Abstract

Human rights, which are protected can be in the form of individuals, groups or property. The state or state officials as part of the state have an international obligation to protect citizens and their property, where international human rights standards are established and developed in various international forums. The purpose of this study is to review the Conventions related to Human Rights which guarantee the right of everyone to be treated equally before the law regardless of race, color, origin and ethnicity, which also establishes the Committee on the Elimination of Racial Discrimination, which oversees its implementation. Qualitative research uses a descriptive approach to collect data systematically, factually, and quickly according to the description when the research is carried out. The results of this study indicate that the Human Rights Principles provide guidance for law enforcers in prosecuting criminals. These principles emphasize the importance of oversight (including clarity in the chain of command) of law enforcement agencies. These principles also explain in detail the guarantee of the fulfillment of the right to life.

Abstract

Guidance for prisoners in Correctional Institutions is inseparable from a dynamic, which aims to provide more provisions for prisoners in returning the TNI's identity as before, namely being able to carry out their duties and responsibilities in the unit so that the Military Correctional Institution (Lemasmil) is the final stage of the system. law enforcement within the Military Courts. The purpose of this study was to determine whether the development of Military Prisoners in Military Correctional Institutions has been going well. Qualitative research uses a descriptive approach to collect data systematically, factually, and quickly according to the description when the research is carried out. The results of this study indicate that the separation of places to undergo punishment for military convicts from civilian convicts is absolutely necessary, because the Penitentiary for civilian prisoners is different in nature and the desired outcome with military convicts.

Abstract

The description of acts of terrorism as a crime against the state is a serious threat to the sovereignty of each country. Acts of terrorism in Indonesia can now be qualified as military threats, namely threats using organized armed forces, which are considered to have capabilities that endanger the state's sovereignty, the territorial integrity of the country, and the safety of the entire nation. The TNI's (Indonesian National Armed Forced) efforts to overcome obstacles in dealing with terrorism in Indonesia are carried out under the Government Regulation in the lie of Law in dealing with it. Through the role of the TNI that is shown to the community and government, showing that the TNI carries out the rights and obligations according to its position, it carries out a function. From looking at these roles, we can illustrate that roles can also be interpreted as individual behavior, which is important for the social structure of society because social beings tend to live in groups. Also, empirical juridical research, namely conducting studies based on observations of the handling of acts of terrorism in Indonesia involving the TNI. It can be concluded that TNI institutions can be used as material for consideration in authority to deal with acts of terrorism.

Abstract

In the context of an emergency situation such as a social conflict or war, such respect and protection must also be extended to those who are on the opposite side of us. The concept of respecting and protecting human dignity is an idea that has existed for a long time and has become an integral part of human civilization to show that the concept of respecting and protecting human dignity is universal. local customs and wisdom. This research problemon how the development of respect and protection of human dignity in emergency situations in international law and how the efforts of the International Committee of the Red Cross (ICRC) in seeking international law affinity in the above context with customary values. Qualitative research uses a descriptive approach to collect data systematically, factually, and quickly according to the description when the research is carried out. The results of this study indicate thatFirst, Over time, the concept of respecting and protecting human dignity has also become an inseparable part of international law, Second, that the concept of respecting and protecting human dignity is an idea that has existed for a long time and has become an integral part of human civilization, Third, each regulation, which is developed in a simple manner, will be complemented by relevant religious customs and norms that are present in various forms in Indonesia where there is a wealth of relevant local traditions, known as adat originating from a rich cultural heritage and diverse influences.

Abstract

Tindak kejahatan yang mencuat ke permukaan telah dirasakan dan semakin multidimensional. Hal ini sering terjadi hampir di seluruh negara-negara belahan dunia terutama aksi kejahatan terorisme. Keamanan negara lebih banyak berperan penting dalam penanggulangan tindak pidana terorisme ini. Perubahan model ancaman terorisme merupakan permasalahan yang perlu segera tindakan konkret dari negara. Kebijakan negara mengeluarkan Undang-undang No. 5 tahun 2018 tentang Pemberantasan tindak pidana terorisme. Permasalahan penelitian ini adalah apabila ditinjau dari Hukum Tata Negara di Indonesia, pemberantasan Tindak pidana terorisme dibagi dalam 2 (dua) bentuk yaitu penegakan hukum dan operasi militer. Penelitian kualitatif menggunakan pendekatan deskriptif untuk menghimpun data secara sistematis, faktual, dan cepat sesuai dengan gambaran saat dilakukan penelitian. Hasil penelitian ini menunjukan bahwa terorisme bukan lagi merupakan kriminal biasa karena memiliki motif politik dan ideologi yang mengganggu Keamanan Nasional, bahkan kedaulatan serta bentuk negara sehingga pemberantasan tindak pidana terorisme dibagi dalam 2 (dua) bentuk yaitu penegakan hukum dan operasi militer. Crimes that have surfaced have been felt and are increasingly multidimensional. This often happens in almost all countries around the world, especially acts of terrorism. State security plays an important role in overcoming this criminal act of terrorism. The change in the model of the threat of terrorism is a problem that requires immediate concrete action from the state. State policy issued Law no. 5 of 2018 concerning the Eradication of Criminal Acts of Terrorism. The problem of this research is that when viewed from the constitutional law in Indonesia, the eradication of criminal acts of terrorism is divided into 2 (two) forms, namely law enforcement and military operations. Qualitative research uses a descriptive approach to collect data systematically, factually, and quickly according to the description when the research is carried out. The results of this study indicate that terrorism is no longer an ordinary crime because it has political and ideological motives that interfere with National Security, even sovereignty and the form of the state so that the eradication of the Crime of Terrorism is divided into 2 (two) forms, namely law enforcement and military operations.

Abstract

Dalam upaya pemberantasan terorisme, dimensi keamanan kental dalam kebijakan pemberantasan terorisme. Masyarakat sipil merasa khawatir dengan materi UU Tahun 2018 Nomor 5 tentang Pemberantasan Tindak Pidana Terorisme, dinilai Undang­undang tersebut dapat menurunkan tingkat kepatuhan negara terhadap penghormatan, pelindungan, dan pemenuhan HAM dalam pemberantasan terorisme, selain soal efektifitas metode pemberantasan terorisme. Pelibatan TNI dalam upaya pemberantasan terorisme menuai keresahan karena sering dianggap tidak sesuai dengan perlindungan HAM. Tujuan penelitian ini untuk memberi gambaran dan analisis bentuk ancaman telah mengalami pergeseran yang menuntut tentara sebagai komponen utama sistem pertahanan untuk melakukan reposisi dengan menempatkan diri pada kedudukan yang tepat di tengah dinamika ancaman yang berkembang. Metode dalam penelitian ini ialah yuridis normatif melalui kajian komprehensif dengan mengambil sumber dari peraturan dan undang-undang. adapun penelitian yuridis empiris merupakan kajian atas dasar pengamatan pada ancaman dengan melibatkan TNI. Berdasarkan hasil penelitian ini dapat disimpulkan bahwa pelibatan TNI dalam persoalan keamanan di Papua perlu ditetapkan dengan pertimbangan eskalasi ancaman bersifat sementara berdasarkan kebijakan negara. In the effort to eradicate terrorism, the security dimension is thick in the policy of eradicating terrorism. Civil society is worried about the material of the 2018 Law Number 5 concerning the Eradication of Criminal Acts of Terrorism, it is considered that the Act can reduce the level of state compliance with respect, protection, and fulfillment of human rights in eradicating terrorism, in addition to the effectiveness of the method of eradicating terrorism. The involvement of the TNI in efforts to eradicate terrorism is causing concern because it is often considered inconsistent with the protection of human rights. The purpose of this study is to provide an overview and analysis of the form of the threat that has undergone a shift that requires the army as the main component of the defense system to reposition itself by placing itself in the right position in the midst of the dynamics of developing threats. The method in this research is normative juridical through a comprehensive study by taking sources from regulations and laws. As for empirical juridical research, it is a study based on observations on threats involving the TNI. Based on the results of this study, it can be concluded that the involvement of the TNI in security issues in Papua needs to be determined by considering the temporary threat escalation based on state policy.

Abstract

Tujuan utama dari Peacekeeping Operation (PKO) multi dimensional ini meliputi: membantu para pihak yang bertikai dalam pemeliharaan keamanan dan ketertiban, membantu pemerintah dalam membangun kembali kewenangannya berdasarkan konstitusi yang dimiliki,  mendukung pembentukan kembali lembaga penegakkan hukum (kepolisian, lembaga pengadilan, dan lembaga pemasyarakatan dalam rangka Rule of Laws), mendukung lembaga-lembaga politik dan proses partisipasi, dan membangun dan keberlangsungan konsensus politik nasional, regional, dan internasional  dalam rangka mendukung proses perdamaian. Tujuan penelitian ini untuk mempertegas bahwa para personel militer yang melaksanakan PKO (peacekeepers) seharusnya memiliki kapabilitas yang cukup untuk menanggulangi setiap ancaman dan untuk mencapai tujuan mandat secara efektif. Penelitian kualitatif menggunakan pendekatan deskriptif untuk menghimpun data secara sistematis, faktual, dan cepat sesuai dengan gambaran saat dilakukan penelitian. Hasil penelitian ini menunjukan bahwa Kepatuhan Angkatan Bersenjata PBB Terhadap Hukum Humaniter Internasional, yang mewajibkan angkatan bersenjata PBB dalam menggunakan kekuatan senjata harus didasarkan pada prinsip-prinsip hukum humaniter.

Abstract

Pajak merupakan salah satu instrumen ekonomi suatu negara. Mayoritas pajak sebagai sumber pendapatan nasional melebihi lima puluh persen pendapatan Nasional. Ketika suatu negara memiliki pendapatan pajak yang lebih besar, misalnya, itu dapat menciptakan lebih banyak pekerjaan, mengurangi pengangguran, dan menyediakan pendidikan dan perawatan kesehatan yang lebih baik. Selain instrumen yang cocok untuk distribusi pendapatan. Saat ini dalam perekonomian, masalah yang paling signifikan adalah distribusi pendapatan. Dimana yang kaya semakin kaya dan yang miskin semakin miskin. Ketika pajak menjadi alat untuk mengurangi ketimpangan pendapatan, baik yang berdampak pada kesejahteraan masyarakat maupun tidak, pemerintah menjalankan berbagai program dan paket stimulus, termasuk perpajakan. Beberapa kebijakan di sektor perpajakan antara lain berupa pemberian insentif bagi pekerja di sektor yang terdampak langsung oleh pandemi melalui fasilitas pajak DTP PPh 21, penurunan tarif PPh Badan, pembebasan PPh 22 Impor, pembebasan pajak impor alat kesehatan dan vaksin. Penelitian ini menggunakan jenis penelitian kepustakaan (Library research), yaitu serangkaian kegiatan yang berkenaan dengan metode pengumpulan data pustaka, data informasi dengan menempatkan fasilitas yang ada di perpustakaan seperti buku, majalah, dokumen, internet, Penelitian kepustakaan murni yang terkait dengan obyek penelitian ataupun dalam kaitannya dengan hal ini. Menurut temuan penelitian ini, peran pajak belum menjawab atau memenuhi kebutuhan masyarakat. Misalnya, masih banyak jalan yang rusak dan belum diperbaiki, serta fasilitas jembatan yang masih kurang. Akibatnya, distribusi barang terhambat sehingga menimbulkan ekonomi biaya tinggi.

Abstract

This study aims to provide a critical review of the Convention related to Human Rights which guarantees the right of everyone to be treated equally before the law regardless of race, color, origin, and ethnicity, which also forms the Committee on the Elimination of Racial Discrimination to supervise its implementation. This qualitative research used a descriptive approach to collect data systematically, factually, and quickly in accordance with the description when conducting research. The results of this study showed that the principles of human rights guide law enforcement in prosecuting criminals. These principles emphasize the importance of supervision (including clarity in the chain of command) of law enforcement agencies. These principles also explain in detail the guarantee of the right to life fulfillment.
