Abstract

The development of the modus of corruption criminal act in Indonesia today has indicated a wide scale and become more sophisticated so that it is very difficult to prove it. One of the methods to uncover this organized crime of corruption is by using the role of whistleblowers that can help uncover the modus of corruption criminal act more easily. Unfortunately, whistleblowers and justice collaborators in corruption case in Indonesia have not received maximal legal protection; in consequence, people who want to expose the crime and who have the right to gain reward will go to prison instead. In Indonesia, judicial normatively, based on Law No.13/2006, whistleblowers and justice collaborators have not yet received maximal legal protection. The same is true for SEMA No.4/2011; whistleblowers and justice collaborators only received leniency of a sentence. The ideal legal protection is by giving reward, treatment, and protection from all charges as the compensation for what a whistleblower has exposed, whether he is one of the perpetrators or not. Abstract

Recently, corruption has been a serious public attention. Whether or not the criminal act of corruption develops cannot be separated from the element of law enforcer. To anticipate the development of corruption, the law enforcers take the steps, among other things, through the process of investigation. This step is a part of the government efforts to reenforces law under the term of criminal policy or from the aspect of criminal law enforcement policy. In Indonesia, investigating the criminal act of corruption is carried out by three institutions such as Police, Attorney and Corruption Eradication Commission (KPK), Due to the limitation of KPK, the investigation at regional level is focused in the Police and Attorney regional affice. The corruption investigation process cannot be separated from the problems related to technical and non-technical process of criminal justice system. In Medan and its vicinity, the investigation of the criminal act of corruption is focused on Medan Resort Police Departement and Medan Attorney Regional Office. The authority to do the investigation is legal according to the law. Yet, in practice, this authority is less optimally empowered by both institutions, in the scope of its job description in the past three years. To cope with less optimal investigation problem, in the future, Medan Resort Police Department and Medan attorney Regional Office will cooperate with the academicians to provide workshop or seminar, to make staff study, to schedule the investigation of the criminal act of corruption in the scale of priority, to increase the number of investigators, to synchronize the perception of investigators in corruption case investigation. The still rooted culture of corruption will be cahanged through investigating the cases of criminal act of corruption. Community participation in the process of corruption case investigation will be improved and the culture of discipline of government apparatuses will be optimalized.

Abstract

ABSTRACTProsecutors acting prosecuting a person suspected of committing crimes is based on Article 8 paragraph (2) of Law No. 16 of 2004 on the Attorney RI. In prosecuting attorney acting for and on behalf of the State. To prosecute a person suspected of committing a crime, the prosecutor is allowed to waive the case in the public interest pursuant to Article 35 letter c. Law No. 16 of 2004 on the Attorney RI. On the other hand the prosecuting attorney must uphold the principle of equality before the law. Authority to waive the case prosecutor apparently misused by the Attorney on specific cases. For example: Case BLBI and Bibit-Chandra case. Setting principles and opportunity in the Code of Criminal Procedure Law. 16 Year 2004 on Indonesian Attorney can not give an explanation although expressly recognized the principle of opportunity. Criminal Procedure Code recognizes the principle of opportunity, however, the Criminal Code does not provide an explanation about this. While in Law. 16 of 2004 on the Attorney RI, the principle of opportunity provided for in Article 35 letter c as the authority of the Attorney General in the case of a waiver in the public interest. Regarding the public interest itself also still can cause a variety of different interpretations due to the Criminal Procedure Code and the Law. 16 Year 2004 on Indonesian Attorney formulate the common definition is too broad and should be returned or refer to the ideals of the law or of the nation as expressed in the preamble of the 1945 Constitution of the Republic of Indonesia. The results showed that: Should termination prosecution done really pay attention to grounds for termination of prosecution; Better regulation principles set opportunity in more detail and specific especially in providing the sense of "the public interest", and should provide limits understanding of the categories included in "the interests of general ".Key Words : Termination of prosecution; Termination of investigation, and the interest of the public.

Abstract

ABSTRACTArrangement complaint about a crime has been arranged expressly in the Book of the Law of Criminal Law Article 72-75 of the Criminal Code. Complaints that have been filed may be withdrawn if still within the grace period of 3 ( three ) months after the complaint is filed ( Article 75 of the Criminal Code). The practice of the law in the Supreme Court decision No. 1600 K/PID/2009. Supreme Court Justice existing legal provisions in the Criminal Code with the advanced legal purpose of restoring the balance that occurs due to a crime and restorative justice teachings that conflict is not simply a crime as a violation of state and public interest but a conflict also represent disrupted and broken relationship between two or more individual in public relations . The panel of judges who handle cases in the decision No.1600 K/PID/2009 has given consideration First Objective of criminal law that is to restore the balance that occurs between the perpetrator and the victim because of the criminal act ; Second : It has been done for peace between the perpetrator and the victim ; Third : To maintain individual relationships within social relationships , especially parties to the conflict are bound family relationship is between the law and the law; Fourth : that the teaching of restorative justice that the judge must be able to facilitate conflict resolution satisfactory to unite the parties to the dispute.

Abstract

ABSTRACTIndonesia as an archipelago has an abundant of fish resources. Geographically, Indonesia is located strategically, for which this condition becomes a challenge, and it is our responsibility to maintain, guard, and conserve these resources. This strategic condition will automatically attract foreign ships to do illegal fishing, particularly in ZEEI (Indonesian Exclusive Economy Zone) in the Area of Fishery Management of the Republic of Indonesia. The result of the research showed that the consequence of the illegal fishing in the area of fishery management of the Republic of Indonesia by foreign fishermen is very big; it amounts to 30 quintillion rupihs each year. It is recommended that, in order to cope with the criminal act of illegal fishing in the Area of Fishery Management of the Republic of Indonesia, particularly in the Indonesia Exclusive Economi Zone, the government should be serious in enlarging the budget for the supervision and furnish equipment and infrastructure which are related to supervision.Keywords: Criminal Act of Illegal Fishing

Abstract

ABSTRACT   In Law No. 15/2001 on brand, the caharacteristics of the criminal act of brand counterfeiting belong to the statement that all criminal act of brand counterfeiting is a violation that it is more to private than public law in nature, the characteristic of criminal law is increasingly less raised, the ordinary offense is changed into a crime on complaint, and the imprisonmentis reduced from 7 years to a maximum of 5 years. The law enforcement resulted in the uncertainty of law and justice. Different court decisions based on different criminal charge and even different imposed articles are given to the matters of the same cases. Abstract

ABSTRACT Law No. 23/2003 on Child Protection is initially intended to protect children and to ensure their safety by providing security for their rights. Nevertheless, sexual harassment toward children often occurs and indicates its escalation even though it is regarded as a felony. How about the regulation on sexual harassment according to the criminal law in Indonesia, how about the enforcement of criminal law in judex facti in the case of sexual harassment toward children under the Verdict No. 2417/Pid.B/2008-Mdn, in conjunction with the Verdict No. 38/Pid/2009/PT-Mdn, and how about the enforcement of criminal law in judex juris on sexual harassment toward children under the Verdict No. 1202K/Pid.Sus/2009.The research used juridical normative method with prescriptive analytic. Sexual harassment toward children is regulated in the Criminal Code, in Law No. 23/2003 on Child Protection, and in Law No. 23/2004 on the Abolition of Violence in Household. The enforcement of criminal law in judex facti under the  Verdict No. 2417/Pid.B/2008-Mdn, in conjunction with the Verdict No. 38/Pid/2009/PT-Mdn is in line with law of criminal procedure. Handing down a verdict is based on the authentication  theory according to law negatively and follows fault theory although the victim’s fault is not considered. The enforcement of criminal law in judex juris under the Verdict No. 1202K/Pid.Sus/2009 is in line with law of criminal procedure and reflects the theory of the victim’s fault. Abstract

ABSTRACT Distributing Imported Horticultural Fresh Products to consumers takes a long time or days so that they have to meet the quality standard and/or food security so that they will be safe to be consumed and will not harm consumers health and social welfare. Article 88 Paragraph 1 and 4 of law No.13/2010 on Horticulture regulate responsibility that everyone who distributing imported horticultural fresh products have to meet quality standard and/or food security. Criminal provision expressly stated in the article 128 and 129 of law No.13/2010 on Horticulture, anyone who distributing imported horticultural fresh products that do not meet the quality standard and/or food security required criminally accountable for his actions because it is very harmful to human health both present and future generations. The Criteria of quality standard and/or food security is stipulated in PP No.28/2004 on Food, Quality and Nutrition. Criminal responsibility, applied to perpetrators in criminal act and implemented in the principle of “no crime without any fault”. Fault aspects can be in the form of taking responsibility, willfulness or negligence and excusing liability. The three aspects cannot be separated since they depend on one to another consecutively, an indispensable element for legal subject to be accountable committing the criminal act distributing imported horticultural fresh products that do not meet the quality standard and/or food security. Legal subjects that anyone can be responsible consist of Individuals,Official Empowered to have autority in giving permit, supervision in distributing imported horticultural fresh products, and corporate comprising legal entity and is not a legal entity.

Abstract

ABSTRAK Law No. 6 of 2011, include the presence of civil servant investigators, which is provided for in Article 105, which confirms that immigration investigators are authorized as a criminal offense Immigration investigators conducted in accordance with the provisions of this Act. Meanwhile, in Article 107 it is explained that in conducting an investigation, criminal offense Immigration investigators must coordinate with Indonesian police officer  to prevent misleading in the investigation.  Investigation process to Foreigners by Law No. 6 of 2011 on Immigration in accordance with Article 105 where investigators Immigration is authorized as a criminal offense Immigration investigators. Semarang First class Immigration Office investigators in 2013 has been investigating 9 immigration and criminal cases. They have sent 3 cases to the public prosecutor in the State Attorney Semarang.  The Coordination between first class Immigration Office investigators and Korwas PPNS Central Java Police’s special criminal unit doesn’t went according to the present law. This condition is caused by Semarang first Class Immigration Office investigators did not give written notice of the commencement and the result of the investigation and to provide a copy of the case to Korwas PPNS. Abstract

ABSTRACT   Criminal sanction contained in Article 137 paragraph b. Act No. 35 of 2009 on Narcotics and Article 3 Jo. Article 2 (1) c. Act No. 8 of 2010 on the Eradiction and Prevention of Money Laundering, especially regarding imprisonment there are differences regarding liability, there is a lighter sentences in Article 137 paragraph b. Act No. 35 of 2009 that is at least 3 year and maximum 10 years in prison, while Article 3 Jo. Article 2 (1) of Act No. 8 of 2010, the criminal prison at most 20 years. Similarly, the sanctions imposed penalties, the Narcotics Act least Rp. 500.000.000,- (Five Hundred Million Rupiahs) and at most Rp. 5.000.000.000,- (Five Billion Rupiahs), while in the Anti Money Laundering Act a fine of Rp. 10.000.000.000,- (Ten Billion Rupiahs). On the one side, the Narcotics Act and Anti Money Laundering Act serves to combat criminal narcotics, but, on the other side, the Narcotics Act and Anti Money Laundering Act can use to lighter legal provisions to prosecute offenders. The problems that stand out in this study is how the reasoning of judges at first instance and appeal against money laundering predicate offenses with a crime associated with the narcotics Court Decision No. 1243/Pid.B/2o12/PN.Mdn., dated October 8th, 2012 that criminalized by Article 137 paragraph b. Act No. 35 of 2009, when according to the fact that unfold before trial, the accused can be punished with the provisions of Article 3 Jo. Article 2 (1) c. Act No. 8 of 2010. After doing some research, the conclusion found that the more specific provisions of law applicable when the legislators did intend to enforce the criminal provisions as a condition of a special nature. Associated with the court’s rulling, the judge has the right and correct in applying the law as lex specialis principle requires that law enforcement systematic use of more specific rules, such as Act No. 35 of 2009 about Narcotics.
