Abstract

This study aims to determine the Bureaucratic Performance of Land and Building Tax Services in the Urban and Rural Sector (PBB-P2) in Increasing Regional Original Income at the Regional Tax and Retribution Management Agency in Medan City and to find out and analyze what factors support and inhibit it. The research method used is descriptive research with observation data collection instruments, documentation studies and interviews, while the data analysis is descriptive analysis. The results of this study indicate that the performance of the Regional Tax and Retribution Management Agency in optimizing the increase in Local Own Revenue through the receipt of Land and Building Taxes for the Urban Sector in Medan City is analyzed from the following sub-indicators: conducting socialization of Medan City Regional Regulation Number 3 of 2011 concerning Land and Building Tax for Urban and Sub-District; carry out validation activities on the Subject and Object of Land and Building Tax in the Urban and Rural Sector; carry out adjustments to the Land Value Zone (ZNT), and: carry out activities to update the Selling Value of Tax Objects (NJOP). Supporting land and building tax revenue by the Regional Revenue Agency is influenced by the following factors, namely economic growth and population. The inhibiting factors in land and building tax revenues are the awareness and compliance of taxpayers and the weakness of the tax apparatus. Meanwhile, the government's recommendation is to socialize regulations regarding local taxes, make adjustments and determine Land Value Zones (ZNT) and update the Sales Value of Tax Objects (NJOP).

Abstract

The purpose of this study is to examine the role, position, actualization of the role and barriers to the Bhabinkamtibmas of the Central Tapanuli Resort Police in order to suppress the occurrence of criminal acts in the context of maintaining security and order. The type of research used is empirical legal research with field data through interviews with officials at the Central Tapanuli Resort Police. This study uses a statutory approach and a case approach. Data analysis in this study was carried out by selecting secondary data from library research and primary data from field research and analyzed qualitatively. The conclusion in this study is that the role and position of Bhabinkamtibmas normatively regulated in the Regulation of the Head of the National Police of the Republic of Indonesia Number 3 of 2015 concerning Community Policing, the actualization of the role of Bhabinkamtibmas of the Central Tapanuli Police in order to suppress the occurrence of criminal acts in the framework of maintaining public security and order in the District Central Tapanuli has been carried out according to statutory provisions. Obstacles in actualizing the role of Bhabinkamtibmas of the Central Tapanuli Resort Police to suppress the occurrence of criminal acts in the context of maintaining public security and order in Central Tapanuli Regency are found in aspects of this legal structure including Bhabinkamtibmas personnel who are still lacking in the quantity and facilities needed are not adequate.

Abstract

This study analyzes the fiscal policy and management of the Land and Building Tax in urban and rural sectors (PBBP2) in Binjai City and its impact on Local Revenue (PAD). The objective is to measure the potential that Binjai City has in managing PBBP2 revenue. This research method involves questionnaires and interviews with respondents selected through purposive sampling. The results showed that by combining the potential of PBBP2 objects and the ability of the apparatus, using the Boston Consulting Group (BCG) matrix analysis and Klassen typology, PBBP2 revenue in Binjai City falls into the "question mark" category requiring urgent development as one of the main sources of PAD in the future. The "dog" category, which indicates low PBBP2 revenue and growth, needs to be avoided. In Klassen's typology approach, underdeveloped PBBP2 areas (low growth and low income) should be prioritized to overcome relative underdevelopment through a collaboration of the Binjai City government, administrative modernization, and validation of the PBBP2 database. In conclusion, PBBP2 revenues in Binjai City require further development as a major source of future revenue. However, challenges related to PBBP2 revenue and growth in certain areas must be addressed through cross-sectoral cooperation.

Abstract

Muḍārabat agreement in financing system by shariāh banks supposedly refers to the freedom of contract (al-hurriyāt). However, Bank Sumut Shariāh as one of the shariāh banks in Indonesia apparently does not apply this principle in the financing schemes. This study presents an analysis of the use of muḍārabat agreement in the financing system, according to its justice and beneficial principles. The study was carried out through exploratory and descriptive observations, while the obtained data was analyzed using an in-depth descriptive content method. The results revealed that the bank intends to implement a non-shariāh agreement instead of muḍārabat agreement in the financing system. The agreement is supposedly constructed according to al-hurriyāt where both parties have fair and proportional obligations and rights. Expectedly, it will imply to the raise of other benefits and equities in the economic growth and financing system, especially to those of the small and medium scale enterprises.

Abstract

This research was conducted to determine how the regulation and application of the law on the imposition of cigarette excise in the Bintan FTZ (Free Trade Zone) and how the Tanjungpinang Customs Office oversees the circulation of illegal cigarettes in the Bintan FTZ. This research is empirical juridical research with a descriptive nature. It is known that the legal arrangements regarding the imposition of cigarette excise at FTZ Bintan refer to Law Number 39 of 2007, Law Number 36 of 2000 as last amended by Law Number 44 of 2007, PP Number 41 of 2021, and Ministerial Regulation Finance Number 34/PMK.04/2021. The application of this law can be seen from the substance of the law, where the law on the imposition of cigarette excise in the Bintan FTZ is subject to cigarette excise. From the legal structure, law enforcement overseeing illegal cigarette distribution in the Bintan FTZ consists of Customs, TNI, Polri, the Attorney General's Office, the Judiciary, and the Civil Service Police Unit as supporters. In terms of legal culture, the decline in the results of controlling illegal cigarettes in the Bintan FTZ shows that the level of public trust in the provisions of the Excise Law has begun to increase. Supervision carried out by Tanjungpinang Customs and Excise is carried out in 2 (two) ways, namely preventive and repressive.

Abstract

Skimming crime is an act of stealing credit or debit card information by illegally copying information contained on the magnetic stripe of a credit or debit card. Generally, skimming criminals in carrying out their actions, perpetrators put a skimmer device on an ATM machine where this tool is useful for duplicating data from the victim's ATM. The type of legal research is juridical normative with conceptual approach methods and legislation with instruments of collecting observational data, documentation studies and interviews. The data analysis is descriptive analytical. In its role, the Police has a very important position to overcome and handle and conduct investigations and investigations of theft using skimmers. Various tasks that have been tried by the Cyber Sub-Directorate of the North Sumatra Police in tackling the crime of money theft using skimmers are in accordance with applicable regulations in Law No. 2 of 2002 concerning the National Police of the Republic of Indonesia. Police efforts are an integral part of social policy. The victim suffered a reported loss of theft and duplication of data (skimming) without the knowledge and consent of Bank Sumut (victim) and suffered a loss of +/- Rp. 4,700,000,000-, (four billion seven hundred million rupiah), then the victim made a report on the incident to the SPKT POLDA SUMUT, so that the reported person could be processed.

Abstract

This study aims to determine the application of Article 2 Paragraph (2) to decision No: 29/Pid.Sus-TPK/2021/PN.Jkt.Pst. The subject matter focuses on how the application of Article 2 Paragraph (2) and the judge's consideration of the decision. The research method used is juridical-normative with a statutory and case approach with data analyzed descriptively and analytically. The results showed that the judge did not apply Article 2 Paragraph (2) but instead applied Article 12 letter b, even though the Covid-19 pandemic was included in the elements of certain circumstances. Whereas judges have the authority to make decisions outside the indictment to create decisions that are in favor of the community. Not applying Article 2 Paragraph (2), the judge could not apply Perma No. 1 of 2020 Sentencing Guidelines Article 2 and Article 3 in his considerations even though the defendant's actions had fulfilled the classification of the Perma. In addition, the mitigating consideration by the judge that the defendant had been found guilty and was reviled by the community did not reflect a just decision with an orientation towards moral, social, and legal justice.

Abstract

The credit agreement is binding on both parties. The offending party, especially those who do not comply with the agreement, will be subject to binding legal regulations and consequences. Legal consequences that must be borne by the offending party can be in the form of contract cancellation, compensation, and even fines. The research method used is normative juridical by conducting a case approach to Decision number 290/Pdt.G/2021/PN Mdn and related laws and regulations. The data analysis used is descriptive analysis with an approach to primary data and secondary data. The result of the research is that the legal rules regarding defaults on credit agreements are regulated in Article 1238 of the Civil Code. The mechanism for granting credit is carried out by paying attention to the 5C principle and the 7P principle. What is considered by the judge in handing down decision number 290/Pdt.G/2021/PN Mdn is the Exception of the Defendants, the evidence of the letters submitted by the Plaintiff and the Defendants, the Plaintiff's lawsuit.

Abstract

Perairan Muara Sungai Banyuasin merupakan daerah yang sangat dinamis dan biasa  dimanfaatkan untuk aktivitas masyarakat sekitar, sehingga mempengaruhi perubahan kondisi perairan. Klorofil-a merupakan salah satu parameter produktivitas primer yang dapat mengetahui kualitas perairan. Teknologi penginderaan jauh dapat mempermudah dalam mendapatkan distribusi dan konsentrasi klorofil-a di perairan. Tujuan penelitian ini untuk menguji akurasi citra Landsat-8 yang sesuai dalam mengekstraksi konsentrasi klorofil-a di perairan Muara Sungai Banyuasin menggunakan algoritma Wibowo et al. (1994) dan Pentury (1997), mengetahui pola sebaran secara spasial klorofil-a pada data lapangan dan data citra di Muara Sungai Banyuasin, serta menganalisis distribusi klorofil-a pada tiap musim tahun 2022 di Muara Sungai Banyuasin. Penelitian ini telah dilaksanakan pada bulan Oktober – November 2022. Hasil penelitian ini menunjukkan uji validasi antara kedua algoritma didapatkan algortima Wibowo et al. (1994) dari persamaan regresi linear (y = 1,4691x - 1,2669) yang lebih sesuai dengan R2 0,918 dan RMSE terendah yaitu 0,0924. Pola sebaran konsentrasi klorofil-a di Muara Sungai Banyuasin antara data lapangan dengan data citra menunjukkan nilai yang tidak jauh berbeda, dengan nilai pada insitu berkisar 2,22–3,35 mg/m3 sedangkan data citra 1,68–3,79 mg/m3. Rata-rata konsentrasi pada musim barat, peralihan I, timur, dan peralihan II pada tahun 2022 sebesar 2,41–3,71 mg/m3.  The Banyuasin River Estuary are very dynamic area and usually used for the activities of the surrounding community, thereby affecting changes in water conditions. Chlorophyll-a is one of the primary productivity parameters that can determine water quality. Remote sensing technology can make it easier to get the distribution and concentration of chlorophyll-a in waters. The purpose of this study was to test the accuracy of Landsat-8 imagery that is suitable for extracting chlorophyll-a concentrations in the Banyuasin River Estuary waters using the Wibowo et al. algorithm. (1994) and Pentury (1997), determined the spatial distribution pattern of chlorophyll-a in field data and image data in the Banyuasin River Estuary, and analyzed the distribution of chlorophyll-a in each season in 2022 in the Banyuasin River Estuary. This research was held in October to November 2022. The results of this study showed that the validation test between the two algorithms was obtained by the Wibowo et al. (1994) from the linear regression equation (y = 1,4691x-1,2669) which is more suitable with the R2 of 0.918 and the lowest RMSE of 0,0924. The distribution pattern of chlorophyll-a concentrations in the Banyuasin River Estuary between field data and image data shows values that are not much different, with insitu values ranging from 2.22–3.35 mg/m3 while image data is 1,68–3,79 mg/m3 . The average concentration in the west season, transition I, east, and transition II in 2022 is 2,41–3,71 mg/m3.
