Abstract

This research investigates the effectiveness of personal data protection policies in protecting human rights in the context of the technological era in Indonesia, using normative juridical analysis. The rapid advancement of digital technology has raised concerns regarding personal data protection, which directly impacts individuals' rights to privacy and freedom from exploitation. This research critically examines Indonesia's existing legal framework, including key regulations and the Personal Data Protection Bill, and assesses its alignment with international standards such as the GDPR. It identifies significant gaps and challenges in the current legal framework, including issues relating to law enforcement, public awareness, and the rapid pace of technological change. The findings suggest that while Indonesia has made progress in building a legal foundation for data protection, further improvements are needed to ensure robust protection for human rights in the digital age. The study concludes with recommendations to improve legal mechanisms to better protect individual rights in an ever-evolving technological landscape.

Abstract

Pelaksanaan keadilan di lingkungan militer memerlukan pengadilan militer tersendiri yang tidak hanya menegakkan keadilan militer murni, tetapi juga keadilan umum yang juga berlaku di militer. Tujuan penyidikan adalah untuk menunjukkan bahwa seseorang sedang diperiksa dan diadili dalam suatu perkara vonis. Militer yang merupakan komunitas khusus mempunyai budaya tersendiri yang berbeda dengan budaya masyarakat pada umumnya. Misalnya ada budaya yang mengharuskan bawahan menghormati atasannya, dan ada sanksi jika bawahan tidak menghormati atasannya. Metode penelitian kualitatif melibatkan pengumpulan data secara sistematis, objektif, dan tepat waktu, seperti yang dijelaskan pada saat penelitian. Hasil penelitian ini menunjukkan bahwa upaya penuntutan melalui pengadilan militer merupakan upaya terakhir (last resort) ketika upaya individu komandan untuk meningkatkan disiplin dan menegakkan keadilan disiplin tidak lagi cukup untuk mengatasinya. Oleh karena itu, pengadilan militer merupakan alat yang efektif untuk menjaga dan meningkatkan disiplin prajurit serta memastikan bahwa setiap prajurit siap menjalankan misi apa pun, kapan pun dan di mana pun.

This study employs VOSviewer to conduct a bibliometric analysis and visualize the intricate research landscape surrounding the themes of digitalization, cultural transformation, organizational practices, and the impact of global crises like the COVID-19 pandemic. Through a series of network density maps, the research identifies key thematic concentrations and academic collaborations over recent years. It reveals how digitalization intersects with various societal dimensions, influencing education, cultural heritage, sustainability, and business practices. The analysis emphasizes the role of digital technologies in facilitating significant social and organizational changes, advocating for policies that enhance digital literacy and inclusivity. Additionally, the examination of authorship networks sheds light on influential scholars and collaborative dynamics, providing insights that can guide future research directions. The study underscores the necessity for adaptive business models that integrate sustainability and resilience, crucial for navigating contemporary and future challenges.

Abstract

This study explores the interplay between digitalization and cultural identity with a focus on local traditions in the digital era, using a bibliometric approach. By analyzing academic publications from key databases, the research identifies trends, thematic clusters, and emerging areas of interest in this interdisciplinary field. Results indicate that "digitalization" and "digital transformation" serve as central themes, connecting topics such as cultural heritage, social media, and industry 4.0. The study reveals an evolving research focus, transitioning from foundational efforts in cultural preservation to contemporary issues like digital leadership, innovation, and sustainability. Network analyses highlight significant global collaborations, with dominant contributions from countries like the United States, China, and the United Kingdom. However, disparities in representation suggest a need for more inclusive research that incorporates perspectives from underrepresented regions. Emerging technologies such as AI and VR offer promising directions for future exploration, while the tension between globalization and localization underscores the importance of balancing cultural authenticity with modern adaptations. This study provides a comprehensive overview of the research landscape and offers practical implications for policymakers, cultural practitioners, and technologists in fostering sustainable cultural preservation in the digital era.

Abstract

The realisation of human rights constitutes a crucial element in the establishment of social justice and the safeguarding of individual dignity. In Indonesia, legal policies pertaining to human rights have evolved since the advent of the reform era, with the advent of numerous regulations and the establishment of institutions dedicated to the protection of human rights. This research employs a literature study method to analyze the impact of legal policies on human rights enforcement in Indonesia. The study analyzes relevant regulations, legal precedents, and academic literature to identify challenges and opportunities in the implementation of human rights policies. The findings reveal that, although Indonesia has witnessed significant advancements in the legislative realm, persistent challenges persist in ensuring consistent policy implementation. These obstacles encompass deficiencies in law enforcement, shortcomings in institutional competence, and the influence of political dynamics upon policy implementation. Hence, enhancements in legal governance and the fortification of human rights institutions are indispensable to guarantee the effective enforcement of human rights in Indonesia.

Abstract

The objective of this research project is to conduct an in-depth examination of the role of law in environmental dispute resolution within the context of urban Yogyakarta. By employing a qualitative methodology, this study examines the factors affecting the implementation of environmental legislation and the efficacy of legal instruments in addressing disputes. This study seeks to elucidate the role of law in environmental dispute resolution in Yogyakarta, examine the obstacles and impediments encountered in the implementation of environmental law, and analyse the efficaciousness of the existing dispute resolution mechanisms. To this end, it employs qualitative methods, with a particular focus on primary data obtained through observation, interviews, and documentation. The findings demonstrate that, despite an adequate legal framework, the efficacy of environmental dispute resolution is constrained by challenges inherent in law enforcement, public awareness, and economic considerations.

Abstract

Cybercrime refers to crimes conducted through computer networks and the internet, encompassing various illegal activities such as data theft, online fraud, hacking, and malware distribution. In Indonesia, regulations concerning cybercrime are primarily governed by Law Number 11 of 2008 on Electronic Information and Transactions (EIT Law), which was later amended by Law Number 19 of 2016. The handling of cybercrime in Indonesia has evolved alongside rapid digitalization, particularly in the financial, telecommunications, and social media sectors.This study aims to analyze the application of cybercrime laws in Indonesia and the challenges faced in law enforcement. Additionally, it examines the preventive efforts made by various stakeholders, including the government, private sector, and the public, through the strengthening of security infrastructure, digital literacy campaigns, and international collaboration in tackling cybercrime.The research methodology used in this study is normative juridical with a legislative and case study approach. The author examines various regulations, including the EIT Law and the Personal Data Protection Law, as well as notable cybercrime cases in Indonesia, such as ransomware attacks on hospitals and data theft in the banking sector.The study concludes that while Indonesia has a strong legal framework for addressing cybercrime, challenges remain in the ability of law enforcement to apply digital forensic technology, low public digital literacy, and suboptimal international cooperation. Therefore, strengthening law enforcement capacity, developing data protection policies, and increasing public awareness are necessary to address the growing cybercrime threat.

Abstract

The digital world's quick development has had a significant and wide-ranging effect on contemporary civilization. But this technical advancement also presents significant obstacles to the defense of human rights, especially in the areas of privacy, freedom of speech, and defense against cybercrimes. Despite the fact that Indonesia has a number of human rights laws, both domestic and international, the application of these laws in cyberspace frequently encounters difficulties. As a result, changing Indonesia's constitution is essential to guaranteeing the protection of people's fundamental rights online. The importance of revising Indonesia's constitution to protect human rights in the digital age is covered in this article, along with the opportunities and difficulties of putting these amendments into effect.

Abstract

The use of the death penalty in drug-related crimes remains a contentious issue globally, raising concerns about fundamental human rights and policies designed to curb drug trafficking. While some countries retain the death penalty as a tool to address drug offenses, citing its deterrent effect and its role in protecting public health, the human rights viewpoint strongly challenges such practices, focusing on the sanctity of the right to life. International legal frameworks set limits on the death penalty's application and urge states to refrain from actions deemed inhumane and ineffective. This article explores the implementation of the death penalty for drug crimes, considering both human rights perspectives and its relationship with international criminal law.

Abstract

This research aims to show the importance of the role of higher legal education in anticipating the negative impacts of technological advances, especially in the industrial era 4.0. Using a descriptive qualitative approach, this research examines how law, which often lags behind technological developments, can be adapted through educational modernization. The findings show that technology, such as AI and e-learning, has the potential to increase efficiency in the teaching-learning process and the justice system. However, ethical challenges and the need to adapt curricula that integrate information technology are important issues. In conclusion, the modernization of legal education is urgently needed to ensure the law is in line with technological advances while maintaining human values.ABSTRAKPenelitian ini bertujuan untuk menunjukkan pentingnya peran pendidikan tinggi hukum dalam mengantisipasi dampak negatif kemajuan teknologi, khususnya dalam era industri 4.0. Dengan pendekatan kualitatif deskriptif, penelitian ini mengkaji bagaimana hukum yang sering tertinggal dari perkembangan teknologi dapat diadaptasi melalui modernisasi pendidikan. Temuan menunjukkan bahwa teknologi, seperti AI dan e-learning, berpotensi meningkatkan efisiensi dalam proses belajar-mengajar dan sistem peradilan. Namun, tantangan etis serta perlunya adaptasi kurikulum yang mengintegrasikan teknologi informasi menjadi isu penting. Kesimpulannya, modernisasi pendidikan hukum sangat dibutuhkan untuk memastikan hukum selaras dengan kemajuan teknologi sekaligus menjaga nilai-nilai kemanusiaan.
