Abstract

Child marriage is still a problem in many cultures, even those that follow Islamic law. This practice is frequently shaped by social, economic, and cultural considerations, along with various theological interpretations. Islamic law does not explicitly stipulate a minimum age for marriage; rather, it underscores physical and psychological maturity as the principal criteria. This study seeks to evaluate the suitability of underage marriage through a normative analysis of Islamic law and to investigate its implications within domestic life. The methodology employed is normative legal research utilizing conceptual and statutory frameworks, executed through literature reviews of Islamic legal sources and relevant laws. The findings suggest that while textual provisions exist, the idea of public welfare (maslahah) in Islamic law underscores the need of mental, emotional, and economic preparedness. Early marriage can lead to a number of bad things, such unhappy marriages, more divorces, and health problems for both the mother and the kid. Consequently, a more contextual normative reinterpretation is essential to ensure the optimal realization of marriage's objectives specifically, the development of a peaceful, loving, and compassionate family.

Abstract

Recent developments in the discussion of gender equality have presented substantial challenges to the understanding and implementation of the Islamic legal protection of women’s rights. The purpose of this study is to study the notion of women’s rights protection in Islamic law and to reconstruct the legal framework of this notion to preserve its application in the resolution of the issues of gender equality in the present time without prejudice to the basic principles of Sharia. The study uses statutory, conceptual, and Islamic legal methods in the context of normative legal research technique. The main legal sources are the Qur’an, Hadith and relevant laws while the secondary sources are scholarly publications, peer-reviewed journal articles and other academic papers. Qualitative analysis of the evidence was performed by legal interpretation and doctrinal analysis. The findings reveal that the preservation of women’s rights under Islamic law is based on the concepts of fairness (al-’adl), public interest (maslahah), equality of human dignity, and the protection of fundamental rights. Nevertheless, patriarchal sociocultural notions and textualist readings nevertheless hinder its application, therefore preventing substantive justice. Therefore, the reconstruction of Islamic law requires contextual interpretation, the maqāṣid al-sharī'ah and adaptive ijtihad so as to cope with modern social changes. The study indicates that the protection of women’s rights in Islamic law must be reconstructed to promote substantive gender justice and respect for the universal principles of Sharia. Islamic law will so provide flexible, inclusive and equitable legal protection in modern society.

Abstract

This study aims to analyse the evolution of Islamic law in reacting to the growth of the digital society in Indonesia, especially changes in patterns of contact, transaction, communication, and technology-based religious rituals. This study uses a normative juridical approach with a conceptual and statutory approach. The data were gathered via a literature review on the Qur’an, hadith, Islamic legal maxims, fatwas, legislation and related scientific material. The results reveal that Islamic law has an adaptable nature through the process of ijtihad, maqasid al-sharia, maslahah, and fatwa revision. This is evident in the regulation of digital transactions, protection of personal data, platform-based Islamic economics, usage of artificial intelligence, and the transmission of religious information via social media. But these advancements also bring along a number of difficulties such as misinformation, privacy breaches, cybercrime, confusion in electronic contracts and poor levels of digital legal literacy. Islamic law reform must therefore be contextual and collaborative, firmly anchored in the concepts of justice, public benefit, rights protection and moral responsibility. There is a need for a stronger synergy between religious scholars, academics, government institutions, technology industry actors and society in formulating applicable regulations and fatwas that are in harmony with national law and capable of anticipating rapidly evolving and increasingly complex technological developments. The study indicates that the reform of Islamic law is a strategic requirement for the relevance, responsiveness, and ability of sharia rules to provide legal certainty for the digital society of Indonesia.

Abstract

This study aims to examine the incorporation of religious moderation within the Islamic Religious Education (PAI) curriculum, emphasizing Sharia values in the framework of globalization. In a time when people are becoming more diverse and connected, it is important to know how to use religious moderation in schools to promote tolerance and fight extremism. The study utilizes a qualitative methodology, specifically a literature review, to examine pertinent sources, including the perspectives of Islamic scholars, educational practices, and the notion of religious moderation as defined in Sharia. The findings demonstrate that religious moderation in the PAI curriculum functions as a crucial instrument for reconciling religious teachings, fostering tolerance, and advancing inclusion amid global difficulties. It shows how important it is to have a curriculum that supports universal Sharia principles and helps create a generation that is moderate, accepting, and open-minded. The study also shows that while there are problems with putting religious moderation into practice, it is important to include it in the PAI curriculum to stop people from becoming radicalized and to promote peaceful coexistence. The results show how important it is to include religious moderation in education to create a peaceful world.

Abstract

This study takes the maqashid al-sharia as the perspective from which Islamic law addresses environmental issues. The research discusses three topics, namely: the response of Islamic law to environmental damage, the principles of maqashid al-sharia as a basis for environmental protection, and the implementation of Islamic laws in the current environmental life. The legal normative research is carried out by using a conceptual and literature study approach. The facts were obtained from Islamic law references, maqashid thought, environmental fiqh references and pertinent scientific studies. The findings indicate that environmental challenges involve moral, social and spiritual dimensions besides technical considerations. The second maqashid al-sharia is that the conservation of the environment is closely related to the conservation of religion, life, intellect, lineage and wealth. The damage to the environment may threaten the survival of human beings and may obstruct the rule of Allah’s creation. Therefore, the Islam law must be understood in its context so that it can tackle the contemporary environmental problems. In conclusion, maqashid al-sharia provides an excellent normative framework for the creation of Islamic legislation which is environmentally friendly, oriented towards the public good and conducive to human sustainability.

Abstract

Preventing domestic violence is a major problem in the world, including Indonesia, and it needs to be dealt with in a whole way. In this context, the incorporation of Islamic law can serve as an effective technique for the prevention of domestic violence, given the moral and ethical ideals inherent within it. This study seeks to examine the application of Islamic law integration in domestic violence prevention measures in Indonesia. The employed study methodology is qualitative, utilizing a literature review to analyze Islamic legal texts concerning familial rights and responsibilities and their practical application in everyday life. The study's findings demonstrate that Islamic law delineates explicit directives concerning the responsibilities of husbands, wives, and families in promoting equitable and peaceful relationships, while also forbidding any manifestation of violence. Moreover, ideals such as justice, compassion, and respect for personal dignity can underpin the formulation of more efficacious domestic violence prevention programs. This study underscores the significance of socialization and the implementation of Islamic law in preventive measures against domestic violence within society.

Abstract

Aceh Qanun represents a unique form of regional regulation as it integrates Islamic legal principles into the national legal framework. However, its existence raises critical issues regarding its harmonization with higher laws, including constitutional principles and human rights protections. This study aims to analyze the legal position of Aceh Qanun within the Indonesian legal system and examine its relevance from the perspective of Islamic law. This research employs a qualitative method with a normative approach, utilizing legal document analysis and interviews with legal experts. The findings reveal that formally, Aceh Qanun holds a position equivalent to regional regulations, yet substantively it possesses distinct characteristics due to the incorporation of Islamic legal norms. Its implementation faces significant challenges, particularly potential conflicts with national law in areas such as criminal law, human rights, and gender equality. From an Islamic law perspective, Aceh Qanun does not fully represent comprehensive Sharia principles, as it has undergone contextual adaptation to socio-political realities. Therefore, legal harmonization through continuous dialogue between local and central governments, as well as the broader community, is essential to maintain a balance between local values, Islamic principles, and the national legal system. This study contributes to the discourse on legal pluralism in Indonesia and offers recommendations for strengthening regulatory synchronization in a sustainable manner.

Abstract

This research is intended to analyse the practice of tajdidun nikah as a reconciliation strategy and strengthening of marital commitment in Muslim families. This study is aimed to find the significance, function, and role of tajdidun nikah in restoring the relationship of husband and wife that experience domestic tension. The research in this study employs a qualitative method with a literature study methodology. Data were collected from Islamic law literature, Muslim family studies, journal papers and other relevant academic resources. The analysis was undertaken utilising the descriptive-analytical technique by examining the idea of tajdidun nikah from the standpoint of Islamic marital jurisprudence and family social dynamics. The findings indicate that tajdidun nikah is not only seen as a symbolic renewal of the marriage contract but also as a reflective place for couples to enhance their communication, increase their responsibilities, and restore their marital commitment. When done with the right religious knowledge, awareness of each other and the aim of preserving the unity of the family, this activity can be a form of reconciliation. However tajdidun nikah is not a substitute for resolving substantive home difficulties. Therefore, this practice needs to be supported by discourse, family guidance and commitment to behavioural change in order to foster the establishment of a harmonious, stable and sustainable family of Muslims.

Abstract

This research aims to analyse the function of contemporary fatwas in mitigating extremism and radicalism, providing insights into their efficacy within the current social and cultural milieu. The goal of this study is to help come up with innovative ways to deal with these threats. The growth of radicalism and religious fanaticism, especially in Muslim populations, is a menace to the whole world. Misreading religious scriptures and spreading radical ideas frequently lead to bloodshed, which makes things less peaceful. Fatwas, which are religious rulings made by Islamic experts, are very important for dealing with these problems. This qualitative study examines the function of fatwas in mitigating extremism and radicalism. It looks at fatwas given by well-known scholars and institutions in reaction to extremist ideology. It focuses on how these fatwas make it clear what the true understanding of Islam is and discourage radical beliefs. The results show how important fatwas are for spreading moderate, peaceful views of Islam and how important religious leaders are for leading communities towards tolerance and living together. The study indicates that fatwas can effectively inhibit the proliferation of extremism, contingent upon their issuance by reputable, competent scholars who prioritise peace in their interpretations. Tujuan dari penelitian ini adalah untuk menganalisis fungsi fatwa kontemporer dalam meredam ekstremisme dan radikalisasi, memberikan wawasan mengenai efektivitasnya dalam konteks sosial dan budaya saat ini. Penelitian ini bertujuan untuk membantu mencari cara inovatif dalam menangani ancaman-ancaman ini. Pertumbuhan radikalisasi dan fanatisme agama, terutama di kalangan populasi Muslim, menjadi ancaman bagi seluruh dunia. Penafsiran yang keliru terhadap teks-teks agama dan penyebaran ide-ide radikal sering kali berujung pada pertumpahan darah, yang mengurangi kedamaian. Fatwa, yaitu keputusan-keputusan agama yang dikeluarkan oleh ahli agama Islam, sangat penting dalam menangani masalah-masalah ini. Penelitian kualitatif ini mengkaji fungsi fatwa dalam meredam ekstremisme dan radikalisasi. Penelitian ini memeriksa fatwa-fatwa yang dikeluarkan oleh ulama dan lembaga terkemuka sebagai respons terhadap ideologi ekstremis. Fokusnya adalah bagaimana fatwa-fatwa tersebut menjelaskan pemahaman yang benar tentang Islam dan mencegah keyakinan radikal. Hasil penelitian menunjukkan betapa pentingnya fatwa dalam menyebarkan pandangan moderat dan damai tentang Islam serta peran penting pemimpin agama dalam membimbing komunitas menuju toleransi dan kehidupan bersama. Penelitian ini menunjukkan bahwa fatwa dapat secara efektif menghambat penyebaran ekstremisme, tergantung pada penerbitannya oleh ulama yang memiliki reputasi dan kompetensi, yang mengutamakan perdamaian dalam penafsirannya
