Abstract

Human rights protect individuals, groups, or property. The nation or state officials as part of the country have an international obligation to protect the community and their property, where international human rights standards are established and developed in various international forums. This study aims to provide a critical review of the Convention related to Human Rights which guarantees the right of everyone to be treated equally before the law regardless of race, color, origin, and ethnicity, which also forms the Committee on the Elimination of Racial Discrimination to supervise its implementation. This qualitative research used a descriptive approach to collect data systematically, factually, and quickly in accordance with the description when conducting research. The results of this study showed that the principles of human rights guide law enforcement in prosecuting criminals. These principles emphasize the importance of supervision (including clarity in the chain of command) of law enforcement agencies. These principles also explain in detail the guarantee of the right to life fulfillment.

Abstract

Danger or nood can occur anytime and anywhere, in this case, it can only occur in a certain area or it can even occur as a whole in the territory of a country.The purpose of this research is to give an idea that emergency constitutional law provides reasons or the basis for granting the state a right to take action in overcoming or dealing with dangerous situations.This qualitative research used a descriptive approach to collect data systematically, factually, and quickly according to the description when the research was conducted. The results of this study indicate that it is necessary to stipulate an emergency law that regulates matters of governance that due to urgent circumstances need to be regulated immediately.

Abstract

To uphold legal principles within the military framework, it is imperative to establish legislative measures that serve as regulatory frameworks for soldiers. These measures are designed to govern their conduct both in the execution of official duties and in the regulation of their involvement within the broader societal context. This research aims to scrutinize the procedural intricacies involved in implementing dishonorable discharge for Indonesian National Armed Forces (TNI) soldiers who engage in criminal activities as a means of upholding the rule of law. Furthermore, it seeks to identify and address the challenges encountered in the process. This study applies a normative juridical approach, specifically descriptive-analytical research. Data comprises both secondary sources (i.e., literature works) and primary sources (i.e., interviews). The presentation of data is structured in a descriptive format, employing a qualitative analytical method. Research findings reveal that the process of implementing dishonorable discharge for TNI personnel involved in criminal activities encompasses both administrative and military disciplinary measures. Challenges encountered in the sanction application include (a) instances of unit commanders’ tardiness in administering administrative penalties and (b) efforts to address these impediments by ensuring meticulous law enforcement within each unit, coupled with conducting awareness campaigns across the entire units in TNI. It is underscored that criminal acts committed by TNI personnel are regarded as breaches of military discipline, carrying the threat of military and disciplinary penalties, alongside administrative sanctions culminating in dismissal. The application of administrative sanctions is anticipated to mitigate violations and instill a deterrent effect among TNI personnel. Legal ramifications persist for the individuals involved until the completion of their service. A proposed solution requires the submission of a comprehensive personality development progress report by respective unit commanders, confirming the completion of all legal processes, thereby facilitating the individual’s seamless career progression.

Abstract

Renewing the Military Criminal Law Criminal System is not easy, especially the special criminal law system such as the Military Criminal Code (KUHPM), which is a codification of criminal law in the Criminal Code. The purpose of this study is to emphasize that the military criminal sanction system must still refer to the sanctions system in the Criminal Code (KUHP) or the Draft Criminal Code which is currently in the process of being drafted. Qualitative research uses a descriptive approach to collect data systematically, factually , and quickly according to the description when the research was conducted. The results of this study indicate that the guideline in the preparation of the Criminal Code is that punishment is an inseparable part of criminal law, so it is not a criminal law if it regulates only norms without being followed by criminal threats. Criminal threats that will be applied to criminal actors, although not primarily, but the nature of the crime is a crime

Abstract

This research investigates the legal protection of children in underage divorce cases in the context of Indramayu, Indonesia. Using a mixed methods approach, the research analyzed the legal framework, reviewed existing literature, and gathered insights through surveys with legal professionals, social workers, and individuals who have direct experience in underage divorce cases. The findings revealed nuances in the legal landscape, challenges in implementation, and the importance of cultural sensitivity. Recommendations emphasize alignment of legal standards, improved support services, interdisciplinary collaboration, compassionate legal processes, and community engagement.

Abstract

One of the factors that should be considered in the legal protection of the poor is the equal position of citizens before the law. In a just society, there should be no gap between the people and those who have money and positions that afford them the same status as citizens in accordance with the legal system. It is imperative that legal aid be made available to impoverished individuals and communities in a criminal justice system that has yet to achieve comprehensive integration. The objective of this research is to ascertain the role of consultation and legal aid institutions in providing legal assistance and community empowerment for economically disadvantaged individuals. This research employs an empirical juridical approach to examine the activities of the Consultation and Legal Aid in fulfilling its role. The findings indicate that the Institute for Consultation and Legal Aid is obliged to provide assistance to legal aid providers free of charge. However, information regarding the provision of free or low-cost legal aid has not been widely disseminated, resulting in a significant number of defendants or suspects who are dealing with the law and do not receive assistance from legal aid providers. This lack of access to legal aid services leaves individuals without the means to effectively navigate accusations, suspicions, or charges from the state, thereby exacerbating their vulnerability.

Abstract

Background. Background This research is based on the need for an effective alternative for the resolution of civil disputes in the District Court due to the problems that often arise in the conventional justice system. Mediation has been considered as one of the promising alternatives, but there has been no thorough evaluation of how effective this method is in the context of the District Court. Purpose. This study aims to quantitatively evaluate how effective mediation is as an alternative to civil dispute resolution in the District Court. Method. The quantitative method collects data through surveys and interviews with mediation participants. The aim was to determine how effective mediation is as an alternative to civil dispute resolution in the district courts. The data collected was then analyzed to identify factors that influence the success of mediation. Results. This study shows the success rate of mediation as a civil dispute resolution option in the District Court and the factors that influence the outcome. Conclusion. This study found that mediation can serve as an effective alternative to civil dispute resolution in the District Court. However, the study also emphasizes that further attention is needed to the factors that determine the success of mediation. The research also provides a basis for policy and practice recommendations that can improve the success of mediation in civil dispute resolution in the District Courts.

Abstract

This study seeks to analyse the constitutional provisions on political neutrality within the framework of Indonesia's democratic process, particularly as it pertains to the establishment and upkeep of a democratic society founded on social fairness and the preeminence of legal principles. This study examines applicable laws, legal theories, and police procedures via a normative-philosophical and descriptive analytical lens. Findings highlight the need of political neutrality in state administration and bureaucracy for maintaining a just and fair democracy. Government impartiality and honesty can only be restored by overhauls to political ethics and the inner workings of bureaucratic politics. In light of Pancasila and the Constitution of the Unitary State of the Republic of Indonesia (1945), this conclusion stresses the need of cooperation across different parts of the country in order to establish a national legal system that upholds democracy and social justice.

Abstract

Military justice is the executor of judicial power within the armed forces to uphold law and justice by taking into account the interests of administering national defense. Article 7 of Law Number 31 of 1997 states that organizational and procedural, administrative and financial guidance for court and judiciary bodies is carried out by the Commander in Chief. This guidance must not reduce the freedom of judges in examining and deciding cases. The aim of this research is to show that Article 9 number 1 which is linked to Articles 1 and 2 of the KUHPM above, can be concluded that the absolute competence of military justice which is based on the subject of criminal acts has placed soldiers as a very special group because almost all violations and crimes those committed by soldiers will be brought under the realm of military justice. Qualitative research uses a descriptive approach to collect data systematically, factually, and quickly according to the description at the time of the research. The results of this research show that the determination of absolute competency based on the severity of the loss can be said to be in line with what is stated in Article 3 paragraph (4) letter a TAP MRP Number VII of 2000 concerning the Role of the Indonesian National Army and the Role of the National Police of the Republic of Indonesia which states "Indonesian National Army soldiers are subject to the powers of the general judiciary in matters of general criminal offences."

Abstract

It is reasonable to expect good judges to render decisions that uphold the law and demonstrate a sense of justice. The purpose of this study is to demonstrate how, if the Code of Ethics for Guidelines for Judges' Conduct (KEPPH) is followed in carrying out these responsibilities and in other contexts, both directly and indirectly, the perceptions and expectations of justice seekers will ultimately change. restored in the realization of military justice. noble, not cloudy, and free from sinful beliefs and actions. In qualitative research, data were collected methodically, factually, and quickly using descriptive methodology in accordance with the description at the time of the study. The findings of this study indicate that openness, participation, accountability, placing the right person in the right place, and objectivity must be prioritized in the recruitment and selection process to produce competent Military Judges. Although the recruitment and selection process has succeeded in producing Military Judges who uphold the principles of KEPPH and become God's representatives on earth, Military Judges are also human beings and therefore prone to error. Therefore, they require continuous education and training.
