Abstract

This study analyzes the fiscal policy and management of the Land and Building Tax in urban and rural sectors (PBBP2) in Binjai City and its impact on Local Revenue (PAD). The objective is to measure the potential that Binjai City has in managing PBBP2 revenue. This research method involves questionnaires and interviews with respondents selected through purposive sampling. The results showed that by combining the potential of PBBP2 objects and the ability of the apparatus, using the Boston Consulting Group (BCG) matrix analysis and Klassen typology, PBBP2 revenue in Binjai City falls into the "question mark" category requiring urgent development as one of the main sources of PAD in the future. The "dog" category, which indicates low PBBP2 revenue and growth, needs to be avoided. In Klassen's typology approach, underdeveloped PBBP2 areas (low growth and low income) should be prioritized to overcome relative underdevelopment through a collaboration of the Binjai City government, administrative modernization, and validation of the PBBP2 database. In conclusion, PBBP2 revenues in Binjai City require further development as a major source of future revenue. However, challenges related to PBBP2 revenue and growth in certain areas must be addressed through cross-sectoral cooperation.

Abstract

This research was conducted to determine how the regulation and application of the law on the imposition of cigarette excise in the Bintan FTZ (Free Trade Zone) and how the Tanjungpinang Customs Office oversees the circulation of illegal cigarettes in the Bintan FTZ. This research is empirical juridical research with a descriptive nature. It is known that the legal arrangements regarding the imposition of cigarette excise at FTZ Bintan refer to Law Number 39 of 2007, Law Number 36 of 2000 as last amended by Law Number 44 of 2007, PP Number 41 of 2021, and Ministerial Regulation Finance Number 34/PMK.04/2021. The application of this law can be seen from the substance of the law, where the law on the imposition of cigarette excise in the Bintan FTZ is subject to cigarette excise. From the legal structure, law enforcement overseeing illegal cigarette distribution in the Bintan FTZ consists of Customs, TNI, Polri, the Attorney General's Office, the Judiciary, and the Civil Service Police Unit as supporters. In terms of legal culture, the decline in the results of controlling illegal cigarettes in the Bintan FTZ shows that the level of public trust in the provisions of the Excise Law has begun to increase. Supervision carried out by Tanjungpinang Customs and Excise is carried out in 2 (two) ways, namely preventive and repressive.

Abstract

Skimming crime is an act of stealing credit or debit card information by illegally copying information contained on the magnetic stripe of a credit or debit card. Generally, skimming criminals in carrying out their actions, perpetrators put a skimmer device on an ATM machine where this tool is useful for duplicating data from the victim's ATM. The type of legal research is juridical normative with conceptual approach methods and legislation with instruments of collecting observational data, documentation studies and interviews. The data analysis is descriptive analytical. In its role, the Police has a very important position to overcome and handle and conduct investigations and investigations of theft using skimmers. Various tasks that have been tried by the Cyber Sub-Directorate of the North Sumatra Police in tackling the crime of money theft using skimmers are in accordance with applicable regulations in Law No. 2 of 2002 concerning the National Police of the Republic of Indonesia. Police efforts are an integral part of social policy. The victim suffered a reported loss of theft and duplication of data (skimming) without the knowledge and consent of Bank Sumut (victim) and suffered a loss of +/- Rp. 4,700,000,000-, (four billion seven hundred million rupiah), then the victim made a report on the incident to the SPKT POLDA SUMUT, so that the reported person could be processed.

Abstract

This study aims to determine the application of Article 2 Paragraph (2) to decision No: 29/Pid.Sus-TPK/2021/PN.Jkt.Pst. The subject matter focuses on how the application of Article 2 Paragraph (2) and the judge's consideration of the decision. The research method used is juridical-normative with a statutory and case approach with data analyzed descriptively and analytically. The results showed that the judge did not apply Article 2 Paragraph (2) but instead applied Article 12 letter b, even though the Covid-19 pandemic was included in the elements of certain circumstances. Whereas judges have the authority to make decisions outside the indictment to create decisions that are in favor of the community. Not applying Article 2 Paragraph (2), the judge could not apply Perma No. 1 of 2020 Sentencing Guidelines Article 2 and Article 3 in his considerations even though the defendant's actions had fulfilled the classification of the Perma. In addition, the mitigating consideration by the judge that the defendant had been found guilty and was reviled by the community did not reflect a just decision with an orientation towards moral, social, and legal justice.

Utilizing a comprehensive literature review, the research defines the scope, selects relevant databases, incorporates reputable reports, evaluates sources for credibility, and meticulously documents findings. This structured approach ensures a thorough understanding of cybercrime complexities and governance measures. Key areas include balancing security and privacy, public-private partnerships, and ongoing vigilance and collaboration to strengthen cyber governance against dynamic threats.

Abstract

Law enforcement against illegal cultivation in the Watershed area is a significant challenge, especially in Simalungun Regency. This study aims to analyze the effectiveness of law enforcement against illegal cultivation, the obstacles faced, and the policies needed to overcome these problems. The research method used is a qualitative approach with data collection techniques through in-depth interviews, field observations, and document studies. The results of the study show that law enforcement efforts have been carried out through repressive approaches, such as joint operations and legal sanctions, as well as preventive approaches, such as socialization and education. However, its effectiveness is still hampered by limited resources, lack of coordination between agencies, resistance of local communities, and lack of accurate data related to watershed management. Some of the recommended strategic policies include capacity building for law enforcement officials, community empowerment through alternative livelihood programs, strengthening technology-based monitoring systems, and participatory approaches in policy formulation. The implementation of holistic and inclusive policies is expected to create a balance between environmental conservation and improving community welfare. This research emphasizes that sustainable watershed management requires synergy between legal, social, and technological approaches. Thus, law enforcement efforts are not only able to overcome legal problems but also build collective awareness to preserve the environment.

Abstract

This study aims to analyze the quality and factors that influence public services at the Library and Archives Service of North Sumatra Province. The services available at the North Sumatra Provincial Library and Archives Service are public services, children's services, deposit services, reference services, digital services and mobile library services. The research method used is descriptive research with a qualitative approach. Data collection techniques used observation, study documentation and interviews. Data analysis used descriptive analysis. The results of this study indicate that the quality of public services at the Library and Archives Service of North Sumatra Province refers to Zeithaml's theory, namely from the dimensions: 1) Reliability (reliability); 2) Responsiveness (responsiveness); 3) Assurance (guarantee); 4) Empathy (empathy); 5) Tangibles (physical evidence). Everything has been done well, but the Tangibles dimensions (physical evidence) have not been maximized in the form of the problematic INSLISLITE application, the room temperature is not cold enough, the room lacks lighting. Factors that affect Public Service Services at the Library and Archives Service of North Sumatra Province are: 1) Inadequate facilities; 2) Budget that has not been maximized.

Abstract

he rise of criminal acts of theft of oil palm plantations is mainly due to law enforcement that is not firm in the sense that it cannot have a deterrent effect on perpetrators of criminal acts. This is because many of the theft cases have a value of less than Rp. 2,500,000, so it is considered a minor crime. This causes people who have lost most of their livelihoods to feel frustrated, causing some people to lose their minds by taking vigilante actions. Based on this, the formulation of the problem in this study: 1) What are the legal rules regarding theft after the issuance of Perma No. 2 of 2012 in Indonesia. 2) How to steal people's oil palm plantations afterithe issuanceiof Perma No. 2 of 2012 in the Legal Area of Hinai Police, Langkat Regency. 3) How to prevent the loss of smallholder oil palm plantations due to theft of plantation produce which is categorized as a minor crime. The research method used is descriptive method, while the data analysis technique uses qualitative. The results of the study show that the legal regulations regarding light theft after the issuance of Perma Number 2 of 2012 in Indonesia are increasingly less strict. This is because the criminal threa in Article 364 of the Criminal Code, which is only 3 months old, means that suspects or defendants of minor crimes cannot be subject to detention, and the examination procedure used is a quick examination procedure. If referring to the provisions in the Criminal Code and Perma No. 2 of 2012 concerning the limits of adjustmen for minor crimes, then the act is categorized as a minor crime However, if the Plantation Law is used, the perpetrator of a crime will be subject to a threat of 4 years in prison. The police as law enforcer basically do not agree with the issuance of Perma No. 2 of 2012. Theft of people's oil palm plantations after the issuance of Perma No. 2 of 2012 in the Legal Territory of the Hinai Police, Langkat Regency, has long been a concern considering the losses caused to oil palm farmers. However, the handling of the perpetrators of the theft of people's garden products tends to be done by mediating, namely seeking so that the victims of theft can get proper compensation for the crops stolen by the perpetrators. The ways that can be done to prevent losses to oil palm plantation farmers due to the theft of their plantation products are: excluding the theft of people's plantation products from minor crimes by implementing the Plantation Law, carrying out strict law enforcement against gardeners who have been harmed by ninja, and urging the farming community to supervise their gardens more by collaborating among farming communities to narrow the space for thieves.

Abstract

The purpose of this paper is to examine and analyze the legal arrangements, roles, and barriers of the labor inspectorate of North Sumatra Province in dealing with labor issues and legal protection for the social security benefits of employment at PT. Superior Tips. This type of research is normative juridical research which refers to the legal norms contained in the legislation. The approach method in this research is used to analyze the research objectives. 3 of 1951 concerning the Statement of Enforcement of the Labor Inspection Law, Regulation of the Labor Inspector in the Regulation of the Minister for Empowerment of State Apparatus No. 30 of 2020 concerning the Functional Position of the Labor Inspector, and the Regulation of the Labor Inspector in the Regulation of the Minister of Manpower Number 33 of 2016 concerning Procedures for Labor Inspection. The role of the Labor Inspector of North Sumatra Province in providing legal protection for the social security benefits for employees at PT. Superior Tips. Barriers faced by the Labor Inspector of North Sumatra Province in providing legal protection for social security benefits at PT. Superior tips can be reviewed from several aspects, namely: Barriers from aspects of legal substance; Barriers from the institutional aspect; Barriers from the aspect of facilities and infrastructure.

Abstract

This study aims to explain how to implement Government Regulation Policy Number 17, 2020 concerning Amendments to Government Regulation Number 11, 2017 concerning Management of Civil Servants in Career Development at the Civil Service and Human Resources Development Agency of Padangsidimpuan. This research is designed as a qualitativeresearch with a phenomenological approach that requires researchers to examine a number of subjects by being directly involved and in a relatively long time in order to develop patterns and relationships of meaning. The results of this study looking for four dimensions: first, from the communication dimension that explains the education and training that personality improvement and the inculcation of the spirit of devotion in accordance with the results of the study. Second, from the dimension of resource availability, it is also important in order to carry out Career Development well. Third, for the Disposition dimension regarding the availability of implementers to carry out these public policies, skills alone are not sufficient, without the availability and commitment to implement policies. Fourth, for the dimensions of the Bureaucratic Structure explained that the mutations of BKPSDM employees who experienced it partially felt that they were in accordance with their competencies.
