Abstract

The family is the closest thing to starting the process of character development in children. Parents are the primary mentors in the family environment. Parents have a duty as an example that teaches noble values in children. The family is an informal educational institution, while formal education institutions are schools. There are essential aspects in fostering the character of children, namely the understanding of ethics (moral knowing), the embodiment of characteristics (moral action), and the instinct of morality (moral feeling). As a parent, not only must pay attention to the three aspects above but also pay attention to their duties as guiding children to have ethical behavior. This study aims to determine the relationship of family roles in the formation of children’s character based on moral understanding, feelings about morals, and moral conduct. This research method uses qualitative research with the type of library research. Qualitative research with this type of literature study can produce data like information obtained through the interview process and is strengthened by describing the findings of research on the problem under study. The type of data needed comes from books, journals, scientific articles, etc. that are obtained by reading as much as possible. Data analysis methods used include data reduction, data display, and data verification (concluding). This study aims to see how moral knowing, moral feeling, and moral action are applied in the family. The results of this study are expected to provide in-depth information about the role of the family in shaping children’s character based on moral knowing, moral feeling, and moral action.

Abstract

This research analyzes international trade through the Heckscher-Ohlin political model towards national economic interests from an Islamic economic law perspective. This research uses qualitative methods with a text analysis approach. The data used is secondary, regarding the relationship between international trade, economic policy and national economic welfare. The research results show that the Heckscher-Ohlin (HO) theory is the main basis for studying the economics of international trade. This theory emphasizes differences in the scarcity of production factors between countries as the main factor influencing trade patterns. The main production factors in this theory are labor and capital. This difference in the scarcity of production factors encourages specialization in production, which helps increase the efficiency of resource allocation. Comparative advantage is basic in HO theory, where countries focus on producing goods they are able to produce at lower costs. This analysis also carries the HO Theory with Islamic economic law, which emphasizes the fairness of wealth distribution, business ethics, integrity, social welfare, balance and social justice, as well as individual moral responsibility in international trade. By combining these two approaches, international trade can provide sustainable economic and social benefits and is in accordance with Islamic ethical values.

Abstract

It becomes a dilemma when Muslim communities cannot apply Islamic criminal law. In fact, a law is not only to be understood but also believed to be true by Muslims themselves. So, it is appropriate that the punishment for adultery is less likely to have a deterrent effect on the perpetrator. This is because, apart from conventional criminal law being poorly understood by the Muslim community, the sanctions are also quite light so that the deterrent effect desired by law enforcers cannot be realized. This research aims to analyze adultery law by applying linguistic approaches and ushul fiqh to adultery law. This type of research is normative law using a language and ushul fiqh approach. The data sources were primary and secondary, while data collection techniques were observation and literature study. The results of this research show that adultery is analyzed using a language and ushul fiqh approach is the perpetrator of a criminal act who deliberately commits the elements of inserting male genitalia into female genitalia (in intercourse), which is unlawful according to the substance of the act, not because subḥāt and women bring lust. The punishment for adultery is to jilīd one hundred times. This penalty can be applied if the legal action has been legal before the court by presenting four witnesses. The stipulated punishment cannot be changed with other types of punishment because the punishment is regulated by the text of the Al-Quran.

Abstract

ABSTRACT Nahdlatul Ulama is one of the Islamic political parties that took part in the national political arena during President Soekarno's time from parliamentary democracy to the transition period from parliamentary democ­racy to guided democracy. NU's progress was closely related to its social and political factors which required NU to accept and integrate into President Soekarno's new government system. This paper aims to reveal the social and political factors that enabled NU to face and then accept guided democracy. This article employed a qualitative approach, particu­larly the historical study method. In tracing the socio-religious history in this study, the stages of heuristics, criticism, interpretation and historiog­raphy were taken. The results showed that NU's social factors in dealing with guided democracy were due to the presence of the PKI which was so strong in national politics and so close to President Soekarno. To deal with the PKI, like it or not, NU had to enter the government in order to resist the PKI and divert President Soekarno's inclination towards NU. Mean­while, the political factor was to maintain NU's position in government, where had always received a share. NU efforts were done solely to protect Muslims, especially ahlussunnah waljamaah an-nahdliyah. Keywords: Guided Democracy, Nahdlatul Ulama, Socio-Political Factors.  ABSTRAK Nahdlatul Ulama merupakan salah satu partai politik Islam yang berkiprah di kancah perpolitikan nasional masa Presiden Soekarno sejak demokrasi parlementer bahkan mampu bertahan pada masa transisi dari demokrasi parlementer ke demokrasi terpimpin. Hal ini karena ada faktor sosial dan politik yang mengharuskan NU menerima dan masuk pada sistem pemerintahan baru Presiden Soekarno. Tulisan ini bertujuan untuk mengungkap faktor sosial dan politik yang memungkiakan NU mengha­dapi dan kemudian menerima demokrasi terpimpin. Artikel ini mengguna­kan pendekatan kualitatif, dengan metodi studi sejarah. Dalam menelu­suri sejarah sosial keagamaan dalam penelitian ini, ditempuh tahapan heuristik, kritik, interpretasi dan historiografi. Hasil penelitian menunju­kan bahwa faktor sosial NU dalam menghadapi demokrasi terpimpin karena adanya eksistensi PKI yang begitu kuat dalam politik nasional dan kedekatannya dengan Presiden Soekarno. Untuk menghadapi PKI maka NU mau tidak mau harus masuk dalam pemerintahan dalam rangka membendung PKI dan mengalihkan kecenderungan Presiden Soekarno kepada NU. Sedangkan faktor politik adalah untuk mempertahankan kedudukan NU di pemerintahan yang sejak zaman demokrasi parlementer NU selalu mendapatkan jatah, hal ini dilakukan semata-mata untuk menjaga dan melindungi umat Islam khususnya ahlisunnah waljamaah an-nahdliyah.  Kata kunci: Demokrasi Terpimpin Faktor Sosial-Politik, Nahdlatul Ulama.

Abstract

When discussing syara’ law, it is always bound by four things, namely al-Hakim, law, mahkumalaih, and mahkumfih. In various legal studies, there are various views in determining that a person can be subject to law, or in other words, capable of law. In essence, everyone is a good bearer, that is, someone who has rights and obligations. Rights bearers are also known as legal subjects. The term legal subject in the discipline of Islamic law is mentioned as mahkumalaih. If there is a legal subject, it will always go hand in hand with a legal object. In the discipline of Islamic law, the object of the law is also called mahkumfih. This article aims to discuss mahkumalaih and mahkumfih in the discipline of Islamic law. The study uses a qualitative approach that is a literature review. The materials for this article were obtained from books, journals, and internet websites related, namely mahkumalaih, and mahkumfih. The data analysis techniques used were data presentation, data reduction, and conclusion drawing. The findings showed that mahkumfih is a legal object or is interpreted as an act of mukallaf based on Allah and the Prophet’s command. In the discussion of legal objects, it cannot be separated from the legal subject. In ushulfiqh the subject of law is called mahkumalaih.

Abstract

This article discusses the classification of tabarru’ contracts and the implementation of qardh contracts on the take over in Indonesian Islamic banks. The research method used in this article was qualitative research method. Data were collected by using literature study technique. Data were collected from several sources as references such as books, articles, and other data sources. Data analysis techniques used were data condensation, data presentation, and drawing conclusions. This article reveals that the tabarru’ contract is a contract that is applied with the concept of helping each other in order to achieve goodness. There are several classifications of tabarru’ contracts, namely the concept of guaranteeing money (qardh, rahn, hiwalah), guaranteeing oneself (kafalah, wakaalah, wadi’ah) and giving something (hibah, hadiah, wakaf, ZIS). This classification makes it easy to understand the concepts and implementation of the tabarru contract in life, but still prioritize the common good. The implementation of the qardh contract on the take over at Bank Syariah Indonesia provides convenience to customers who need assistance in transferring debt to conventional financial institutions. The existence of qardh facilities on the principle of helping each other remains sticking to the rules of the Sharia. Artikel ini membahas tentang klasifikasi akad tabarru’ serta implementasi akad qardh atas take over di bank syariah Indonesia. Metode penelitian yang digunakan dalam artikel ini yaitu metode penelitian kualitatif. Teknik pengumpulan data menggunakan cara studi kepustakaan. Data dikumpulkan dari beberapa sumber untuk dijadikan referensi seperti buku-buku, artikel, dan sumber data yang lainnya. Teknik analisis data yang digunakan adalah kondensasi data, penyajian data, dan penarikan kesimpulan. Artikel ini mengungkapkan bahwa akad tabarru’ merupakan akad yang diterapkan dengan konsep saling tolong menolong dalam rangka mencapai kebaikan. Ada beberapa klasifikasi akad tabarru’ yaitu konsep menjamin uang (qardh, rahn, hiwalah), menjamin diri (kafalah, wakaalah, wadi’ah) dan memberikan sesuatu (hibah, hadiah, wakaf, ZIS). Klasifikasi tersebut memberikan kemudahan untuk memahami konsep-konsep dan pengimplementasian akad tabarru’ dalam kehidupan, dengan tetap mengedepankan kemaslahatan bersama. Implementasi akad qardh atas take over di Bank Syariah Indonesia memberikan kemudahan terhadap nasabah yang membutuhkan bantuan terhadap pengalihan hutang terhadap lembaga keuangan konvensional. Adanya fasilitas qardh atas prinsip tolong menolong dengan tetap berpegang teguh pada aturan syariat.

Abstract

The Nahdlatul Ulama Party is one of the Islamic parties that became a loyalist party to President Soekarno during the implementation of guided democracy. This is because the political strategy used by the NU Party is a realistic political strategy and tends to be accommodating and cooperative in dealing with President Soekarno’s new political situation, namely guided democracy. So that after the NU Party decided to accept guided democracy, the return of the 1945 Constitution, and the Nasakom and Manipol-Usdek, the NU party supported the leadership of President Soekarno, one of its supports was the awarding of a charter with the title waliyul amri adh-dharuri bi syaukah from Nahdlatul Ulama to President Soekarno. This paper aims to reveal the waliyul amri adh-dharuri bi syaukah title charter as moral support from the Nahdlatul Ulama Party to the leadership of President Soekarno during the guided democracy. The method used in this study is the historical method, while the approach used is the hermeneutic theory of Paul Ricoeur. The results of the study show that the waliyul amri adh-dharuri bi syaukah charter is a form of moral support from the Nahdlatul Ulama Party for the leadership of President Soekarno, so it has legitimized that the government led by President Soekarno himself is a legitimate government according to the eyes of fiqh law. This charter is also the basis for acceptance and support from the NU Party for President Soekarno and his guided democracy.

Abstract

This paper describes the political contestation in the election of leaders that has occurred in the last five years in Indonesia. Since the reformation era, conservative Islamic movements have gained wide freedom to spread Islamic political ideology such as the idea of upholding Islamic law. This was clearly seen in the 2017 Jakarta Gubernatorial Election and 2019 Presidential Election, where the conservative Islamic movement voiced practical political aspirations by involving the role of religion. The case that happened to Basuki Tjahaja Purnama (Ahok) who was suspected of committing blasphemy at the end of 2016, turned into a protest movement that held “Aksi Bela Islam I, II, III” (Action for Defending Islam I, II, III) which was able to mobilize all elements of religious organizations in Indonesia. This movement is also supported by the role of social media which adds to the massive Islamic populism movement to promote the enforcement of Islamic law through the political stage. This is a qualitative research that prioritizes bibliographic sources. The results of this study indicate that the voices of Muslims who are involved in the “Action to Defend Islam” add to the success of the conservatism process which has a dichotomy of political interests to realize religious authoritarianism by using the Qur’anic verses. However, this study also explains the characteristics of the attitudes of leaders in the history of Islamic civilization who uphold egalitarianism that does not conflict with the democratic system because the responsibility of a leader is to create prosperity and justice for all mankind.

Abstract

This study aims to determine the implementation of pre-aqil baligh (before puberty) education through male and female programs as an effort to form students’ religious attitudes. Pre-aqil baligh education is essential to implement in elementary schools considering the development of puberty is faster. This research was conducted at Ashfiya Elementary School, which is one of the Islamic schools in the city of Bandung. The research subjects were fifth and sixth-grade students when they were closer to pre-aqil baligh. The method used is qualitative research, which is conducted in the form of case studies. The sources used in the research are observation and interviews. And supported by scientific articles (journals) and books related to research. Data collection techniques are carried out by reduction, presentation, and verification. The research found that pre-aqil baligh education can be implemented by providing education about morals, fiqh of haidh (menstruation) and ihtilam (wet dreams), early sex education, and the habit of reciting the Koran. This activity uses the mentoring method as an approach to students. The religious attitude that is formed from pre-aqil baligh education through the male and female programs consists of three religious dimensions, namely aqidah, sharia, and morals. (Penelitian ini bertujuan untuk mengetahui pelaksanaan pendidikan pra aqil baligh (sebelum pubertas) melalui “program laki-laki dan perempuan” sebagai upaya membentuk sikap religius peserta didik. Pendidikan pra-aqil baligh penting dilaksanakan di sekolah dasar mengingat perkembangan masa pubertas lebih cepat. Penelitian ini dilakukan di SD Ashfiya yang merupakan salah satu sekolah Islam di kota Bandung. Subyek penelitiannya adalah siswa kelas V dan VI yang mendekati pra aqil baligh. Metode yang digunakan adalah penelitian kualitatif dengan melakukan penelitian lapangan berupa studi kasus. Sumber yang digunakan dalam penelitian adalah observasi dan wawancara. Serta didukung dengan artikel ilmiah (jurnal) dan buku-buku yang berkaitan dengan penelitian. Teknik pengumpulan data dilakukan dengan cara reduksi, penyajian, dan verifikasi. Penelitian ini menemukan bahwa pendidikan pra aqil baligh dapat dilaksanakan dengan memberikan pendidikan tentang akhlak, fiqh haidh (haid) dan ihtilam (mimpi basah), pendidikan seks sejak dini, dan kebiasaan mengaji. Kegiatan ini menggunakan metode pendampingan sebagai pendekatan kepada siswa. Sikap keagamaan yang terbentuk dari pendidikan pra-aqil baligh melalui “program laki-laki dan perempuan” terdiri dari tiga dimensi keagamaan, yaitu aqidah, syariah, dan akhlak.)

Abstract

Political economy is understood as a scientific discipline that discusses political and economic problems and their very complex nature related to thinking about the application of politics and economics. This article uses qualitative research methods. Data collection is done by the library research method. These data are sourced from scientific papers, authoritative books, internet websites, and those related to research topics. The data analysis technique used is a qualitative data engineering model, Miles et al., namely data condensation, data presentation, and drawing conclusions. The study results show that the state's welfare refers to the government's active role in managing the economy. Therefore, the source of state finances is the driving force for the welfare of the state and society. In Indonesia, the government has detailed regulated how state financial resources are obtained and issued for the public benefit. Judging from the history of Islamic economic politics that has been carried out during the time of the Prophet until now, financial sources such as business, taxes, and public debt have become significant contributions to the Indonesian government in running the economy.
