Abstract

The debates on the application of Islamic criminal law in various Muslim-majority countries are still ongoing. This is because these countries still adhere to a positive legal system. This phenomenon has spread to many things including implementing the punishment of cutting off the hands of corruptors as is the punishment for thieves in the provisions of Islamic criminal law. One of the obstacles, in this case, is due to differences of opinion on the use of the term "thief" to be applied to "corruptor". This article aims to analyze the punishment provisions for thieves as regulated in Surah al-Maidah verse 38 to be applied to perpetrators of corruption. This article is the result of qualitative research with a linguistic approach. The primary data source in this study is the Qur'an, whereas, the secondary data sources are articles, books, and other relevant documents. Data were collected through a literature study method which was then processed, analyzed, and concluded. This study found that the crime of corruption, seen from a linguistic perspective, has the same meaning as thievery; the perpetrator, therefore, can be sentenced to the same punishment (cutting off the hand). The punishment here is the most severe type that can be imposed on perpetrators of corruption, considering that the impact it causes is heavier and wider than the impact that arises in the crime of thievery. Certainly, this punishment is applied if it has met all the elements and legal requirements and is applied in a very strict manner.

Abstract

Indonesia, as an archipelago with a coastline of 81,000 km, is a coastal and marine area that has a variety of vast and diverse resources. With the unique potential and economic value of development, coastal areas are also faced with a high threat, so special handling is needed so that this region can be managed sustainably. Economic development in this framework is realized through the sea toll program. This article will aim to discuss how the sea toll program has an impact on the national development economy and the reinterpretation of marine verses in Al-Quran. This study uses qualitative research methods that are literature research. The sources of data in this study were sourced from books, journals, scientific articles, research reports, laws, and internet websites related to the sea toll program. After all, data have been collected, the data are analyzed by data analysis methods, namely data reduction, data presentation, and conclusion drawing. Findings. The results showed that the use of marine wealth by humans is justified in Al-Quran even it is recommended for the benefit of humans. On the other hand, the development of defense forces requires strong economic capabilities as a form of an effort to realize Indonesia’s ideals as a world maritime nation. Indonesia’s maritime potential can create a dominant economic development power for the Indonesian state to face global or international competition.

Abstract

This article discusses a comparative analysis of mudharabah sukuk, ijarah sukuk, and wakalah bi al-istithmar sukuk. This article aims to highlight and analyse the comparison of mudharabah sukuk, ijarah sukuk, and wakalah bi al-istitsmar sukuk so as to provide answers to the effectiveness and efficiency of the sukuk concept without denying the sharia principles in it. This research is in the form of a comparative study, namely a research procedure that compares interrelated variables by determining their differences and similarities. The data sources used come from books, classical text (yellow book), scientific article, website internet, theses, and fatwas related to the theme the author is taking. The results of the research in the article are: First, there are differences in the characteristics and schemes of mudharabah sukuk, ijarah sukuk, and wakalah bi al-istithmar sukuk, these three sukuk schemes are permissible because they are by predetermined rules. The differences that exist in these three types of sukuk do not mean that they are not allowed to make each other but can be done in different ways. Second, from this comparison, the author sees that investment in sukuk with certainly contract characteristics, especially ijarah sukuk, tends to be safer because of the certainty of the predetermined ujrah. Third, of the three types of sukuk, sukuk with a wakalah bi al-istitsmar scheme tend to be more flexible and easier to understand and implement. The level of risk and profit of the three is different, sukuk with certainly contracts tend to be safer but stable profits and tend to stagnate in contrast to sukuk that use uncertain contracts whose risks tend to be greater but there is a possibility of greater profits.

Abstract

This research aims to analyze the political model of Islamic law within the indigenous community of Kerinci. The idea behind this research is the triumph of the Islamic party in the local, governor, and presidential elections in Kerinci, Jambi Province, between 2009 and 2019. Gradually, Islam acquired substantial political influence inside the customary domain of Kerinci. The study employs a combination of socio-historical and qualitative research. The data is examined utilizing Miriam Budiardjo’s political law approach, encompassing classical, behavioral, post-behavioral, dependence, neo-Marxist, rational choice, and new institutionalism approaches. Our research indicates that the implementation of Political Islamic Law in Kerinci is an integral component of the Islamic Populism movement, which has gained momentum and become deeply rooted in the political conduct of the local Muslim community. These cultural habits originate from the fundamental principles of society, which have emerged as a result of the assimilation of Islamic teachings into daily life. These individuals are involved in the decision-making processes of Adat Institution and Majelis Pengkajian Ulama’ (MPU). These individuals inherently endorse Islamic parties such as PAN (National Mandate Party) and PKS (Prosperous Justice Party). Adat institutions play a significant role in local elections by offering guidance through sectoral delegates in every adat region. Penelitian ini bertujuan untuk menganalisis model politik Hukum Islam dalam masyarakat adat Kerinci. Ide dari penelitian ini berasal dari kemenangan partai Islam dalam pemilihan kepala daerah, gubernur, dan presiden di Kerinci, Provinsi Jambi antara tahun 2009 dan 2019. Secara bertahap, Islam memperoleh pengaruh politik yang substansial di dalam wilayah adat Kerinci. Penelitian ini menggunakan kombinasi penelitian sosio-historis dan kualitatif. Data yang ada dikaji dengan menggunakan pendekatan hukum politik Miriam Budiardjo, yang meliputi pendekatan klasik, perilaku, post-behavioral, ketergantungan, neo-Marxis, pilihan rasional, dan institusionalisme baru. Penelitian kami menunjukkan bahwa penerapan Syari’at Islam Politik di Kerinci merupakan komponen integral dari gerakan Populisme Islam, yang telah mendapatkan momentum dan mengakar kuat dalam perilaku politik masyarakat Muslim setempat. Kebiasaan budaya ini berasal dari prinsip-prinsip dasar masyarakat, yang muncul sebagai hasil dari asimilasi ajaran Islam ke dalam kehidupan sehari-hari. Individu-individu ini terlibat dalam proses pengambilan keputusan di Lembaga Adat dan Majelis Pengkajian Ulama (MPU). Individu-individu ini secara inheren mendukung partai-partai Islam seperti PAN (Partai Amanat Nasional) dan PKS (Partai Keadilan Sejahtera). Lembaga adat memainkan peran penting dalam pemilihan kepala daerah dengan memberikan arahan melalui delegasi sektoral di setiap wilayah adat.

Abstract

In general, in leasing, the object of the contract is the benefit of a tangible object. However, it is different from renting a Zoom Meeting Premium account whose position is as application software. So that its position will have benefits if its use has collaborated with hardware as hardware. Meanwhile, what is being rented is the software only. Therefore, this study will discuss the rental of Zoom Meeting Premium accounts according to the perspective of sharia economic law. This research uses a descriptive case study method with an empirical juridical approach. The data analysis technique was carried out through three stages namely data reduction, data presentation and conclusions. This study found that the position of Zoom Meeting is premium as a software application that is part of a computer program. At the same time, the computer program is part of the copyright in the form of intangible movable objects. So that there is the development of the object of the ijarah contract, generally in the form of benefits from tangible objects, which can also be in the form of benefits from intangible objects. However, the development of intangible objects as contract objects needs to be studied further by researchers so that they can be applied to all contract objects, such as intangible objects becoming objects of buying and selling contracts, mudharabah, musyarakah and other contracts.

Abstract

The debate about the involvement of Islamic boarding schools in the world of politics is in a tug of war, contradicting each other in the sense of experiencing pros and cons. Miftahul Huda Manonjaya Islamic Boarding School is one of the boarding schools in Tasikmalaya Regency, the founder of the Miftahul Huda Islamic Boarding School is late. K.H. Choer Affandi. There were 20 mandates that he left, one of which forbade him to enter the world of politics, but in the next reality, there were sons and grandsons of K.H. Choer Affandi who entered the world of politics. This article discusses Miftahul Huda Islamic Boarding School students who have entered politics, which seems to contradict one of Uwa Choer Affandi's mandates. This article aims to highlight the goals of Miftahul Huda Islamic boarding school students to enter the world of politics. This article uses qualitative research that is literature. The approach used is the theory of the relationship between religion and the state. The analytical technique used is the analysis technique popularized by Miles and Huberman, namely data reduction, data presentation, and drawing conclusions. The results show that the Miftahul Huda Islamic Boarding School has succeeded in producing scholars as well as politicians whose main goals and motivations are Islamic da'wah, understanding the ahli sunnah wal jamaah, amar ma'ruf nahi munkar, and entering politics in the case of Miftahul Huda (as KH Asep Maoshul and Uu Ruzhanul Ulum) is a mandate from the Kyai Council and in order to carry out the mandate of the late. The main thing for Uwa Choer Affandi is to maintain the aqidah of the ahli sunnah wal jamaah and in the context of izatul Islam wal muslimun (the glory of Islam and the Muslims).

Abstract

Abstract Da’wah is an activity of inviting others to strengthen the faith of Muslims. The Prophet Muhammad has given examples of how Dakwah should be done. People who accept the materials of Dakwah depend on the way of ulama’s deliver the messages. Then, ulama’ will encounter problems whether people accept or reject what they said. The adherents of radicalism in Islam believe that the teaching of Islam should be presented in many ways, including coercion and violence. This understanding is based on how they interpret some verses in the Quran about dakwah. This paper will try to reconstruct some verses and how the dakwah should be conducted inclusively by describing the ethics of dawah. So, the image of dakwah is not only about the propagation of the Islamic Religion to convert non-muslim to Islam, but also strengthening and deepening the faith of Muslims and helping them lead their daily lives in conformity with Islamic principles. Keywords: Da’wah, Radicalism, Al-Qur’an. Abstrak Dakwah adalah aktivitas untuk mengundang orang lain dalam upaya menguatkan keimanan. Nabi Muhammad telah memberikan contoh bagaimana seharusnya dakwah dilakukan. Masyarakat menerima dakwah tergantung pada bagaimana ulama menyampaikan pesan-pesannya. Dimana kemudian, seringkali para ulama tersebut menghadapi berbagai persoalan apakah pesan tersebut diterima atau justru ditolak oleh masyarakat. Pada titik ini, para penganut radikalisme percaya bahwa ajaran Islam harus disampaikan secara tegas, bahkan jika harus dengan pemaksaan dan kekerasan. Pemahaman ini hadir berdasarkan pemahaman mereka terhadap ayat-ayat AlQuran. Artikel ini berupaya untuk merekonstruksi beberapa ayat AlQuran tentang bagaimana dakwah seharusnya dilakukan secara inklusif, dengan menjelaskan etika dakwah. Sehingga, gambaran tentang dakwah tidak hanya propaganda agama agar non muslim masuk islam, tetapi lebih pada penguatan dan pendalaman keimanan dan membantu masyarakat dalam memahami prinsip-prinsip keagamaan. Kata Kunci: Dakwah, Radikalisme, Al-Qur’an.

Abstract

This article discusses one of the court products focused on the verdict. The presentation of the decision is divided into three sub-discussions, namely the understanding of court decisions, types and developments of court decisions in sharia economic cases, and legal remedies against sharia economic decisions. This article aims to find out how the decisions of Religious Courts regarding sharia economic disputes are used. The method used in this article is normative juridical, which is carried out qualitatively. The materials in this article come from laws, decisions of the Constitutional Court, decisions of the Supreme Court, books, scientific articles from journals, internet websites and so on related to the theme being studied, namely Religious Court decisions on sharia economics disputes. The data analysis technique used content analysis techniques. The results of the analysis show that the court’s decision is the final result or conclusion in written form, which is decided by a state official (judge) who is given the authority to end or settle a lawsuit because there is contention between the disputing parties in court which must be submitted in a hearing.

Abstract

The 21st century is the century of technological development in the information and communication sector. In March 2019, it was shown that out of 150 million active Indonesian users, 88% were confirmed to have accessed YouTube. Being the best-selling application motivates content creators to create exciting content that can continue to attract fans. Lately, netizens are very fond of entertainment-based content which is closely related to pranks. One of the best-selling prank videos that topped trending number 1 in January 2019 was a YouTuber video disguised as a vagrant and a crazy person with his wife. This article aims to provide an insight into how pranks (joking) are taught in Islam based on the perspective of the Al-Quran and Hadith so that the content or videos created do not harm YouTubers. This research is qualitative research with the character of library research. The research data is obtained from books, international and national journals, research reports, articles from news media, magazines related to prank. After the data is collected, read and understand related to the problem being researched. Then the data were analyzed using data analysis techniques Miles and Huberman, namely data reduction, data presentation, and concluding. The results showed that even though entertainment by joking and laughing is a form of interactive communication that indicates happiness is also human nature. However, the culture of joking that is trending like pranks is not justified. On the other hand, prank becomes an act of humour that does not meet the ethical requirements of joking on the Islamic viewpoint.

Abstract

This article discusses the paradigm of Islamic political economy and conventional political economy by looking at the discourse of Indonesian sharia banks. This article aims to find out how the political economy that occurs in Indonesian sharia banks. This article is qualitative library research. The data in this study were obtained from library materials such as books, journals, and so on related to the problems studied, namely the conventional political economy paradigm and the Islamic political economy paradigm. The data collection technique used is to collect as much data as possible about the problems studied through the internet and library websites. The data writing technique used is a data analysis technique known by Miles et al., namely data condensation, data presentation, and drawing conclusions. The analysis results show that the differences between Islamic and conventional political economy paradigms are seen in the unification (religion and economic activity) by Islamic economics and separation (religion and economic activity) by conventional economics. The dominance of the conventional economic system, represented by the capitalist and socialist economic system in the world economy, especially Indonesia, does not dampen the significant development of the Islamic economic system, which is agreed upon by various parties.
