Abstract

Keberhasilan dalam pengembalian aset hasil tindak pidana korupsi menjadi salah satu indikator keberhasilan dalam upaya pemberantasan korupsi di Indonesia. Tren korupsi yang lintas negara dan melibatkan banyak aktor, menyebabkan upaya pengembalian aset (asset recovery) menjadi tidak mudah. Paper ini bertujuan untuk mengkaji tiga hal penting, yakni: (1) upaya pengembalian aset hasil korupsi yang berada di luar negeri, (2) peran lembaga negara dan aparat penegak hukum, dan (3) faktor hambatannya. Penelitian paper ini menggunakan pendekatan yuridis sosiologis, penelitian kualitatif dengan spesifikasi penelitiannya deskriptif analitis, teknik pengumpulan data dengan cara wawancara dan dokumentasi. Paper ini menggarisbawahi bahwa p pengembalian aset dapat dilakukan melalui jalur formal dengan MLA dan informal melalui hubungan diplomatik. Tahap pengembalian aset terdiri atas: (1) identifikasi dan penelusuran, (2) proses hukum, dan (3) perampasan aset. Hambatan dalam pengembalian aset meliputi sistem hukum yang berbeda, lemahnya putusan hakim, kemauan politik pemerintah, dan berlakunya asas kerahasiaan bank di beberapa negara. Permasalahan yang muncul dalam pengembalian aset bisa diatasi dengan perjanjian bilateral, meningkatkan kompetensi aparat penegak hukum, dan memantapkan aturan dan sarana prasarana pendukung. Peran pemerintah baik Kejaksaan Agung, NCB Interpol Indonesia, KPK, Kemenkumham, dan Kemenlu, semuanya saling mendukung satu sama lain dalam upaya pengembalian aset sesuai dengan aturan hukum yang berlaku. Paper ini menyimpulkan bahwa dalam pengembalian aset membutuhkan kerjasama antar lembaga dan aparat penegak hukum baik yang berada di dalam maupun di luar negeri.One of aimed indicators on corruption eradication in Indonesia is the successful of assets recovery. Trend of corruption that cross border nations and involved many actors caused the assets recovery process was not easy to be done. This paper would examine three main points: (1) the effort of corrupted asset which save abroad; (2) roles of state institutions and law enforcement officers on assets recovery; and (3) the obstacles on assets recovery. The paper used a socio-legal approach, qualitative research with descriptive analytical research specifications, and techniques of data collection through interviews and documentation methods. This paper was underlined that assets recovery can be optimized by two ways, one of formal track through MLA and other is informal track with diplomatic relations. The process of assets recovery started from (1) identify and trace, (2) legal proceedings, and until (3) repatriate. The obstacles on asset recovery was concerning to a different legal system, a weakness of judicial verdict, good and political will of government, and the implementation of bank secrecy principle in some countries. Some problems faced in assets recovery process resolved by conducting bilateral agreements, improving the competence of law enforcement officers, and establishing the rules and supporting infrastructure. The roles of government, whether its Attorney General, National Central Bureau Interpol Indonesia, KPK, Kemenkumham, or Kemenlu, all of which mutually support one another in an effort to return the assets in accordance with the rules of the applicable law. This paper concluded that the asset recovery requires cooperation between institutions and law enforcement agencies both within and outside the country.

Abstract

AFTER the previous edition of JILS raised the theme of “Crimes and Society: General Issues on Criminal Law in Indonesia”, in this edition JILS wanted to explore various cases and developments in criminal law enforcement. The complexity of criminal law enforcement in many conditions presents a variety of debates, ranging from legality and non-retroactive principles of law which in certain cases find discrepancies between facts and existing theories. In addition, criminal law which is considered ultimum remedium and has the character of a double-edged sword, on the one hand protects the interests of victims and the public but on the other hand injures the rights of the accused, becomes very complex because of its relation to the protection of human rights. In order to provide the most up-to-date discourse in the development of criminal law enforcement, in this edition we take the theme “Penal Policy and The Development of Criminal Law”. This theme provides a different perspective for readers relating to criminal law policy and formulation of criminal law enforcement. In this edition, we received a large number of articles sent to the editorial desk, therefore it requires considerable time in choosing, reviewing and giving our best feedback and comments to the authors. To highlight the development of criminal law enforcement, this Journal volume is dedicated to discuss several issues related to the penal policy and development of criminal law enforcement.

Abstract

The four principles of freedom (four freedoms) include freedom of speech and expression, freedom of religion and belief, freedom from want, and freedom from fear, are basic principles recognized by countries and translated into many more specific forms of human rights fulfillment human. The fulfillment and protection of human rights is one indicator of the progress of a country. The scope of fulfilling human rights that covers a very broad field, from education, health, to law enforcement, is a challenge. The UN Security Council 2017 Universal Periodical Review (UPR) session provides recommendations for strengthening human rights in Indonesia, including the ratification of international human rights instruments, the continued cooperation of UN human rights, the abolition of the death penalty, matters related to sexual orientation and efforts to protect tolerance and diversity. The Commission for Missing Persons and Victims of Violence (Kontras) 2017 records 84 cases of violence and human rights violations that occurred. The issue of interpreting different human rights standards is one of the causes of this high problem in Indonesia. Many different interpretations are caused by the running of different political systems of state administration, causing the implementation of human rights fulfillment to be different. This paper looks at and compares the practices of human rights enforcement covering the four principles of freedom in Indonesia. This paper will compare the implementation of human rights standards and norms in national domestic practices based on international human rights principles and norms.

Abstract

Tujuan dalam penulisan ini adalah untuk mengetahui bentuk pencucian uang yang dilakukan oleh pelaku korporasi, untuk mengetahui bentuk pertanggungjawaban sebuah perusahaan dalam tindak pidana pencucian uang, untuk mengkaji mengenai bentuk pertanggungjawaban tindak pidana korporasi dalam peraturan yang ada dalam perundang–undangan serta mengkaji mengenai pertanggungjawaban tidak pidana korporasi dalam kasus tindak pidana pencucian uang. Penulisan ini bersifat deskriptif guna untuk mengetahui gambaran permasalahan yang ada, yang kemudian dianalisis secara deduktif. Bentuk pidana pencucian uang oleh korporasi ada tiga jenis yaitu penempatan, pelapisan, dan penggabungan. Subjek korporasi akan mendapatkan hukuman pidana sesuai dengan perbuatannya. Seperti yang telah disebutkan dalam pasal 6 UU No 8 tahun 2010 bahwa dalam tindakan pencucian uang sebagaimana yang dimaksud dalam pasal 3, 4 dan pasal 5 dilakukan oleh korporasi sehingga pidana akan dijatuhkan kepada personil pengendali korporasi. Apabila personil tidak mampu membayar maka akan diganti dengan penyitaan korporasi dan personil pengendali perusahaan. Dan apabila belum cukup maka penjara dapat diganti oleh denda kontrol perusahaan.

Abstract

The national and international economic development raises new problems besides the positive side of finance. International economic recession that has global impacts including in Indonesia presents its own challenges. One of the challenges faced is a serious impact on the fulfillment of economic and social rights. Various economic austerity measures were taken to maintain the country’s economic stability. One of the most controversial is the reduction of subsidies in the health, social security, trade and education sectors. The unemployment rate also increased as a direct impact of these economic policies. This paper analyzes the rights of human rights in Indonesian political economic policy both on a national and international scale. This paper compares and analyzes various cases of Indonesian economic policy with the basic principles of human rights, especially social, economic and cultural rights. Studies in this paper cover the areas of study of International Economic and Trade Law, Human Rights Law, and International Law. This paper highlighted that economic policies in the form of reducing subsidies and austerity measures undermine a wide range of human rights human rights frameworks.

Abstract

Berbagai kasus penyebaran berita palsu dan bohong (fake news and hoax) di Indonesia telah menjadi permasalahan yang sangat serius. Bukan hanya berkaitan dengan keamanan dan kenyamanan, namun pada perlindungan hukum terhadap masyarakat dan penegakan hukum. Pada kasus-kasus penyebaran fake news and hoax, undang-undang beserta perangkat penegakan hukum lebih fokus kepada pelaku kejahatan, sementara korban (victim) dalam kasus tersebut tidak banyak mendapatkan porsi yang lebih. Tulisan ini mendiskusikan tentang pengaturanterkait beritapalsu atauberita hoaxdan penerapan sanksiterhadap pelaku tindak pidana penyebaran berita hoax terhadap beberapa pihak yang juga ikut terkait penyebarluasanberita bohong. Tulisan ini juga fokus kepada upaya perlindungan terhadap korban dalam berbagai kasus penyebaran berita hoax di media sosial di Indonesia. Penelitian ini menganalisis berbagai kasus terjadi di Indonesia yang diperoleh dari berbagai media baik cetak maupun online. Sehingga, metode dalam penelitian ini menggunakan studi empiris dan kepustakaan. Penelitian ini menegaskan bahwa dasar pengaturan atas penyebaraluasanberitapalsu (hoax)telah diaturdan ditetapkan keUU No.19 Tahun 2016 pasal28 ayat1 dan ayat 2. Kemudian dari Undang-Undang itu ada juga peraturan lain yang membahas tentang penyebarluasanberitahoaxyang kemudian dijelaskan ke dalam UU No. 1Tahun1946 (UU Peraturan Hukum Pidana) pasal 14danPasal 15, juga dalam pasal311 dan pasal 378KUHP,serta Pasal27ayat3UUNo. 19Tahun2016(UU ITE). Perlindungan korban dalam kasus ini dapat ditemukan pada berbagai aturan perundang-undangan, diantaranya PP No. 44 Tahun 2008 tentang Pemberian Kompensasi, Restitusi, dan Bantuan kepada saksi dan korban; dan Undang-Undang No. 13 Tahun 2006 tentang Perlindungan Saksi dan Korban.

Abstract

Indonesia is a country oriented to the democratic system. As stated in the 1945 Constitution Article 1 Paragraph (2) which states "Sovereignty is in the hands of the people and carried out according to the Constitution." 2019 is a political year. Soon the Indonesian people will hold a democratic party for the umpteenth time. The rise of Negative Campaigns and Black Campaigns is unavoidable ahead of general elections in Indonesia. The emergence of a black campaign became a reflection of the dilapidated morale of the Indonesian people today. It cannot be denied that black campaign has a very bad impact on the political education of the Indonesian people. The phenomenon that occurs is SARA participation in politics. Where we know that Indonesia has pluralism, we not only have one religion, culture, and tribe. Religious issues may be familiar to the public ahead of the 2019 presidential election, which raises some perspectives and assumptions that they are a form of religious politicization, embodiment of religious values ​​in politics, and the opinion of the khilafah government system in Indonesia. Differences of opinion must always exist amid a pluralistic society. The differences and diversity that exist in Indonesia can lead to conflict and division if not addressed wisely. Conversely, plurality can be an adhesive in society if it is able to be managed properly without uniformity. Therefore, ahead of the 2019 Presidential Election, the public is expected to be able to filter all the news obtained, whether the campaign used is included in the negative campaign or is it a black campaign? It is hoped that free and fair democratic parties can be realized in the upcoming 2019 Presidential Election, so that it can maintain harmony in the life of the nation and state. The community must be clever in digesting the information that is obtained and it is hoped that it will not be easily provoked for the integrity of the nation.
