Abstract

In carrying out its duties, the TNI is given the authority to use firearms in accordance with existing military equipment standards. The TNI limits the use of firearms to prevent misuse, namely in peaceful or non-combat conditions. The aim of this research is to show that every member of the TNI actually has the same position as ordinary people who are not members of the military, but as members of the TNI apart from being subject to the legal rules that apply in society. Qualitative research uses a descriptive approach to collect data systematically, factually, and quickly according to the description at the time of the research. The results of this research show that the aim of implementing licensing, supervision and control of military standard firearms is to create a management system that is well structured and correct according to procedures and can be accounted for, so that there is no misuse of firearms and/or ammunition.

Abstract

Climate change, especially the threat to the outermost small islands, has a significant impact on Indonesia's national resilience. The worsening climate crisis has the potential to threaten the survival of coastal communities, trigger tensions in border areas, and worsen the social and economic situation through mass migration. This study aims to analyze the threat of the climate crisis to the outermost small islands and its implications for Indonesia's national defense and security. The method used is a normative legal analysis with a statutory, conceptual, and case approach, with deductive reasoning. The findings show that Indonesia, as the largest archipelagic country, faces real threats due to climate change, such as rising sea levels that can submerge many outermost small islands. This threat has the potential to affect territorial sovereignty, economic stability, and food security, and can trigger social and international conflicts. This study also identifies the need for mitigation policies, including the New and Renewable Energy Bill, and the Climate Change Management Bill, to reduce greenhouse gas emissions and strengthen the country's resilience to the impacts of climate change.

Abstract

Examined through the prism of national security, the imperative emerges for the Indonesian National Armed Forces (TNI) to play a central role in addressing conflicts in Papua, harmonizing effectively with their fundamental mission of promoting the well-being of the local populace. This study aims to establish that achieving resolution in Papua necessitates the implementation of two parallel approaches. In this study, the researcher employs a qualitative method with a descriptive approach. The data is systematically, factually, and expeditiously collected following the contextual conditions prevalent during the research period. The findings underscore the viability of conflict resolution in Papua through the dual avenues of military operations for war and military operations other than war, both executed by the TNI soldiers.

Abstract

This study conducts a bibliometric evaluation of open access publishing in the realm of intellectual property rights (IPR), aiming to provide insights into the landscape, trends, and potential research directions within this domain. Utilizing data spanning from 1970 to 2024, encompassing 1000 papers with 9684 citations, the analysis employs network visualization, cluster analysis, and trend examination techniques. The results highlight the collaborative nature of scholarly endeavors in IPR, with key themes emerging around the economic implications of IPR, its intersection with global trade, biotechnology, and human rights. These findings offer valuable insights for researchers, policymakers, and practitioners, facilitating evidence-based decision-making and promoting transparency and accessibility in the dissemination of IPR-related knowledge.

Abstract

This research examines the ethical and legal implications of deploying Artificial Intelligence (AI) systems in law enforcement, with a particular focus on potential human rights violations in Indonesia. Utilizing a normative analysis approach, the study evaluates existing ethical frameworks, legal principles, and human rights standards to assess the governance and implications of AI-driven policing. Key findings indicate significant ethical concerns, including bias, discrimination, lack of transparency, and privacy violations. The legal analysis reveals gaps in Indonesia’s regulatory framework, highlighting the need for specific legislation to address AI’s complexities. Human rights implications, such as threats to privacy, freedom of expression, and equality, are critically analyzed. Comparative case studies from other jurisdictions provide empirical insights and underscore the importance of robust ethical and legal frameworks. The research proposes several recommendations, including the establishment of clear ethical guidelines, strengthening legal frameworks, enhancing transparency and accountability, promoting public engagement, and conducting regular impact assessments to ensure responsible AI governance in law enforcement. This study aims to contribute to the development of ethical AI governance frameworks and inform policy recommendations for responsible AI deployment in law enforcement practices.

Abstract

This study examines the constitutional obligation of the Indonesian state to guarantee equal access to education through a juridical normative analysis. Education in Indonesia is not only a social necessity but also a fundamental right enshrined in Article 31 of the 1945 Constitution, which mandates the government to organize and ensure an equitable national education system. The research uses a normative juridical approach by analyzing constitutional provisions, statutory regulations, and Constitutional Court decisions related to education and equality. The findings reveal that the Constitution provides a strong legal foundation for the right to education and equality before the law, supported by instruments such as Law No. 20 of 2003 on the National Education System and the constitutional requirement of allocating 20% of the national budget to education. However, challenges persist in implementation, including regional disparities, unequal resource distribution, and weak legal enforcement mechanisms. The study concludes that the realization of educational equality requires stronger legal accountability, equitable fiscal policy, and institutional consistency between constitutional norms and their practical execution. Strengthening constitutional integrity through judicial oversight and human rights–based education policies is essential to achieving the constitutional goal of “educating the life of the nation”.

Abstract

The work of dentists has been regulated in the Regulation of the Minister of Health Number 39 of 2014 concerning Coaching, Supervision and Licensing, Dentist Work. The authority of the dentist only makes and installs removable dentures, either partially or fully, using heat curing acrylic material and meets the health element where it does not cover the remaining tooth roots. Although the standard of work and authority of dentists has been regulated, many dentists ignore it by doing work outside of their authority and often do not meet medical rules in practice. This can certainly cause losses for consumers, both material and immaterial losses. There must be a balance between the accountability carried out by dentists and legal protection for consumers of dentist services who feel disadvantaged so that consumers are not always in a weak position. The research conducted is normative juridical and carried out with several approaches such as legislation, conceptual and case study approaches. Primary, secondary and tertiary data are used to answer the problems of this study. The results of this study show that the accountability of dentists can be carried out in the form of administrative law, civil law and criminal law. Consumer protection has been regulated in Law Number 8 of 1999. Dentist consumer protection is carried out by providing compensation. In addition, it can also be done by holding coaching and supervision carried out by the government.

Abstract

Penelitian ini menyelidiki tantangan dan prospek perlindungan hukum dan hak asasi manusia bagi pengungsi Rohingya di Indonesia dari sudut pandang masyarakat Indonesia, dengan menggunakan analisis kualitatif. Melalui wawancara mendalam dengan para pengungsi Rohingya, ahli hukum, perwakilan LSM, dan anggota masyarakat Indonesia, penelitian ini menyoroti berbagai dimensi dari pengalaman pengungsi. Temuan-temuan yang ada menunjukkan adanya tantangan hukum yang signifikan, termasuk rintangan birokrasi, keterbatasan akses terhadap pendampingan hukum, dan masalah dokumentasi. Situasi hak asasi manusia ditandai dengan hambatan terhadap pendidikan, perawatan kesehatan, dan pekerjaan, ditambah dengan diskriminasi dan tantangan sosial-ekonomi. Meskipun ada optimisme yang hati-hati untuk perbaikan, kekhawatiran tentang kemauan politik tetap ada. Perspektif masyarakat bervariasi, dipengaruhi oleh pembingkaian media, pendidikan, dan eksposur. Penelitian ini menggarisbawahi pentingnya kebijakan, advokasi, dan pelibatan masyarakat yang disesuaikan untuk meningkatkan kesejahteraan dan integrasi pengungsi Rohingya di Indonesia.

Abstract

Ketentuan mengenai pemberhentian tidak dengan hormat diatur dalam Pasal 53 ayat (1) Peraturan Pemerintah Nomor 39 Tahun 2010 tentang Administrasi Prajurit TNI, yang mengatur pemberhentian tidak dengan hormat dari dinas keprajuritan, sebagai pelaksanaan ketentuan pasal 62 ayat (3) UU Nomor 34 Tahun 2004 tentang Tentara Nasional Indonesia. Tujuan penelitian ini untuk menunjukan bahwa norma penjatuhan pidana tambahan pemecatan oleh Hakim dalam sidang pengadilan adalah Pasal 26 ayat (1) KUHPM yang menegaskan bahwa Terdakwa berdasarkan kejahatan yang dilakukannya dipandang tidak layak lagi untuk tetap berada di kalangan Militer. Penelitian kualitatif menggunakan pendekatan deskriptif untuk menghimpun data secara sistematis, faktual, dan cepat sesuai dengan gambaran saat dilakukan penelitian. Hasil penelitian ini menunjukan bahwa dari segi perspektif hukum Acara Pidana Militer dapat dikatakan pemecatan merupakan kewenangan Hakim Militer sepenuhnya dengan pertimbangan ketidaklayakannya prajurit tersebut untuk dipertahankan untuk tetap berdinas di lingkungan militer, sehingga kewenangan ini yang tidak bisa didelegasikan kepada Hakim sipil, disebabkan putusan tersebut akan dijadikan dasar oleh pimpinan TNI untuk ditindak lanjuti. Bagi anggota Militer tersebut, pemecatan dari dinas Militer merupakan akhir dari karir dan pengabdiannya di lingkungan Tentara Nasional Indonesia (TNI) yang konsekuensinya akan diikuti dengan pemberhentian hak-hak yang diterima selama ini.

Abstract

Penelitian ini menyelidiki faktor-faktor penentu pertumbuhan Usaha Mikro, Kecil, dan Menengah (UMKM) di Jawa Barat, dengan fokus pada dampak dari jaringan bisnis, lingkungan regulasi, dan pembiayaan eksternal. Dengan menggunakan pendekatan kuantitatif, data dikumpulkan dari sampel 120 UMKM yang beroperasi di Jawa Barat dan dianalisis menggunakan Structural Equation Modeling (SEM). Temuan menunjukkan adanya hubungan positif yang signifikan antara jaringan bisnis dan pertumbuhan UMKM, serta antara lingkungan regulasi yang kondusif dan pertumbuhan. Namun, penelitian ini tidak menemukan pengaruh langsung yang signifikan dari pembiayaan eksternal terhadap pertumbuhan UMKM. Hasil penelitian ini menggarisbawahi pentingnya membina jaringan bisnis yang kuat dan menciptakan kerangka kerja peraturan yang mendukung untuk mendorong pengembangan UMKM di wilayah tersebut. Penelitian ini berkontribusi pada literatur yang ada dengan memberikan bukti empiris tentang pendorong pertumbuhan UMKM di Jawa Barat dan menawarkan wawasan bagi para pembuat kebijakan, lembaga keuangan, dan pemangku kepentingan UMKM yang ingin mendukung pembangunan ekonomi yang berkelanjutan.
