Abstract

Credit agreements signed by creditors and debtors by providing collateral in the form of certificates are generally bound by a notarial deed, whether made authentically or privately. The credit agreement will then be processed to encumber the rights to the collateral. Before the imposition process is completed, it is customary for the Notary-PPAT to create and publish a covernote so that the bank is confident in disbursing credit to the debtor. The aim of this research is to determine the position of covernotes in fulfilling the requirements of credit agreements in banking. This research uses normative research methods. Normative legal research is research conducted or aimed at written regulations because the research is carried out based on statutory regulations, namely the relationship between one regulation and another and its relationship to its application in practice. The research results show that the position of the covernote issued by the Notary-PPAT to fulfill the requirements of the credit agreement at the bank is only limited to being a certificate, to explain that a credit agreement has been agreed and signed by providing a guarantee. However, the covernote is not an object of collateral or guarantee, the covernote is only a certificate that can be used as temporary collateral as a guide for the bank to issue credit to the debtor.

Abstract

Procurement of goods and services is a very urgent need in a developing country, the need for goods and services certainly requires quite large funds to obtain them. Service Users (in this case the Government) certainly expect good quality goods and services with the smallest amount of capital, while Service Providers (in this case the Contractor) will expect large profits, these two interests will attract each other. other. Procurement of goods and services is increasingly chaotic due to the lack of legal regulations in the form of laws, while the legal regulations used so far are only at the level of Presidential Decrees (Kepres) and Presidential Regulations. When talking about Procurement of Goods and Services, it includes several legal provisions, namely Civil law, if it concerns contracts, of course the legal consequence is a Civil lawsuit, if it concerns administrative decisions then it will be resolved through the Administrative Court, then if there is an allegation of a criminal act of misappropriation of State finances it will be resolved through criminal law, however, the specific legal rules for criminal liability for perpetrators of procurement of goods and services still use the provisions of general criminal law and the Corruption Crime Law. The method used in this research uses normative research. Normative legal research methods are research that positions law as a building system of norms.

Abstract

Indonesia has Law Number 20 of 2001Jo. Law Number 31 of 1999 concerning Amendments to Law Number 31 of 1999 concerning Eradication of Corruption (hereinafter abbreviated as the PTPK Law). Based on Article 6 of Law Number 19 of 2019 concerning the Second Amendment to Law Number 30 of 2002 concerning the Corruption Eradication Commission. Unfortunately, the criminal provisions contained in Article 21 and Article 22 of Law No. 28 of 1999 concerning Clean and Corruption-Free State Administrators are contrary to the principles contained in the Criminal Code, namely that the Criminal Code does not use a special minimum criminal system and cumulative principal criminal penalties, so that the Criminal Code including the Criminal Procedure Code cannot be used in eradicating criminal acts of Collusion and Nepotism. In other words, violations of criminal acts of collusion and criminal acts of nepotism in our beloved country currently cannot be addressed penally based on Law No. 28 of 1999 concerning Clean and Corruption-Free State Administrators. Therefore, this law needs to be immediately updated in terms of its criminal aspects. Article 20 paragraph (7) of Law Number 31 of 1999, which states that the main punishment is only a fine with a maximum plus 1/3 (one third). The determination of this criminal fine is imperative, meaning that judges have no other choice in imposing criminal sanctions on corporations other than criminal fines

Abstract

The issuance of Law Number 1 concerning Financial Relations Between the Central Government and Regional Governments has had a negative effect on foundations. Based on the results of the study, it was found that the regulation on the provision of BPHTB reduction or exemption facilities owned by foundations is an order from Law Number 28 of 2009 concerning Regional Taxes and Regional Levies, which was then followed by the issuance of Law Number 20 of 2000 concerning Amendments to Law Number 21 of 1997 concerning Land and Building Acquisition Fees. The issuance of Law Number 1 of 2022 concerning Financial Relations between the Central Government and Regional Governments (HKPD) eliminates these facilities. There is a lack of synchronization in the implementation of Law Number 1 of 2002 with the regent/mayor regulations regarding the provision of BPHTB reduction or exemption facilities for foundations, considering that these regulations are still based on the old law. Abstract

Overlapping related to state finances also occurs in several judicial decisions, namely the decision of the Constitutional Court of the Republic of Indonesia No. 77/PUU-IX/2011 on the judicial review of Law No. 49 Prp of 1960 concerning the State Receivables Affairs Committee. The substance of the Judicial Review of this Law is to ask the Court to cancel the provisions of Article 4, Article 8, Article 10, and Article 12. In the ruling of the Constitutional Court, it is stated that the assets owned by BUMN are separate from state assets, so that the authority to manage assets, businesses, including the settlement of BUMN debts is subject to limited liability company law based on Law No. 40 of 2007 concerning Limited Liability Companies. The formulation of state financial losses is interpreted as the same as state losses. This can be seen in the provisions of Article 35 paragraph (1) and paragraph (4) of Law Number 17 of 2003 concerning State Finance; Article 1 number 22, and Articles 59 to 67 of Law Number 1 of 2004 concerning State Treasury; Article 20 paragraph (4), paragraph (5), and paragraph (6) of Law Number 30 of 2014 concerning Government Administration. These regulations regulate Treasury Claims (TP) and Compensation Claims (TGR) for non-treasurer state/regional finances. Based on Supreme Court Regulation Number 4 of 2015 concerning Guidelines for Proceedings in the Assessment of Elements of Abuse of Authority, the PTUN has the authority to assess before a criminal process. It is clear that the actions of BUMN directors that result in state financial losses can be subject to administrative and/or criminal sanctions

Abstract

Regarding Legal Justice in Restitution of Victims of Criminal Acts, further provisions regarding the procedure for carrying out conditional sentences (voorwaardelijke veroordeling) are regulated in Article 276 of the Criminal Procedure Code which states: "In the event that the court imposes a conditional sentence, its implementation shall be carried out with serious supervision and observation and in accordance with the provisions of the Law." According to Muladi, conditional sentences (voorwaardelijke veroordeling) are a form of humane criminal law, namely by prioritizing prevention, not only oriented towards actions but also towards people who commit crimes, which are tat-tatterstrafrecht, placing social welfare as the ultimate goal, oriented towards the future. The mechanism for applying compensation is also regulated in Article 275 of the Criminal Code which states: "If more than one person is convicted in one case, then the court costs and/or compensation as referred to in Article 274 shall be borne by them jointly in equal proportions". The explanation is explained as follows “Because the defendants in the case referred to in this article are jointly sentenced because they are accused of committing a crime in one case, it is reasonable if the court costs and/or compensation are borne jointly in equal proportions

Abstract

Sensor flex sering digunakan sebagai sensor untuk mendeteksi perubahan pergerakan jari, namun nilai perubahan sensor tersebut belum tentu berbanding lurus dengan perubahan pergerakan jari. Dalam artikel ini akan membahas penggunaan dua sensor untuk mengetahui respon pergerakan jari, yaitu dengan sensor flex dan sensor IMU. Sensor flex diletakkan pada area metacarpal hingga distal phalange. Pada area proximal phalange dan distal phalange diletakkan sensor IMU untuk mendeteksi sudut yang dibentuk pada gerakan jari. Informasi tersebut digunakan sebagai acuan untuk melihat respon resistansi sensor flex pada titik sudut yang sama saat jari melakukan pergerakan menekuk. Hasil percobaan pada pengujian sensor flex didapatkan bahwa gerakan untuk membuka dan menggenggam pada semua jari memberikan respon pola yang sama namun terdapat perbedaan resistansi diperulangan dan didapatkan ∆R rata-rata sebesar 0.12%. Dengan melakukan pengamatan pada θ_DIP dan θ_PIP, dapat diketahui respon resistansi sensor flex pada masing-masing sudut tekuk tiap jari. Dengan pengamatan pada θ_DIP, θ_PIP dan sensor flex, maka pendeteksian pergerakan jari akan menjadi lebih presisi.

Abstract

In this paper, systems of linear equations on sparse matrices investigated through modified improve method using Gauss-Seidel and successive overrelaxation (SOR) approach. Taking into adapted convergence rate on the Improve refinement Gauss-seidel outperformed the prior two Gauss-Seidel methods in terms of rate of convergence and number of iterations required to solve the problem by applying a modified version of the Gauss-Seidel approach. to observe the effectiveness of this method, the numerical example is given. The main findings in this study, that Gauss seidel improvement refinement gives optimum spectral radius and convergence rate. Similarly, the SOR improved refinement method gives. Considering their performance, using parameters such as time to converge, number of iterations required to converge and spectral radius level of accuracy. However, SOR works with relaxation values so that it greatly affects the convergence rate and spectral radius results if given greater than 1.

Abstract

Pendidikan karakter adalah upaya guru dalam mempengaruhi kepribadian peserta didik mencakup segala hal yang ada di dunia pendidikan, baik keteladanan dari guru, perilaku guru, pembelajaran guru. Oleh karena itu guru adalah cermin bagi peserta didik. Dalam pembentukan karakter dibutuhkan metode yang sesuai agar karakter dapat tumbuh dalam diri peserta didik. Metode yang digunakan SD Negeri 0603 Tandihat dalam membentuk karakter peserta didik adalah metode pembiasaan. Metode pembiasaan adalah metode yang menitik beratkan pada penanaman kegiatan atau amalan yang sifatnya terus menerus atau rutunitas. Metode penelitian ini menggunakan pendekatan kualitatif dan jenis penelitian adalah studi kasus. Teknik pengumpulan data meliputi wawancara, observasi, dan dokumentasi. Teknik analisis data menggunakan Miles dan Huberman dengan langkah-langkah reduksi data, penyajian data, dan penarikan kesimpulan. Dari hasil penelitian ditemukan bahwa: (1) Latar belakang diadakannya metode pembiasaan di SD Negeri 0603 Tandihat adalah dalam penyelenggaraannya di SD Negeri 0603 Tandihat pembiasaan menjadi salah satu metode agar menciptakan budaya sekolah yang sesuai dengan visi dan misi sekolah, menjamin kesuksesan dalam menanamkan karakter pada peserta didik, dan untuk menciptakan budaya positif di lingkungan sekolah. (2) Bentuk-bentuk metode pembiasaan di SD Negeri 0603 Tandihat dapat dikategorikan menjadi 4 bentuk pembiasaan, yakni pembiasaan terprogram, pembiasaan rutin, pembiasaan spontan dan pembiasaan keteladanan. (3) Dampak metode pembiasaan terhadap karakter siswa SD Negeri 0603 Tandihat adalah menumbuhkan karakter religius, disiplin, kepedulian lingkungan, kepedulian sosial, toleransi, dan jujur.
