodology/approach – This study was conducted through a survey research with a quantitative approach, involving 32 Batik SMEs in Indonesia. The testing method employed classical assumption tests, multiple linear regression analysis, and path analysis. Findings – The study finds that Emotional Intelligence positively influences Green Creativity and Green Innovation Behavior, while Spiritual Intelligence has a negative impact on Green Creativity but a positive effect on Green Innovation Behavior. Additionally, Green Creativity plays a crucial role in driving Green Innovation Behavior within family businesses. The findings highlight the significance of Emotional Intelligence and Green Creativity in promoting sustainable practices in Batik SME family businesses Novelty/value –  The novelty and value of this research lie in its exploration of the interplay between emotional intelligence, spiritual intelligence, green creativity, and green innovation behavior within Batik SME family businesses in Indonesia. These findings offer a unique perspective on how emotional and spiritual intelligence, coupled with creativity, can enhance competitive advantage and sustainability in the Batik industry.

Abstract

Research aims: The purpose of this study is to examine the connection between innovation orientation (IO) and entrepreneurial orientation (EO) and its role in mediating marketing orientation (MO) to achieve marketing performance (MP), specifically focusing on MSMEs in the culinary sector in Banyumas, Purbalingga, Cilacap, and Kebumen (Barlingmascakeb).Design/Methodology/Approach: Data were collected from 100 food industry businesses in Barlingmascakeb. Structural equation modeling (SEM) was used utilizing Smart PLS to analyze data.Research findings: The results demonstrated that innovation orientation had a positive effect on entrepreneurial orientation and marketing performance. EO, which mediated the relationship between IO and MP, acted as a partial mediator. RBV is still a relevant theory for MSMEs, where organizational resources are assets that need to be managed and become superior to expand in a dynamic market. The research findings also support the MBV theory, where the market is a necessary factor to be considered by MSMEs in business and entrepreneurial decision-making. RBV and MBV actually complement each other and have an important role in influencing marketing performance.Theoretical contribution/Originality: This study contributes to the management study literature, which has built an empirical model that encourages MSME marketing performance by investigating the relationship between IO, EO, and MO to support MSME marketing performance.Practitioners/Policy Implications: This study provides insight into culinary MSME entrepreneurs to focus on innovation orientation and not ignore market orientation as a supporter of innovation and marketing performance.Research Limitations/Implications: This research only focused on MSMEs in the culinary sector, so generalizations and findings were limited. Therefore, future studies are expected to combine larger and more diverse samples.
