Abstract

Abstract

This study attempts to see the contribution of Islamic Religious Education in the establishment of ethical behaviour on social media in the perspective of Islamic law. This research is qualitative research with a literature review technique. The data were collected from numerous sources such as Qur’an, hadith, textbooks of Islamic Religious Education, fiqh literature, and scientific discourses on digital communication, social ethics, and Islamic law. Data analysis included gathering, reducing, classifying, analyzing and making descriptive findings. The results reveal that Islamic Religious Education has an important role in establishing the virtues of honesty, responsibility, politeness, tabayyun, self-control and respect for the privacy of others. These rules are important to avoid the spread of hoax, defamation, backbiting, hate speech, cyberbullying and damaging information. The use of social media has to be based on the principles of public interest, prevention of harm, protection of human dignity and making all people accountable for what they share under Islamic law. Students are also exposed to case-based learning to comprehend the social repercussions, legal ramifications and restrictions to freedom of expression in digital environments. The study concluded that the introduction of digital ethics in Islamic Religious Education can improve students’ moral and legal awareness and foster responsible social media use.

Abstract

Divorce is a societal problem that affects children, extended families, married couples, and the general social resilience of communities. Local wisdom values, such as siri' na pacce, sipakatau, sipakalebbi, sipakainge, and tudang sipulung, stand for respect, empathy, accountability, and thoughtful dispute resolution in Bugis-Makassar society. The goal of this study is to determine how applicable Bugis-Makassar traditional knowledge is to family mediation as a divorce prevention tactic and how it may be updated and revived. This study employed a descriptive design and a qualitative methodology. In-depth interviews, observations, and documentation involving couples who had experienced marital discord, as well as traditional leaders, religious leaders, mediators, and family members involved in mediation procedures, were used to collect data. Techniques for data reduction, data display, and conclusion drawing were used to analyze the data. The findings indicate that while sipakatau and sipakalebbi improve respect between married couples, siri' na pacce strengthens accountability and empathy. While tudang sipulung provides a deliberative setting for discovering common answers, sipakainge encourages constructive reminders. The findings suggest that the parties' desire to voluntarily embrace the mediation process can be increased by involving traditional authorities, religious leaders, and dependable family members. Reviving these ideals in an adaptive, equitable, and impartial manner might support family mediation. The results of this study show that incorporating local knowledge into family mediation could be beneficial in reducing divorce.

Abstract

In the Indonesian Islamic family law system, divorce has legal repercussions, but it also has social ramifications related to social interactions, family dignity and the continuity of links among parties concerned. The ideals of honour, empathetic, solidarity, responsibility, and dignified dispute resolution depicted by Siri’ na Pacce are vital in improving the systems of divorce settlement, in the Bugis-Makassar culture. The objective of this research is to find out the position of Siri' na Pacce values in divorce settlements and to develop a divorce resolution reconstruction model that is in accordance with the Indonesian Islamic family law system. This research adopts a normative legal method. Primary and secondary legal sources and literature on Islamic law and local wisdom are analyzed. The research is based on statutory, conceptual, and cultural value approaches. The results suggest that divorce settlement is mostly focused on ending the formal partnership, but the dignity restoration, moral duty, child protection and post-divorce reconciliation have not been sufficiently taken into account. To include Siri’ na Pacce’s ideals into religious court procedures, it can be done thru increasing mediation, post-divorce obligations, defending the parties’ dignity and adopting restorative approaches. Such integration encourages a divorce settlement that is procedural, as well as considers the balance of rights and obligations, family bonds and what is best for the children. The study finds that by reconstructing divorce settlement based on Siri' na Pacce, it is possible to establish a more compassionate, just, contextual and welfare-oriented Islamic family law system.

Abstract

This study aims to analyze the legitimacy of the mappacci tradition from the perspective of Islamic law through the concept of ‘urf and to examine its conformity with the principles of Islamic marriage law. The research method used is normative legal research with a qualitative, conceptual, and socio-legal approach through library research on primary Islamic legal sources and scholarly literature concerning the Bugis marriage tradition. The analysis was conducted by identifying the forms, meanings, and functions of the mappacci tradition and examining them based on the concepts of ‘urf, uṣūl al-fiqh, qawā‘id fiqhiyyah, and the legal maxim al-‘ādah al-muḥakkamah. The results show that the mappacci tradition meets the criteria of ‘urf ṣaḥīḥ because it has been continuously practiced and socially accepted by the Bugis community, contains values of self-purification, respect for parents, prayer, moral preparation, kinship, and social solidarity, and does not fundamentally contradict the Qur’an, Sunnah, tawḥīd, or the objectives of Islamic law (maqāṣid al-sharī‘ah). The mappacci tradition is also more appropriately positioned as a social and cultural practice within marriage rather than ‘ibādah maḥḍah, meaning that its absence from the practices of the Prophet does not automatically constitute bid‘ah. In conclusion, the mappacci tradition is legally permissible and may be maintained as a Bugis cultural tradition within Islamic marriage practices, provided that its implementation remains free from shirk, khurafat, superstition, prohibited elements, and beliefs that contradict the principles of Islamic law.

Abstract

Waqqf land management in Indonesia faces a number of difficulties, including low asset productivity, nazhir (waqqf managers) capacity limitations, lack of transparency, and the absence of sustainability principles in waqf governance. In order to transform religious assets toward sustainable development, this study aims to create a waqf land governance model based on Maqashid al-Shariah and Environmental, Social, and Governance (ESG) principles. This study uses a qualitative approach, utilizing a library research approach and conceptual analysis of national regulations, maqashid al-shariah studies, waqf jurisprudence literature, and modern ESG frameworks. The findings demonstrate that a waqf governance model centred on asset protection (hifz al-mal), social empowerment (hifz al-nafs and hifz al-mujtama'), environmental sustainability, and enhancing institutional accountability can be created by combining maqashid al-shariah and ESG. Using social impact, innovation, and transparency, this model presents Nazhir as a key player in the management of profitable waqf assets. The study comes to the conclusion that waqf can be transformed from a passive philanthropic asset into a tool for sustainable socioeconomic development by reconstructing waqf land governance based on maqashid al-shariah and ESG.
