Abstract

The development of the digital era has opened up great opportunities for women in public leadership, but often their presence is reduced to symbolic representation that does not touch the substance of power, exacerbated by gender stereotypes and conservative religious interpretations. This study aims to analyze the legitimacy and contribution of women's leadership in the digital era from the perspective of Siyasah Syar'iyyah, positioning it as a contextual managerial and ethical foundation. Using a descriptive qualitative approach through library research, primary data in the form of the Qur'an and classical books and secondary data in the form of relevant books and journals are analyzed through content analysis to connect the principles of Siyasah Syar'iyyah with digital reality. The results of the study conclude that leadership legitimacy is based on the integration of al-quwwah (competence) and al-amanah (integrity) as fundamental managerial values. The transition to substantive leadership is achieved through the implementation of tahqiq al-maslahah (realization of benefits) and mas'uliyyah (accountability), which demands real-time accountability in the digital space. Therefore, the practical implication is the need for digital and political ethics education based on Islamic values ​​to ensure that women's roles are effective and have integrity.

Abstract

Throughout Islamic civilization, the synergy between economics and constitutional law has played a crucial role in achieving community welfare based on the principles of Maqāṣid al-Syarī‘ah. This study aims to analyze the contribution of Islamic constitutional law to the development of an equitable Islamic economic system. The research employs a qualitative descriptive approach through literature studies, examining various sources related to Islamic constitutional law and Islamic economics. The findings indicate that the principles of Islamic constitutional law, such as justice (‘adl), consultation (syurā), trust (amānah), and the protection of individual and communal economic rights, significantly influence the formation of a more inclusive and sustainable economic system. The implementation of Maqāṣid al-Syarī‘ah in Indonesia’s economic policies is reflected in regulations on zakat, Islamic banking, halal investment, and resource management aimed at public welfare. However, key challenges remain, including the harmonization of Islamic law with positive law and disparities in wealth distribution. Strengthening Maqāṣid al-Syarī‘ah-based policies is therefore necessary to ensure that the Islamic economic system can optimally contribute to improving societal well-being.

Abstract

Several classical Islamic legal regulations related to child protection still exhibit patriarchal tendencies, which can lead to gender inequality. This is evident in aspects such as the distribution of custody rights (hadhanah), the obligation to provide for children, and the decision-making process that affects children's lives, which are often based on literal interpretations of texts without considering the essence and universal objectives of sharia (maqashid al-syari'ah). Therefore, this research aims to reconstruct the concept of gender just child protection within the framework of Islamic law. Methodologically, this research is a library research study with a qualitative approach oriented towards philosophical- normative analysis. Primary data sources include authoritative texts of the Qur'an and Hadith, as well as classical and contemporary works of Islamic jurisprudence, while secondary sources are obtained from academic literature related to gender studies, Islamic family law, and maqashid al-syari'ah. The data analysis technique was carried out through two main stages: thematic content analysis to identify prevailing legal discourse patterns, followed by critical-reflective analysis using the maqashidiyah approach to evaluate and reconstruct these concepts. The research findings reveal that several conventional fiqh constructions regarding child protection tend to ignore the principle of substantive justice, particularly in the establishment of rigid gender roles. As an alternative, this study reconstructs the concept of gender-just child protection through a reinterpretation of the hadhanah institution as a collective responsibility (takaful) based on the principle of the benefit of the child (maslahat al-thifl).

Abstract

The transformation of digitally-based work systems and the emergence of flexible working patterns after the COVID-19 pandemic present new opportunities and dilemmas for working women. On the one hand, flexibility in working hours and locations provides women with the space to balance their professional careers and domestic responsibilities. However, on the other hand, entrenched patriarchal norms mean that they continue to bear a double burden. This study aims to reveal the mechanisms of role negotiation between husbands and wives in families where the wife has a career in the context of flexible and remote work. This study uses a phenomenological qualitative approach with data collection techniques through literature study, document analysis, and observation of developing social dynamics. The results show that remote work encourages a more equal division of roles, both in household responsibilities and emotional support between spouses. However, traditional gender norms remain a major obstacle, causing women to often face psychological and social pressure. Education and gender awareness have been proven to influence a couple's ability to adapt. This study emphasizes the need for policies that promote gender equality in flexible work systems as an effort to achieve a balance of roles in modern families.

Abstract

This study discusses gender relations in modern households, focusing on the pattern and factors of domestic labor division between dual-earner couples. The research is motivated by the persistence of patriarchal culture that causes unequal domestic roles despite women’s increasing participation in the public sphere. The aim of this study is to analyze the forms of domestic labor division, the influencing factors, and the efforts to achieve equality within modern households. Using a qualitative descriptive approach through a literature review of academic sources and statistical data, the results indicate that domestic work division is influenced by economic factors, working hours, cultural norms, education level, presence of children, and power relations in the family. Efforts to promote equality include fostering awareness and communication, utilizing household technology, and providing emotional support between partners. In conclusion, gender equality in domestic life can be achieved when husbands and wives build cooperative relationships grounded in justice and compassion as taught in Islam.

Abstract

The phenomenon of inequality in marital relations, particularly in divorce practices, remains a significant issue in the study of family law in Indonesia. One crucial point is the concept of divorce, which shapes the distribution of power between husband and wife. This study examines the issue of gender inequality in the concept of divorce in classical Islamic jurisprudence (fiqh) and Indonesian positive law. The aim of the study is to analyze the fundamental differences between the right of divorce in both systems and to assess the resulting level of gender justice. Using a comparative literature study method, this study examines Islamic jurisprudence sources, laws and regulations, and empirical findings related to divorce practices. The results show that classical Islamic jurisprudence places the right of divorce as the husband's prerogative, creating an imbalance in power relations, while positive law provides a more equal space through divorce by divorce and divorce by lawsuit. However, the implementation of positive law still presents obstacles, such as the heavy burden of proof in divorce by lawsuit and weak guarantees of post-divorce support. The novelty of this study lies in the agreement on the reconstruction of the right of divorce, which emphasizes substantive equality between husband and wife. This proposal has the potential to strengthen women's protection and improve justice in the Indonesian family law system.

Abstract

Domestic violence (DV) is a form of human rights violation that continues to occur frequently in various levels of society. One of the factors underlying domestic violence is the power imbalance between men and women in domestic relationships. From an Islamic legal perspective, the relationship between husband and wife should be based on the principles of equality, compassion, and justice. However, patriarchal culture often places men in a dominant position, creating an imbalance of power and opening up opportunities for violence. This article aims to analyze the influence of power imbalance in gender relations on domestic violence and to seek solutions to reduce this inequality in accordance with Islamic values.

Abstract

This field research provides an overview and factual and explains the various relationships of all the data obtained. This research was conducted in Majene and precisely in the working area of the Majene Religious Court. The study is based on an application for marriage dispensation. Instruments used are researchers, observation, interview, and documentation data. The judge's consideration in granting or rejecting the application for marriage dispensation at the Majene Religious Court is the completeness of the administration at the time of applying for marriage dispensation following Perma No. 5 of 2019, and there is no pro; there on marriage as in Article 8 of Law No. 1 of 1974 concerning Marriage, while still taking into account the aspects of benefit and mudharatan arising from the granting of the application for marriage dispensation.

Abstract

This study discusses the practice of implementing changes in the age limit of marriage that occur in Mattiro Sompe District. This type of research is descriptive qualitative field research. This study uses primary data sources, namely interviews with child marriage actors, the Head of the Office of Religious Affairs, and people who were considered related to the discussed topic. Meanwhile, the secondary data is from various relevant books and literature, such as RI Law Number 16 of 2019 concerning Marriage and Child Protection Law Number 35 of 2014. The result of this research / scientific papers, articles, and other documents relevant to the research's substance. For tertiary data from legal dictionaries, Encyclopedias of Islam, magazines, and newspapers. The data collection methods used are observation, interviews, and documentation. Data processing and analysis techniques are carried out through three stages: data reduction, data presentation (data display), and conclusion drawing /verification. The results of this study show that the ratification of Law number 16 of 2019 is a legal product that binds every Indonesian citizen without exception, including the people of Mattiro Sompe District, as a basis or reference for those who will carry out marriages must be as regulated in Law number 16 of 2019 concerning the age limit of marriage. The social impact of the marriage age limit is based on Law number 16 of 2019, which has been implemented in the Mattiro Sompe District. The social conditions of the people of Mattiro Sompe District, which is the majority of farmers, affect responding to changes in this age limit so that they feel objections and difficulties when implementing it. Meanwhile, those with a higher education level feel the positive impact of this change in the marriage age limit. Meanwhile, the Head of KUA Subdistrict, Mattiro Sompe, in terms of psychology, puts pressure when an application is submitted from a close family or has a kinship relationship. The application of changes in the marriage age limit does not reduce the number of cases of child marriage in Mattiro Sompe District. Still, from 3 years, the application of the marriage age limit shows an increase every year and is dominated by women.
