Abstract

Background. Background This research is based on the need for an effective alternative for the resolution of civil disputes in the District Court due to the problems that often arise in the conventional justice system. Mediation has been considered as one of the promising alternatives, but there has been no thorough evaluation of how effective this method is in the context of the District Court. Purpose. This study aims to quantitatively evaluate how effective mediation is as an alternative to civil dispute resolution in the District Court. Method. The quantitative method collects data through surveys and interviews with mediation participants. The aim was to determine how effective mediation is as an alternative to civil dispute resolution in the district courts. The data collected was then analyzed to identify factors that influence the success of mediation. Results. This study shows the success rate of mediation as a civil dispute resolution option in the District Court and the factors that influence the outcome. Conclusion. This study found that mediation can serve as an effective alternative to civil dispute resolution in the District Court. However, the study also emphasizes that further attention is needed to the factors that determine the success of mediation. The research also provides a basis for policy and practice recommendations that can improve the success of mediation in civil dispute resolution in the District Courts.

Abstract

This study seeks to analyse the constitutional provisions on political neutrality within the framework of Indonesia's democratic process, particularly as it pertains to the establishment and upkeep of a democratic society founded on social fairness and the preeminence of legal principles. This study examines applicable laws, legal theories, and police procedures via a normative-philosophical and descriptive analytical lens. Findings highlight the need of political neutrality in state administration and bureaucracy for maintaining a just and fair democracy. Government impartiality and honesty can only be restored by overhauls to political ethics and the inner workings of bureaucratic politics. In light of Pancasila and the Constitution of the Unitary State of the Republic of Indonesia (1945), this conclusion stresses the need of cooperation across different parts of the country in order to establish a national legal system that upholds democracy and social justice.

Abstract

Military justice is the executor of judicial power within the armed forces to uphold law and justice by taking into account the interests of administering national defense. Article 7 of Law Number 31 of 1997 states that organizational and procedural, administrative and financial guidance for court and judiciary bodies is carried out by the Commander in Chief. This guidance must not reduce the freedom of judges in examining and deciding cases. The aim of this research is to show that Article 9 number 1 which is linked to Articles 1 and 2 of the KUHPM above, can be concluded that the absolute competence of military justice which is based on the subject of criminal acts has placed soldiers as a very special group because almost all violations and crimes those committed by soldiers will be brought under the realm of military justice. Qualitative research uses a descriptive approach to collect data systematically, factually, and quickly according to the description at the time of the research. The results of this research show that the determination of absolute competency based on the severity of the loss can be said to be in line with what is stated in Article 3 paragraph (4) letter a TAP MRP Number VII of 2000 concerning the Role of the Indonesian National Army and the Role of the National Police of the Republic of Indonesia which states "Indonesian National Army soldiers are subject to the powers of the general judiciary in matters of general criminal offences."

Abstract

It is reasonable to expect good judges to render decisions that uphold the law and demonstrate a sense of justice. The purpose of this study is to demonstrate how, if the Code of Ethics for Guidelines for Judges' Conduct (KEPPH) is followed in carrying out these responsibilities and in other contexts, both directly and indirectly, the perceptions and expectations of justice seekers will ultimately change. restored in the realization of military justice. noble, not cloudy, and free from sinful beliefs and actions. In qualitative research, data were collected methodically, factually, and quickly using descriptive methodology in accordance with the description at the time of the study. The findings of this study indicate that openness, participation, accountability, placing the right person in the right place, and objectivity must be prioritized in the recruitment and selection process to produce competent Military Judges. Although the recruitment and selection process has succeeded in producing Military Judges who uphold the principles of KEPPH and become God's representatives on earth, Military Judges are also human beings and therefore prone to error. Therefore, they require continuous education and training.

Abstract

The provision of suspensions and administrative sanctions is intended as an effort to develop personnel and provide a deterrent effect for law violators, and to prevent other TNI soldiers from imitating them. The aim of this research is to show that TNI soldiers are different from civilians who are only bound by general legal rules, TNI soldiers are not only bound by general legal rules but also bound by military legal rules (military disciplinary law and military criminal law), so it can be said that it is not easy. for a TNI soldier when faced with the implementation of legal regulations. Qualitative research uses a descriptive approach to collect data systematically, factually and quickly according to the description at the time of the research. The results of this research show that TNI soldiers who violate the law are subject to suspension and administrative sanctions are two things that are closely related to the legal process and personnel development. This condition causes special burdens for a TNI soldier who violates the law because it impacts his career and income.

Abstract

Law enforcement within the TNI is carried out jointly in a military criminal justice system, which involves several elements, including: Investigators, Ankum, Prosecutors and Papera. Papera/unit commanders have the obligation to guide soldiers in determining their careers according to the competencies required by TNI regulations. The desire and hope of a Papera/unit commander is for the subordinates/soldiers under him to do their best for the progress of the TNI organization he leads, but in fact, for some reason, there are some Soldiers who violate the laws and regulations, by committing criminal acts. The aim of this research is to show that superiors who have the right to punish (Ankum)/unit commanders have the obligation to guide soldiers in determining their careers according to the competencies required by regulations within the TNI. The desire and hope of a unit commander is for the subordinates/soldiers under him to do their best for the progress of the TNI organization he leads, but in fact, for some reason, there are some Soldiers who violate the laws and regulations, by committing criminal acts. Qualitative research uses a descriptive approach to collect data systematically, factually, and quickly according to the description at the time of the research. The results of this research show that in the ongoing legal process, superiors who have the right to punish (Ankum) and Papera have 2 (two) paths in an effort to defend their service members from being punished or dishonorably dismissed (fired) due to considerations of military interests. with several considerations such as the TNI soldier having abilities that are really needed by the unit, the TNI soldier being assessed for good behavior on a daily basis or other considerations, so that Ankum can try through these 2 (two) paths, namely providing recommendations to be retained as a TNI soldier and submitting efforts law according to statutory regulations.

Abstract

Permasalahan penelitian yaitu tentang Pengadaan lahan tanah untuk pembangunan satuan-satuan baru Kodam XVIII Kasuari di wilayah Papua Barat menemui permasalahan yang unik karena dinamika penguasaan, pemilikan, penggunaan, pemanfaatan dan bahkan pelepasan hak ulayat masyarakat adat atas tanah, selalu berubah-rubah mengikuti pola perubahan tingkah laku masyarakat atas penguasaan, pemilikan, penggunaan dan pemanfaatan tanah tersebut. Kebiasaan praktis sehari-hari di Papua, terutama jika terjadi transaksi jual beli tanah (peralihan hak) sering terjadi penuntutan kembali oleh masyarakat adat terhadap tanah adat/ulayat yang telah dipergunakan untuk pembangunan kepentingan umum seperti bandara, kantor-kantor pemerintah, padahal pada saat pembangunannya masyarakat adat tersebut sudah mendapatkan ganti rugi, disuatu sisi diperlukannya kepastian hukum dalam gelar organisasi Kodam XVIII Kasuari. Penelitian ini bertujuan untuk memberikan gambaran untuk memberikan gambaran dan menganalisis dampak dan upaya terhadap hak ulayat masyarakat hukum adat dalam gelar kekuatan satuan di jajaran Kodam XVIII Kasuari di Provinsi Papua Barat. Penelitian menggunakan metode kualitatif. Data diperoleh dari para informan yang ditetapkan yang selanjutnya dianalisis dengan teknik analisis kualitatif berdasarkan studi kasus guna mengungkap permasalahan yang ada. Hasil penelitian menunjukkan bahwa melalui PP No. 19 tahun 2021 masyarakat adat memiliki kesempatan berhubungan langsung dengan pihak penyelenggaraan pengadaan tanah dan menerima uang ganti rugi sesuai nilai apprisal yang dikeluarkan agar di kemudian hari tidak menjadi permasalahan yang berkepanjangan seperti yang terjadi selama ini. Upaya-upaya yang dapat dilakukan oleh Kodam XVIII Kasuari adalah dengan merumuskan strategi penyelesaian aset tanah Kodam XVIII Kasuari yang sesuai dengan aturan PP No. 19 tahun 2021 dari mulai pembentukan tim penataan aset tanah yang menyusun konsep dari mulai tahap perencanaan, persiapan, pelaksanaan dan pengakhiran. Kesimpulan dari penelitian ini perlunya keseriusan antar stakeholder terkait penataan aset tanah di wilayah Papua Barat agar kepentingan pertahanan negara dapat terwujud sesuai dengan aturan perundang-undangan yang berlaku

Abstract

In the effort to eradicate terrorism, the security dimension is thick in the policy of eradicating terrorism. Civil society is worried about the material of the 2018 Law Number 5 concerning the Eradication of Criminal Acts of Terrorism, it is considered that the Act can reduce the level of state compliance with respect, protection, and fulfillment of human rights in eradicating terrorism, in addition to the effectiveness of the method of eradicating terrorism. The purpose of this study is to provide an overview and analysis of the form of the threat that has undergone a shift that requires the army as the main component of the defense system to reposition itself by placing itself in the right position in the midst of the dynamics of developing threats. The method in this research is normative juridical through a comprehensive study by taking sources from regulations and laws, while empirical juridical research is a study based on observations on threats involving the TNI. The theory used is the Theory of Authority and Theory of Rule of Law as the theoretical basis for the analysis of the main problems regarding the change of the army from a conqueror to a professional soldier. The military does not intervene in politics and conversely there is no political intervention in the military. Law of 2004 Number 34 concerning the TNI states that the Indonesian National Army was built and developed professionally according to the country's political interests, referring to the principles and values of democracy, human rights, civil supremacy, provisions of national and international laws that have been ratified.

Objective study For the analysis of the implementation of environmental law and environmental conservation efforts in Indonesia, the methods used are method study qualitative and type study studies. Types of studies References used for digging deep understanding about a topic or phenomenon with analyzing literature And where are the relevant sources? in study This is related to the implementation of environmental laws and environmental conservation efforts in Indonesia. As for the data, it was obtained through the study and analysis of various references, like journals, scientific articles, and documents related to the topic being researched. Then, the researcher read an interesting thread and concluded from the results, findings, and study. Results study This leads to a conclusion. In the context of implementing environmental law and environmental conservation efforts in Indonesia, this research identifies a number of key aspects. Implementation of environmental law is faced with a number of challenges, including conflicts of interest, unequal access to the law, and differences in capacity at the regional government level. However, environmental conservation efforts in Indonesia also show positive initiatives, such as natural habitat conservation, reforestation programs, and renewable energy development. Technological and social innovations are key to increasing the effectiveness of conservation efforts.

Abstract

During the General Election, the problem of political polarization is a recurring problem and must be resolved immediately. To overcome this problem, the role of social media is very necessary. Based on this, this research aims to analyze the role of social media in overcoming the problem of political polarization during the General Election. This research is qualitative research with a descriptive approach. The data used in this research is secondary data obtained from scientific journals, books, websites and all sources that should be used in every research. The results of this research show that first, social media is like a knife that can become a weapon to protect yourself and others and can also injure yourself and those around you. Second, polarization is caused by ethnic factors, cults, fanaticism and abuse of authority by those in power. Third, social media can play a role by prohibiting campaigns containing SARA, focusing on vision and mission, and increasing educational content.
