Abstract

In carrying out its duties, the TNI is given the authority to use firearms in accordance with existing military equipment standards. The TNI limits the use of firearms to prevent misuse, namely in peaceful or non-combat conditions. The aim of this research is to show that every member of the TNI actually has the same position as ordinary people who are not members of the military, but as members of the TNI apart from being subject to the legal rules that apply in society. Qualitative research uses a descriptive approach to collect data systematically, factually, and quickly according to the description at the time of the research. The results of this research show that the aim of implementing licensing, supervision and control of military standard firearms is to create a management system that is well structured and correct according to procedures and can be accounted for, so that there is no misuse of firearms and/or ammunition.

Abstract

This study examines Article 26 of Law No. 27 of 2022 on Personal Data Protection (PDP Law) in Indonesia, focusing on its provisions related to digital data breaches. With the increasing use of digital platforms, the risk of personal data breaches has grown significantly, making data protection a critical issue for policymakers. Article 26 outlines the obligations of data controllers and processors in the event of a data breach, particularly requiring prompt notification to affected individuals and the relevant regulatory authority. This paper employs a normative legal analysis to assess the effectiveness of these provisions in safeguarding personal data, comparing them with international standards such as the European Union’s General Data Protection Regulation (GDPR). The analysis identifies strengths, including the obligation to notify breaches, while also highlighting weaknesses, such as the absence of clear deadlines for breach reporting and insufficient enforcement mechanisms. The study concludes with recommendations to strengthen the Personal Data Protection Law, including clarifying notification timelines, enhancing sanctions, and improving infrastructure for breach reporting and law enforcement.

Abstract

This paper examines the normative legal implications of Article 28E Paragraph (3) of the 1945 Constitution of the Republic of Indonesia concerning restrictions on freedom of expression on social media. The Constitution guarantees the right to freedom of expression, but allows limitations under certain circumstances, particularly to maintain public order, national security, and morality. The emergence of social media platforms has complicated this balance, as they provide space for free expression while also posing risks such as the spread of misinformation, hate speech, and incitement to violence. This study analyzes the application of constitutional provisions, regulatory frameworks such as the Electronic Information and Transactions Law (ITE Law), and judicial interpretations of these laws. Through qualitative legal analysis, this paper discusses how Indonesian law regulates social media content and evaluates whether these legal limitations align with constitutional principles. The paper concludes that while social media regulation is necessary, existing laws need to be clearer and more specific to prevent abuse of authority and potential violations of freedom of expression.

Abstract

This study examines the protection of Indigenous Peoples’ land rights within the framework of agrarian reform policy through a normative and implementational legal analysis. The research aims to analyze the extent to which existing legal frameworks recognize and protect Indigenous land rights, identify inconsistencies within regulatory structures, and evaluate the effectiveness of their implementation in practice. Employing a normative juridical approach, this study analyzes constitutional provisions, statutory regulations, and relevant legal doctrines, complemented by a qualitative assessment of implementation challenges. The findings reveal that although Indigenous land rights are formally recognized in the legal system, such recognition remains conditional and fragmented across sectoral regulations. Overlapping authorities between land, forestry, and other resource-related laws create legal uncertainty and hinder the effective protection of customary land. Furthermore, the implementation of agrarian reform policies often fails to accommodate the collective nature of Indigenous land tenure, resulting in the marginalization of Indigenous communities. Bureaucratic complexities, limited institutional coordination, and weak enforcement mechanisms further exacerbate these challenges, leading to persistent land conflicts and dispossession. This study highlights a significant gap between normative legal guarantees and practical realities. It emphasizes the need for a more integrative and responsive legal framework that harmonizes regulations, strengthens the recognition of customary land rights, and ensures meaningful participation of Indigenous Peoples in agrarian reform processes. By bridging normative analysis with implementation perspectives, this research contributes to the development of more equitable and inclusive land governance systems that uphold Indigenous rights and promote social justice.

Abstract

The development of a military paralegal system within the Indonesian Army (TNI AD) is a strategic step to address the challenges of providing prompt and effective legal assistance, particularly in remote units or operational areas. Military paralegals, consisting of military personnel with basic legal training, have the potential to play a crucial role in supporting the duties of the Military Legal Corps (CHK), including providing legal assistance, managing legal administration, and providing legal education to soldiers. Although Law Number 16 of 2011 concerning Legal Aid and TNI Commander Regulation Number 46 of 2023 provide the legal basis for providing legal assistance, the absence of specific regulations regarding military paralegals in Indonesia creates gaps in the military legal system. Military paralegals play a role in supporting law enforcement, protecting soldiers' rights in accordance with the principle of due process of law, and strengthening the professionalism of the military legal system. Comparative studies with paralegal systems in other countries, such as the United States, demonstrate the need for structured education, certification, and strict oversight to ensure the efficiency and accountability of paralegals. Recommendations include the development of specific regulations, the development of a training curriculum, and the integration of paralegals into the CHK structure. With proper implementation, military paralegals can be a crucial element in strengthening justice and professionalism within the Indonesian military legal system.

Abstract

This study analyzes the legality and challenges of implementing carbon trading in Indonesia under Presidential Regulation No. 98 of 2021 using a normative legal approach. The regulation establishes the legal foundation for Carbon Economic Value (Nilai Ekonomi Karbon/NEK) instruments, including carbon trading, as part of Indonesia’s commitment to achieving its emission reduction targets under the Paris Agreement. Through a statutory and conceptual analysis, this research evaluates the coherence, clarity, and enforceability of the regulatory framework governing carbon trading mechanisms. The findings indicate that, normatively, carbon trading in Indonesia has a valid legal basis and reflects a progressive shift toward market-based environmental governance. However, several challenges hinder its effective implementation. These include regulatory fragmentation across sectors, overlapping institutional authorities, limited clarity in implementing regulations, and the underdevelopment of monitoring, reporting, and verification (MRV) systems. In addition, issues related to market readiness, stakeholder capacity, and alignment with international carbon trading standards further complicate the operationalization of the system. This study concludes that while the legal framework for carbon trading has been formally established, its practical effectiveness depends on further regulatory refinement, institutional strengthening, and improved coordination mechanisms. Strengthening legal certainty and enhancing implementation capacity are essential to ensure that carbon trading can function as an effective instrument for climate change mitigation in Indonesia.

Abstract

Human rights protect individuals, groups, or property. The nation or state officials as part of the country have an international obligation to protect the community and their property, where international human rights standards are established and developed in various international forums. This study aims to provide a critical review of the Convention related to Human Rights which guarantees the right of everyone to be treated equally before the law regardless of race, color, origin, and ethnicity, which also forms the Committee on the Elimination of Racial Discrimination to supervise its implementation. This qualitative research used a descriptive approach to collect data systematically, factually, and quickly in accordance with the description when conducting research. The results of this study showed that the principles of human rights guide law enforcement in prosecuting criminals. These principles emphasize the importance of supervision (including clarity in the chain of command) of law enforcement agencies. These principles also explain in detail the guarantee of the right to life fulfillment.

Abstract

The increasing environmental awareness among consumers has encouraged businesses to promote eco-friendly products through digital communication channels. Social media has emerged as a powerful platform for influencing consumer behavior, particularly through eco-influencers and environmental advocacy campaigns. This study aims to examine the influence of eco-influencers and social media advocacy on consumers’ intention to purchase eco-friendly products in West Java. A quantitative research approach was employed using a survey method. Data were collected from 175 respondents who actively use social media and are familiar with eco-friendly products. The research instrument utilized a five-point Likert scale, and the collected data were analyzed using SPSS version 25 through validity testing, reliability testing, descriptive analysis, multiple linear regression, coefficient of determination analysis, and hypothesis testing. The results reveal that eco-influencers have a positive and significant effect on purchase intention, indicating that credible environmental influencers can effectively encourage consumers to consider eco-friendly products. Social media advocacy also demonstrates a positive and significant influence on purchase intention, suggesting that environmental campaigns disseminated through social media enhance awareness and motivate sustainable purchasing behavior. Furthermore, eco-influencers and social media advocacy simultaneously influence purchase intention, explaining 46.1% of the variance in consumers’ intention to purchase eco-friendly products. The findings highlight the strategic importance of digital environmental communication in promoting sustainable consumption and provide practical implications for businesses, marketers, and policymakers seeking to encourage environmentally responsible purchasing behavior.

Abstract

This study examines the vulnerabilities of philanthropy in Indonesia amid its rapid growth through digital platforms and social organizations, highlighting risks of abuse and misuse of donations. The case of Agus Salim, a victim of acid attack whose Rp1.5 billion in public donations was diverted for personal and family use, illustrates how weak regulatory oversight has triggered a trust crisis in philanthropic institutions. The research aims to analyze manipulative practices in philanthropic activities, the factors contributing to weak supervision, and the resulting legal and social implications. Using a juridical-normative method, the study draws on literature review, case analysis, and relevant regulations, including Law No. 9 of 1961, Government Regulation No. 29 of 1980, the Criminal Code, and the Electronic Transactions Law. By comparing legal norms (das sollen) with empirical practices (das sein), the findings reveal that donation funds are often transferred into personal accounts without accountability, government supervision remains inadequate, and while existing legal instruments such as Articles 372 and 378 of the Criminal Code are applicable, enforcement is slow and inconsistent. The study concludes that philanthropy should be recognized not only as a moral activity but also as a “business of philanthropy” highly vulnerable to manipulation. It underscores the urgency of regulatory harmonization, the establishment of a national philanthropic code of ethics, and the application of good governance principles. Recommendations include the adoption of open public audits and digital reporting systems to strengthen accountability and prevent future misuse.
