Abstract

Social life in Indonesia is experiencing progressive development from various aspects. Crimes or criminal acts committed by individuals or groups are currently growing along with the development of technology. One of the crimes that are often violated in the scope of social media is the criminal act of defamation, where this crime is carried out by destroying the good reputation of others by using the media in the form of a cellphone as the main item used. Based on this description, this study aims to determine the validity and considerations of judges regarding cell phone evidence in cases and to find out the views of Islamic Criminal Law regarding evidence as reinforcement in cases. By using normative research methods, it can be seen that cellphone evidence is very useful in providing judges' considerations in deciding cases, and in Islamic law itself Evidence has been arranged based on what is stated in the sources of Islamic law itself. Things that can be done so that law enforcement can work properly are rejuvenating the existing rule of law in the State of Indonesia, and making expert views in interpreting evidence in Islamic law as one of the references

Abstract

Tujuan penelitian: Penelitian ini bertujuan untuk membuat analisis perpskriptif terhadap tatanilai yang menjadi kultur hukum dengan menggunakan pendekatan transcendental.Metodologi: Penelitian ini merupupakan jenis penelitian hukum normative. Pendekatan yang digunakan adalah pendekatan filosofis, dimana hukum dimanakan sebagai kumpulan nilai, asas-asas dan moral yang memiliki misi suci kebenaran, dan keadilan.Temuan Utama: Agar hukum benar-benar menjadi mutiara, dan tempat persemaian kebenaran yang mengemban misi suci, maka ada beberapa tatanilai yang dibutuhkan dalam membangun kultur hukum (kesadaran hukum), yakni hukum harus menjadi alat integrasi social, sarana yang meningkatkan kualitas idividu, berhukum harus dipandu oleh standar moral, keadilan menjadi mahkota hukum, dan hukum harus mampu mendorong pembebasan. Penerapan penelitian ini: Hasil pemikiran ini dapat menjadi alternative pemikiran tata nilai dalam membangun kultur hukum oleh pengemban hukum dan masyarakat luas.Kebaruan/Originalitas dari penelitian ini: Kebaruan dari pemikiran ini adalah perspektif baru dalam kultur hukum dengan pendekatan transendental, berupa nilai yang yang menjadi kultur hukum yang dielaborasi dari berbagai pemikiran.Kata Kunci: Kultur, Hukum, Transendental, Tatanilai.

Abstract

Financial performance analysis in this study is an assessment process regarding the level of progress in achieving the implementation of work/activities of the Regional Government in the financial sector by using tools in the form of financial ratios which consist of: Analysis of Regional Financial Independence Ratio, Analysis of Regional Financial Dependency Ratio, Analysis of Effectiveness of Original Income Ratio Regions, Regional Financial Efficiency Ratio Analysis, Activity Ratio Analysis, Growth Ratio Analysis and Proportion Analysis The purpose of writing this final project is to determine the financial performance of the Government of Jombang Regency in the 2014-2018 Fiscal Year. The data used are primary and secondary data obtained through interviews, observation and literature study. The data obtained were analyzed using quantitative descriptive analysis methods. After analyzing, it can be concluded that the financial performance of the Jombang Regency Government shows the average regional financial performance which is still unstable. Where the results of calculations every year are still experiencing numbers up and down. This is because the Government of Jombang Regency has not been optimal in managing the wealth of available regional resources. However, on the side of revenue achievement, Jombang Regency has demonstrated its ability to achieve Regional Original Revenue beyond the set targets.

Abstract

In Indonesia, the 1945 Constitution mandates the establishment of health social security. Similarly, Section 15 of Article II of the Philippines’ 1987 Constitution asserts that the state has a duty to protect and promote the right to health for its citizens. Bangladesh’s Constitution, while not explicit, recognizes healthcare as a fundamental human right under Articles 15 (which addresses the provision of basic necessities) and 18 (which pertains to public health). Through a classic socio-dogmatic research method—a type of normative legal research—this study interprets how these constitutional provisions are implemented in practice. While Indonesia’s constitution clearloy requires the state to ensure health security, the government often falls short, lacking sufficient financial supports. In the Philippines, health security initiatives are gradually expanding but also suffer from inadequate funding. In contrast, Bangladesh has not prioritized health security, focusing instead on food security without emphasizing health as a state responsibility. Applying Rodriguez-Blanco’s theory reveals that Indonesia’s approach to social security leans towards an insurance model due to its reluctance to allocate adequate funds. In the Philippines, there is progress, albeit slow and underfund, while Bangladesh’s lack of health security development stems from its prioritization of basic food needs over health provisions.

Abstract

Digital transformation presents significant challenges in safeguarding the personal data of banking customers, particularly when banks collect and manage extensive personal information without ensuring adequate protection. This study examines the implementation of the accountability principle by personal data controllers within the banking sector. The objective is to assess how far this principle has been integrated into the obligations stipulated by data protection regulations. Using a qualitative legal research method combined with a comparative approach, this study analyzes the Personal Data Protection Law (PDPL) in Indonesia and the General Data Protection Regulation (GDPR) in Sweden. The findings reveal that Indonesia’s PDPL still demonstrates several deficiencies, including limited data leakage notifications, lack of transparency in third-party data disclosure, insufficient information technology security responses, and inefficient data updates. Similarly, under the GDPR framework, challenges persist in managing data shared with third parties and in providing timely written notices in cases of data breaches. The study concludes that the weaknesses identified in both jurisdictions highlight the need for strengthening the accountability principle to enhance the effectiveness of personal data protection in the banking sector. Reinforcing this principle will ensure greater responsibility among data controllers and foster public trust in digital financial systems.

Abstract

In health research, many categorical variables are found that must be analyzed using descriptive statistical methods, then interpreted. Currently, there are still many health researchers who interpret categorical variable data in the health sector in the same way as social research in general, namely focusing on the categories with the largest proportions. In fact, for health research, researchers should focus on the expression of unexpected categories. Therefore, this should be a concern for the health research community, especially in the campus environment as the first place for students and health researchers to study and apply various types of health research. This is an urgency, so that the quality of health research can be immediately improved, especially in terms of data interpretation. It was concluded that there were many errors in interpreting categorical variable data in the health sector, so this had to be anticipated from the time of education on campus. Abstract

There was a proposal that the minimum age of Indonesia’s Presidential and Vice-Presidential candidates should be 35 years as opposed to the original 40 years. Decision of the Constitutional Court No. 90/PUU-XXI/2023 on the Minimum Age of Presidential and Vice-Presidential Candidates rejected this proposal and declared that the minimum age is 40 years old with an additional sentence of "having had experience as a head of a region". This paper aims to analyze how Constitutional Court judges reconstruct the characteristics of the Constitutional Court decision in interpreting case No. 90/PUU-XXI/2023 and the considerations of Constitutional Court judges in applying legal regulation principles in deciding upon case No. 90/PUU-XXI/2023. Results found that The Decision of the Constitutional Court No. 90/PUU-XXI/2023 is unconstitutional as it violates the mandate of the 1945 Constitution and Article 169 letter (q) of Law No. 7 of 2017 on the General Election.

Abstract

The Sumba people has a culture called ‘capturing the bride’ (kawin tangkap), where a man captures the woman he will marry. But its practice has deviated and it became full of intimidation. This paper aims to analyze the ‘capturing the bride’ practice of Sumba people from the victimological perspective. This was descriptive qualitative research. Results show that the current form of ‘capturing the bride’ is a form of violence against women. The violence experienced by ‘capturing the bride’ victims is motivated by a created opportunity and a man’s idealized need to marry a woman. From the victimological perspective, based on Mendelshon’s theory on the degree of victims’ fault, the above victims are completely innocent victims. Based on Schafer’s concept on victim responsibility, they are categorized as biologically and socially weak victims. Then, if related to Fattah’s theory on victim involvement, they are categorized as non-participating victims.

Abstract

This research, which aims to describe the legal protection of children as consumers of dangdut koplo songs, is based on legal research using a doctrinal approach. The main data in this study is in the form of secondary data obtained through a literature study of the dangdut koplo song which is broadcast via the YouTube platform. Based on the discussions that have been carried out, it is known that the dangdut koplo song still does not provide legal protection for children as song consumers, because it is contrary to Law Number 23 of 2002 concerning Child Protection. Abstract

Introduction: E-commerce is a modern business activity that has two properties: not meeting the parties directly (nonfice) and without the need for a genuine signature by the non-signing parties. Methodology: Type of research using normative juridical research. This study used two approaches: a state approach and a conceptual approach. The primary and secondary data are sourced by qualitative methods of data analysis and the presentation of descriptive data analysis. Results and Discussions: Act No. 19 of 2016 on ITE explains that E-commerce transactions are included in responsible transactions. The legal form of protection is listed in Article 28 (1). The settlement of E-commerce transactions in dispute is carried out using peaceful means. If the line is ineffective, the consumer may sue the owner in accordance with the contents of Article 45 of the Constitution. Conclusion: Consumer law protection has two concepts: preventive and repressive legal protection. Efforts can be completed through litigation or processing of adaptation, negotiation, mediation, conciliation and arbitration)
