Abstract

There was a proposal that the minimum age of Indonesia’s Presidential and Vice-Presidential candidates should be 35 years as opposed to the original 40 years. Decision of the Constitutional Court No. 90/PUU-XXI/2023 on the Minimum Age of Presidential and Vice-Presidential Candidates rejected this proposal and declared that the minimum age is 40 years old with an additional sentence of "having had experience as a head of a region". This paper aims to analyze how Constitutional Court judges reconstruct the characteristics of the Constitutional Court decision in interpreting case No. 90/PUU-XXI/2023 and the considerations of Constitutional Court judges in applying legal regulation principles in deciding upon case No. 90/PUU-XXI/2023. Results found that The Decision of the Constitutional Court No. 90/PUU-XXI/2023 is unconstitutional as it violates the mandate of the 1945 Constitution and Article 169 letter (q) of Law No. 7 of 2017 on the General Election.

Abstract

Kondisi hukum dan aparat hukum di semua tingkatan termasuk hakim, dipenjara dalam positivisme yang fatal. Pemahaman ini mereduksi hukum hanya sebagai hukum dan peraturan deterministik, mekanistik dan esoteris belaka. Hukum soliter adalah hukum soliter tanpa memasukkan transendensi, moralitas, atau kebiasaan. Hasil akhir dari paradigma ini hanya mampu menghadirkan kepastian hukum tetapi kurang keadilan. Akar semua krisis dan runtuhnya kepercayaan publik pada hukum berasal dari hukum yang hanya mendidik corong undang-undang. Hukum yang mengajarkan legislasi sebagai ideologi sakral, hukum itu hanya hukum atau regulasi. Lulusan hukum baru yang mengisi posisi ahli hukum memiliki keterampilan tetapi mereka kurang empati, mengabaikan keadilan publik dan korup. Diperlukan paradigma pilihan hukum baru, yaitu realisme hukum teistik yang memberikan kebebasan kepada para hakim dan aparat hukum lainnya dari belenggu keadilan prosedural dalam gaya positivisme. Melalui hukum dengan paradigma Realisme Hukum Teistik, diharapkan aparatur hukum akan memiliki kebajikan, untuk dapat membaca substansi keadilan dengan keimanannya kepada Allah daripada sekadar menjadi corong hukum dan mampu menjaga dari perilaku tercela atas dasar imannya.The condition that law and legal apparatus in all levels including judges, are imprisoned in fatal positivism. This understanding reduces the law only as mere deterministic, mechanistic and esoteric laws and regulations. Solitary law is solitary law without include the transcendence, morality, or custom. The final result of this paradigm is only able to present legal certainty but lack of justice. The roots of all crises and the collapse of public trust in the law are originated from a law that educates only the mouthpiece of the legislation. The law that teaches the legislation as a sacred ideology, the law is just law or regulation. Fresh graduate of law who fill positions of legal apparatus experts have skills but they are lack of empathy, neglect of public justice and corrupt. A new legal choice paradigm is needed, namely theistic legal realism which gives judges and other legal apparatuses the freedom from the shackles of procedural justice in the style of positivism. Through the law with the Theistic Legal Realism paradigm, it is expected that the legal apparatus will have virtue, to be able to read the substance of justice with his faith in Allah rather than merely being a mouthpiece of the law and be able to guard against despicable behavior on the basis of his faith.

Abstract

This study examines the integration of positive law and Islamic law within contemporary sustainable development–based forest management conservation policies through a comparative analysis of Indonesia and Malaysia. The research aims to analyze the normative and regulatory frameworks governing forest conservation in both countries and explore the extent to which Islamic legal principles are incorporated into state-based environmental governance. Employing a qualitative doctrinal and comparative legal approach, this study analyzes statutory regulations, policy documents, judicial decisions, and relevant Islamic legal sources, complemented by secondary scholarly literature. The analytical framework combines sustainable development theory with maqāṣid al-sharīʿah to assess how environmental protection aligns with both constitutional mandates and Islamic normative objectives. The findings reveal that Indonesia and Malaysia demonstrate different models of legal integration. Indonesia tends to institutionalize environmental protection through constitutional and statutory mechanisms, while incorporating Islamic values in a more implicit, socio-cultural manner. In contrast, Malaysia exhibits a more formal recognition of Islamic legal principles within state-level religious and environmental governance structures. Despite these differences, both countries reflect a converging commitment to ecological sustainability grounded in legal pluralism. However, challenges remain in harmonizing regulatory enforcement, addressing the drivers of deforestation, and ensuring community-based participation. This study contributes to the development of contemporary Islamic environmental jurisprudence by offering a comparative legal model of integrative governance between positive and Islamic law in forest conservation policy. It advances scholarly discourse on legal pluralism, sustainable development, and the operationalization of maqāṣid al-sharīʿah within modern environmental regulatory frameworks in Muslim-majority countries.

Abstract

This study aims to reconstruct contemporary legal methodology by proposing the Noetic Triadic Spiral Model as a trans-epistemological framework that integrates revelation (waḥy), reason (ʿaql), and empirical reality (wāqiʿ) in a dynamic and iterative structure. The research responds to the growing epistemic fragmentation between normative-textual approaches and socio-empirical legal reasoning in contemporary Islamic legal thought. It seeks to formulate a methodological model that bridges classical uṣūl al-fiqh with contemporary interdisciplinary demands without undermining its theological foundations. This research employs a qualitative normative-philosophical approach combined with conceptual analysis and critical hermeneutics. Primary sources include classical works of uṣūl al-fiqh and modern reformist legal theories, which are analyzed through a comparative-constructive method. The study also incorporates epistemological mapping to identify structural tensions between scriptural authority, rational deliberation, and socio-historical contingencies. Through this approach, the Noetic Triadic Spiral Model is formulated as a spiral (rather than linear) interaction among three epistemic domains, emphasizing continuous reinterpretation, reflexivity, and contextual validation. The findings demonstrate that the proposed model offers a coherent methodological reconstruction that transcends the dichotomy between textualism and contextualism. By conceptualizing legal reasoning as a spiral process of noetic engagement—where revelation provides normative orientation, reason ensures coherence and systematicity, and empirical reality functions as a field of verification—the model strengthens methodological adaptability while preserving doctrinal integrity. The spiral nature ensures that interpretation remains open to revision without collapsing into relativism. The scientific contribution of this study lies in its formulation of a trans-epistemological paradigm that rearticulates legal methodology beyond classical dualisms. It provides a theoretical bridge between traditional jurisprudential structures and contemporary legal challenges, contributing to ongoing debates on reform, renewal (tajdīd), and methodological integration in legal theory. The Noetic Triadic Spiral Model thus offers an innovative framework for rethinking legal reasoning in a plural, complex, and rapidly evolving global context.

Abstract

Business competition is an important element in the modern market economic system in Indonesia, functioning to achieve efficiency and innovation, as well as increase social welfare. However, the competition dynamics do not always operate in an ideal manner. Various market distortions, such as monopolies, cartels, tender control, and the abuse of dominant positions, still often happen, hindering the creation of an efficient market. The problem formulations of this paper are: (1) What are the basic characteristics of the business competition legal procedures? (2) How are they implemented? This research strives to answer basic questions on the characteristics and implementation of business competition legal procedures as applied by the Business Competition Supervisory Commission. This research utilized the normative-juridical research method with a focus on the study of positive legal norms, especially those which are applied by the Business Competition Supervisory Commission. The procedural law carried out by this commission has its own unique characteristics, which are sui generis, meaning that they do not fully follow the patterns of criminal and civil legal procedures. The Business Competition Supervisory Commission combines the legal and economic approaches to assess an action as a violation of business competition principles. Thus, the evidencing process not only focuses on the formal law aspect but also considers market dynamics, industrial structure, and economic impacts towards business actors and consumers. The application of the procedural law by the Business Competition Supervisory Commission shows a systematic process, starting from the investigation, initial examination, and up to the further examination processes. This process is rather effective in disclosing violation patterns, such as cartels, tender control, and the abuse of dominant positions. The Business Competition Supervisory Commission’s decisions in various cases shows this commission’s capability to comprehensively assess anti-competition behavior through profound economic analysis.

Abstract

The placement program of Indonesian migrant workers overseas is the Indonesian government’s program for the society’s welfare. One of the referential laws used in the working relations between the Indonesian migrant workers and the Arabic employers is the employment agreement. The Saudi Arabian employment agreement implements the sharia law which is influenced by the Hambali school of taught. The King’s decree No. M/51 year 2005 regulates the labor laws in Saudi Arabia, and this country’s government only accepts employment agreements written in Arabic. The solution is that the employment agreements written in two languages are prepared, with Arabic as the authoritative language. Apart from implementing the Kafala System, as a substitute of tax, Saudi Arabia also implements the Nitaqat Policy. The employment agreements in Saudi Arabia have a high risk of being misused by the agencies, as the position of the Indonesian migrant workers is under the responsibility and under the power of the agencies, who have the right to terminate or to send the workers back home if there are some problems. The employment agreements are made because of the employer’s complaints on how the migrant workers often run away, which undoubtedly causes them a high loss. The aim of the contract is so that both parties may achieve a win-win solution, and that they are both given protection. Yet, the contract also limits the participation of the host country’s delegates, as all affairs are given to the Saudi Arabian Immigration Office. The employment agreement must be owned by both parties. Yet, based on some researches established by the Embassy of the Republic of Indonesia’s safe house, it is known that almost none of the migrant workers keep an employment agreement. Another problem is that there are multiple contracts: one before departing for Saudi Arabia, and a different one after having arrived in the country. Another written agreement that is signed by the employer and the agency in Saudi Arabia doesn’t involve the domestic worker. The three contracts which are signed in Indonesia, in front of the Immigration Office, and the one-sided contract between the employer and the agency regulates the same thing, though there is a chance that in all three contracts, the wages written are different.
