Abstract

Narcotics crimes have long been the enemy of the nation and are now increasingly alarming for Indonesia and the world. The production and distribution of narcotics have become massive, not only in big cities but also in rural areas. Perpetrators of abuse are no longer limited to adults but have spread to all levels of society, including students, entrepreneurs, officials, and children. The problem of drug abuse has drawn continuous public attention and discussion, as it threatens the nation’s future. Almost all elements of society emphasize the importance of vigilance, especially in monitoring children’s social interactions to prevent exposure to narcotics. Despite global commitments to combat narcotics crimes, illicit trafficking continues to escalate, indicating that these offenses constitute extraordinary crimes. This study examines the regulation of narcotics crimes under Law Number 35 of 2009 concerning Narcotics and the role of community involvement in eradication efforts. Using a normative juridical research method, the study finds that such crimes are regulated in Articles 111–116 in conjunction with Articles 127 and 132 of Law 35/2009. Community participation includes searching for, obtaining, and providing information on suspected narcotics crimes to law enforcement or the police. The study recommends drafting a special law to strengthen community involvement in combating narcotics crimes, incorporated into the Criminal Code, legislation, government regulations, and ministerial regulations. The government is urged to create a clear and comprehensive legal framework to ensure effective and coordinated efforts in eradicating narcotics crimes.

Abstract

Article 18 paragraph (1) letter b of Law No. 31 of 1999 in conjunction with Law No. 20 of 2001 stipulates that replacement money must equal the assets obtained from corruption. However, differences between the law’s explanatory section and the article’s formulation create ambiguity about its intended purpose, leading to dual interpretations in calculating replacement money. This study, using a normative juridical method, finds that imposing replacement money is a legal mechanism to recover stolen state assets. Success is not merely assessed by the amount ordered by the court or the quantity of assets confiscated, seized, or auctioned by prosecutors, but by how much is actually deposited into the state treasury. In Decision No. 1441/Pid.Sus/2019/PN Mks, involving medical malpractice causing serious injury, the court ruled that a subsidiary prison term could not apply because the defendant, Heru Hidayat, was sentenced to life imprisonment—one of two prison types under Article 12(1) of the Criminal Code. Consequently, prosecutors must locate, seize, and auction his assets to fulfill the replacement payment within his lifetime.

Abstract

Management of apartments and their environment is carried out by an association of residents that is formed and granted authority and responsibility in management. This study examines the form of legal responsibility of the association of owners and occupants of apartment units in managing land, parts, and common objects toward holders of apartment unit ownership rights, and how disputes related to this responsibility are resolved. The research uses a normative juridical method. Findings show that under Article 75 paragraph (3) of Law 20/2011, PPPSRS is obliged to manage the interests of owners and occupants concerning common objects, common parts, common land, and occupancy. The main purpose of establishing PPPSRS is to take necessary legal actions for the benefit of owners and occupants, maintain the environment and facilities, manage common property, and settle disputes related to these responsibilities. Disputes in apartment management require resolution efforts, and Law 20/2011 regulates this through Article 105, which includes: (a) deliberation to reach consensus, (b) settlement outside the court, and (c) court settlement. The study suggests improvements through new regulations on the association of owners and occupants of apartment units, integrated into laws, government regulations, and banking regulations, to ensure fairness for all parties. It is recommended that the government issue clear, comprehensive legal frameworks to strengthen PPPSRS’s role and accountability, providing certainty and protection to both owners and occupants in managing apartment environments.

Abstract

Penundaan Kewajiban Pembayaran Utang (PKPU) is a legal mechanism that aims to provide debtors with the opportunity to restructure debts and avoid bankruptcy by preparing a peace plan agreed to by creditors, as stipulated in Law Number 37 of 2004. However, in practice, PKPU in Indonesia does not always run effectively due to various obstacles that arise, including liquidity difficulties and legal pressure from creditors who continue to file homologation cancellation lawsuits and criminal reports against debtors. This research aims to analyze the implementation of PKPU in the bankruptcy process and identify the obstacles faced, with a normative and empirical legal approach through a case study of PT Mahkota Properti Indo Senayan and PT Mahkota Properti Indo Permata. The results of the study indicate that although PKPU can provide a way out of the threat of bankruptcy, its implementation is often hampered by the lack of post-homologation supervision and adequate legal protection for debtors. Therefore, this study recommends strengthening regulations and increasing supervision so that PKPU can become an effective instrument in debt restructuring and supporting the stability of debtors' businesses.

Abstract

Medical malpractice is a form of action carried out by health experts, namely doctors, who in carrying out their obligations deviate from what they should be. If the action taken causes physical or material harm to others, in this case the patient, the deviant action can be held accountable either criminally, civilly, or administratively. The research method used is normative juridical. The results of the study are Criminal liability for medical malpractice in Law Number 17 of 2023 concerning Health, namely that the laws and regulations in Indonesia basically do not explicitly regulate criminal liability for malpractice. Provisions regarding criminal liability for Malpractice in Article 447 paragraph (1) of Law No. 17 of 2023 concerning Health. The determining factors in medical malpractice cases are Professional Standards and Operational Procedures; Doctor-Patient Relationship; Negligence and Elements of Professional Error; Evidence of Losses and Causal Relationship; Competence and Experience of Medical Personnel; Role of Technology and Health Facilities; and Legal Supervision and Regulation System. From the perspective of legal certainty and justice, legal certainty provides a clear and objective basis for resolving cases, while justice ensures that all parties receive balanced treatment and no one is harmed unilaterally. The combination of the two is the key to creating a more accountable and humane health system.

Abstract

This study is a descriptive qualitative study that aims to describe the student learning participation in IPAS learning. The subjects in this study were of the teachers and the students of the fifth grade at SDN 71 Maccini. The research data collection techniques used were interview, observation and questionnaire techniques. The data analysis techniques of this study were data reduction, data presentation and drawing conclusions. Results and conclusions: The learning participation of students of grade V of SDN 71 Maccini, Liliriaja District, Soppeng Regency in science learning are (1) Students are enthusiastic, enthusiastic, active in asking and answering questions, active in discussions and group work, have the initiative in seeking information through various sources, and have the courage and confidence in conveying the results of group discussions in front of the class.

Abstract

This study is a pre-experiment that aims to determine whether the Point-Based Gamification learning model has an effect or not on increasing the motivation in learn the IPAS of the Fifth Grade students of SD Inpres 12/79 Masukg, Mare District, Bone Regency in science learning. The variables in this study are the Point-Based Gamification learning model and students' IPAS learning motivation. The population in this study were all of the Fifth Grade students of SD Inpres 12/79 Masukg, totaling 20 students. The sampling technique used was saturated sampling. The data from this study were obtained through the provision of questionnaires. The data collection techniques used were observation and questionnaires to determine the students' learning motivation before and after using the Point-Based Gamification learning model. Based on the descriptive statistical analysis, the average pretest and posttest were of 65.95 and 82.25 respectively; based on the inferential statistical analysis, the Sig. value was of 0.00 <0.05, which means that there is a significant difference between the average pretest score and the average posttest. Conclusion: The point-based gamification learning model has a significant effect on increasing the motivation in the learn the IPASof the Fifth Grade students of SD Inpres 12//79 Masukg, Mare District, Bone Regency

Abstract

Krecek Hamlet is a Buddhist tourism village that plays an important role in promoting and preserving the noble values of Borobudur Temple. This research aims to analyze the transformation of the cultural capital of Borobudur Temple and the habitus of the people of Krecek Hamlet through the analysis of Pierre Bourdieu's theory. The method used in this research is a case study. The research results stated that Borobudur Temple as a representation of Buddhist teachings is a cultural capital. Borobudur cultural capital has a role in shaping the character and cultural identity of the people of Krecek Hamlet. The habits formed include religious habitus, togetherness, friendliness and tolerance, simplicity, respect for tradition, respect for nature, as well as traditional and spiritual leadership.  The habitus of the people of Krecek Hamlet is the result of social interaction. The people of Krecek Hamlet live based on socio-cultural structures and adhere to religious values and traditional norms. The transformation of Borobudur's symbolic capital into the habitus of the people of Krecek Hamlet is performed through the process of reproducing religious culture and local wisdom. This research has many shortcomings, thus it needs to be studied more deeply, especially regarding social media and the digitization of the culture of Buddhists in Krecek Hamlet in preserving religious values and promoting Buddhist tourism.

Abstract

This study aimed to measure the improvement of students' creative thinking skills after using Controversy-based integrated science learning tools.  The study employed a pre-experimental design with one group pretest-posttest. The research subjects were 20 students of the Science Education Program, The State University of Makassar selected using the Nonprobablit sampling technique (saturation sampling). The instrument was an essay test that had been validated. The findings show a significant difference in students' average creative thinking skills before and after learning using Controversy based Integrated Science learning tools. It shows that the improvement of students' creative thinking skills after being treated with Controversy based Integrated Science learning tools was in high category and significant. Students were able to develop their knowledge, predict some limited information, formulate a solution to a problem, and analyze information from different perspectives.

Abstract

Law enforcement of election crimes is a critical aspect to ensure the creation of a fair, honest, and transparent democratic process. This research discusses the role of the Integrated Law Enforcement Centre (Gakkumdu) under Bawaslu East Jakarta in handling and resolving cases related to election crimes. Gakkumdu Bawaslu East Jakarta is mandated to address various violations, including administrative breaches, code of ethics violations, and criminal acts within the electoral process. This study aims to identify how Gakkumdu East Jakarta carries out its preventive and enforcement functions, as well as to analyse the challenges encountered in implementing these tasks. The research adopts a qualitative method with a literature and legal approach, utilising secondary data sources such as official documents, reports, regulations, and interviews with related stakeholders. The findings reveal that Gakkumdu East Jakarta plays a pivotal role in maintaining electoral integrity by actively monitoring, investigating, and processing election violations. However, several obstacles persist, notably limited human and financial resources, the complexity of legal procedures, and challenges in inter-institutional coordination between Bawaslu, the police, and the prosecutor’s office. This research emphasizes the need for improved institutional synergy, capacity building, and clearer regulatory frameworks to enhance the effectiveness of Gakkumdu’s performance in future elections. Strengthening these aspects is vital to upholding democratic values and ensuring that elections run according to the principles of fairness and justice.
