Abstract

This article examines the structural vulnerabilities in the legal protection of Communal Intellectual Property in Indonesia, focusing on ownership claims, misappropriation, and the limited effectiveness of enforcement mechanisms. While existing scholarship has primarily addressed CIP through intellectual property and human rights perspectives, limited attention has been given to the intersection of doctrinal inconsistencies, weak enforcement, and the absence of criminal law mechanisms. This study employs a doctrinal legal research methodology, integrating statutory, conceptual, historical, and comparative approaches, supported by qualitative analysis. The findings identify three interrelated challenges. First, Indonesia’s CIP regime, influenced by the TRIPS framework, reflects an individualistic and economically oriented paradigm that is incompatible with the collective and intergenerational nature of indigenous knowledge. Second, a persistent doctrinal tension positions the state as the formal rights-holder, thereby weakening the legal standing and autonomy of indigenous communities. Third, the absence of explicit criminal provisions addressing misappropriation, biopiracy, and unauthorized commercialization creates a significant enforcement gap that undermines deterrence and enables continued exploitation. This article argues that violations of CIP should be reconceptualized not merely as economic infringements but as violations of cultural rights and human dignity. It further highlights the lack of criminal accountability as a critical weakness in the current legal framework. By incorporating recent developments in Indonesian criminal law, including the recognition of living law and corporate criminal liability, this study proposes a reconstruction of the CIP regime through a sui generis approach that integrates human rights principles with criminal enforcement to strengthen protection and ensure equitable benefit-sharing

Abstract

The family is the closest thing to starting the process of character development in children. Parents are the primary mentors in the family environment. Parents have a duty as an example that teaches noble values in children. The family is an informal educational institution, while formal education institutions are schools. There are essential aspects in fostering the character of children, namely the understanding of ethics (moral knowing), the embodiment of characteristics (moral action), and the instinct of morality (moral feeling). As a parent, not only must pay attention to the three aspects above but also pay attention to their duties as guiding children to have ethical behavior. This study aims to determine the relationship of family roles in the formation of children’s character based on moral understanding, feelings about morals, and moral conduct. This research method uses qualitative research with the type of library research. Qualitative research with this type of literature study can produce data like information obtained through the interview process and is strengthened by describing the findings of research on the problem under study. The type of data needed comes from books, journals, scientific articles, etc. that are obtained by reading as much as possible. Data analysis methods used include data reduction, data display, and data verification (concluding). This study aims to see how moral knowing, moral feeling, and moral action are applied in the family. The results of this study are expected to provide in-depth information about the role of the family in shaping children’s character based on moral knowing, moral feeling, and moral action.

Abstract

Democracy is a government of the people, by the people and for the people. The popularity of the democratic system is arguably at its peak. This is proven by the many uses of the democratic system in modern countries in the world. Indonesia as a country that runs a democratic system does not give authority to the authorities to monopolize votes in an election. Because security and freedom for every citizen, free to choose as a representation of the sovereignty of the people. But on the side that democracy often happens is seen as freedom so that there are some elements mixing elements in democracy that actually damage democracy itself. Call it when campaigning for a candidate to hate speech, insult, and berate other candidates so that damage the good name in the eyes of the community. As reported in Detik.com in 2016, the National Police stated that there were 2,018 cases of hate speech that occurred. Then it increased by 44.99% in 2017 to 3,325 cases. Furthermore, in 2018 reported in January 2019 there were 3,884 cases of hate speech that occurred. This proves that in campaigning the candidates cannot be said to campaign peacefully, fairly and competitively. Whereas Allah s.w.t. It has been said in Surah al-Hujurat verse 11. Based on the description above the writer is interested in discussing and studying more about the campaign in the Elections in Indonesia and campaigning peacefully perspective of Surah al-Hujurat verse 11. This is important to discuss given the rampant hate speech cases that conducted by candidates in campaigning. This study aims to contribute knowledge to the candidates so that in campaigning, they do not utter hate speech, insult, and berate other candidates.

Abstract

This paper examines the ritual tradition of esoteric scientific practices in Islamic boarding schools (pesantren), with a focus on the practical teachings outlined in the Kitab Amalan Khizib Kubro Ismul Haq. The study employs a qualitative research approach, utilizing library research methods. The primary data source is the Kitab Amalan Khizib Kubro Ismul Haq, along with supporting literature such as books, academic articles, and journals relevant to the research topic. Data collection is carried out through documentation, and content analysis is used for data analysis, incorporating techniques of data condensation, presentation, and conclusion drawing. The research findings reveal three main points. First, Islamic boarding schools (pesantren) are key institutions in preserving and developing Islamic traditions, including esoteric scientific practices. Second, esoteric practices are often misunderstood or negatively stigmatized due to a lack of comprehensive understanding, where the outward forms of the practices are emphasized over their deeper meanings. Third, the esoteric practices within pesantren share common ground with Sufism, as both emphasize inner spiritual transformation and the unveiling of hidden truths, with the ultimate aim of attracting benefits and avoiding harm for the practitioner. This paper aims to offer a fresh perspective on the esoteric ritual traditions in Islamic boarding schools and contribute to a deeper understanding of their role in Islamic spiritual practices.

Abstract

This study aims to examine the practice of Murabahah contracts in Indonesian Islamic banking through a Maudhu’i approach to the hadith of the Prophet Muhammad, as a response to concerns about ethical deviations. Although Murabahah is commonly used as a financing instrument, this study assesses its normative and applicative suitability with the principles of hadith. The method employed is a qualitative descriptive-analytical analysis of 4 main hadiths and 42 supporting hadiths from Imam al-Bukhari, Nasa’i, and other Rawi. The results of the study indicate that the principles of Murabahah, such as price clarity, ownership of goods, and mutual agreement, have a strong foundation in authentic hadith, particularly Bukhari No. 1926 and Nasa’i No. 4571. Three main themes were identified: justice and willingness, the validity of deferred payment (nasi’ah), and the prohibition of gharar and hidden usury. In principle, Murabahah is permissible, but its implementation often violates the valid conditions of the contract. This study emphasises the importance of hadith literacy for industry practitioners and the role of the Sharia Supervisory Board (DPS). The implications are the need for standardisation of digital contracts and harmonisation of bank operations with hadith values to ensure the conformity of Murabahah with the objectives of Sharia law.

Abstract

This article aims to highlight the role and struggles of KH Idham Chalid during the New Order era in Indonesia. This article employs a qualitative research method with a historical approach consisting of heuristics, criticism, interpretation, and historiography. Primary data sources were obtained from historical books, including Ahmad Barjie entitled “Dr. K.H. Idham Chalid Ulama Politisi Banjar di Kancah Nasional,” Arief Mudatsir Mandan with the title “Napak Tilas Pengabdian Idham Chalid: Tanggung Jawab Politik NU dalam Sejarah,” and Abdul Rahman Jaferi Rahmadi and Ahmad with the title “Elite Muslim Banjar di Tingkat Nasional.” Secondary data was obtained from scientific articles, books, and other relevant literature related to the research topic. The data analysis techniques used were data condensation, data presentation, and conclusion drawing. This study found that the role and struggle of KH Idham Chalid during the New Order era can be categorised into two categories. First, he fought within the New Order government. President Soeharto trusted KH Idham Chalid to hold strategic positions. One of them was to succeed the Family Planning (KB) programme. Second, he fought outside the New Order government through the education sector by establishing Darul Ma’arif in Cipete, South Jakarta, and Darul Qur’an in Cisarua, Bogor. KH Idham Chalid also frequently held religious study sessions that were widely attended by the public and played a role in the establishment of the Nahdlatul Ulama University (UNNU) in Bandung, which later evolved into the Nusantara Islamic University (UNINUS). Exploring the history of the educational institutions established by KH Idham Chalid could serve as a valuable subject for further research.

Abstract

The state policy regulating the concept of syibhul iddah for husbands as outlined in Circular Letter Number: P-005/DJ.III/HK.00.7/10/2021 has sparked debate among religious officials in Indonesia. This paper aims to discuss the chronology of the emergence of the concept of syibhul iddah for husbands and analyse the responses or perspectives of the heads of the Office of Religious Affairs (KUA) in Indonesia. In addition, it also discusses the relevance of the concept of syibhul iddah to the reform of Islamic family law in Indonesia. Methodologically, this research is a juridical-empirical research. Primary data was obtained through interviews with several religious leaders spread across various regions of Indonesia, while secondary data was obtained from reference materials such as scientific articles, scientific books, etc. The data analysis techniques used were data condensation, data presentation, and conclusion drawing. The results of the study show that the state policy through a circular letter regulating syibhul iddah is based on several reasons. First, the prevalence of covert polygamy in society, which can harm women’s rights. Second, as a legal measure to fill the legal vacuum regarding new marriages for husbands during their wives ‘iddah period. Third, as a legal measure to support the spirit of gender equality between men and women in carrying out responsibilities after divorce. However, in its application within the Office of Religious Affairs (KUA), the circular letter still causes differences of opinion among religious leaders in Indonesia. On the one hand, the majority of religious leaders are very responsive and supportive of the issuance of the circular letter. On the other hand, there are a small number of religious leaders who criticise the circular letter.

The Concept of Substitute Heirs: A Comparative Analysis between the Compilation of Islamic Law (KHI) and Customary Law amongst Muslim Communities in Pemalang Regency Imaro Sidqi; Yasni Efyanti; Rahmad Setyawan; Muh Zaitun Ardi; Doli Witro; Muslih Muslih

Abstract

This study was prompted by conceptual differences regarding substitute heirs between the Compilation of Islamic Law (KHI) and customary law practised by Muslim communities in Pemalang Regency. These differences reflect the dynamics of the application of Islamic inheritance law at the local level, which does not always align with formal legal norms. This study aims to examine the dynamics of the concept of substitute heirs and to analyse them comparatively between the provisions in the KHI and the practices of customary law within the local community. This is a field study employing a socio-legal approach and utilising comparative law theory. Data were collected through observation, interviews with eleven key informants, and a literature review, which were subsequently analysed qualitatively. The findings indicate that the KHI normatively restricts the substitution of heirs to specific conditions as stipulated in Article 185. Conversely, customary law practices amongst the Muslim community in Pemalang Regency permit a grandchild to replace the primary heir (a child) even whilst that heir is still alive; an adopted child may replace their adoptive parent; and a grandchild acting as a substitute heir may restrict (hijab) the share of the inheritance due to the biological siblings of the heir they are replacing. These differences are influenced by deeply rooted social constructs that have developed as a legal culture within the community. The implications of this research indicate that the Compilation of Islamic Law (KHI) remains an ideal normative reference, whilst customary law functions as a ‘living law’ that is adaptive and responsive to the social needs of the community. Therefore, the relationship between the two cannot be viewed dichotomously, but rather as a dialectic between formal law and ever-evolving social practices.
