Abstract

Military justice carried out by the Military Prosecutor is an indirect authority because the delegation of the case is an implementation of the Handover of the Case from Papera, in other words the Military Prosecutor cannot delegate the case or take prosecution action to the competent court without the existence of a Decree from Papera because it is in accordance with Article 123 paragraph (1) letter f of Law Number 31 of 1997, in essence, the authority to hand over cases is the authority of Papera, not the authority of the Military Prosecutor. The aim of this research is to analyze the responsibilities of Military Prosecutors in carrying out prosecutions. Technically, juridically, they are responsible to the TNI Prosecutor General (Orjen TNI), while operationally they are responsible to the Case Submitting Officer (Papera). Qualitative research uses a descriptive approach to collect data systematically, factually, and quickly according to the description at the time of the research. The results of this research show that Military Prosecutors as law enforcers in the field of prosecution in the Military Justice environment have a strategic and decisive role in indicting someone before trial. For this reason, the professionalism of Military Prosecutors is a necessity in carrying out their duties so that prosecutions can be carried out in accordance with applicable regulations and the goal of law enforcement itself can be achieved optimally as expected.

Abstract

Handing over a case to a military court is the authority of the Case Handing Officer (Papera) not the authority of the Military Prosecutor as a general summons, which is a specialty of military justice that handing over a case to a military court is an order from the Case Handing Officer (Papera) to the Military Prosecutor all summoning the public to do so. Linking the case at the conference. The purpose of this research is to analyze the existence of the authority of the Case Handing Officer (Papera) which is only directed at criminal acts committed by TNI soldiers who are under the authority of their command which is an order to the Military Prosecutor. The entire military summons the public to summon the matter at the conference. Qualitative research uses a descriptive approach to collect data systematically, factually, and quickly according to the description at the time of the research. The results of this research indicate that the submission of criminal charges (requisitoir) made by the Military Prosecutor for all general summonses must be based on a conference because the conference facts are legal facts produced through the conference examination process by analyzing all the evidence submitted.

Abstract

One interesting case to examine is when a soldier is suspected of committing the crime of document forgery, which is one of the prerequisites for becoming a TNI soldier before the perpetrator officially becomes a TNI soldier. The objective of this research was to demonstrate the importance of considering the tempus delicti (time of the offense) when determining the jurisdiction of the judiciary. This qualitative research employed a descriptive approach to systematically gather data that were systematic, factual, and expedient in line with the condition when this study was conducted. The findings indicated that when a soldier is suspected of committing the crime of document forgery, a requirement for becoming a TNI soldier before their official enlistment, the jurisdiction of the civilian court system applies.

Abstract

The state considers that all forms of violence, especially domestic violence, constitute violations of human rights and crimes against human dignity. The objective of this study was to demonstrate that the integrity and harmony of a household can be disrupted if the quality and self-control cannot be maintained, ultimately leading to domestic violence and causing a sense of insecurity or injustice to those within the household. This qualitative research used a descriptive approach to systematically gather data that were factual and rapid in line with the condition when this study was conducted. The results showed that every individual within a household, in carrying out their rights and responsibilities, must be guided by religion. Such principles need to be nurtured and developed to build the integrity of a household.

Abstract

To reduce corruption in the future, of course, it is necessary to provide anti-corruption education from now on, because education and public awareness are also important components in fighting corruption. The purpose of this paper is to analyze corruption education in combating corruption crimes in the future and handling corruption and anti-corruption education in various countries. The type of research used in this research is normative juridical. Normative juridical research is research that uses the legis positivist conception. Anti-corruption education in the future must be instilled in an integrated manner from primary to tertiary education Anti-corruption education in the future must be instilled in an integrated manner from primary to tertiary education. It is hoped that through education about anti-corruption from an early age, it can create a person who has a more introspective personality, so that when it is time to enter society, children are no longer easily influenced and have sufficient and correct knowledge about anti-corruption. Learning from China, Indonesia should also be able to fight corruption and eradicate this chronic disease from the country. In addition to a strong commitment from the country's leaders and law enforcers, China-style corruption eradication may be applicable in Indonesia. The preventing corruption through education in Indonesia and Malaysia is almost the same, namely through the internalization of anti-corruption values into certain subjects, while Singapore emphasizes more on character education.

Abstract

Penelitian ini menyelidiki kesadaran, opini, dan persepsi masyarakat Indonesia mengenai konflik Israel-Palestina dan peran keputusan Dewan Keamanan Perserikatan Bangsa-Bangsa (DK PBB). Sampel yang terdiri dari 1.200 partisipan disurvei, mewakili berbagai kelompok usia, jenis kelamin, latar belakang pendidikan, dan lokasi geografis. Temuan-temuan tersebut mengungkapkan populasi dengan kesadaran yang tinggi (65%) dan pemahaman yang bernuansa tentang konflik, yang menampilkan beragam pendapat tentang isu-isu utama seperti penentuan nasib sendiri, klaim teritorial, dan kelangsungan solusi dua negara. Persepsi terhadap keputusan DK PBB menunjukkan spektrum pengaruh, dengan variasi kesadaran yang menonjol terhadap resolusi-resolusi tertentu. Opini mengenai status hukum wilayah di Tepi Barat mencerminkan lanskap yang kompleks. Analisis korelasi mengeksplorasi hubungan antara faktor demografis dan opini, yang menunjukkan adanya hubungan yang signifikan. Perbandingan dengan literatur yang ada menyoroti kesesuaian global dan perspektif Indonesia yang unik. Implikasi untuk kebijakan dan diplomasi menggarisbawahi pentingnya menyesuaikan strategi untuk menyelaraskan dengan sentimen publik. Dengan mengakui adanya keterbatasan dan menyarankan arah penelitian di masa depan, penelitian ini memberikan kontribusi wawasan yang bernuansa pada wacana konflik internasional dalam konteks budaya yang beragam.

Abstract

Penelitian ini menyelidiki hubungan yang rumit antara keputusan Dewan Keamanan Perserikatan Bangsa-Bangsa (DK PBB) dan status hukum suatu wilayah, dengan fokus khusus pada Tepi Barat dalam konteks konflik Israel-Palestina. Dengan menggunakan metodologi analisis dokumen kualitatif, penelitian ini mengkaji resolusi-resolusi DK PBB, instrumen hukum, perjanjian bilateral, dan pernyataan-pernyataan para pemangku kepentingan untuk mengurai dinamika yang membentuk lanskap hukum di Tepi Barat. Analisis kronologis resolusi-resolusi DK PBB mengungkapkan fase-fase yang berbeda, menyoroti pergeseran dalam pendekatan Dewan dan memberikan wawasan ke dalam narasi hukum yang berkembang. Pemeriksaan terhadap instrumen-instrumen hukum, terutama Kesepakatan Oslo dan perjanjian KTT Camp David, menggarisbawahi keseimbangan antara norma-norma internasional dan negosiasi bilateral. Perspektif para pemangku kepentingan menawarkan pemahaman yang bernuansa tentang interpretasi yang diperdebatkan, yang menekankan kompleksitas penentuan hukum di wilayah tersebut. Sintesis temuan-temuan ini berkontribusi pada wacana yang lebih luas mengenai hukum internasional, resolusi konflik, dan kompleksitas konflik Israel-Palestina yang sedang berlangsung.

Abstract

Penelitian ini menyelidiki tantangan dan prospek perlindungan hukum dan hak asasi manusia bagi pengungsi Rohingya di Indonesia dari sudut pandang masyarakat Indonesia, dengan menggunakan analisis kualitatif. Melalui wawancara mendalam dengan para pengungsi Rohingya, ahli hukum, perwakilan LSM, dan anggota masyarakat Indonesia, penelitian ini menyoroti berbagai dimensi dari pengalaman pengungsi. Temuan-temuan yang ada menunjukkan adanya tantangan hukum yang signifikan, termasuk rintangan birokrasi, keterbatasan akses terhadap pendampingan hukum, dan masalah dokumentasi. Situasi hak asasi manusia ditandai dengan hambatan terhadap pendidikan, perawatan kesehatan, dan pekerjaan, ditambah dengan diskriminasi dan tantangan sosial-ekonomi. Meskipun ada optimisme yang hati-hati untuk perbaikan, kekhawatiran tentang kemauan politik tetap ada. Perspektif masyarakat bervariasi, dipengaruhi oleh pembingkaian media, pendidikan, dan eksposur. Penelitian ini menggarisbawahi pentingnya kebijakan, advokasi, dan pelibatan masyarakat yang disesuaikan untuk meningkatkan kesejahteraan dan integrasi pengungsi Rohingya di Indonesia.

Abstract

Penelitian ini menyelidiki faktor-faktor penentu pertumbuhan Usaha Mikro, Kecil, dan Menengah (UMKM) di Jawa Barat, dengan fokus pada dampak dari jaringan bisnis, lingkungan regulasi, dan pembiayaan eksternal. Dengan menggunakan pendekatan kuantitatif, data dikumpulkan dari sampel 120 UMKM yang beroperasi di Jawa Barat dan dianalisis menggunakan Structural Equation Modeling (SEM). Temuan menunjukkan adanya hubungan positif yang signifikan antara jaringan bisnis dan pertumbuhan UMKM, serta antara lingkungan regulasi yang kondusif dan pertumbuhan. Namun, penelitian ini tidak menemukan pengaruh langsung yang signifikan dari pembiayaan eksternal terhadap pertumbuhan UMKM. Hasil penelitian ini menggarisbawahi pentingnya membina jaringan bisnis yang kuat dan menciptakan kerangka kerja peraturan yang mendukung untuk mendorong pengembangan UMKM di wilayah tersebut. Penelitian ini berkontribusi pada literatur yang ada dengan memberikan bukti empiris tentang pendorong pertumbuhan UMKM di Jawa Barat dan menawarkan wawasan bagi para pembuat kebijakan, lembaga keuangan, dan pemangku kepentingan UMKM yang ingin mendukung pembangunan ekonomi yang berkelanjutan.

Abstract

This research investigates the intricate interplay between freedom of expression, access to information, political participation, and the protection of political rights in Indonesia through a quantitative analysis. A sample of 1500 respondents from diverse demographics was surveyed, and the data were subjected to confirmatory factor analysis and structural equation modeling. The findings reveal strong positive relationships between freedom of expression, access to information, political participation, and the protection of political rights. The measurement model demonstrated robust psychometric properties, and discriminant validity was confirmed. While the model fit was acceptable, ongoing refinement is suggested. The R-Square value indicates that approximately 60.2% of the variance in the protection of political rights can be explained by the selected variables. The study contributes to the understanding of democratic governance in Indonesia, emphasizing the pivotal role of information, expression, and civic engagement in safeguarding political rights.
