Abstract

The universal protection of human rights rests on a set of basic concepts known as human rights. This research aims to analyze (1) How does the low level of constitutional awareness among Indonesian society affect the implementation of human rights (HAM) and constitutional sovereignty in real practice? and (2) What is the impact of the lack of citizenship education on understanding constitutional rights and responsibilities as citizens towards realizing the goals of social justice mandated by the Indonesian constitution?. The research method used in this research is normative legal research with a descriptive analytical approach. The research results show that low constitutional awareness has a serious impact on the implementation of Human Rights and the sovereignty of a country's constitution. Citizenship education is likened to a rail or means that guides citizens to become good citizens. Increasing constitutional awareness and citizenship education are expected to support the struggle for legal justice in Indonesia. It is hoped that a society that is more aware of the constitution can play an active role in protecting and fighting for human rights (HAM), as well as supporting constitutional sovereignty to achieve the goals of social justice.

Abstract

Persenjataan perang zaman sekarang semakin kompleks, dalam arti selain penggunaan jenis senjata dengan berbasis teknologi perang yang dinamakan hard power, sudah tidak berlaku lagi dan dalam peperangan saat ini telah digunakan pengaruh kuat terhadap pihak lainnya, pada bidang sosial budaya, politik, dan ekonomi, sebagai jenis senjata baru yang sulit dikenali sebagai senjata untuk perang dan dinamakan soft power sehingga sangat perlunya disiapkan Bela Negara oleh seluruh Komponen Rakyat. Tujuan penelitian ini untuk mempertegas bahwa telah ada dasar hukum terhadap pemberlakuan Bela Negara yang merupakan tindakan preventif yang dilakukan oleh seluruh rakyat Indonesia dalam mencegah terjadinya kehancuran sebuah bangsa. Penelitian kualitatif memakai pendekatan deskriptif untuk mengumpulkan data secara sistematis, cepat, faktual, dan berdasarkan deskripsi ketika dilakukan penelitian. Hasil penelitian ini menunjukkan hukum tata negara telah mengatur negara untuk melakukan sesuatu dalam menghindari dari dampak ancaman asimetris tersebut, kesadaran bela negara adalah sesuatu yang penting dan harus ada pada setiap WNI (Warga Negara Indonesia), yang menjadi wujud kekuatan bangsa dan modal dasar guna memelihara kelangsungan hidup, keutuhan, dan kedaulatan hidup negara dan bangsa Indonesia.

Abstract

After the incident of the attack on a military rayon command post in Kisor, Maybrat, West Papua Province occurred, people felt scared & threatened, and decided to flee to the forest. In addressing this situation, the Regent of Maybrat called on his people who were still displaced to return to their respective homes or villages. The addition of personnel of Kodam XVIII Kasuari in that location was not for a military operation but rather looking for the perpetrators of criminal acts of terrorism because they had caused tremendous fear in the local community, making them flee into the forest. This study aimed at examining the subject matter based on the scope and identification of the aforementioned problems through a normative juridical approach. Moreover, the researchers also included juridical-historical and juridical-political approaches based on the scope and identification of the problems. In this study, the researchers applied normative and empirical legal research methods at the same time. However, the researchers focused more on the normative legal research method, while the empirical legal research method was used to obtain supporting information. The object of this study was Kodam XVIII Kasuari which always tries to eliminate the bad culture of the Arfak mountain community, especially daily activities that clash with criminal acts (e.g., presenting firearms as a dowry). In addressing this problem, Kodam XVIII Kasuari had used various ways with the anthropological approach. This approach had been fully implemented by soldiers in West Papua within the framework of territorial operations in the aspect of education, raising awareness, and enforcing national laws in the communities in West Papua.

Abstract

The description of acts of terrorism as a crime against the state and is a serious threat to the sovereignty of each country. Terrorist acts in Indonesia can now be qualified as military threats, namely threats using organized armed forces that ar e considered to have capabilities that endanger the sovereignty of the state, the territorial integrity of the country, and the safety of the entire nation. The TNI's efforts to overcome obstacles in dealing with terrorism in Indonesia are carried out in accordance with the Perpu in dealing with it. Through the role of the TNI that is shown to the community and government, showing that the TNI carries out the rights and obligations according to its position, it carries out a function. From looking at these roles, we can illustrate that roles can also be interpreted as individual behavior, which is important for the social structure of society because social beings have a tendency to live in groups. also empirical juridical research, namely conducting studies based on observations of the handling of acts of terrorism in Indonesia involving the TNI. It can be concluded that TNI institutions can be used as material for consideration in the authority to deal with acts of terrorism.

Abstract

Human rights protect individuals, groups, or property. The nation or state officials as part of the country have an international obligation to protect the community and their property, where international human rights standards are established and developed in various international forums. This study aims to provide a critical review of the Convention related to Human Rights which guarantees the right of everyone to be treated equally before the law regardless of race, color, origin, and ethnicity, which also forms the Committee on the Elimination of Racial Discrimination to supervise its implementation. This qualitative research used a descriptive approach to collect data systematically, factually, and quickly in accordance with the description when conducting research. The results of this study showed that the principles of human rights guide law enforcement in prosecuting criminals. These principles emphasize the importance of supervision (including clarity in the chain of command) of law enforcement agencies. These principles also explain in detail the guarantee of the right to life fulfillment.

Abstract

Danger or nood can occur anytime and anywhere, in this case, it can only occur in a certain area or it can even occur as a whole in the territory of a country.The purpose of this research is to give an idea that emergency constitutional law provides reasons or the basis for granting the state a right to take action in overcoming or dealing with dangerous situations.This qualitative research used a descriptive approach to collect data systematically, factually, and quickly according to the description when the research was conducted. The results of this study indicate that it is necessary to stipulate an emergency law that regulates matters of governance that due to urgent circumstances need to be regulated immediately.

Abstract

To uphold legal principles within the military framework, it is imperative to establish legislative measures that serve as regulatory frameworks for soldiers. These measures are designed to govern their conduct both in the execution of official duties and in the regulation of their involvement within the broader societal context. This research aims to scrutinize the procedural intricacies involved in implementing dishonorable discharge for Indonesian National Armed Forces (TNI) soldiers who engage in criminal activities as a means of upholding the rule of law. Furthermore, it seeks to identify and address the challenges encountered in the process. This study applies a normative juridical approach, specifically descriptive-analytical research. Data comprises both secondary sources (i.e., literature works) and primary sources (i.e., interviews). The presentation of data is structured in a descriptive format, employing a qualitative analytical method. Research findings reveal that the process of implementing dishonorable discharge for TNI personnel involved in criminal activities encompasses both administrative and military disciplinary measures. Challenges encountered in the sanction application include (a) instances of unit commanders’ tardiness in administering administrative penalties and (b) efforts to address these impediments by ensuring meticulous law enforcement within each unit, coupled with conducting awareness campaigns across the entire units in TNI. It is underscored that criminal acts committed by TNI personnel are regarded as breaches of military discipline, carrying the threat of military and disciplinary penalties, alongside administrative sanctions culminating in dismissal. The application of administrative sanctions is anticipated to mitigate violations and instill a deterrent effect among TNI personnel. Legal ramifications persist for the individuals involved until the completion of their service. A proposed solution requires the submission of a comprehensive personality development progress report by respective unit commanders, confirming the completion of all legal processes, thereby facilitating the individual’s seamless career progression.

Abstract

Renewing the Military Criminal Law Criminal System is not easy, especially the special criminal law system such as the Military Criminal Code (KUHPM), which is a codification of criminal law in the Criminal Code. The purpose of this study is to emphasize that the military criminal sanction system must still refer to the sanctions system in the Criminal Code (KUHP) or the Draft Criminal Code which is currently in the process of being drafted. Qualitative research uses a descriptive approach to collect data systematically, factually , and quickly according to the description when the research was conducted. The results of this study indicate that the guideline in the preparation of the Criminal Code is that punishment is an inseparable part of criminal law, so it is not a criminal law if it regulates only norms without being followed by criminal threats. Criminal threats that will be applied to criminal actors, although not primarily, but the nature of the crime is a crime

Abstract

This research investigates the legal protection of children in underage divorce cases in the context of Indramayu, Indonesia. Using a mixed methods approach, the research analyzed the legal framework, reviewed existing literature, and gathered insights through surveys with legal professionals, social workers, and individuals who have direct experience in underage divorce cases. The findings revealed nuances in the legal landscape, challenges in implementation, and the importance of cultural sensitivity. Recommendations emphasize alignment of legal standards, improved support services, interdisciplinary collaboration, compassionate legal processes, and community engagement.

Abstract

One of the factors that should be considered in the legal protection of the poor is the equal position of citizens before the law. In a just society, there should be no gap between the people and those who have money and positions that afford them the same status as citizens in accordance with the legal system. It is imperative that legal aid be made available to impoverished individuals and communities in a criminal justice system that has yet to achieve comprehensive integration. The objective of this research is to ascertain the role of consultation and legal aid institutions in providing legal assistance and community empowerment for economically disadvantaged individuals. This research employs an empirical juridical approach to examine the activities of the Consultation and Legal Aid in fulfilling its role. The findings indicate that the Institute for Consultation and Legal Aid is obliged to provide assistance to legal aid providers free of charge. However, information regarding the provision of free or low-cost legal aid has not been widely disseminated, resulting in a significant number of defendants or suspects who are dealing with the law and do not receive assistance from legal aid providers. This lack of access to legal aid services leaves individuals without the means to effectively navigate accusations, suspicions, or charges from the state, thereby exacerbating their vulnerability.
