Abstract

Cybercrime refers to crimes conducted through computer networks and the internet, encompassing various illegal activities such as data theft, online fraud, hacking, and malware distribution. In Indonesia, regulations concerning cybercrime are primarily governed by Law Number 11 of 2008 on Electronic Information and Transactions (EIT Law), which was later amended by Law Number 19 of 2016. The handling of cybercrime in Indonesia has evolved alongside rapid digitalization, particularly in the financial, telecommunications, and social media sectors.This study aims to analyze the application of cybercrime laws in Indonesia and the challenges faced in law enforcement. Additionally, it examines the preventive efforts made by various stakeholders, including the government, private sector, and the public, through the strengthening of security infrastructure, digital literacy campaigns, and international collaboration in tackling cybercrime.The research methodology used in this study is normative juridical with a legislative and case study approach. The author examines various regulations, including the EIT Law and the Personal Data Protection Law, as well as notable cybercrime cases in Indonesia, such as ransomware attacks on hospitals and data theft in the banking sector.The study concludes that while Indonesia has a strong legal framework for addressing cybercrime, challenges remain in the ability of law enforcement to apply digital forensic technology, low public digital literacy, and suboptimal international cooperation. Therefore, strengthening law enforcement capacity, developing data protection policies, and increasing public awareness are necessary to address the growing cybercrime threat.

Abstract

The digital world's quick development has had a significant and wide-ranging effect on contemporary civilization. But this technical advancement also presents significant obstacles to the defense of human rights, especially in the areas of privacy, freedom of speech, and defense against cybercrimes. Despite the fact that Indonesia has a number of human rights laws, both domestic and international, the application of these laws in cyberspace frequently encounters difficulties. As a result, changing Indonesia's constitution is essential to guaranteeing the protection of people's fundamental rights online. The importance of revising Indonesia's constitution to protect human rights in the digital age is covered in this article, along with the opportunities and difficulties of putting these amendments into effect.

Abstract

The use of the death penalty in drug-related crimes remains a contentious issue globally, raising concerns about fundamental human rights and policies designed to curb drug trafficking. While some countries retain the death penalty as a tool to address drug offenses, citing its deterrent effect and its role in protecting public health, the human rights viewpoint strongly challenges such practices, focusing on the sanctity of the right to life. International legal frameworks set limits on the death penalty's application and urge states to refrain from actions deemed inhumane and ineffective. This article explores the implementation of the death penalty for drug crimes, considering both human rights perspectives and its relationship with international criminal law.

Abstract

This research aims to show the importance of the role of higher legal education in anticipating the negative impacts of technological advances, especially in the industrial era 4.0. Using a descriptive qualitative approach, this research examines how law, which often lags behind technological developments, can be adapted through educational modernization. The findings show that technology, such as AI and e-learning, has the potential to increase efficiency in the teaching-learning process and the justice system. However, ethical challenges and the need to adapt curricula that integrate information technology are important issues. In conclusion, the modernization of legal education is urgently needed to ensure the law is in line with technological advances while maintaining human values.ABSTRAKPenelitian ini bertujuan untuk menunjukkan pentingnya peran pendidikan tinggi hukum dalam mengantisipasi dampak negatif kemajuan teknologi, khususnya dalam era industri 4.0. Dengan pendekatan kualitatif deskriptif, penelitian ini mengkaji bagaimana hukum yang sering tertinggal dari perkembangan teknologi dapat diadaptasi melalui modernisasi pendidikan. Temuan menunjukkan bahwa teknologi, seperti AI dan e-learning, berpotensi meningkatkan efisiensi dalam proses belajar-mengajar dan sistem peradilan. Namun, tantangan etis serta perlunya adaptasi kurikulum yang mengintegrasikan teknologi informasi menjadi isu penting. Kesimpulannya, modernisasi pendidikan hukum sangat dibutuhkan untuk memastikan hukum selaras dengan kemajuan teknologi sekaligus menjaga nilai-nilai kemanusiaan.

Abstract

This research aims to analyze the role of law as an instrument of modernization in sustainable rural development in Indonesia. The problem faced is the lack of legal protection for rural communities, especially vulnerable groups such as women and children, as well as the inability of existing legal policies to be effectively implemented in the field. This research uses a qualitative method with a juridical sociological approach, collecting data from document analysis of laws and policies related to village development. The results show that the involvement of village communities and the support of NGOs are essential to improve the effectiveness of legal protection and development sustainability. In conclusion, strong legal protection and government and NGO collaboration are needed to create inclusive and sustainable rural development.ABSTRAKPenelitian ini bertujuan untuk menganalisis peran hukum sebagai instrumen modernisasi dalam pembangunan pedesaan yang berkelanjutan di Indonesia. Persoalan yang dihadapi adalah kurangnya perlindungan hukum bagi masyarakat desa, terutama kelompok rentan seperti perempuan dan anak-anak, serta ketidakmampuan kebijakan hukum yang ada untuk diterapkan secara efektif di lapangan. Penelitian ini menggunakan metode kualitatif dengan pendekatan yuridis sosiologis, mengumpulkan data dari analisis dokumen peraturan perundang-undangan dan kebijakan terkait pembangunan desa. Hasil penelitian menunjukkan bahwa keterlibatan masyarakat desa dan dukungan NGO sangat penting untuk meningkatkan efektivitas perlindungan hukum dan keberlanjutan pembangunan. Kesimpulannya, perlindungan hukum yang kuat dan kolaborasi pemerintah serta NGO diperlukan untuk menciptakan pembangunan pedesaan yang inklusif dan berkelanjutan.

Abstract

Penyalahgunaan wewenang tidak hanya melibatkan aspek hukum, tetapi juga etika dan moral dalam menjalankan tugas sebagai pejabat publik. Penyalahgunaan wewenang oleh pejabat publik adalah pelanggaran serius yang harus ditangani dengan tegas. Tindakan ini tidak hanya merugikan masyarakat, tetapi juga mencederai prinsip-prinsip hukum yang mendasari tata kelola pemerintahan yang baik. Penyalahgunaan wewenang dapat didefinisikan sebagai tindakan seorang pejabat publik yang menggunakan kekuasaan yang dimilikinya tidak sesuai dengan ketentuan hukum dan untuk kepentingan pribadi atau pihak tertentu, sehingga merugikan kepentingan publik. Penerapan prinsip-prinsip hukum administrasi negara dan teori yang relevan sangat penting untuk mencegah dan menindaklanjuti tindakan tersebut. Upaya preventif dan penegakan hukum yang efektif sangat diperlukan untuk menjaga integritas pemerintahan dan kepercayaan publik. Penyalahgunaan wewenang oleh pejabat publik dapat berakibat pada sejumlah konsekuensi hukum, yang antara lain tindakan Administratif semisal pemecatan atau pencopotan dari jabatannya, tuntutan secara Pidana, melakukan ganti rugi dan juga pengawasan serta audit, dan juga pemberian sanksi disiplin.

Abstract

Diskresi dalam konteks hukum administrasi negara merupakan konsep penting yang memberikan fleksibilitas kepada pejabat publik untuk mengambil keputusan dalam situasi yang tidak diatur secara jelas oleh hukum. Menurut hukum administrasi negara meskipun diskresi memberi kebebasan, keputusan yang diambil tetap harus sesuai dengan prinsip legalitas dan tidak boleh bertentangan dengan hukum yang berlaku. Menurut hukum administrasi negara terhadap kebijakan diskresi menekankan pentingnya keseimbangan antara fleksibilitas dalam pengambilan keputusan dan kepatuhan terhadap prinsip-prinsip hukum. Diskresi yang dikelola dengan baik dapat meningkatkan efisiensi dan responsivitas pemerintah, sementara pengawasan yang ketat dapat mencegah penyalahgunaan dan memastikan keadilan. Diskresi dalam konteks hukum administrasi negara ini merupakan konsep penting yang memberikan fleksibilitas kepada pejabat publik untuk mengambil keputusan dalam situasi yang tidak diatur secara jelas oleh hukum. Sehingga dapat melihat betapa vitalnya diskresi dalam proses pemerintahan yang responsif. Namun dibalik itu semua diskresi juga memiliki kekurangan atau keterbatasan dalam pengaplikasiannya.

Abstract

This paper explores the influence of social justice movements on public policy and community empowerment in Indonesia through a juridical analysis. By examining key legal documents, court rulings, and government policies, the study assesses how social justice movements have shaped the legal landscape in areas such as labor rights, environmental protection, and gender equality. The findings reveal that social justice movements have successfully influenced the development of laws and policies aimed at addressing systemic inequalities, though challenges remain in their implementation. Furthermore, the research highlights how these movements have empowered marginalized communities by providing them with the tools and resources to advocate for their rights. The study concludes that while social justice movements have made significant strides in influencing public policy, continuous efforts are needed to ensure effective enforcement and sustained community empowerment.

Abstract

The law education program implemented in Cempaka Putih Subdistrict, East Jakarta, aims to increase legal awareness among the community, particularly those aged 23-60 who do not have a permanent job. This program uses interactive presentation methods and participatory discussion to facilitate a deeper understanding of citizens' rights and obligations. The results of the program's implementation show a significant increase in participants' understanding of law, as reflected in a survey that shows a surge in awareness and ability to resolve legal conflicts peacefully. The program also successfully increased community participation and built a stronger legal support network among participants. The positive response from the community and requests for further programs demonstrate the program's success and relevance in empowering the community. Through a suitable approach, this law education program has had a positive impact, reducing minor legal issues, and promoting active participation in social and economic activities. Therefore, the development of additional materials is necessary to further explore more specific legal issues, ensuring the continuation of the program's benefits for the community of Cempaka Putih Subdistrict Abstrak Penyuluhan hukum yang dilaksanakan di Kecamatan Cempaka Putih, Jakarta Timur, bertujuan untuk meningkatkan kesadaran hukum masyarakat, khususnya mereka yang tidak memiliki pekerjaan tetap berusia 23-60 tahun. Program ini menggunakan metode presentasi interaktif dan diskusi partisipatif untuk memfasilitasi pemahaman yang lebih dalam tentang hak dan kewajiban warga negara. Hasil pelaksanaan menunjukkan peningkatan signifikan dalam pemahaman hukum peserta, dengan hasil survei yang memperlihatkan lonjakan kesadaran dan kemampuan menyelesaikan konflik hukum secara damai. Program ini juga berhasil meningkatkan partisipasi komunitas dan membangun jaringan dukungan hukum yang lebih kuat di kalangan peserta. Respon positif dari masyarakat dan permintaan untuk program lanjutan menunjukkan keberhasilan dan relevansi program ini dalam memberdayakan masyarakat. Melalui pendekatan yang tepat, program penyuluhan ini memberikan dampak positif yang nyata, mengurangi permasalahan hukum kecil, dan mendorong partisipasi aktif dalam kegiatan sosial dan ekonomi. Oleh karena itu, pengembangan materi lanjutan diperlukan untuk lebih mendalami isu-isu hukum yang lebih spesifik, memastikan keberlanjutan manfaat program bagi masyarakat Kecamatan Cempaka Putih.

Abstract

A ruling by the Constitutional Court constitutes a judicial product, necessitating harmonization and synchronization between the Constitutional Court's decisions and subordinate regulations. This process is essential for the legislative body to ensure legal coherence. This study aims to demonstrate that insufficient communication between institutions may impede the timely alignment and harmonization of laws amended by the Constitutional Court with regulations beneath the statutory level, thereby creating conflicts among legal provisions. This qualitative research employs a descriptive approach to systematically and factually collect data, reflecting the situation during the study. The findings underscore the critical need to harmonize derivative legal products after Constitutional Court rulings.
