Abstract

Land boundary disputes, often caused by natural factors and competition among two or more individuals over land ownership, indicate tension in human interactions, and the sought-after resolution is an effort to improve relationships. One common approach is through the judiciary, but there is also an alternative to resolving disputes through peace, known as mediation, which can be facilitated by entities such as the Land Office of Bekasi City. The author discusses this topic to explore how mediation by the Land Office can be used in settling land boundary disputes, based on the author's observations at the Land Office of Bekasi City and the chronology of related cases. From the above description, the author uses a Qualitative approach with the Empirical Juridical method aimed at identifying the causes of land boundary disputes at the Land Office of Bekasi City and the resolution of land boundary disputes between applicants and respondents at the Land Office of Bekasi City. The research highlights the public's lack of understanding of land preservation and registration as the main trigger for land boundary disputes. Insufficient awareness in placing land markers has the potential to cause conflicts, resulting in a violation of the principle of contradiction. To reduce the possibility of disputes, landowners need to complete the registration process with accurate measurements, involving land surveyors and witnesses. The Land Office of Bekasi City offers a solution through mediation, with three mediation summons to facilitate an amicable resolution. It is crucial for landowners to officially register their land at the land office, gather ownership evidence, and conduct re-measurements and stake installations to maintain legal certainty.

Abstract

As the owner of the ownership rights to an apartment unit whose ownership is proven by a Certificate of Ownership of the Apartment, the owner of the apartment can apply for credit by using the Certificate of Ownership Rights for the apartment unit he owns as collateral for credit at the bank. With the imposition of mortgage rights on the ownership rights of apartment units in Semarang Tengah District, Kembangsari Village, Semarang City. Taking the problem formulation: (1) Why is the ownership right to the flat unit Kel. Kembangsari, District. Central Semarang, Semarang City used as debt collateral? and (2) What is the procedure for imposing an ownership certificate on an apartment unit, Ex. Kembangsari, District. Central Semarang, Semarang City, burdened with mortgage rights? The method used is a qualitative descriptive legal research method with a sociological juridical approach. The data collected is primary data and secondary data. Data validity using source triangulation techniques. The research results show: (1) Requirements and procedures for guaranteeing ownership certificates for condominium units, Kel. Kembangsari, District. Central Semarang, Semarang City as collateral in a banking credit agreement, namely a certificate of ownership of an apartment unit must meet the requirements for economic value and juridical value. Meanwhile, the procedures in SHMSRS guarantee are stages that have been determined in an organized manner and must be fulfilled for the sake of smoothness and security between debtors and creditors, consisting of the credit application stage, data analysis stage, credit implementation stage, guarantee stage, and credit expiration stage. In these stages, there are several parties who have roles and duties to ensure that the credit is implemented properly, including the bank, the notary/PPAT, and the Land Office. (2) Procedure for Imposing Ownership Certificates on Flat Units in Kel. Kembangsari, District. Central Semarang, Semarang City is closely related to agreements or contracts between legal subjects, namely creditors and debtors regarding debt agreements in the form of, for example, bank credit, with the Ownership Certificate being used as collateral for the debt with the consequence that if the debtor breaks his promise or defaults, then the guarantee is can be executed to take repayment of the debt. The encumbrance procedure is related to the registration mechanism, making Certificates of Ownership Rights for Flats in Kel. Kembangsari, District. Central Semarang, Semarang City, Power of Attorney to Encumber Mortgage Rights, and others.

Abstract

The authority and significance of the State Administrative Court (PTUN) for seekers of legal truth depends on the implementation of its decisions by state administrative apparatus in accordance with the rulings. As a consequence, the fundamental problem with the existence of the PTUN actually centers on the compliance of State Administrative Bodies/Officials with the bonds stated in the court verdict. Dwangsom or forced money is an additional sanction imposed on the convicted party to pay off a sum of money outside the main sentence, with the intention that the convicted party is willing to carry out the main sentence according to schedule and procedures. The application of dwangsom in the execution of private cases in the General Jurisdiction is anticipated to optimize the success rate of sentence executions. However, the facts indicate that the implementation of dwangsom is still faced with problems, with the PTUN panel of judges rarely handing down dwangsom sentences in order to optimize the executability of the verdict. This article was composed using a literature study methodology, by accumulating, interpreting and reviewing data from various correlated literature sources. Data accumulation is carried out through investigation and restructuring of sources such as scientific journals, reference books, and previous research results. The analysis methodology applied is content and descriptive analysis. Library material from various reference sources is analyzed critically and comprehensively to support the substance of the discussion and the author's conception.

Abstract

There is HGB land indicated as abandoned whose rights will expire in 2027. However, the community asked the Kebumen Regency Kantah and the Central Java BPN Regional Office not to extend the HGB land in the future. Until the author conducted research, the HGB land was still included in the land database indicated as abandoned. The problems studied in this research are: (1) What causes HGB land to be indicated as abandoned?  (2) What is the action of the Central Java BPN Regional Office regarding HGB land that is indicated to be abandoned? and (3) Can HGBs that are indicated to be abandoned be extended? This research uses a qualitative approach method with an empirical juridical research type.  The results of this research show that HGB land which is still included in the land database is indicated as abandoned because the land is not used according to its intended use and cannot be extended. The Central Java BPN Regional Office has carried out control over the HGB land but it has not been optimal due to obstacles related to the limited budget for controlling abandoned land. Then based on the research results related to HGB land and to optimize the stages of controlling abandoned land, the author proposes that HGB holders be able to carry out their obligations, namely utilizing and using the land according to the designation for granting rights, then it is proposed to increase cooperation between rights holders and related stakeholders in the granting process. the right to make decisions on HGB extensions and the need for an additional budget for the implementation of controlling abandoned land carried out by the Central Java BPN Regional Office.

Abstract

Infrastructure, Facilities and Utilities are the basic physical equipment of a residential environment that meets certain standards for the needs of a decent residence. Providing and handing over Infrastructure, Facilities and Utilities is an obligation that the developer must fulfill when building housing. However, in Tangerang City, there are still many developers who have not handed over the Infrastructure, Facilities and Utilities even though the time period has passed, resulting in the abandonment of the Infrastructure, Facilities and Utilities. This research uses empirical juridical methods with a qualitative approach. Data collection techniques in this research used observation, interview and documentation techniques. The results of this research indicate that the inhibiting factor in handing over housing Infrastructure, Facilities and Utilities by developers to the government in Tangerang City is the abandonment of Infrastructure, Facilities and Utilities by developers whose whereabouts are unknown. Infrastructure, Facilities and Utilities that have not been handed over are managed entirely by the Developer, so that if the Developer's whereabouts cannot be known then the management of the Infrastructure, Facilities and Utilities will not work which will result in the abandonment.

Abstract

Exchange of Village Treasury Land with Land Ownership Rights in Gebyog Village, Mojogedang District, Karanganyar Regency which occurred in 1977. The exchange that occurred in 1977 was only done verbally so there is no written evidence. This study aims to: (1) Find out the Process of Exchanging Village Treasury Land with Land Owned by Residents in Gebyog Village, Mojogedang District, Karanganyar Regency? (2) Find out the factors causing the emergence of two certificates, namely the right to use in the name of the Gebyog village government and the right to own in the name of an individual? This study uses an empirical legal research method, with a Qualitative approach. The types and sources of research data are Primary data, Secondary data, and Tertiary data. Primary data is obtained through interviews and observations, Secondary data is obtained through laws and regulations and literature studies, and Tertiary data through the Great Dictionary of the Indonesian Language. Data is analyzed descriptively qualitatively. The results of the study were (1) the exchange carried out by the Gebyog Village Government with the Gebyog Village community (the late Kasan Mulyadi, the late Muh Thulabi, and Marinah). The exchange occurred in 1977 and occurred verbally. The exchange occurred because residents complained to the Head of Gebyog Village that they wanted to have rice fields as their livelihood and the Gebyog Village Government also wanted to build an elementary school in Gebyog Village. (2) the existence of a double certificate on the Land Owned by Residents that was exchanged, two certificates were issued, namely when the land registration took place Kasan Mulyadi had died so that the one who registered it was Imam Ahmad. Intentionally or unintentionally, Imam Ahmad registered land that did not match the one he owned and in 1996 there was no plotting so it had not been mapped properly.

Abstract

Land is a very vital asset for every person and country. When viewed from the physical and value aspects of the soil, it is certainly a thing that has economic and political value in it. Problems that arise in the soil in Indonesia have been a very long time even since the time of the Netherlands because of its high value, problems often arise. For example, the Jepara Regency Government with its citizen named Tanto Untung and his heir Tanto Santoso has even reached the Court with Decision Nomo 19/Pdt.G/2020/PN Jepara. This research is carried out by means of qualitative research using a sociological juridical or empirical juridical approach. The sources used are primary and secondary sources obtained from observations, interviews, documentation and also literature studies. The results of this study show that there is a way of land acquisition carried out by the Jepara Regency Government that is known to the holder of the Certificate from which the land claim originated. The existence of two rights that exist on a piece of land without legal clarity is referred to as a double certificate. The registration of management rights processed by the Jepara Land Office which produced the management right certificate Number 6 of 1998 Jobokuto on behalf of the Jepara Regency Government without taking into account whether the land has or not causes an overlap of rights in the future. The heirs who do not know the land boundary are also a problem that the court decision by the Jepara Land Office cannot be implemented in accordance with the Minister of Agrarian Affairs Number 21 of 2020 concerning the Handling and Settlement of Land Cases, the Jepara Land Office by implementing the decision Number 19/Pdt.G/2020/PN Jpa
