Abstract

This paper aims to analyze the imposition of sanctions for perpetrators of environmental pollution due to hazardous and toxic waste in West Cikarang District, Bekasi Regency, Indonesia. It was based on the enactment of the Republic of Indonesia's Law No. 32 of 2009 on Environmental Protection and Management. The research problems are: 1) How does the government apply criminal sanctions for the perpetrators of environmental pollution due to hazardous and toxic waste in West Cikarang District?; 2) What factors hinder the application of criminal sanctions related to hazardous and toxic waste in West Cikarang District and what efforts have been carried out to resolve such challenges?; and 3) What is the concept of criminal sanction application for perpetrators of environmental pollution? This paper employed the normative juridical research method, which involves an evaluation of related legal regulations (legislations). The results of this paper showed that: 1) The application of sanctions for perpetrators of environmental pollution due to hazardous and toxic waste in West Cikarang District must be carefully carried out. As a foundation for determining a verdict, judges must use Law No. 32 of 2009 on Environmental Protection and Management as a legal basis; 2) Some challenges or hindrances include the lack of legal certainty related to limitations in categorizing the types of committed actions and the yielded impacts; and 3) The process of criminal sanction imposition involves a series of actions that are planned to make sure that the perpetrators are responsible for their actions.

Abstract

The current era of digitalization has made everything digital, including currency. Other countries' currencies have implemented a Central Bank Digital Currency (CBDC) or an official digital currency issued by a central bank, such as El Salvador, Bahamas, China and Nigeria. The background to this research is that until now, there has been no precise legal regulation for using this digital currency in implementing CBDC use in Indonesia, even though the digital currency has been implemented in several countries, as mentioned above. This research uses qualitative research methods by implementing the use of CBDC in Indonesia and examining relevant legislation using it. The next stage uses comparative techniques with several countries, namely Bahamas, China, and Nigeria. The results of this research found that CBDC in Indonesia still needs to have legal regulations or laws that clearly regulate the implementation of CBDC. Rules regarding this use Law Number 7 of 2011 concerning Currency. However, the issuance of Law Number 4 of 2023 concerning the Development and Strengthening of the Financial Sector (UU P2SK) opens up opportunities for the issuance of CBDC. Apart from that, Bank Indonesia also launched a project called White Paper "Garuda Project". According to the project, CBDC will be issued in 2025, which increases the chances of CBDC being issued in Indonesia.

Abstract

This research aims to find out how to harmonize relevant applicable laws and regulations in Cybercrime Sniffing and to analyze the protection provided by law to deal with sniffing cases. This research uses normative research methods. The results of this research are: first, crime regulation sniffing in hacking M Banking via the WhatsApp application, which has been regulated in Article 51 paragraph (2) of the ITE Law and its amendments and Article 67 paragraph (1) of the PDP Law has differences in the aspect of criminal sanctions and/or fines, where the sanctions in the ITE Law and its amendments are more the severity of the sanctions contained in the PDP Law. Refers to the principle of preference, namely the principle of a particular law derogating from the general law and based on teleological/sociological interpretation by looking at the purpose of establishing the law, it can be concluded that in cases of criminal acts in the form of sniffing In the hacking of M Banking via the WhatsApp application, because it relates to personal data breaches, what applies is the provisions of Article 67 paragraph (1) of the PDP Law, because the PDP Law is a regulation that more specifically regulates personal data breaches, so the ITE Law and its amendments are as follows: more general settings should be ruled out. The protection provided by the Act to deal with cases of sniffing M-Banking hacking via the WhatsApp application is regulated by criminal sanctions in Article 67 paragraph (1) of the PDP Law, which can be interpreted to mean that the PDP Law provides criminal sanctions and/or fines to all parties, including banks if there is loss resulting from these actions. Sniffing has implications for harming the victim.

Abstract

This study critically inquires the role of religious figures within the framework of instilling the concept of religious moderation in Indonesia. The main reason for this study is that social facts in Indonesia today, indicate that there are certain people who interpret religion in extreme ways. This is the background behind the issuance of Presidential Regulation Number 18 of 2020 which places religious moderation as a fundamental social capital for nation building. In line with that, this paper maps out the strategies run by religious leaders in carrying out their roles in grounding the concept of religious moderation. This article is based on socio-legal research. The data were collected through observation, in-depth interviews, and documentation. The result of this study shows that religious leaders play an important role in instilling religious moderation by acting as inspirations in inter-religious interactions, motivators in understanding religious moderation, role models in moderation behavior, initiators of moderate religious perspectives, promoters of internal and external dialogue, mediators, catalysts, in carrying out Islam as rahmatan li al-alamin, and is at the forefront (spearhead) in socializing the concept of religious moderation.

Abstract

Introduction: The waste management in the Bengawan Solo River basin in Indonesia leaves a feeling of profound sadness as the river is filled with waste and is very dirty. It decreases the quality of the river water and the environment around the river basin. This research aims to analyze the implementation of waste management around the Bengawan Solo River basin. This was a type of sociological legal research, i.e., research which utilized data from the field. This was descriptive qualitative research, meaning that it describes the policy on waste management in the Bengawan Solo River basin and the authors selected qualitative data to be analyzed. The authors conducted the sociological approach which was obtained from respondents through interviews and observation in the field. The data were processed and analyzed qualitatively. Then, the authors drew a conclusion. Results and Discussion: There is a very high volume of pollution and waste in the Bengawan Solo River as society lacks environmental awareness, making them not think twice about littering in rivers. Apart from that, the government does not carry out enough systematic efforts by educating society, implementing legal sanctions, or cleaning the river, worsening the condition of this river. Conclusion: The government needs to show a firm attitude in law enforcement by imposing sanctions on pollution and littering perpetrators in the Bengawan Solo River as well as increasing the budget and apparatus to carry out river cleaning activities.

Abstract

This study addresses the gap between the normative objectives of Indonesia’s Sustainable Food Agricultural Land Protection Law and its implementation in practice, particularly in urbanizing areas such as Singkawang City, West Kalimantan. It examines how adaptive, non-formal implementation strategies can bridge this gap by placing farmer welfare at the center of policy implementation and using the Prophetic Social Science paradigm as an analytical lens. Accordingly, the study asks how an adaptive approach to socializing sustainable food crop land protection policies, grounded in farmer welfare and prophetic values, can reconcile formal regulations with the social realities of farming communities in Singkawang City. The study employs a qualitative case study approach, with data collected through interviews, observations, and document analysis. The data are analyzed using the street-level bureaucracy framework alongside three core prophetic values: humanization, liberation, and transcendence. The findings indicate that a formal, predominantly procedural approach is insufficient, as local governments operate under significant structural and institutional constraints. Instead, implementation becomes more effective through adaptive strategies developed by Field Agricultural Extension Workers. These strategies involve building social capital and trust through a humanistic approach and by providing concrete incentives that directly address farmers’ needs. Such practices reflect the prophetic value of liberation, helping farmers navigate and reduce the structural pressures that might otherwise undermine policy implementation. Academically, this study contributes to the street-level bureaucracy literature by demonstrating that non-formal and adaptive approaches inspired by prophetic values can enable street-level bureaucrats to translate state policies into meaningful social practices. It further shows that such approaches can strengthen government legitimacy by ensuring that policy implementation remains responsive to the lived realities and welfare needs of local communities.

Abstract

This study analyzes the sale of inherited family land in Ternate City to enhance understanding of the legislative framework governing inheritance—specifically regarding legal issues arising from the sale of inherited family land that complicate the distribution of the estate. This study employs a normative-juridical legal research methodology, which involves the analysis of documents and secondary data sources such as legislation, court rulings, legal theories, and scholarly opinions. The study utilizes statutory, conceptual, and legal instrument approaches. The research findings indicate that: 1) The sale of inherited family land by a single heir without the written consent of all other heirs is null and void by operation of law. This is because the transaction violates the requirements for a valid agreement under Article 1320 of the Indonesian Civil Code as the transfer of rights to jointly owned land requires the participation of all rights holders. 2) Legal protection for aggrieved heirs can be pursued through civil litigation by filing a lawsuit in the District Court to annul the sale and transfer of rights on the grounds of an Unlawful Act pursuant to Article 1365 of the Civil Code, as well as by exercising the right to reclaim the estate as stipulated in Article 834 of the Civil Code.

Abstract

Foso and Boboso have functional customary legal force within the scope of the Ternate customary community as informal law (living law) to maintain the order of the Ternate customary community, North Maluku. This study analyzes: (1) the legal position of the customary criminal sanctions of foso and boboso in the Se Atorang customary tradition in the Ternate Sultanate of North Maluku and (2) the prospects and challenges of transforming customary criminal law as additional punishment in Law Number 1 of 2023 concerning the Criminal Code in the Ternate Sultanate of North Maluku. The research method used in this study is an empirical legal research method with a live case study approach. The results of the study indicate that the origin of Article 66 paragraph (1) letter f provides recognition of customary sanctions against perpetrators of criminal acts. However, there are problems in its application. This is because customary criminal sanctions, known in Ternate customary law as "Foso se Boboso," are based on the Adat se-Atorang philosophy and the principle of the relationship between the Sultan and the People, which prioritizes the implementation of the "Ngofa se Nyeku" custom. Violations of norms, ethics, etiquette (politeness), and customary law by ngofa se nyeku members will be subject to tiered customary sanctions. Initial sanctions include stern warnings, advice, or guidance from traditional elders or the customary council (fala raha) or spiritual leaders (sowohi) within the customary structure of the sultanate in North Maluku.
