Abstract

Existing studies on watershed and forest conservation in the upstream Bengawan Solo region have largely focused on ecological degradation, technical conservation strategies, or regulatory shortcomings. However, there remains a significant gap in understanding how an ecoregion based approach can be systematically integrated with local wisdom to produce a comprehensive and context specific conservation policy. The study investigates the role of local wisdom in upstream forest management, the existence of gaps in legal protection for watershed conservation, and the impact of integrating local wisdom with legal frameworks on policy effectiveness. An empirical method with a qualitative approach was employed, drawing on primary data obtained through field observations in four regencies, namely Wonogiri, Sukoharjo, Surakarta, and Karanganyar. The results of this study reveal three principal findings. First, sustainable conservation in the upstream Bengawan Solo watershed requires a synergistic model that integrates ecological considerations with community based knowledge systems. Second, fragmented regional regulations and weak legal coordination continue to obstruct effective watershed governance, resulting in inconsistent conservation practices across administrative boundaries. Third, the study highlights the need for comprehensive policy reform through the establishment of interregional cooperation mechanisms supported by a Memorandum of Understanding, which can strengthen institutional governance, harmonize conservation strategies, and enhance long term ecological resilience within the watershed area.

Abstract

Undang-Undang Nomor 6 Tahun 2023 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 tentang Cipta Kerja telah membuka ruang bagi pelaku Usaha Mikro Kecil (UMK) untuk bisa mendaftarkan badan usahanya menjadi perseroan terbatas. Meskipun sudah ada aturan hukum yang mengaturnya, namun saat ini masih banyak pelaku usaha UMK di Kota Ternate di Kelurahan Makassar Timur yang belum mendaftarkan badan usahanya karena belum mengetahui aspek hukum tentang pendirian perseroan perorangan. Solusi yang ditawarkan melalui kegiatan Pengabdian Kepada Masyarakat ini adalah dengan melakukan penyampaian materi kepada Pelaku Usaha UMK mengenai aspek hukum tentang pendirian perseroan perorangan. Metode pendekatan yang digunakan adalah dengan metode ceramah dan tanya jawab. Adapun target luaran kegiatan Pengabdian Kepada Masyarakat ini adalah terlaksananya kegiatan penyuluhan hukum kepada kepada Pelaku Usaha UMK di Kelurahan Makassar Timur Kota Ternate, dan hasil dari kegiatan ini dapat terpublikasi melalui jurnal pengabdian masyarakat.

Abstract

Indonesia and Malaysia have different judicial systems, given that they differ in applying the legal system. However, Indonesia and Malaysia have implemented digitalization in the judicial process from the earliest to the final stages. The use of technology is an effort to reform and digitize to achieve modern justice that is fast and efficient while still upholding legal norms. The objectives of this research are: (1) To find out what forms of technology utilization are in the judicial system in Indonesia and Malaysia and (2) To find out how the law views and regulates this based on applicable Legislation. The writing that was written using the normative juridical method based on a literature study found that the use of technology is desired by the law as evidenced by Legislation governing digitization. The two countries' regulations still require much improvement and evaluation, both substantively and in implementation, to achieve the main objectives.

Abstract

This research aims to describe the natural resources management policies in the mineral and coal sectors. The description is based on the social welfare value contained in Law No. 3 of 2020 concerning Amendment of Law No. 4 of 2009 concerning Mineral and Coal Mining, as well as Law No. 11 of 2020 concerning Employment and Labour Law. This research employed a normative judicial method based on law regulations that are conceptualized as principles or norms and have evolved into proper human behavior standards. Secondary data were employed by exploring literature correlated with the mineral and coal mining management law and analyzed using juridical-qualitative techniques. Subsequently, the research indicated that the Indonesian government policy in the Mineral and Coal, alongside Omnibus Laws, are unable to accommodate social welfare values and support only profit-oriented businesspersons. This research is expected to proffer suggestions for the central or regional government to make regulations prior to the social welfare principle.

Abstract

This study aims to construct the form of customary law empowerment as a means of overcoming family conflict. The research design used is empirical legal research with a qualitative-naturalistic approach. The research was conducted in Palu City, especially in Birobuli Utara Village. The data for this study came from field observations and interviews with traditional leaders. The results of the study indicate that customary law empowerment as a means of overcoming family conflict is constructed in the form of implementing alternative dispute resolution, a method of resolving disputes outside the court with mediation and negotiation techniques. Customary law empowerment as a means of overcoming family conflict should continue to be strengthened from various aspects so that it can be more optimal in carrying out its function as an alternative dispute resolution institution, considering that this institution has been proven to be able to resolve family disputes simply, quickly, and at low cost (speedy administration of justice), while maintaining community harmony. Otherwise, this very valuable social capital will only become wisdom that is increasingly being marginalized.

Abstract

Arabic is one of the primary source languages for various international legal documents, bilateral treaties, and the legal systems of countries with Sharia-based or mixed legal frameworks. This article explores the relevance of Arabic language proficiency as a component of foreign legal literacy within legal education in Indonesia. Using a qualitative approach through literature review and curriculum analysis, the study finds that mastery of Arabic significantly enhances the comprehension of foreign legal texts, including international agreements, commercial laws, and transnational civil law. Nonetheless, several challenges persist, such as the lack of standardized teaching materials, inconsistencies in legal terminology, and the limited number of qualified instructors capable of integrating language and legal studies effectively. This study recommends the incorporation of legal Arabic into law school curricula, particularly in areas focusing on international law, comparative law, and legal translation

Abstract

This study aims to analyze the legal basis and responsibilities of notaries regarding the use of fingerprints as proof of identity in notarial practice. Furthermore, this study also seeks to assess the accuracy of fingerprints as authentic evidence that can guarantee the authenticity of legal documents and legal protection for the parties. The research method used is normative (doctrinal) legal research with a statutory approach and library research. Data were obtained through literature studies, analysis of laws and regulations, and interviews with notaries to strengthen the empirical findings. The research results show that fingerprints have a high accuracy rate (97–99%) in the identity verification process, making them legitimate for use as scientific evidence in notarial practice. Legally, the legal basis is derived from Law Number 2 of 2014 concerning the Position of Notary Public, the Civil Code, and Law Number 27 of 2022 concerning the Protection of Personal Data. Notaries are responsible for the use and storage of fingerprint data from the applicant. The application of the principle of prudence and personal data protection is essential to ensure that the identity authentication process does not result in legal violations. The conclusion of this study is that the mandatory use of fingerprints in notarial practice strengthens the authenticity of deeds, provides legal protection for the parties, and is an important step towards the digitalization of notaries that is safe and accountable

Abstract

The urgency of this research necessitates prosecutors to implement restorative justice to minor crimes through the principle of dominus litis. It must be subject to clear limitations and parameters in the ius constituendum. The restorative justice approach aims to restore the condition of the victim, the perpetrator, and the community. The objective of this research is to achieve prosecutorial discretion through restorative justice. The research method used is empirical law. The data types used are primary data (primary, secondary, and tertiary legal materials) and secondary data (literature studies and interviews). The North Maluku High Prosecutor's Office prioritizes restorative efforts in cases of assault. This mechanism involves the victim's family and the perpetrator's family. The number of cases in the jurisdiction of the High Prosecutor's Office in 2024 was 47 cases and 14 of them were resolved using restorative justice. This is in line with the provisions of Article 34A of Law Number 11 of 2021 concerning the Prosecutor's Office, which states that the principle of discretion regulated in Article 139 of Law Number 8 of 1981 concerning Criminal Procedure Law is carried out without ignoring the principle of law enforcement objectives which include achieving legal certainty, a sense of justice, and its benefits in accordance with the principles of restorative justice.

Abstract

Indonesia’s Marine Fisheries Resources Supervisory Agency is a government institution under the Ministry of Maritime Affairs and Fisheries which is committed to continuing to combat illegal fishing and destructive fishing, considering that illegal fishing activities that often occur are fish theft by foreign fishing vessels originating from several neighboring countries. The aim of this research is to analyze the role of fishery supervisors in supervising illegal fishing and destructive fishing practices in North Maluku Province. This was empirical legal research which utilizes both literature review and fieldwork, including interviews. The research results demonstrate the urgency of criminal law's function as an ultimum remedium. To support the realization of sustainable development in the fisheries sector, it is necessary to regulate alternative sanctions for perpetrators of illegal and destructive fishing that are anticipatory in nature. These alternative sanctions can take the form of sanctions aimed at social and economic improvements and repair of damage to fish resources and their ecosystems caused by illegal and destructive fishing practices. Fishery supervisors have the role in supervising illegal and destructive fishing practices in North Maluku Province. The Fishery Supervisory law enforcement system and partners have the role in stopping illegal fishing practices and destructive fishing in North Maluku Province.

Abstract

Pesatnya perkembangan informasi dan teknologi mengakibatkan informasi dapat diakses dengan mudah dan cepat. Pada akhirnya banyak konten negatif yang diserap oleh pelajar, diantaranya yang bermuatan kekerasan, perilaku menyimpang, perjudian atau konten yang mendorong pelajar berperilaku negatif. Selain itu, pelajar juga rentan mengalami kejahatan siber seperti kekerasan seksual online, sexting, sextortion, prostitusi online dan lain. Berdasarkan Data Badan Pusat Statistik, pada tahun 2022 terdapat sekitar 66,48 persen penduduk Indonesia yang mengakses internet dan naik menjadi 79,5 % pada tahun 2024. Berdasarkan kelompok umur, terdapat 14,24 persen pengguna internet di Indonesia adalah Pelajar dengan usia 13-18 tahun. Dengan demikian, para pelajar khususnya pelajar SMP adalah kalangan yang cukup rentan mengalami dampak negatif dan kejahatan cyber. Solusi yang ditawarkan melalui kegiatan Pengabdian Kepada Masyarakat ini adalah dengan melakukan sosialisasi hukum kepada Pelajar SMP agar memiliki pemahaman dan kesadaran menggunakan teknologi informasi sehingga mengindarkan Pelajar SMP dari dampak negatif atau kejahatan cyber. Adapun target luaran kegiatan Pengabdian Kepada Masyarakat ini adalah terlaksananya kegiatan penyuluhan hukum kepada para Pelajar SMP Al- Irsyad Kota Ternate, dan hasil dari kegiatan ini dapat terpublikasi melalui jurnal pengabdian masyarakat.
