Abstract

Mahkamah Konstitusi (MK) merupakan lembaga yudikatif yang memiliki kewenangan dalam melakukan pengujian perundang-undangan guna memastikan bahwa setiap regulasi yang berlaku tidak bertentangan dengan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 (UUD 1945). Salah satu instrumen utama dalam menjalankan tugasnya adalah mekanisme judicial review, yang memungkinkan MK untuk menilai dan membatalkan undang-undang yang dianggap inkonstitusional. Penelitian ini bertujuan untuk menganalisis peran MK dalam judicial review, efektivitasnya dalam melindungi hak konstitusional warga negara, serta tantangan yang dihadapinya dalam menjalankan tugasnya. Hasil penelitian menunjukkan bahwa MK memainkan peran penting dalam menjaga supremasi konstitusi dan demokrasi di Indonesia, meskipun terdapat tantangan signifikan, seperti tekanan politik dan kontroversi terhadap beberapa putusan yang dikeluarkan. Studi ini menyoroti pentingnya menjaga independensi MK agar tetap mampu menjalankan tugasnya secara optimal. Oleh karena itu, diperlukan langkah-langkah strategis untuk memperkuat posisi MK sebagai lembaga yang berorientasi pada perlindungan hak konstitusional dan penegakan hukum yang adil.

Abstract

The digital world's quick development has had a significant and wide-ranging effect on contemporary civilization. But this technical advancement also presents significant obstacles to the defense of human rights, especially in the areas of privacy, freedom of speech, and defense against cybercrimes. Despite the fact that Indonesia has a number of human rights laws, both domestic and international, the application of these laws in cyberspace frequently encounters difficulties. As a result, changing Indonesia's constitution is essential to guaranteeing the protection of people's fundamental rights online. The importance of revising Indonesia's constitution to protect human rights in the digital age is covered in this article, along with the opportunities and difficulties of putting these amendments into effect.

Abstract

The use of the death penalty in drug-related crimes remains a contentious issue globally, raising concerns about fundamental human rights and policies designed to curb drug trafficking. While some countries retain the death penalty as a tool to address drug offenses, citing its deterrent effect and its role in protecting public health, the human rights viewpoint strongly challenges such practices, focusing on the sanctity of the right to life. International legal frameworks set limits on the death penalty's application and urge states to refrain from actions deemed inhumane and ineffective. This article explores the implementation of the death penalty for drug crimes, considering both human rights perspectives and its relationship with international criminal law.

Abstract

International Humanitarian Law (IHL) serves as a vital normative framework aimed at regulating armed conflict, protecting civilians, and limiting unnecessary suffering. While its principles are well-established, contemporary warfare poses significant challenges to its implementation. Advances in technology, asymmetrical tactics, and evolving military doctrines often create tensions between operational objectives and legal obligations. This study adopts a sociological perspective to explore the interaction between IHL norms and military practice, focusing on how legal rules are interpreted, negotiated, or contested within armed forces and broader society. Using qualitative methods, including case studies of recent conflicts, the research examines factors influencing compliance with IHL, such as organizational culture, societal attitudes, and political pressures. The findings indicate that, although IHL remains a cornerstone of international normative order, its effectiveness is contingent on social, political, and institutional contexts. Recognizing these sociological dimensions is crucial for enhancing the legitimacy, enforcement, and adaptability of IHL, ensuring it continues to provide meaningful protection in increasingly complex and technologically driven warfare environments.

Abstract

This article examines the complex interactions between the military and civil society in regions affected by conflict, approached from a sociological-legal perspective. The study seeks to understand how military power influences civil society, the ways in which legal and social legitimacy are established, and how local communities respond military presence and control. Employing a qualitative case-study methodology, the research utilized in-depth interviews with community members and military personnel, extensive field observations, and detailed analysis of relevant legal documents. The findings reveal that military power structures significantly impact civil rights, security, and social dynamics, with interactions ranging from cooperative engagement to open conflict. Furthermore, the legitimacy military actions closely linked factors such operational performance, transparency, accountability, and social acceptance by local populations. Based on these insights, the article argues for the importance improving communication channels between military forces and communities, integrating formal legal frameworks with local norms and practices, and actively involving community members in security and governance programs. These measures are proposed as strategies to enhance the legitimacy of military operations, reduce conflict, and promote long-term social stability. The study contributes the broader understanding of civil-military relations by highlighting the sociological and legal dimensions of military influence in conflict-affected areas.

Abstract

Law Number 3 of 2002 concerning National Defense states that the General Policy on National Defense functions as a guideline for the management, implementation and supervision of national defense. The aim of this study is to show that the various players participating in state practices require organizing the implementation of national security through integrated mechanisms that consider all factors to produce the best results. To create national security, it is necessary to combine the capabilities of the entire country, including security forces, law enforcement, government agencies and the entire community. In qualitative research, data is collected methodically, factually and quickly using descriptive methodology according to the description at the time of the research. The findings of this research show that the TNI's task is to fight all military and armed disturbances, both domestically and internationally. Therefore, the TNI is also tasked with dealing with deviant beliefs and other armed conflicts that occur in Indonesia, such as what happened in Papua.
