Abstract

Overcoming poverty problem constitutes a part of da’wah bil hal. Moreover, it is a main problem experienced by Moslems in Indonesia. To overcome the problem, the governor of Nusa Tenggara Barat TGB. Muhammad Zainul Majdi pionered Halal Tourist Village through his Governor rule no. 51/2016. The term of Halal Tourist Village constituted a Governor’s attempt in packaging tourism, so that foreign tourists would like to come. Through the rule, Ida Wahyuni Sahabudin, a community development activist, took an innitiative to promote Setanggor Village as one of destinations of Halal Tourist Village. He improved various local assets into attractive tourist spots. This study described the roles of community assets in developing community of Halal Tourist Village of Setanggor. This study used library research method and a concept approach of community assets. The result of this study indicated that that those various assets came with different roles and all of them were integrated in the tourism of Setanggor Village to overcome the poverty problem there.

Abstract

Due to recent technological advances, marketing strategies have shifted from conventional to online. Traditional businesses use this digital marketing strategy because it is considered no more effective than other forms of marketing, such as using brochures and catalogs. Kopi Tuku as a business that mushroomed first during the Covid-19 pandemic, used digital marketing strategies to introduce digital products, one of which was social media. This is because social media is a platform that allows people to communicate information in the form of text, photos, videos, and audio with each other and with businesses, or vice versa. This study aims to find out how Kopi Tuku's digital marketing strategy during the Covid-19 pandemic uses content analysis. The method used is Krippendorff's content analysis via Instagram @tokokopituku for the period January 1, 2021 to September 30, 2021. The conclusion of this study is that Kopi Tuku's marketing strategy is more of an advertising strategy that highlights related information about Kopi Tuku.

Abstract

In perspective law (criminal), the victims of trafficking are women and children. This crime is a criminal action that has become an international problem. The criminal action is also against the human rights and lowers womens and childrens dignity. The nation policy by applying law no 21 year 2007 about the criminal action of trafficking proves that the law makes the doer undaunted. The fact is that the criminal actor is not only the person who is unknown by the victim, but the one known by the victim, or even the parents themselves are the doers. The victims of the crime are usually women and children that can be classified as latent victim. Because the impact of the criminal action leaves a continuous trauma, especially to the victims mental, it needs an effort to prevent it done solidly.Dalam perspektif hukum (pidana), perdagangan orang atau trafficking korbannya adalah perempuan dan anak-anak. Kejahatan ini merupakan tindak pidana yang telah menjadi masalah internasional. Tindak pidana tersebut juga melanggar Hak Asasi Manusia dan merendahkan harkat dan martabat perempuan dan anakanak. Kebijakan negara dengan menerapkan Undang Uundang No. 21 Tahun 2007 Tentang Tindak Pidana Perdagangan Orang, membuktikan bahwa UU itu tidak membuat pelaku menjadi jera. Pada kenyataannya pelaku tindak pidana tersebut tidak hanya orang yang tidak dikenal korban, namun justru orang yang dikenal korban, bahkan orang tua korban sendiri juga menjadi pelaku. Adapun korban kejahatan tersebut adalah perempuan dan anak-anak yang tergolong latent victim. Mengingat dampak tindak pidana tersebut meninggalkan trauma yang berkepanjangan, terutama terhadap psikis korban, maka perlu adanya peningkatan upaya pencegahan yang dilakukan secara terpadu.

Abstract

Narcotics abuse has become a necessity in the modern world. Law No. 35 of 2009 on Narcotics is strictly regulated on what actions can be categorized as criminal offenses and what sanctions will be faced by those legally and convincingly proven to be the perpetrators of narcotics abuse. In the past 5 years, the government has massively enforced law enforcement and law enforcement in the field of narcotics and has sent dozens of people to challenge death against firing squads in the execution process. Fidelis a civil servant from Sanggau West Kalimantan, was arrested by the BNN apparatus for being proven to plant marijuana at his home. Through a process integrated in the Indonesian criminal justice system, the judge finally ruled that Fidelis was legally and convincingly guilty and sentenced to 8 months in jail plus a fine of 1 billion 1-month subsidence cage. Many parties admit it because Fidelis should be tried and punished, but many also praise the courage of the judge who has decided the case by using the attachment of progressive legal theory.DOI: https://doi.org/10.26905/idjch.v8i2.2117

Abstract

This study examines the free application to the perpetrators of narcotics violations applied in the Banjarbaru District Court in accordance with various regulations relating to children’s rights such as Law No. 4 of 1949 concerning Child Welfare, Law No. 39 of 1999 concerning Human Rights, Law No. 35 of 2014 concerning Child Protection and Law No. 11 of 2012 concerning the Juvenile Justice System, including diversification requirements where the threat of punishment is less than 7 years and the perpetrator is not recidivism. Because that is true and true what hasbeen done by the facilitator of transfer / child judge in case Number 4 / Pid.Sus-Anak / 2016 / PN.BJB because it is in accordance with the rules relating to the transfer of those who transact with the law. Factors that hinder the adoption of a diversion attempt on children who abuse drugs in the Banjarbaru District Court are: Understanding of law enforcement officers involved in the Diversion process is still lacking. i.e. parties involved in the transfer process, such as Community / Bapas Supervisors including legal counsel / legal counsel who are interns, including juvenile judges, should be more familiar with the contents of Perma No. 4 of 2014 concerning the Guidelines for the Implementation of Diversification in the Child Criminal Justice System and the Role of Parents in the Transfer process are still less active due to a lack of understanding of the process.How to cite item: indrawati, I., Mirasari, B. Abstract

Strict efforts in enforcing excise laws, criminal sanctions are used as a tool to provide maximum forced power for the excise duty community. But the truth is that criminal provisions are the last resort when administrative sanctions no longer work optimally. This study uses normative legal research methods. An offense to be categorized as a criminal offense cannot be separated from the legality of the legal subject, namely the BKC businessman and the legal object, namely the BKC and the Excise Band. If one of the legal subjects or legal object is illegal, then the violation committed is a form of criminal offense. In addition, an act can be convicted under the Customs law if it meets the following criteria: explicitly and clearly formulated as a violation, significantly causing state losses, and is a recurring act, or state losses incurred cannot be repaired. The application of the principle of ultimum remidium in law enforcement in the excise sector needs to use the theory of restorative justice to restore state losses caused by criminal offenders in the excise field, and social cost theory to provide additional costs and risks for criminals to dissuade them commit crime.How to cite item: Indrawati, I., Menezes, B. Abstract

This study discusses criminal liability towards companies that fail to register their workers as participating BPJS workers. Social security is very important for all Indonesian workers to have because socioeconomic risks can occur to anyone, anywhere and to anyone. The type of legal research used in this study is normative research. Results and discussion of research conducted where PT. This True Farmer Initiative has made a mistake in the form of negligence or negligence from the company that does not pay BPJS Employment contributions to workers and there are some workers who are not registered as BPJS Employment participants. This has been received by a court ruling punishing the company which resulted in the rights of the workers who could not be fulfilled. Seeing the decision that has been determined by the judge there is no criminal sentence, the judge’s decision does not provide a deterrent effect on the company. Abstract

Currently, there are many crimes that take advantage of the sophistication of internet developments, such as crimes that are committed online or commonly called Cyber Crime. This is based on the argument that Cyber Crime is an activity that uses computers as a medium that is supported by a communication system, whether it’s a Dial Up System, using a telephone line, or a wireless system that uses a special wireless antenna. One form of crime related to the misuse of information technology facilities is a crime or criminal act of online job vacancies as regulated in Article 378 Book II of the Criminal Code (KUHP) and Article 28 paragraph (1) Jo. Article 45 paragraph (2) of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Electronic Information and Transaction. This study seeks to answer the background of fraud in online job vacancies as well as a form of countermeasures against fraud in online job vacancies. This study uses a normative juridical research method.

Abstract

The change of view in treating prisoners in Indonesia is of coursebased on a humanitarian evaluation which is a manifestation ofPancasila as the basis for a nation's view of life that recognizes thehuman rights of prisoners. This research discusses the role of prisonofficers in the implementation of educational coaching for femaleprisoners in Class IIA Women's Prison. Kebonsari Malang City. Theauthor uses this type of empirical legal research, which means thatthis research describes the facts that occur in the field and knows theeffectiveness of the enactment of positive law in society. The results ofthis study the authors found that the role of female prison officers inthe implementation of educational coaching for female prisoners inClass IIA Kebonsari Women Penitentiary Malang City includespersonality development activities and independence developmentactivities. Personality development is directed at fostering mental andcharacter so that prisoners become fully human, pious and responsibleto themselves, their families and society. Development of personalityand independence includes matters related to devotion to GodAlmighty, National and State Awareness, Intellectuals, Attitudes andBehaviors, Physical and Spiritual Health, Legal Awareness,Reintegration with Society, Work Skills, Work Training andProduction in accordance with Article 3 Government RegulationNumber 31 of 1999.

Abstract

Penelitian ini berawal dari perlunya dilakukan perbaikan pembelajaran dengan menggunakan model pembelajaran kooperatif tipe Student Teams Achievement Divisions (STAD). Model kooperatif tipe STAD menjadikan siswa sebagai pusat pembelajaran (student centered). Penelitian ini bertujuan untuk memperbaiki proses pembelajaran dan hasil belajar PKn di kelas V SD Negeri 23 Batang Anai Kabupaten Padang Pariaman.Penelitian ini menggunakan penelitian tindakan kelas. Model pembelajaran kooperatif tipe STAD merupakan model pembelajaran yang menempatkan siswa dalam kelompok belajar yang beranggotakan 5 atau 6 orang siswa. Model pembelajaran ini dilakukan melalui tujuh tahap, dimulai dari penyajian materi oleh guru, kegiatan belajar kelompok, pemeriksaan terhadap hasil kerja kelompok, mengerjakan tes secara individu, pemeriksaan hasil tes, dan penghargaan kelompok. Dari hasil penelitian terlihat bahwa dengan menggunakan model pembelajaran kooperatif tipe STAD dapat meningkatkan hasil belajar PKn siswa di kelas V SD Negeri 23 Batang Anai Kabupaten Padang Pariaman. Saran yang diberikan dalam penelitian ini agar guru dapat memperhatikan setiap langkah yang dilakukan.
