Abstract

The matter of connectivity is a criminal matter carried out by military personnel and civilians, both jointly (mede dader) and as accomplices (deelneming), so in the resolution process, it is regulated by several laws and regulations because it involves two jurisdictions, namely civilian and military courts. The purpose of this research is to demonstrate that in cases where the damage is more inclined towards military interests, the case is tried in military court, and if the damage is heavier on civilian/public (non-military) interests, there is a possibility of being tried in civilian court. A descriptive approach in qualitative research was used to systematically and quickly gather factual data in accordance with the description when conducting research. The results of this research show that although Article 90 of the Criminal Procedure Code (KUHAP) explains which jurisdiction handles the case, it is in the hands of the research team, including the prosecutor or chief prosecutor and military prosecutor or chief military prosecutor, based on Article 33 of the Supreme Court Law, the Supreme Court is worthy of taking over this authority.

Abstract

This study set out to address the question, "How is the future legal construction of the pattern of implementing inclusive, specialized, and equal Education for Persons with Disabilities in Indonesia?" The normative issue of how disabled people in Indonesia are often managed inspired this study. The Law on the Education System and the Law on Disabilities both include ambiguous principles on inclusive and special (segregated) education. The Statute Approach method was used to conduct this normative assessment of the law. The study's findings suggest that moving forward, Indonesia will revise legal norms in both laws and the integration of special schools and regular schools by establishing special units in regular schools to accommodate students with disabilities, all with the goal of achieving full inclusive education for people with disabilities. This may be done in increments, on a continuous basis, and using metrics based on the state of Indonesia's infrastructure right now

Abstract

Corruption cases in Indonesia are very widespread and even always increase every year. In Indonesia itself, there are regulations regarding corruption, namely the Corruption Law, the TPPK Law, the TPPU Law and other related regulations. However, these regulations are still not able to provide maximum handling. Because it places more emphasis on punishing the perpetrators and has not maximized the recovery of state financial losses. For this reason, a regulation is needed to be able to deal with corruption in Indonesia and optimize the recovery of state financial losses or the return of corrupted assets. Illicit Enrichment is a rule regarding the illegal or unfair wealth of public officials compared to their income. Illicit Enrichment is regulated in the UNCAC convention which was ratified by the United Nations in Mexico and Indonesia is a participating country in the convention as well as ratifying the UNCAC convention. However, until now in Indonesia in the regulations regarding criminal acts of corruption there are still no rules regarding Illicit Enrichment. The urgency of regulation regarding illegitimate assets must be established in Indonesia because the orientation of handling them is to optimize the return of corrupted assets. Illicit Enrichment does not only look at the assets of corruptors who are allegedly related to alleged corruption, but also looks at the entire wealth of public officials, whether this wealth can be accounted for or not.

Abstract

Overcrowding in Indonesian prisons is a structural problem in the criminal justice system that reflects the repressive nature of criminal law policy. Data from the Directorate General of Corrections (Ditjen PAS) shows that the occupancy rate of prisons exceeds 200% of the ideal capacity, violating the rights of prisoners as guaranteed in the 1945 Constitution and Law Number 12 of 1995 concerning Corrections. Overcrowding has an impact on the increase in violence, the spread of disease, and the failure of coaching programs. One of the main causes of this condition is a punishment policy that focuses too much on imprisonment without considering alternatives such as decriminalization and restorative justice. Most prisoners come from minor criminal cases, including drug abuse in the category of users who are more appropriate for rehabilitation. This policy not only burdens the state budget but also increases recidivism. Studies from various countries show that a rehabilitation-based punishment system is more effective in reducing crime. Therefore, criminal law reform through regulatory revision and the application of alternative punishment are crucial steps in overcoming overcrowding and creating a more equitable correctional system

Abstract

This research explores the strategic and economic significance of the Pakistan–Afghanistan Central Asia corridor, a region historically linked by the ancient Silk Road and now positioned at the heart of modern connectivity initiatives such as China’s Belt and Road Initiative (BRI). While the corridor offers vast potential for trade, energy, and regional integration, it simultaneously faces persistent challenges of insecurity, political instability, and great power rivalry. The study examines whether economic integration can serve as a catalyst for peace or whether stability must first be secured to enable development. Drawing on economic, security, and geopolitical perspectives, the paper argues that peace and prosperity are mutually reinforcing rather than sequential goals. Projects such as TAPI and CASA-1000 demonstrate the potential of shared economic interests to promote cooperation; however, insecurity in Afghanistan and identity-based divisions continue to threaten progress. The analysis recommends an inclusive economic approach, a joint regional security mechanism, balanced engagement with major powers, and gradual, community-centered integration. Ultimately, sustainable peace in the corridor depends on parallel progress in both security and development. If managed wisely, the corridor can transform from a zone of tension into a platform for interregional cooperation and shared prosperity.

Abstract

This community service-based empirical study examines activities at the Wagah Border through the integrated perspectives of national security, sociology of law, and military law. Using participatory field observation, structured interviews with military personnel and visitors, and qualitative document analysis, the research explores how ceremonial and security practices function as instruments of state sovereignty, legal order, and social regulation. The findings indicate that the Beating Retreat Ceremony operates not merely as a symbolic performance but as a structured security mechanism governed by hierarchical command, regulated force expression, and institutional accountability. Patterns of public compliance and coordinated inter-agency control reflect the internalization of legal norms within both military institutions and civilian audiences. The border space thus emerges as a socio-legal arena where national identity, deterrence signaling, and rule-based discipline converge in a controlled yet highly performative environment. The study demonstrates that military law and security governance at Wagah contribute to regional stability by institutionalizing order, reinforcing legal legitimacy, and fostering civic awareness of state authority within a geopolitically sensitive boundary zone.

Abstract

Military justice carried out by the Military Prosecutor is an indirect authority because the delegation of the case is an implementation of the Handover of the Case from Papera, in other words the Military Prosecutor cannot delegate the case or take prosecution action to the competent court without the existence of a Decree from Papera because it is in accordance with Article 123 paragraph (1) letter f of Law Number 31 of 1997, in essence, the authority to hand over cases is the authority of Papera, not the authority of the Military Prosecutor. The aim of this research is to analyze the responsibilities of Military Prosecutors in carrying out prosecutions. Technically, juridically, they are responsible to the TNI Prosecutor General (Orjen TNI), while operationally they are responsible to the Case Submitting Officer (Papera). Qualitative research uses a descriptive approach to collect data systematically, factually, and quickly according to the description at the time of the research. The results of this research show that Military Prosecutors as law enforcers in the field of prosecution in the Military Justice environment have a strategic and decisive role in indicting someone before trial. For this reason, the professionalism of Military Prosecutors is a necessity in carrying out their duties so that prosecutions can be carried out in accordance with applicable regulations and the goal of law enforcement itself can be achieved optimally as expected.

Abstract

Handing over a case to a military court is the authority of the Case Handing Officer (Papera) not the authority of the Military Prosecutor as a general summons, which is a specialty of military justice that handing over a case to a military court is an order from the Case Handing Officer (Papera) to the Military Prosecutor all summoning the public to do so. Linking the case at the conference. The purpose of this research is to analyze the existence of the authority of the Case Handing Officer (Papera) which is only directed at criminal acts committed by TNI soldiers who are under the authority of their command which is an order to the Military Prosecutor. The entire military summons the public to summon the matter at the conference. Qualitative research uses a descriptive approach to collect data systematically, factually, and quickly according to the description at the time of the research. The results of this research indicate that the submission of criminal charges (requisitoir) made by the Military Prosecutor for all general summonses must be based on a conference because the conference facts are legal facts produced through the conference examination process by analyzing all the evidence submitted.

Abstract

One interesting case to examine is when a soldier is suspected of committing the crime of document forgery, which is one of the prerequisites for becoming a TNI soldier before the perpetrator officially becomes a TNI soldier. The objective of this research was to demonstrate the importance of considering the tempus delicti (time of the offense) when determining the jurisdiction of the judiciary. This qualitative research employed a descriptive approach to systematically gather data that were systematic, factual, and expedient in line with the condition when this study was conducted. The findings indicated that when a soldier is suspected of committing the crime of document forgery, a requirement for becoming a TNI soldier before their official enlistment, the jurisdiction of the civilian court system applies.

Abstract

The state considers that all forms of violence, especially domestic violence, constitute violations of human rights and crimes against human dignity. The objective of this study was to demonstrate that the integrity and harmony of a household can be disrupted if the quality and self-control cannot be maintained, ultimately leading to domestic violence and causing a sense of insecurity or injustice to those within the household. This qualitative research used a descriptive approach to systematically gather data that were factual and rapid in line with the condition when this study was conducted. The results showed that every individual within a household, in carrying out their rights and responsibilities, must be guided by religion. Such principles need to be nurtured and developed to build the integrity of a household.
