Abstract

Directors often face dilemmas in making business decisions in buying and or selling assets, shares, investment, expansion because they have two sides of supervision. If they are always restrained by fear and fear in making decisions, the business movement will definitely be hampered. The approach method used in this research is a sociological juridical approach using secondary data and reinforced by primary data. Secondary data was obtained from laws and regulations and interviews with informants, and questionnaires who had served as Directors in BUMN, while secondary data was obtained from the statute approach and conceptual approach. The data obtained from this study were then analyzed qualitatively to answer the problems in this study. The results of this study indicate that the decision of the Board of Directors in business if it is based on good faith cannot be blamed, either civilly or criminally. However, if the Board of Directors is guilty (schuld) and/or negligent (culpoos), the members of the Board of Directors are fully responsible personally and jointly and severally (Article 97 paragraph (3), (4) and (5) of the Company Law). The Board of Directors personally can also be bankrupt so that it is not only PT that is obliged to pay its obligations, the Board of Directors must also be responsible for paying debts.

Abstract

Investigators of predicate crimes who are authorized to conduct ML investigations have determined in a limited manner, namely only appointing investigators from the State Police agency Republic of Indonesia, Attorney General's Office, Corruption Eradication Commission (KPK), National Narcotics Agency (BNN) and the Directorate General of Taxes and the Directorate of Customs and Excise of the Ministry of Finance Republic of Indonesia, meanwhile a TNI soldier, TNI Investigator is not on the list as an investigator for predicate crimes. The purpose of this study is to analyze the authority TNI investigators in conducting an investigation of money laundering offenses allegedly committed by Justisiabel Military Courts are still a problem, on the other hand there should be no omission of every act that violates the law in the pursuit of justice and legal certainty. Method The approach used in this research is a sociological juridical approach with using secondary data and reinforced by primary data. Secondary data obtained from interviews with resource persons, and questionnaires distributed to nurses in the District Sidoarjo, while secondary data were obtained from the statute approach and conceptual approach. The sampling method chosen is the purposive sampling method which is considered to be able to represent the population. The data obtained from this study were then analyzed qualitatively to answer the problems in this research. The results of this study indicate that according to the applicable procedural law within the Military Courts which are authorized to conduct an investigation into a criminal act allegedly committed by a Judicial Justicia he military is a TNI Investigator, it turns out that it can't be applied immediately in the process ML investigation because the Law (UU TPPU) has determined otherwise, in providing ML investigation authority.

Abstract

Determination of the status of evidence of crimes in military courts has the same legal implications as in general courts. Based on the provisions of Article 191 of Law 31 of 1997 concerning Military Courts, it is stated that "In the case of a sentencing decision or being free from all charges or acquittal from all legal charges, the Court stipulates that the confiscated evidence be handed over to the party most entitled to receive it back whose names are listed in the the decision, except if according to the provisions of the legislation, the evidence must be confiscated for the benefit of the state or destroyed or damaged so that it cannot be used anymore", but when the court decides that the evidence is returned to the rightful person, it often issues a decision that raises the question of who is entitled to it. . The purpose of this study is to analyze using the approach method used in this study is a juridical approach by conducting a comprehensive study based on laws and regulations and also empirical juridical research, namely conducting an assessment based on observations of several court decisions which until now have not been able to return of evidence to the rightful person. The results of this study indicate that according to the procedural law applicable in the Military Courts and general courts, it is necessary for the judge to confirm in the court's decision by stating who has the right so that there is legal certainty.

Abstract

Human rights, which are protected can be in the form of individuals, groups or property. The state or state officials as part of the state have an international obligation to protect citizens and their property, where international human rights standards are established and developed in various international forums. The purpose of this study is to review the Conventions related to Human Rights which guarantee the right of everyone to be treated equally before the law regardless of race, color, origin and ethnicity, which also establishes the Committee on the Elimination of Racial Discrimination, which oversees its implementation. Qualitative research uses a descriptive approach to collect data systematically, factually, and quickly according to the description when the research is carried out. The results of this study indicate that the Human Rights Principles provide guidance for law enforcers in prosecuting criminals. These principles emphasize the importance of oversight (including clarity in the chain of command) of law enforcement agencies. These principles also explain in detail the guarantee of the fulfillment of the right to life.

Abstract

Guidance for prisoners in Correctional Institutions is inseparable from a dynamic, which aims to provide more provisions for prisoners in returning the TNI's identity as before, namely being able to carry out their duties and responsibilities in the unit so that the Military Correctional Institution (Lemasmil) is the final stage of the system. law enforcement within the Military Courts. The purpose of this study was to determine whether the development of Military Prisoners in Military Correctional Institutions has been going well. Qualitative research uses a descriptive approach to collect data systematically, factually, and quickly according to the description when the research is carried out. The results of this study indicate that the separation of places to undergo punishment for military convicts from civilian convicts is absolutely necessary, because the Penitentiary for civilian prisoners is different in nature and the desired outcome with military convicts.

Abstract

It is reasonable to expect good judges to render decisions that uphold the law and demonstrate a sense of justice. The purpose of this study is to demonstrate how, if the Code of Ethics for Guidelines for Judges' Conduct (KEPPH) is followed in carrying out these responsibilities and in other contexts, both directly and indirectly, the perceptions and expectations of justice seekers will ultimately change. restored in the realization of military justice. noble, not cloudy, and free from sinful beliefs and actions. In qualitative research, data were collected methodically, factually, and quickly using descriptive methodology in accordance with the description at the time of the study. The findings of this study indicate that openness, participation, accountability, placing the right person in the right place, and objectivity must be prioritized in the recruitment and selection process to produce competent Military Judges. Although the recruitment and selection process has succeeded in producing Military Judges who uphold the principles of KEPPH and become God's representatives on earth, Military Judges are also human beings and therefore prone to error. Therefore, they require continuous education and training.
