Abstract

Ensuring public health is the duty of all human beings in the country. Providing legal certainty and protection is the government's duty, including providing safe and comfortable health services. The case of syrup drugs that cause kidney failure in children presents the latest challenge for the government regarding its failure to supervise operating permits and distribution permits for drugs in Indonesia. This turned out to result in several children dying after several times consuming syrup drugs containing ingredients that can trigger kidney failure. The state should be able to protect the public through the Consumer Protection Law, and the victims are children, so the Child Protection Law is then targeted. Even though as we know, that this country has a state institution that focuses on taking care of this, namely the Food and Drug Supervisory Agency (BPOM). So through this study, researchers will convey the analysis of accountability from BPOM and the role of UUPK in this problem. This research uses Juridical‐Normative research methods by testing the Law.

Abstract

This research focuses on legal protection for debtors who bind themselves to an agreement and in the end there is a misuse of rental goods by the debtor. The basis of this research refers to the decision of the Surakarta District Court, and in this problematic the Surakarta District Court is authorized and decides the case. This research uses a normative juridical approach method and uses secondary data. The results of this study indicate that the legal protection given to creditors for acts of default by the debtor has been pursued by the rules of law if the debtor does not fulfill or does not do what has been promised, he has committed an act of default and returned the object of dispute to be returned to the creditor. The judge's consideration is by the applicable laws relating to the default committed by the defendant.

Abstract

This paper discusses the implementation of digital transformation to land certificate issuance in Sragen Regency, focusing on efficiency, transparency, and cultural inclusion. The transition from physical to digital certificates has become a global trend, driven by advances in information technology. The research methodology involved a comprehensive literature review, analysis of existing regulations, and interviews with stakeholders to understand the current landscape and challenges around land certificate digitization in Sragen Regency. In contrast to previous research, this study specifically examines the implications of digital transformation on land certificate issuance in Sragen Regency, taking into account the unique cultural context and challenges faced by the local community. By focusing on efficiency, transparency, and cultural inclusion, this paper contributes new insights to the ongoing discourse of digitization in the field of land administration. The findings highlight the significant impact of digital transformation on administrative efficiency, information transparency, and access to land ownership data in Sragen Regency. While there is widespread support for the modernization of the land administration system, challenges related to the regulatory framework, cultural perceptions, and digital literacy need to be addressed to ensure the successful implementation of digital land certificates. The digital transformation of land certificates in Sragen Regency provides many benefits in terms of efficiency and transparency. However, to fully realize these benefits, it is important to address regulatory challenges, encourage digital literacy, and integrate local cultural values into the implementation process.

Abstract

This research highlights the importance of building integrity in human resource management through the application of the ethics of the civil service profession in the digital era. It includes a summary of the background of the problem, research objectives, and relevance of the topic in the current context. This research uses a qualitative approach with data collection techniques through in depth interviews and participatory observation. The data analysis method involves a process of coding and theming to identify patterns and trends emerging from t he data. This article makes a novel contribution by highlighting how integrity in human resource management can be strengthened through the implementation of professional civil service ethics in the digital age. It distinguishes itself from previous research by exploring the impact of recent digital technologies on Human Resource management practices and professional ethics. This research reveals findings that illustrate the important role of professional personnel ethics in building organizational integrity. Discussions include the implications of the findings for effective Human Resource management practices in the digital era and efforts to address challenges related to integrity. The integration of professional ethics in human resource management emerged as a key strategy to strengthen organizational integrity in the digital era. The conclusions of this study provide an overview of the practical implications and directions for further research in this domain.

Abstract

Defamation is one of the many legal issues arising from the realm of cyberspace. There are various reasons behind the emergence of defamation issues. Often, defamation receives different interpretations under the prevailing law. This research is a normative juridical study examining the application of legal norms to a specific event. Legislative approach and literature study approach are combined through the utilization of available data. Secondary data sources consisting of primary, secondary, and tertiary legal materials are well-managed through descriptive analysis methods to address the issues under review. The objectives of this research include: 1) Understanding the legal basis related to defamation offenses; and 2) Understanding the judges' considerations in criminal decisions related to defamation, with a case study of the decision of the Surabaya High Court Number 528/PID/2013/PT.Sby. The research findings indicate that the Panel of Judges, in deciding criminal cases committed by five Defendants, must first consider the legal provisions stipulated in Article 311 of the Criminal Code. At least there are 3 (three) elements comprising the article. When the elements include, Any Person / Every Person, intentional element, and attacking the honor / good name element. The Panel of Judges felt that the actions of the Defendants had fully met the elements of this article, thus the judge's decision of 6 (six) months imprisonment was in accordance with the applicable law. In addition to considering the criminal articles, the Panel also considers other aspects such as the appeal memory, timeliness, and law enforcement. All considerations are then examined and result in a decision as it should be. The application of the law in line with norms is an obligation that must be fulfilled by the Panel of Judges in order to create social justice that benefits the community.

Abstract

Renting a meeting hall is part of an agreement. The definition of an agreement is an action where someone promises to another person or where two people promise each other to carry out something. This article aims to describe legal responsibilities in resolving defaults on the lease of meeting halls. The research method used in this article is normative juridical, a way of analyzing library materials, namely primary and secondary legal materials. The results of the analysis show that legal efforts that can be taken by one of the injured parties can be resolved through non-litigation or litigation processes. This depends on the agreement between both parties, both the renter and the lessor. If it will go through a non-litigation process such as family peace, negotiation, mediation, consolidation and arbitration. Meanwhile, dispute resolution is through litigation, namely by submitting a case to the Court with the aim of obtaining certainty of permanent legal force and obtaining justice in accordance with applicable law. If deliberations have been held but the lessee does not want to pay or the renting party still feels aggrieved, they can file a lawsuit or claim to the District Court or arbitration on the basis of breach of contract.

Abstract

This article aims to determine the effectiveness of the law regarding tourism-based waste management carried out by the Yogyakarta City Government, targeting the center of the Malioboro Tourism Area as one of the waste producers. This research uses empirical legal methods which are deductive and analyzed qualitatively. Research Location in the Malioboro Tourist Area, Yogyakarta City, Yogyakarta Special Region. This research uses library study data sources, interviews with Yogyakarta City DLH employees and questionnaire techniques for tourists. Then it is processed to get answers to problems related to waste management in the city of Yogyakarta. This research aims to find out 1) There is an overview of waste management in the Jalan Malioboro Tourist Area in terms of Regional Regulation Number 1 of 2022 concerning waste management which describes the technical waste management carried out by the Yogyakarta City Government starting from monitoring the implementation of tourist waste management and the flow of waste sorting. to Final Waste Processing. Then you can describe 2) The effectiveness of waste management in the Malioboro Tourism Area and explain the theory of effectiveness based on the five factors that support implementation in the sectors of legal rules, law enforcement, infrastructure, society and culture. With awareness of protecting the environment carried out by the community and firmness from the Yogyakarta City Government, and carrying out outreach regarding compliance with protecting the environment, especially waste, to tourists and the surrounding community.

Abstract

Legal certainty in the land sector is indeed a necessity that must exist, but researchers have found that there are many individuals taking advantage of the weakening of law enforcement which has resulted in an increase in several land disputes. The aim of this research is to identify the factors causing land disputes at the Sriwedari Mosque in Surakarta. This research is research that uses sociological legal methods with a qualitative descriptive approach which was carried out on Jl. Slamet Riyadi Taman Sriwedari, Surakarta city in March-May 2023 using data collection techniques, namely literature study and interviews. Meanwhile, data analysis techniques utilize comparative studies. Based on the research results, the researchers concluded that the chronology of the Sriwedari land, which is now a problem regarding land disputes, was originally purchased by Paku Buwono (PB) This right to land ownership is what caused the land dispute at the Sriwedari Mosque in Surakarta and the construction of the mosque to stop.

Abstract

The heirs whose whereabouts cannot be known are heirs who have lost news so that it is not known whether he is still alive or dead. Or it can be called a missing person. In fact, many heirs ignore the inheritance rights of heirs whose whereabouts cannot be traced. Based on this background, this research was conducted with the aim of explaining the inheritance regulations for heirs whose whereabouts cannot be determined and the legal consequences for heirs whose existence is known after the distribution of inheritance. The research method used in this study is normative legal research using secondary data in the form of laws, court decisions, and related literature. This research also shows that in practice, there are various problems in determining the whereabouts of unknown heirs, such as difficulties in finding sufficient information and evidence to determine the existence of heirs, as well as differences of opinion regarding whether unknown heirs are entitled to receive a share of the inheritance.

Abstract

The author writes a journal by analyzing and explaining BPOM's goals in enforcing and enforcing consumer protection regulations based on the Consumer Protection Administration Law No. 8 of 1999. In this case the Food and Drug Supervisory Agency (BPOM) has a role and responsibility for the circulation of each drug and food product in the framework of granting permits for each drug and food product circulating in the community. The Food and Drug Supervisory Agency (BPOM) is a government agency responsible for drug and food control. The Consumer Protection Law prohibits the manufacture of goods for the general public, namely the types of goods listed in Law Number 8 of the Republic of Indonesia concerning Consumer Protection for the purpose of increasing knowledge and skills (1999 Consumer Protection Law). violated because of the indiscriminate nature of the company's behavior. and independence of consumer self-defense. Protect the dignity of customers by protecting them from harmful use and oversupply of services. Empowering consumers by letting them choose the products they want to buy and asserting their legal rights.
