Abstract

Perkembangan industri e-commerce di Indonesia yang pesat telah memunculkan potensi praktik monopoli dan persaingan usaha tidak sehat, khususnya pada platform digital berskala besar seperti Shopee. Meskipun Indonesia telah memiliki kerangka hukum berupa Undang-Undang Nomor 5 Tahun 1999 tentang Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat serta Komisi Pengawas Persaingan Usaha (KPPU) sebagai lembaga pengawas independen, efektivitas penegakan hukumnya di era digital masih menghadapi berbagai hambatan yang perlu dikaji secara mendalam. penelitian ini merumuskan dua permasalahan utama, yaitu bagaimana peran hukum dalam praktik persaingan usaha e-commerce dan bagaimana tantangan hukum yang dihadapi dalam penegakan persaingan usaha di sektor digital. Tujuan penelitian ini adalah untuk menganalisis peran hukum persaingan usaha dalam mengatur industri e-commerce di Indonesia sekaligus mengidentifikasi hambatan yang dihadapi KPPU dalam menegakkan hukum terhadap dugaan praktik monopoli pada platform digital. Penelitian ini menggunakan metode hukum normatif dengan pendekatan kuantitatif berbasis data sekunder yang bersumber dari peraturan perundang-undangan, jurnal ilmiah, artikel, dan hasil penelitian terdahulu yang relevan. Hasil penelitian menunjukkan bahwa kerangka regulasi yang ada belum sepenuhnya mengakomodasi karakteristik khusus pasar digital, seperti sifat multisisi platform, efek jaringan, penguasaan data, dan praktik penetapan harga berbasis algoritma. Hambatan penegakan hukum meliputi keterbatasan yurisdiksi terhadap pelaku usaha asing, kesulitan pembuktian dalam lingkungan digital, keterbatasan kapasitas teknis dan sumber daya KPPU, serta lemahnya koordinasi antarlembaga. Penelitian ini menyimpulkan bahwa diperlukan pembaruan UU No. 5 Tahun 1999, penguatan kapasitas kelembagaan KPPU, peningkatan koordinasi lintas lembaga, serta penguatan kerja sama internasional guna mewujudkan ekosistem e-commerce yang sehat, adil, dan berdaya saing di Indonesia

Abstract

Introduction: This article examines the recurring gap between the normative principle of justice in land acquisition regulations for public interest development and the reality of its implementation in Indonesia. This study highlights recurring conflicts, weak community participation, and socio-cultural tensions that arise in state-driven development projects. Purposes of the Research: This study aims to analyze issues of justice in land acquisition for public purposes and reconstruct a more balanced model of justice using Werner Menski's legal pluralism, which integrates state law, social norms, and moral-ethical values. Methods of the Research: This study employs normative legal research, adopting a legislative, conceptual, and philosophical approach. Analysis was conducted on the regulatory framework, land acquisition principles, and the application of Menski's triangular legal pluralism model to assess the gap between norms and field practices. Results of the Research: Findings reveal that the dominance of state-centered legal positivism in land acquisition often neglects socio-cultural values and moral dimensions of justice, resulting in social conflict, marginalization, and inequality. As its principal novelty, this study reconstructs the concept of justice in land acquisition through a pluralistic, participatory, and contextual model. This model integrates state law, living law, and ethical considerations, promotes meaningful community participation in decision-making processes, and adapts legal implementation to local socio-cultural realities. In doing so, it seeks to balance legal certainty, social legitimacy, and substantive justice in the governance of land acquisition.

Abstract

The National Social Security System (SJSN) in Indonesia represents the implementation of the state's responsibility in realizing welfare as mandated by the 1945 Constitution of the Republic of Indonesia. However, the use of the term "insurance" in the social security system raises problems because the term is identical to private coverage mechanisms that are contractual, transactional, and based on premium payments. This condition has shifted the understanding of social security, which should be positioned as a constitutional right of citizens, into a financial obligation dependent on the ability to pay contributions. This study aims to analyze the theoretical deconstruction of the insurance terminology within the National Social Security System from the perspective of the decommodification principle in the welfare state, as well as to examine the legal implications of the transition from state responsibility to mandatory levies on citizens' constitutional rights. The findings indicate that the implementation of social security in Indonesia still reflects the logic of commodification, as access to health services and social protection depends on membership status, fulfillment of contribution payments, and the financial capacity of the community. Consequently, the right to social security, which is constitutionally universal, has become a conditional right. Therefore, a reconstruction of social security policies and regulations is necessary, positioning the state as the primary guarantor of public welfare through a more equitable, universal social protection system that aligns with the principles of the welfare state.

Abstract

The State Confiscated Goods Storage House (RUPBASAN) holds a strategic position in the criminal justice system as the institution responsible for managing confiscated and seized assets used as evidence in criminal proceedings. Effective asset management is essential to ensure legal certainty, accountability, and the integrity of judicial processes. This study aims to examine the optimization of confiscated and seized asset management at the Class II RUPBASAN in Ternate and to analyze the factors affecting the non-execution of such assets. This research adopts an empirical legal approach, utilizing both primary and secondary data. Primary data were obtained through field interviews, while secondary data consisted of primary, secondary, and tertiary legal materials collected through a literature review. The findings reveal that asset management at the Ternate Class II RUPBASAN—covering receipt, registration, classification, placement, security, maintenance, transfer, disposal, and release—generally complies with applicable regulations. However, shortcomings persist at the receipt stage, particularly in the processes of assessment and examination, due to the absence of qualified personnel. Optimization is therefore required, especially in the stages of receipt, maintenance, and transfer. The study identifies legal factors and law enforcement capacity as the main obstacles to the effective execution of confiscated and seized assets.

Abstract

The German Constitutional Court was the first to implement constitutional complaints. It can serve as comparative models for granting the Indonesian Constitutional Court the authority to adjudicate constitutional complaints in the context of strengthening the fulfillment of economic, social, and cultural rights. The problem can be formulated as follows: How is the description of disputes over regional election results through election courts? And how effective is the resolution of disputes over regional election results through election courts? This research is a sociological juridical study, so the approaches used to solve the problems in this research are doctrinal and non-doctrinal approaches. Several key issues related to regional elections include the lack of good quality of regional election regulations; Regional General Elections Commission, the Elections Supervisory Committee, including the police, the prosecutor's office, and the courts; regional election disputes, including administrative disputes, election crimes, and election result disputes. To ensure effective and high-quality election dispute resolution, three stages of the regional election process must be regulated and implemented comprehensively and thoroughly. Criminal disputes must be resolved expeditiously by the relevant legal authorities before the vote count begins or at the latest before the election winner is declared.

Abstract

Health sector fraud is a significant global challenge that undermines health systems by exploiting financial gains through methods like upcoding and false insurance claims. Despite legal updates, healthcare fraud remains a persistent issue. This study systematically examines fraud detection techniques and the legal framework, providing insights to guide policymakers in developing effective prevention strategies in Indonesia. This research employs a doctrinal research methodology with a literature review approach. Using secondary data from Scopus, PubMed, ScienceDirect, and Google Scholar, this study investigates the patterns, causes, and effects of fraud in the Indonesian healthcare system. This paper reviews nine selected articles and compares them with updated Indonesian legal instruments, mainly Law No. 17 of 2023 on Healthcare and Law No. 1 of 2023 on Criminal Code. The findings demonstrate that although legislative reforms have introduced stricter provisions, their implementation remains inconsistent due to lack of oversight and technology. This study proposes integrative strategies, such as digital audit systems, strengthening legislation, and public reporting mechanisms, to improve fraud prevention. It contributes to the debate by identifying gaps in enforcement and proposing regulatory and technological solutions to strengthen the transparency and integrity of the Indonesian healthcare system.
