Abstract

Corporate crime poses a growing threat to economic integrity, public safety, and environmental sustainability, yet legal systems often struggle to hold corporations accountable. This study explores the challenges faced by Indonesian law enforcement agencies and courts in proving and prosecuting corporate crimes, ranging from environmental violations to corruption and financial fraud. Through analysis of selected case studies, court judgments, and interviews with prosecutors, investigators, and legal scholars, the research identifies key barriers such as evidentiary complexity, corporate shielding structures, weak regulatory frameworks, and institutional reluctance. The study highlights the limitations of current legal tools in attributing liability to corporate entities, especially in the absence of clear standards for corporate intent and culpability. It also discusses recent legal reforms and their potential to improve enforcement. The novelty of this study lies in its comprehensive examination of both procedural and structural barriers to corporate accountability. It offers policy recommendations for strengthening corporate criminal liability mechanisms and ensuring that justice is not evaded through legal and institutional loopholes.

Abstract

As digital communication becomes increasingly central to public discourse, courts in Indonesia face growing pressure to balance the right to free speech with protections against defamation, particularly in online settings. This study examines judicial decisions related to digital libel, especially under the controversial Electronic Information and Transactions (EIT) Law, which has been criticized for its vague definitions and potential to criminalize dissent. Using case law analysis and doctrinal review, the research assesses how courts interpret the boundaries between expression, public interest, and reputational harm in the age of social media. The findings reveal a judicial pattern that often prioritizes social order and morality over individual rights, resulting in convictions that may stifle legitimate criticism and public participation. While some rulings attempt to incorporate constitutional protections of freedom of expression, inconsistencies in judicial reasoning and the discretionary use of the EIT Law continue to create legal uncertainty. This study argues that the current jurisprudence risks normalizing the criminalization of speech, particularly when used by state actors against critics and journalists. The novelty of this research lies in its focus on digital-era defamation from a rights-based perspective, highlighting the tension between outdated legal frameworks and emerging digital realities. Policy and judicial reform are urgently needed to ensure that defamation law protects reputations without undermining democratic freedoms.

Abstract

Corruption trials in Indonesia have long been viewed as both a test and a symbol of judicial integrity. In recent years, however, shifts in political dynamics and public sentiment have reshaped the way corruption cases are prosecuted and adjudicated. This study investigates the changing nature of corruption trials in Indonesia by examining recent high-profile cases, the role of the Corruption Eradication Commission (KPK), and the judiciary’s response under increased political scrutiny. Using case study analysis, media reviews, and legal documentation, the research explores how political influence and public pressure affect prosecutorial discretion, judicial decisions, and institutional accountability. The findings reveal a growing concern over selective enforcement, perceived leniency toward political elites, and the weakening of anti-corruption institutions. Public trust in judicial outcomes is increasingly contingent on transparency and the appearance of impartiality, yet courts often struggle to maintain credibility in politically charged contexts. The novelty of this study lies in its integrated analysis of legal processes, political pressure, and societal expectations. It argues that restoring public confidence in corruption trials requires not only institutional reform but also judicial courage and systemic insulation from partisan influence. The study contributes to comparative discussions on judicial accountability in transitional democracies.

Abstract

This paper investigates the interfaith responses to the Palestinian question in Indonesia, exploring the relationship between religion, human rights, and solidarity with Palestine. Indonesia, with its diverse religious landscape, is home to various responses to the Palestinian cause, particularly from Muslim, Christian, and interfaith groups. This study examines how these religious communities interpret and respond to the Palestinian struggle through the lenses of faith, justice, and human rights. Focusing on religious leaders, interfaith dialogue, and humanitarian initiatives, the paper explores how the Palestinian issue is framed as both a religious and a human rights concern, transcending religious boundaries. The research highlights the role of religious-based humanitarian organizations in Indonesia’s support for Palestine, considering their efforts in advocacy, fundraising, and raising awareness about the Palestinian plight. The paper also explores the challenges of balancing religious principles with international human rights frameworks in advocating for Palestine. Ultimately, it reflects on the role of religion as a tool for both moral advocacy and political resistance in the context of the Palestinian cause.

Abstract

This paper examines the experiences of ethnic and religious minorities in urban areas of Indonesia, focusing on the legal structures that either facilitate or hinder their access to justice. Indonesia’s urban centers, such as Jakarta and Surabaya, are home to diverse populations, yet minorities in these areas often face discrimination in housing, employment, education, and public services. The study reviews the legal frameworks governing urban rights, including the 1945 Constitution, the Law on Ethnic Equality, and municipal regulations, and evaluates their effectiveness in addressing discrimination. Drawing on case studies, interviews with minority group leaders, and surveys of urban residents, the paper highlights the systemic barriers faced by minorities in accessing justice, particularly in relation to land disputes, religious freedoms, and employment discrimination. The findings suggest that while legal protections exist, they are often inadequately enforced or are subject to local political dynamics that favor the majority population. The paper concludes by recommending reforms aimed at improving legal access and ensuring more equitable treatment for minorities in urban areas, including stronger anti-discrimination laws, better enforcement of existing regulations, and the creation of specialized legal services for minority communities.

Abstract

This paper offers a comparative analysis of Indonesia’s religious freedom laws and minority rights protections, evaluating their alignment with international standards such as the Universal Declaration of Human Rights and the International Covenant on Civil and Political Rights. While Indonesia’s Constitution guarantees religious freedom, minority religious groups, including the Ahmadiyya, Christians, and indigenous belief systems, face significant restrictions on their practice and recognition. The study examines key legislative frameworks, including the 1965 Blasphemy Law and the 2006 Joint Ministerial Decree on Religious Groups, assessing their impact on religious minorities. The paper contrasts these national laws with international human rights standards, highlighting gaps in Indonesia’s legal framework that lead to the persecution of religious minorities. Using case law, human rights reports, and interviews with legal experts and religious leaders, the paper explores how the Indonesian legal system often fails to protect religious minorities from violence, discrimination, and legal marginalization. The findings suggest that while Indonesia's laws theoretically uphold religious freedom, practical enforcement and political dynamics often undermine these protections. The paper concludes by recommending legal reforms to bring Indonesia’s laws in line with international human rights standards, including the decriminalization of religious offenses and the establishment of stronger protections for minority religious communities.

Abstract

This paper examines the legal barriers to inclusion and the protection of rights for disabled individuals in Indonesia, with a focus on the gaps in legislation and systemic challenges that prevent full participation in society. While Indonesia ratified the 2007 Law on Disability Rights, which mandates equality in areas such as education, employment, and access to public services, disabled individuals continue to face widespread discrimination and marginalization. The paper critically analyzes how the law falls short in terms of implementation and enforcement, leading to unequal access to quality education, employment opportunities, and healthcare. By using case studies of disabled individuals in urban and rural settings, the paper explores the social and legal obstacles they encounter, such as inaccessible infrastructure, discriminatory hiring practices, and limited access to adaptive technologies. The study also critiques the inadequate enforcement of existing regulations, particularly at the local government level, and the lack of legal support for disabled people in seeking redress for their grievances. The findings highlight the urgent need for a more comprehensive legal framework that not only guarantees rights on paper but also ensures the practical inclusion of disabled individuals. The paper concludes by proposing targeted reforms, including better disability awareness training for government officials, stricter regulations for accessibility, and the establishment of dedicated legal support services for disabled individuals.

Abstract

Introduction: Restorative justice, which focuses on repairing harm caused by crime or conflict through dialogue and mutual agreement, is gaining traction as a community-based legal intervention in Indonesia. Unlike traditional punitive measures, restorative justice emphasizes healing for both the victim and the offender.Purpose: This paper investigates the application of restorative justice within community settings in Indonesia, analyzing how it serves as an alternative approach to conventional legal responses for resolving local disputes and promoting reconciliation.Method: The study includes case studies of restorative justice programs in Indonesian communities, focusing on their process, outcomes, and challenges. Interviews with participants in these programs, as well as legal professionals and community leaders, provide insights into the effectiveness of restorative justice.Findings and Results: The findings suggest that restorative justice programs have had positive outcomes in resolving conflicts, particularly in cases involving juvenile offenders or minor offenses. These programs encourage community involvement and promote reconciliation, although challenges such as societal acceptance and implementation inconsistencies remain.Urgency: Given the increasing rates of petty crime and social unrest in Indonesia, restorative justice offers an urgent and viable alternative to punitive measures that may not always address the root causes of conflict.Contribution: This paper highlights the potential of restorative justice as a tool for building community resilience and fostering reconciliation at the local level.Recommendation: The study recommends the expansion of restorative justice programs, particularly in schools and rural communities, along with training for local leaders and legal professionals to ensure successful implementation.

Introduction: Social problems such as poverty, violence, discrimination, and environmental degradation often lead to legal challenges that exacerbate inequality. Communities facing these problems need not only legal interventions but also resilience-building strategies to cope with ongoing challenges.Purpose: This paper examines comprehensive legal interventions aimed at building legal resilience in communities, focusing on how community legal services can empower individuals to navigate complex social problems effectively.Method: The research is based on qualitative interviews with community leaders, legal professionals, and individuals who have benefited from legal interventions. It also includes a review of community legal initiatives that combine legal aid with empowerment strategies.Findings and Results: The study finds that legal interventions that include education, empowerment, and long-term support help communities build resilience to social problems. Successful programs also focus on creating networks of legal advocates within the community to ensure sustainability.Urgency: The urgency of addressing legal vulnerabilities in marginalized communities cannot be overstated, as these issues contribute to long-term cycles of poverty and inequality.Contribution: This paper contributes by offering a framework for building legal resilience, which is essential for empowering communities and fostering sustainable solutions to social problems.Recommendation: The study recommends investing in community-led legal programs that emphasize education, empowerment, and long-term capacity building.

Abstract

This study examines the role of LinkedIn in enhancing academic visibility and fostering legal research collaboration among faculty members at the Universitas Negeri Semarang (UNNES) Law Faculty. In the digital age, social media platforms have emerged as significant tools for professional networking, knowledge dissemination, and collaborative research. LinkedIn, as a professional-oriented platform, offers opportunities for academics to showcase their scholarly achievements, connect with peers, and engage in research partnerships both nationally and internationally. Using a qualitative case study approach, this research involved in-depth interviews with ten UNNES Law Faculty lecturers actively using LinkedIn, alongside an analysis of their LinkedIn profiles and professional activities. The findings reveal that LinkedIn significantly contributes to increasing individual academic visibility, promoting interdisciplinary collaboration, and facilitating access to international research networks. However, challenges such as limited platform engagement, varying digital literacy, and privacy concerns were also identified. The study highlights strategies to optimize LinkedIn use for academic purposes, including profile optimization, active content sharing, and strategic networking. This research contributes to a better understanding of how professional social media platforms can support scholarly communication and collaboration in the legal field. The implications of this study suggest that higher education institutions should encourage and provide training for faculty to effectively leverage LinkedIn for academic networking and collaborative research initiatives.
