Abstract

Most countries in the world choose the form of Federal state or Unity within organizing a government. The selection of this form of state based on political, s­ocial will include the culture and history of a country. Each form of this country has advantages and disadvantages. The Unitary State emphasizes the administration of government in the government centers and regions in the province do not have extensive autonomy in managing their regions. Unlike the Federal State, where the position of the Federal State and the State are equal. The concept of federalism has been applied in many countries. The state is given the widest possible autonomy to take care of their area. Regional autonomy aims to improve community service, develop democratic life, and encourage the community empowerment to foster creativity. Regional autonomy also has a positive impact and a negative impact on the region. This paper intends to analyze the concept of federalism and regional autonomy with practical analysis in Indonesia.

Abstract

Makalah ini membahas kasus tata kelola imigrasi menanggapi kebijakan migrasi Indonesia selama wabah Covid-19. Hal ini mengindikasikan kebijakan imigrasi di Indonesia yang dengan cepat berubah setiap bulannya menjadi isu yang serius, misalnya tentang tumpang tindih kewenangan di perbatasan, kebijakan yang terfragmentasi, sengketa penegakan hukum di perbatasan, dan kebingungan tentang kebijakan visa dan izin tinggal. Makalah ini menerapkan metodologi penelitian kualitatif studi kasus tunggal dengan pendekatan kerangka teori. Studi ini menemukan bahwa kebijakan dan tata kelola migrasi di Indonesia dalam pandemi Covid-19 telah memasukkan teori tata kelola dengan lima proposisi seperti yang dijelaskan dalam Stoker (1998). Namun, tanggung jawab penutupan stasiun lintas batas kabur yang mengindikasikan tidak adanya koordinasi antar lembaga perbatasan, dan ini bisa mengarah pada menyalahkan dan mengkambinghitamkan. Kebijakan imigrasi di perbatasan Indonesia menggambarkan proses pembuatan kebijakan yang ketat namun tidak konsisten dimana instrumen kebijakan direvisi dan diperpanjang setiap bulan. Kebijakan tersebut belum dirancang untuk situasi setelah krisis Covid-19 di Indonesia dinyatakan selesai oleh otoritas yang berwenang.

Abstract

Along with the development in the world of technology, especially in the internet sector, which has provided so many benefits and advantages and conveniences for many people, in addition to these advantages there are also developments in negative aspects, the existence of risks, and the negative impact of its misuse by parties who not responsible. Some time ago the Indonesian people were quite troubled by the emergence of cases of leakage of personal data of Facebook users. The personal data leakage scandal of Facebook users that has been broken into by the analytical research firm Cambridge Analytica is targeting the entire world population, one of which is Indonesia. Many people are wondering who is to blame and responsible for this case. What is the cause of this case and can it be prevented.

Abstract

The right to education is a fundamental human right and must be fulfilled by the state. However, the right to education, especially for women with underage marriages (child marriages), has not yet had adequate education. This paper aims to analyze the legal and social aspects of children's educational rights, especially women with conditions of underage marriage (child marriage) in Indonesia. This study examines the formal juridical aspects of the protection and guarantee of education rights for women and social aspects related to the constraints of fulfilling women's education. This research is a normative juridical study in which this study looks at the community's various facts based on the applicable legal rules. This research's social aspects are seen based on various social theories related to this research study; the data and facts obtained in this study are data sourced from previous research, both print and online media. This research confirms that child marriage is motivated by many factors, one of which is economic conditions so that women cannot achieve the rights to education. However, according to the 1945 Constitution Article 31 paragraph (1) that every citizen has the right to get an education. However, there are no strict criminal sanctions for families who leave their children out of school in terms of law enforcement.

Abstract

Coffee is one of the leading commodities for Indonesia. The growth of coffee farming throughout Indonesia has also increased significantly in line with the growing trend of love for coffee on a national and international scale. This paper aims to discuss and explain the legal protection of coffee farmers registered with geographic indications in Tlahap Village, Kledung Temanggung, Central Java. This paper describes and analyzes various efforts to increase understanding of legal protection of geographic indications for coffee farmers. The method used in this program is direct assistance to coffee farmers in Tlahap Village and evaluation through interviews and surveys. The program found that the main obstacle faced by geographically indicated coffee farmers in Tlahap Village is human resources. The absence of a certified party to control coffee quality is one of the obstacles faced, in addition to the constraints of the geographical indication coffee farmer organizational structure. In addition, this program emphasizes that by increasing the understanding of legal protection for coffee farmers with geographical indications, the farmers are able to have readiness to face various obstacles in the field, one of which is regarding brand disputes, label fraud, and other legal problems. This program concludes that in terms of legal protection, cross-sectoral cooperation between farmer associations, government agencies and universities is required.

Abstract

A clean and healthy lifestyle (PHBS) is a set of behaviors that are practiced on the basis of awareness as a result of learning that makes a person, family, group or community able to help themselves (independently) in the health sector and play a role in realizing public health. The student group KKN BMC UNNES 2020 has a mission to make the people of Kalirancang Village, Alian District, Kebumen Regency, Central Java aware of implementing a clean and healthy lifestyle (PHBS) in their daily life, especially during the Covid-19 pandemic. The method of implementing KKN includes socialization and counseling on the application of a clean and healthy lifestyle (PHBS) directly to the people of Kalirancang Village, Alian District, which is the object. Several activities are carried out, such as weighing the baby every month, using clean water, washing hand use soap, healthy eating patterns, and doing bodily activities. The results achieved through these activities are being able to make people aware of the importance of implementing a clean and healthy lifestyle (PHBS) and can provide knowledge to the community regarding how to properly implement a clean and healthy lifestyle so that people can implement PHBS regularly in their daily life.

Abstract

Law students are expected to have special abilities in the field of legal science, either in oral or oral. But in fact, the analytical skills of law students are not comparable to other abilities. Based on preliminary research conducted by the Proposer Team, it shows that out of 200 law students surveyed (Students of the Faculty of Law, Semarang State University), only 10 have written and conducted scientific publications in both national and international journals. Meanwhile, of the 200 people stated that students' critical abilities and analytical thinking are important, 184 people said that discussion forums are mandatory for law students, but in fact, of these 184 people, only 2 people followed up on the results of the discussion. . In other words, discussions conducted by students were not followed up in various forms of scientific studies and publications that could be read by many people. This program provides facilities for law students in in-depth critical analysis studies and criminal case studies related to human rights. In this program, students are expected to be able to have good analytical skills both in oral and verbal forms. Partners in this program are the law student community at Semarang State University. This program is expected to be able to solve partners' problems in the lack of critical analytical skills and case studies of criminal law as well as scientific publication of legal research results. The output of this program is expected to create a sustainable and sustainable activity related to critical analysis and legal case studies.

Abstract

This study is to examine the nature of collaboration between the Department of Home Affairs Australia (DHA) and the Directorate General of Immigration Indonesia (DGI) to protect their borders and intercept unauthorized arrivals, and to identify current challenges of postings of Airline Liaison Officers (ALOs) at airports in Indonesia. This study employs the qualitative research method methodology using the document analysis and observation at Jakarta and Bali airports by collecting sources of data from public organizational reports, official documents, books, online publications, or journal articles. The data is analyzed by using the five indicators by O’Leary & Vij: power, communication, perceived legitimacy, trust, and information exchange. The study shows the collaboration between DHA and DGI in posting of ALOs at airports in Indonesia has been running for more than a decade as the extraterritorial immigration control despite legal challenges, sovereignty, non-refoulment principles, human rights violations, and authority overlap. This paper recommends both countries to ratify new arrangements about posting of ALOs subject to the national sovereignty, data sharing, use of technology, Indonesian legislations, and involvement in operation protocols. Further study about  extraterritorial immigration control by postings of ALOs in Indonesia can be discussed from the perspectives of national sovereignty, border integrity, and intelligence service.Keywords: DHA, extraterritorial immigration control, ALOs, unauthorised arrivals, perceived legitimacy

Abstract

Fulfilment and protection of human rights in all aspects is a form of Constitutional Rights for Citizens that must be fulfilled by the State. Basic human rights also under no circumstances can be reduced even deprived. However, the fact is, human rights regulated in various laws and regulations in Indonesia have not been maximally implemented. The fulfilment and protection of human rights also faces its own challenges in implementing it in certain cases, for example disasters such as Pandemic Covid-19. Various legal instruments, both central and regional, were created to deal with and resolve the Covid-19 Pandemic problem. This study aims to examine the implementation of the fulfilment and protection of human rights in special situations such as Covid-19 Pandemic. This research is limited to the Semarang City area. This study wanted to find out and analyze various aspects of law and human rights in the implementation of various policies related to Covid-19 in the City of Semarang. This study seeks to find challenges and problems in the protection and fulfilment of human rights in the city of Semarang in the Covid-19 Pandemic. The method in this study uses empirical research, where researchers directly go to the field. The planned data was obtained from various related agencies in the city of Semarang, the community, and related NGOs. This research will assist the government in mapping human rights fulfilment policies in national disaster situations in this case the Covid-19 Pandemic.
