Abstract

The development of computer network technology, including LAN and WAN, has had a significant impact on various aspects of life, including land information services. Land has a strategic role in people's lives, as regulated in Article 33 paragraph (3) of the 1945 Constitution. Good land management can support people's welfare and sustainable investment. The National Land Agency (BPN) as the institution responsible for land affairs has the main task of regulating, serving and administering land. In an effort to increase legal certainty and service efficiency, the government introduced Electronic Land Certificates (STE) based on ATR/BPN Ministerial Regulation No. 1 of 2021. STE offers easy access to information, speeds up land transactions, and increases transparency and accountability. Nonetheless, STE implementation faces challenges, including cybersecurity risks and data inaccuracies. Therefore, a strong security system, clear regulations and public education are needed to ensure the success of STE implementation. With the right strategy, STE can be an innovative solution in modernizing land administration in Indonesia, supporting legal certainty, and improving the quality of public services.

Abstract

Various aspects of life have become easier thanks to advances in information technology, including managing village government. E-government allows village fund management to be clearer and more efficient. The purpose of this study was to see how ready the technology infrastructure and digital literacy of Ketaon Village are to implement e-government in managing village funds. The method used is the empirical legal method using a qualitative and descriptive approach, observation, interviews, and document studies. The results of the study show that Ketaon Village faces many challenges when implementing e-government, including limited internet access, outdated hardware, and low digital literacy among village officials and the community. E-government has great potential to increase village transparency and accountability, this can speed up the administration process and facilitate the supervision of village funds.

Abstract

The advancement of digital technology has significantly impacted copyright protection, particularly on social media platforms such as TikTok. This study aims to examine the effects of copyright infringement involving film excerpts on TikTok and to explore potential solutions for protecting such copyrighted content. The research employs a normative legal approach with doctrinal study, focusing on the analysis of relevant laws and legal literature. The findings indicate that uploading film excerpts without permission on TikTok violates Article 9(1) of the Copyright Law, resulting in both material and immaterial losses for copyright holders, while also shaping consumer habits toward illegal content access. Furthermore, effective copyright protection can be achieved through stricter law enforcement, increased public awareness, and the development of more advanced content detection systems on TikTok, modeled after YouTube's Content ID system.

Abstract

This research is motivated by the continued discovery of violations of the legal obligations of Micro and Small Business Permits (IUMK) by karak cracker entrepreneurs in Gadingan Village, Mojolaban District, which have the potential to result in legal liability consequences and hinder business protection and development. The purpose of this study is to determine and analyze the form of legal responsibility of karak cracker entrepreneurs in violation of business permits and to identify factors that cause low legal compliance of entrepreneurs with the obligation to have and comply with IUMK in Mojolaban Village. The research method used is empirical juridical legal research with a field approach through interviews, observations, and document studies of business actors and related agencies. The results of the study indicate that the legal responsibility of business actors for violations of IUMK in practice is mostly realized through guidance, assistance, and facilitation of permits by the local government, although normatively it is possible to apply administrative sanctions. In addition, low legal compliance is influenced by internal factors such as limited legal understanding, the perception that permits are not yet urgent, and digital literacy constraints, and external factors such as uneven socialization, weak supervision, lack of firm sanctions, and the strength of traditional business culture that has been passed down through generations.

Abstract

The growth of local food-based small businesses, particularly the ampyang industry in Gadingan Village, has demonstrated significant economic contributions, but still faces issues of business legality and weak licensing oversight by the local government. This study offers novelty by specifically analyzing the effectiveness of local government oversight in licensing small businesses at the village level and its implications for legal protection and business development, which have not been widely studied. This study aims to analyze the effectiveness of local government oversight of the legality and development of small businesses in the ampyang industry and examine the views of business actors on the implementation of such oversight. The method used is empirical juridical with a legislative and sociological approach through in-depth interviews and literature studies. The results of the study indicate that supervision has been carried out through data collection, legality checks, licensing socialization, and coaching, which has resulted in increased legal awareness for business actors. However, its implementation has not been optimal due to limited resources, lack of coordination, and uneven oversight coverage. Business actors assess supervision as positive because it not only functions as administrative control but also provides mentoring, increases market confidence, and supports business development. Therefore, the effectiveness of local government supervision plays a crucial role in promoting the sustainability of small businesses based on the local economy.

Abstract

Introduction: Overloaded freight vehicles constitute a serious issue in road transportation systems as they contribute to traffic accidents and accelerate road infrastructure damage.Methods: This study aims to analyze the effectiveness of supervision and enforcement of overloaded freight vehicles by the Transportation Agency of Karanganyar Regency and to identify the obstacles encountered in its implementation. This research employs an empirical juridical method with statutory and field approaches through in-depth interviews and document studies.Novelty: This research offers a novel contribution by integrating a legal-institutional analysis with empirical findings on the implementation of supervision and enforcement mechanisms, particularly highlighting the limitations of administrative sanctions and intergovernmental authority fragmentation in addressing overloading violations.R&D: The findings indicate that supervision and enforcement have been carried out through preventive and repressive measures, such as vehicle inspection (VI), weighing at weighbridges, joint operations, ticketing, and load reduction. However, their effectiveness remains suboptimal as violations persist and sanctions are predominantly administrative in nature.Conclusion: The main obstacles include limited human resources, inadequate infrastructure and authority, economic pressure from freight companies, and structural constraints related to the division of authority between central and regional governments, which restrict the flexibility of supervision.

Abstract

The implementation of the Free Nutritious Meal Program through a partnership with the National Nutrition Agency requires certainty of business legality, so that business licensing is a crucial aspect in ensuring the accountability and quality of nutrition services in the region. This study aims to explain the practice of implementing business licensing by the National Nutrition Agency partners at SPPG Karanganyar and its supporting and inhibiting factors. This study uses an empirical juridical method with a legislative and sociological approach, qualitative descriptive, with primary data through interviews and secondary data from laws and regulations and legal literature. The results show that the implementation of licensing has been carried out through the OSS system with the fulfillment of basic legalities such as NIB, business risk classification, and administrative and technical verification, although it still requires assistance in understanding business procedures and standards. Supporting factors include policy support, local government facilitation, and institutional coordination, while inhibiting factors include administrative obstacles, low licensing literacy, and social rejection due to the impact of business operations. In conclusion, the implementation of business licensing for partners of the National Nutrition Agency in Karanganyar Regency has been running, but its effectiveness still needs to be optimized through strengthening guidance, supervision, and harmonization of technical regulations.

Abstract

  This study aims to analyze the implementation of legal protection for employees experiencing workplace accidents at HCP Ltd. and to evaluate the extent to which the company fulfills workers’ rights in accordance with Indonesian labor regulations. The findings demonstrate that HCP Ltd. has formally implemented legal protection through employee participation in the BPJS Employment program, provision of medical treatment access, continuation of wage payments during recovery periods, and maintenance of employment relationships for injured workers. However, the implementation of such protection remains predominantly procedural and reactive, indicating a substantial gap between formal legal compliance and the substantive fulfillment of workers’ rights. Delays in Work Accident Insurance (JKK) claims, limited employee understanding of labor protection mechanisms, inconsistent occupational safety and health (OSH) supervision, and the absence of structured psychological rehabilitation reflect that worker protection has not yet fulfilled the due diligence standard required within contemporary labor governance. The novelty of this research lies in its empirical and micro-level examination of labor protection effectiveness within a specific corporate setting, thereby moving beyond conventional normative labor law studies that primarily emphasize statutory adequacy without critically assessing practical implementation. Theoretically, this study contributes to the development of labor law scholarship by strengthening the discourse on substantive legal protection, corporate due diligence obligations, and human-centered occupational safety governance. Practically, this research recommends strengthening internal OSH supervision, institutionalizing worker legal education, accelerating administrative claim mechanisms, and integrating psychological rehabilitation into post-accident recovery systems to ensure more effective, sustainable, and justice-oriented worker protection.

Abstract

Introduction: It is noted that 513 women with Indonesian citizenship traveled to Iraq and Syria after being impacted by cyber indoctrination. Among these women, there are those with a manus minustra (victim) status. Some are trapped in Iraq and Syria overseas as they were brought there by their families when they were still young or were babies. Methods: This research employed the classical dogmatic juridical method with a literary approach. This research was conducted to find the best solution for women as victims of terrorists’ indoctrination who have not committed terror acts or women who migrated to Iraq and Syria when they were still young or were babies. Results and Discussion: Social rehabilitation is only given to indoctrination victims who have not committed terror, as well as women who were trapped in Iraq and Syria because they were brought over by their families when they were still young/babies, thus requiring identification. Social rehabilitation is crucial to prevent equal punishments between victims and offenders. Some countries apply social rehabilitation with various methods and requirements, such as Uzbekistan, Germany, and the United States. Conclusion: Rehabilitation is possible as the providing institutions are experienced in giving social rehabilitation to children of terrorism perpetrators. Social rehabilitation in these three countries was successful with various degrees of success. It is deemed as more successful than punishments as the former prevents victims from obtaining further indoctrination in jails

Abstract

In the case of so much the role of the husband towards his wife, the Shari'a gives legitimacy to husbands to beat nusyuz wives. However, the permissibility of hitting a wife to educate is not explained clearly in the Qur'an, how to beat her or when it is permissible, so that this beating has the potential to be punished according to Law No. 23 Years of Articles 5 and 6 concerning the elimination of Domestic Violence (KDRT). The gap that occurs between the prohibition of domestic violence as regulated in the law and the permissibility of hitting one's wife in Islamic law becomes an ongoing polemic if there is no bright spot for an in-depth discussion that has the potential to criminalize Islamic law. This research uses a normative doctrinal approach. The main data source is secondary data in the form of documents. This research is descriptive in nature which explains in detail the data collection and the current situation. The data collection technique is done by means of literature. The data analysis method of this paper is normatively qualitative, initially identifying through various forms of documents. Next, examine the data obtained from the field and literature by studying the rule of law to generate data and conclusions from the materials obtained by the researcher. From this research, it was found that the hitting procedure that has been put forward by the opinion of the Syafi'i, Hanafi, and Hanbali schools is categorized as a misdemeanor in Article 44 paragraph (4) of the 2004 PKDRT Law, because this procedure of hitting basically causes pain, inflicted by the husband on his wife, and this physical violence does not cause illness or hinder the victim's ability to work, carry out his position, or carry out daily activities. Meanwhile, Imam Malik's opinion requires that the procedure for hitting him should not be painful or cause pain, so that he does not qualify as a crime of physical violence in the PKDRT Law.
