Abstract

The increasing involvement of children in narcotics abuse in Indonesia poses significant challenges for juvenile justice and child protection systems. This study examines the criminal responsibility of child offenders from a restorative justice perspective, focusing on the implementation of diversion and rehabilitative approaches. Using normative legal research and analysis of legislation, case studies, and court decisions, particularly case No. 53/Pid.Sus.Anak/2017/PN.Jkt.Brt, the research highlights the gap between progressive laws and their practical application. Findings reveal inconsistent diversion efforts and limited rehabilitation support, resulting in punitive rather than restorative treatment of child offenders. The study concludes that comprehensive reform is necessary to ensure a juvenile justice system that prioritizes the best interests and future well-being of children involved in narcotics offenses.

Abstract

Depending on its kind, content, and treatment, soil can have a variety of qualities. Stabilization is therefore required to increase the soil's bearing capacity. The use of supplemental materials like pumice and Hebel (lightweight brick) is one approach to boost the soil's bearing capacity. Hebel is a lightweight, permeable material that helps ease the burden on the soil. The study was conducted in two stages: 1) Evaluating the physical properties of the soil; 2) Compaction test As per the AASHTO classification, the soil falls within the clay soil category (A-7-6). The soil falls within the category of inorganic clay soil with a low to medium degree of flexibility according to the USCS classification. Because lightweight bricks and pumice have a high lime content, which increases the soil's bearing capacity, test results showing their addition to the soil using the standard proctor showed an increase of up to 15% from the original soil.

Abstract

Through a holistic approach to the conceptualization of progressive law, this research aims to analyze and provide a comprehensive view of the fragile meaning of law in Indonesia after the MKMK decision Number 2/MKMK/L/11/2023 as viewed from progressive law. This research is normative or dogmatic legal research which refers to two data sources: primary and secondary. The primary source refers to MKMK Decision Number 2/MKMK/L/11/2023. Furthermore, secondary sources include law books, law research results, and the views of experts, especially the Progressive Law paradigm by Prof. Satjipto Rahardjo. The research results show that MKMK Decision Number 02/MKMK/L/11/2023 marks the point of fragility of the meaning of law in Indonesia based on violations of the Constitutional Court Judge's Code of Ethics and Behavior by Anwar Usman as Chief Judge of the Constitutional Court at the time of ratification of Constitutional Court Decision Number 90/PUU -XXI/2023 which is full of personal interests. The “nemo judex in causa sua” principle in law indicates that a judge cannot handle cases involving his interest. That is important to revitalize the meaning of law by promoting progressive law that prioritizes morality to minimize ethical defects in the rule of law in the future.

Abstract

This study aims to determine and analyze the effect of  Commitment and Organizational Culture on  Employee Performance through Organizational Citizenship Behavior as an intervening variable at the Public Works and Spatial Planning Department of Parepare. This research uses a quantitative method approach with a sample is 71 employees. Research data analysis is processed using the Smart PLS analysis.  The data collection methods used were questionnaires, observation, and documentation. The results obtained in the study are as follows: Organizational commitment has a positive and significant effect on employee performance; organizational culture has a positive and significant effect on employee performance; organizational citizenship behavior has a positive and significant effect on employee performance; organizational culture has a positive and significant effect on employee performance through organizational citizenship behavior; and organizational commitment does not have a significant effect on employee performance through organizational citizenship behavior among employees of the Department of Public Works and Spatial Planning in Parepare City. Therefore suggested that to enhance employee performance, the Department of Public Works and Spatial Planning in Parepare City should prioritize strengthening organizational culture, commitment, and organizational citizenship behavior (OCB). A strong culture and high OCB directly improve performance, with culture also influencing performance indirectly through OCB. This indicates that fostering shared values and encouraging voluntary, proactive behavior among employees are essential strategies. However, the lack of a significant indirect effect of organizational commitment through OCB implies that commitment alone is not enough to drive extra-role behavior. Therefore, management must implement programs that not only build commitment but also translate it into meaningful actions. Enhancing communication, recognition, and leadership support can further stimulate OCB and improve overall performance. These findings highlight the importance of aligning organizational values and behaviors to achieve optimal employee outcomes.

Abstract

The phenomenon of parents revoking their children's inheritance rights is still found in society, even though Islamic inheritance law has clearly defined the share of each heir. A case that occurred in Tanjung Mulia Village, South Labuhan Batu Regency, shows that a father unilaterally revoked his son's inheritance rights because of the son's behavior as a drug addict. This action raises a dilemma between the moral will of the parents and the binding provisions of Sharia law. The purpose of this study is to analyze the factors behind the revocation of inheritance rights and to examine the views of the Indonesian Ulema Council (MUI) of South Labuhan Batu Regency on this case. This study uses a qualitative method with an empirical juridical approach through in-depth interviews with family members, community leaders, village officials, and the local MUI. The results of the study show that the revocation of inheritance rights is motivated by emotional, moral, and economic factors, as well as the community's misunderstanding of Islamic inheritance law. The MUI emphasizes that the revocation of a child's inheritance rights is not valid according to Sharia law, unless there are clear Sharia reasons such as religious differences or the murder of the heir. Revoking a child's inheritance rights has no valid basis because it contradicts the provisions of the Qur'an Surah An-Nisa verses 11-14, which clearly stipulate the inheritance share of each heir and cannot be changed by individual will.
