Abstract

This study examines the legal, institutional, and socio-cultural mechanisms influencing the social reintegration of ex-offenders in Indonesia and Spain. Despite a global trend toward rehabilitative approaches, practical implementation reveals significant divergence due to structural, cultural, and economic factors. Indonesia’s penal system, guided by Law No. 22 of 2022 and the new Criminal Code (KUHP), emphasizes statutory rehabilitation and vocational and spiritual programs. However, challenges such as prison overcrowding, limited post-release support, and societal stigma constrain effectiveness. Judicial decisions indicate cautious application of restorative provisions, reflecting both public expectations and institutional limitations. In Spain, rehabilitation is constitutionally entrenched under Article 25(2) of the Constitution and operationalized through the General Penitentiary Organic Law (Ley Orgánica General Penitenciaria; LOGP), which mandates individualized treatment, progressive custody, and open-regime programs. Court rulings reinforce the rights of inmates and ex-offenders to social reintegration, while structured vocational, psychological, and community programs enhance post-release outcomes. Socio-legal analysis shows that Indonesia’s reintegration is vulnerable to societal exclusion, whereas Spain demonstrates effective alignment between law, institutional capacity, and cultural legitimacy. The study integrates theoretical frameworks such as labelling theory, desistance theory, and reintegrative shaming to explain the interplay between law, institutions, and social contexts. Findings indicate that successful social reintegration requires coordinated legal, institutional, and societal mechanisms, with attention to economic inclusion and cultural acceptance.

Abstract

This research explores Indonesia’s legal policy on the ASEAN Mutual Legal Assistance Treaty in Criminal Matters (AMLAT) and its implications for law reform in the enforcement of cross-border crime in Southeast Asia. AMLAT plays a critical role in facilitating legal cooperation among ASEAN member states in criminal matters, addressing challenges posed by transnational crimes such as human trafficking, drug smuggling, and cybercrime. Despite its significance, Indonesia faces legal and procedural gaps in aligning its domestic legal framework with AMLAT provisions, creating obstacles in efficient criminal law enforcement across borders. The novelty of this study lies in its focus on Indonesia’s unique legal challenges and reform needs in the context of AMLAT, an area that has received limited scholarly attention. While previous studies have explored AMLAT’s role at a regional level, this research specifically investigates the legal and policy issues within Indonesia and how they affect broader ASEAN cooperation on cross-border crime. The urgency of this research is underscored by the increasing prevalence of transnational crimes in Southeast Asia, exacerbated by advancements in technology and globalization. A more robust legal framework is crucial for Indonesia to effectively collaborate with ASEAN members in combating these crimes. The contribution of this study is twofold. First, it provides a comprehensive analysis of the current state of Indonesia’s legal policy on AMLAT, highlighting key areas for legal reform. Second, it offers practical recommendations for policymakers to strengthen Indonesia’s role in regional legal cooperation, ensuring more effective cross-border crime enforcement in Southeast Asia.

Abstract

The contemporary criminal justice system faces multifaceted challenges, particularly concerning the efficacy of supervision mechanisms. This study delves into the pivotal role of supervision within the framework of integrated justice, advocating for legal reform and constructive enforcement strategies. The primary objective is to elucidate the necessity of reforming criminal execution practices to enhance the overall effectiveness and fairness of the criminal justice system. Methodologically, this study adopts a socio-legal approach, Research data were obtained from interviews, observations, interpretation of documents and materials as well as persona experience. In accordance with the constructivism paradigm and then in making observations researchers take a position as facilitators using participatory principles. Results underscore the critical need for recalibrating supervision approaches, emphasizing proactive intervention, rehabilitation, and community engagement. By synthesizing theoretical insights with practical considerations, this paper offers actionable recommendations for policymakers, law enforcement agencies, and judicial authorities to optimize supervision practices in the pursuit of justice reform.

Abstract

Juvenile justice systems worldwide face persistent challenges in balancing accountability, rehabilitation, and the protection of children’s rights. Traditional punitive approaches often fail to address the underlying existential and psychosocial needs of adolescents, contributing to high recidivism rates and social marginalization. This paper proposes an Integrated Existential Education Model as a transformative framework for juvenile justice reform within the context of international human rights, with a case study conducted at the Lembaga Pembinaan Khusus Anak Kelas I (LPKA) Kutoarjo, Central Java, Indonesia. Drawing on existential psychology, the model emphasizes self-awareness, personal responsibility, and meaning-making, empowering adolescents to reflect on their life choices and develop authentic identities. It integrates human rights education and restorative practices to foster empathy, respect for others, and adherence to legal and ethical norms. Methodologically, the study employs a qualitative approach, including interviews with adolescents, educators, and staff, as well as analysis of international child rights frameworks, to examine the feasibility and potential impact of the model. The findings suggest that implementing existential education within juvenile rehabilitation programs can enhance psychological resilience, reduce recidivism, and promote social reintegration while ensuring compliance with global human rights standards. This integrated approach offers a practical, rights-based strategy for policymakers and practitioners in Indonesia and beyond.

Abstract

Maraknya kasus perdagangan orang (human trafficking) di Indonesia bukan hanya menyasar pada umur dan gender tertentu, namun juga hampir semua umur baik laki-laki maupun perempuan. Bahkan beberapa kasus perdagangan orang sudah terorganisir dan menjadi kejahatan yang melintasi batas negara. Hukum pidana dan aturan hukum terkait perdagangan manusia baik secara nasional maupun internasional telah berlaku dan memiliki kekuatan hukum mengikat, namun demikian, fakta di lapangan membuktikan bahwa aturan hukum tersebut belum cukup memberikan efek jera bagi pelaku. Bahkan, aturan-aturan tersebut hanya fokus kepada pemidanaan pelaku namun mengesampingkan sisi hak-hak dan perlindungan korban. Padahal, dalam setiap kejahatan yang terjadi, selalu ada dua pihak, pelaku dan korban. Perlindungan korban dianggap penting dalam pemenuhan hak-hak asasi manusia. Tulisan ini menganalisis bagaimana perlindungan korban dalam kasus perdagangan manusia di Indonesia baik dari segi aturan hukum nasional maupun internasional. The rise of cases of human trafficking in Indonesia not only targets certain age and gender, but also almost all ages, both men and women. Even some cases of trafficking in persons have been organized and become crimes that cross national borders. Criminal law and the legal rules relating to human trafficking both nationally and internationally have been in force and have binding legal powers, however, the facts in the field prove that the rule of law is not enough to provide a deterrent effect for the perpetrators. In fact, these rules only focus on the conviction of the perpetrator but override the side of the rights and protection of the victim. In fact, in every crime that occurs, there are always two parties, the perpetrator and the victim. Protection of victims is considered important in fulfilling human rights. This paper analyzes how to protect victims in the case of trafficking in Indonesia both in terms of national and international legal rules.

Abstract

Gender-based violence remains a pervasive human rights issue in Indonesia, despite recent legal reforms aimed at strengthening victim protection and ensuring access to justice. The enactment of the Sexual Violence Crime Law (Law No. 12 of 2022) represents a significant milestone in Indonesia’s legal framework for addressing sexual violence. This article examines the implementation of the law and evaluates its effectiveness in responding to gender-based violence from a feminist legal perspective. Using a normative juridical approach complemented by qualitative analysis of statutory regulations, policy documents, and reported cases, the study investigates the extent to which the law has transformed institutional responses to victims. The findings reveal that while the legislation introduces comprehensive definitions of sexual violence, victim-centered protection mechanisms, and broader state obligations, substantial implementation challenges persist. These include limited institutional capacity, inadequate law enforcement training, socio-cultural stigmatization of victims, and uneven coordination among relevant agencies. The study further identifies tensions between progressive legal norms and patriarchal social structures that continue to shape legal practices and public perceptions. The article argues that legal reform alone is insufficient to eradicate gender-based violence without parallel institutional, cultural, and educational transformations. By assessing the early implementation of the Sexual Violence Crime Law, this study contributes to ongoing debates on feminist legal reform and offers policy recommendations for strengthening victim protection and improving access to justice in Indonesia. The findings also provide insights for other jurisdictions seeking to develop comprehensive legal responses to sexual violence within complex socio-cultural contexts.

Abstract

Corruption remains one of the most persistent challenges affecting governance, public trust, and economic development in Indonesia. Although extensive legal reforms and institutional mechanisms have been introduced to combat corruption, enforcement outcomes often reveal inconsistencies and political contestation. This study examines corruption law enforcement in Indonesia through a political economy and Critical Legal Studies perspective. Using a normative-critical methodology, the research analyzes the interaction between legal institutions, political interests, and economic power structures in shaping anti-corruption enforcement. The findings indicate that corruption law enforcement operates within a complex environment characterized by competing political agendas, institutional rivalries, and unequal access to power. Legal processes frequently reflect broader political and economic dynamics rather than functioning as entirely autonomous mechanisms of justice. The study demonstrates that selective enforcement, institutional dependence, and political intervention may undermine the effectiveness and legitimacy of anti-corruption initiatives. Furthermore, anti-corruption discourse often emphasizes legal compliance while overlooking structural factors that facilitate corrupt practices. From a critical legal perspective, corruption is not merely an individual legal violation but also a manifestation of broader governance and power relations. The research argues that sustainable anti-corruption reform requires strengthening institutional independence, enhancing public accountability, and addressing structural inequalities that enable the concentration of political and economic influence. The study concludes that effective corruption law enforcement depends on transforming both legal institutions and the political-economic conditions within which they operate. These findings contribute to critical legal scholarship by highlighting the interconnected relationship between law, power, and governance in contemporary Indonesia.

Abstract

Corruption is an extraordinary crime. It grows in the human body because man's eternal nature is greed. Corruption is an act committed with the intention of obtaining several benefits that is contrary to official duties and other truths. The Corruption Law is regulated in Law Number 31 Year 1999. It is understandable if corruption is so difficult to eradicate, partly because the approach used is still partial, whereas the handling needed is a multidimensional approach. Abstract

Filicide is one of the most complex forms of domestic homicide. Criminal law studies generally focus on the fulfillment of the elements of the crime and criminal responsibility. In contrast, psychiatric and criminological research focuses more on the psychological condition of the perpetrator. Consequently, there is still a gap in the legal literature regarding how subconscious psychological dynamics can explain filicide without shifting the principle of criminal responsibility. This study aims to fill this gap through a Freudian psychoanalytic analysis within a comparative criminal law framework, comparing the cases of Panca Darmansyah in Indonesia and José Bretón in Spain. The study uses normative legal methods with a comparative approach combined with psychoanalytic interpretation of court decisions, legal frameworks, and forensic findings. The results show that the Indonesian and Spanish criminal justice systems both determine criminal responsibility based on the perpetrator's cognitive and volitional capacities, despite the presence of deep psychological conflict. Meanwhile, the psychoanalytic analysis reveals that filicide develops through processes of repression, narcissistic injury, identity fragmentation, symbolic objectification of the child, and the redirection of aggression. This study demonstrates that criminal responsibility and subconscious motivation exist at different but complementary levels of analysis. The contribution of this research is the development of a psycho-legal framework that integrates Freudian psychoanalysis and comparative criminal law to enrich the legal analysis of filicide and support the development of forensic assessment and criminal justice policy.

Abstract

Despite Indonesia’s commitment to human rights through its legal framework and ratification of international conventions, the practical implementation of human rights court rulings often faces significant challenges. This study investigates the gap between the theoretical foundations of human rights protections in Indonesia and their real-world application, focusing specifically on the difficulties encountered in implementing rulings made by human rights courts. By analyzing a combination of case studies, legal texts, and interviews with legal experts, practitioners, and affected individuals, the research explores systemic issues such as political interference, institutional inertia, lack of enforcement mechanisms, and limited public awareness. The findings reveal that while human rights rulings may be issued in accordance with national laws and international human rights standards, their actual enforcement is often delayed or obstructed by weak institutional capacity, insufficient political will, and a lack of effective coordination among various government agencies. The study’s novelty lies in its detailed examination of both the theoretical and practical dimensions of human rights court rulings in Indonesia, providing a comprehensive view of the implementation challenges. The urgency of this issue is underscored by the need to strengthen judicial independence and promote greater accountability within the legal system. This research contributes to the broader discourse on human rights enforcement, offering recommendations for reforming the legal infrastructure and improving the efficiency of implementing human rights decisions
