Abstract

The purpose of this study was to determine the effect of the discovery learning model on students' critical thinking skills in the IPAS (Science and Social Studies) subject, specifically on the topic of the States of Matter and Its Changes.The research method employed was a Quasi-Experimental design using the Non-equivalent Control Group Design. The study was conducted in the 4th grade of Madrasah Ibtidaiyah Islamiyah Ciwaru, where students were divided into an experimental group (receiving the discovery learning treatment) and a control group. The object of this research was the students' critical thinking skills. Data collection techniques included essay tests in the form of pretest and posttest, as well as observation. Data analysis was performed quantitatively using the t-test to determine the significance of the difference in the mean scores of the pretest and posttest between the two groups. The results showed a significant increase in critical thinking skills in the experimental class. The mean posttest score for the experimental class (86.63) was substantially higher compared to the control class (63.27). Based on the t-test analysis, the difference in the pretest and posttest scores between the two groups was significant, with a significance value (2-tailed) of 0.000 (p 0.05). The conclusion of this study is that the implementation of the discovery learning model is effective and can improve the critical thinking skills of 4th-grade students on the topic of the States of Matter and Its Changes.

Abstract

The status of couriers as expedited employees often raises legal issues, especially regarding fulfilling their rights as workers in the context of labour law protection in Indonesia. These legal issues are then exacerbated by enacting the labour copyright law, which is detrimental to many workers. This study aims to determine the implementation of the work agreement between the expedition company and the courier. This research analyses the work contract model between couriers and expedition companies in Pamekasan Regency. This research uses empirical legal research methods conducted at several expedition companies in Pamekasan. The result of the research is that the expedition company chooses to be financially responsible in implementing the employment contract with the courier, where the model of employment contract applied by the expedition company to the courier is a certain time employment agreement (PKWT), which is renewed every year, so there are several things that the company can avoid including severance pay, employee leave, overtime pay, and health insurance facilities.

Abstract

Violence against children is a significant social issue in Indonesia, with its incidence continually rising, signaling a concerning trend. The impacts of such violence are not limited to physical harm but also affect children’s psychological and social well-being, influencing their future development. To address this, it is crucial to strengthen efforts in protecting and fulfilling the rights of children who are victims of violence, particularly through legal frameworks. This research employs a normative legal method, focusing on library studies that analyze legal theories and applicable laws and regulations. The approach is based on a statutory method, complemented by a conceptual approach. The study’s findings indicate that the protection of children who are victims of domestic violence is governed by various national legal provisions. These provisions are primarily found in the 1945 Constitution of the Republic of Indonesia, with specific regulations in Law Number 23 of 2002 on Child Protection, later amended by Law Number 35 of 2014, and Law Number 17 of 2016, which enacts the Government Regulation in Lieu of Law Number 1 of 2016, amending Law Number 23 of 2002. This is further supported by Government Regulation Number 78 of 2021, which addresses Special Protection for Children. These legal instruments highlight the state's commitment to upholding human rights and ensuring the protection of children’s rights. However, to optimize their implementation, it is essential to strengthen related institutions and involve multiple stakeholders, including community support.

Abstract

The right to freedom of expression is a fundamental aspect of human rights, guaranteed by both the Indonesian Constitution and international human rights instruments. However, this freedom is not absolute and may be subject to restrictions through regulatory frameworks such as the Electronic Information and Transactions (ITE) Law. In practice, the application of the ITE Law has sparked controversy due to the vague and overly broad language of several provisions, leading to multiple interpretations and granting excessive discretionary power to law enforcement authorities and certain parties in controlling the dissemination of electronic information. This situation has resulted in numerous cases of criminalization, raising serious concerns about the shrinking democratic space in Indonesia. This study aims to examine the legal implications of Constitutional Court Decision Number 105/PUU-XXII/2024 in relation to freedom of expression and its limitation under the ITE Law. Employing a doctrinal legal research method with a conceptual and statutory approach, the study analyzes primary legal materials and human rights theories as its analytical framework. The findings indicate that the Court’s decision constitutes a critical corrective measure by limiting the subject of defamation offenses under the ITE Law solely to individuals. This interpretation strengthens the principle of lex certa (legal certainty), curtails arbitrary interpretation in law enforcement, and reinforces the protection of freedom of expression in the digital space. Moreover, it reflects a balanced approach between safeguarding individual rights and upholding the public interest in a democratic society.

Abstract

The peatland ecosystem in Indonesia, covering an area of 33.4 million hectares, plays a strategic role as a carbon sink, a water regulator, a habitat for biodiversity, and a foundation of community livelihood in economic, social, and cultural dimensions. However, its sustainability is increasingly threatened by land conversion, natural resource exploitation, and infrastructure development that neglects ecological principles. Weak governance, development policies prioritizing investment, and limited community participation have resulted in environmental degradation, agrarian conflicts, and the erosion of local communities’ ecological rights. Constitutionally, the right to a good and healthy environment is guaranteed under Article 28H paragraph (1) and Article 33 paragraph (3) of the 1945 Constitution, as well as Law No. 32 of 2009 on Environmental Protection and Management. This recognition is further reinforced by international instruments such as the 1972 Stockholm Declaration, the 1992 Rio Declaration, the 2015 Paris Agreement, and the Sustainable Development Goals (SDGs), which affirm environmental rights as part of third-generation human rights. Nevertheless, the implementation of ecological rights protection continues to face challenges, including weak law enforcement, limited access to justice, and the dominance of economic paradigms. This study examines the protection of ecological rights of peatland communities within Indonesia’s national legal policy through a human rights perspective, while also analyzing its harmonization with international law. The study is expected to contribute to strengthening regulation, advancing conservation strategies, and formulating policies grounded in ecological justice and human rights.

Abstract

Lahan rawa di Kabupaten Barito Kuala memiliki peran strategis bagi pertanian pasang surut, ekonomi lokal, serta sebagai penyimpan air alami yang berfungsi mencegah banjir dan kebakaran lahan gambut. Namun, keberlanjutan ekosistem rawa menghadapi berbagai tantangan, seperti alih fungsi lahan tidak terkontrol, penurunan produktivitas lahan (“taung”), dan pergeseran ke perkebunan sawit maupun karet yang berdampak pada kesuburan tanah. Permasalahan tersebut diperburuk oleh minimnya pemahaman masyarakat dan aparatur desa mengenai hak ekologis serta ketiadaan regulasi desa yang mengatur perlindungan lahan rawa. Aparatur desa juga masih terbatas dalam keterampilan mediasi dan penyelesaian konflik agraria. Untuk itu, kegiatan pengabdian ini dilaksanakan di Desa Andaman, Kecamatan Anjir Pasar, dengan fokus pada penguatan kapasitas aparatur desa dalam perlindungan hak ekologis masyarakat rawa. Kegiatan mencakup dua tahap: pertama, penyuluhan hukum terkait regulasi lingkungan dan agraria serta perlindungan ekosistem rawa; kedua, pelatihan keterampilan mediasi konflik agraria dan pendampingan penyusunan Peraturan Desa (Perdes) tentang perlindungan lahan rawa. Kegiatan ini berdampak nyata pada peningkatan pemahaman aparatur desa mengenai hak ekologis, keterampilan dalam menyelesaikan sengketa agraria, serta terbentuknya Perdes Desa Andaman sebagai instrumen perlindungan dan pengelolaan berkelanjutan ekosistem lahan rawa. Kata Kunci: Perangkat Desa, Hak Ekologis, Masyarakat Lahan Rawa.

Abstract

Process Safety is a branch of the science of safety that focuses on special accident control and characteristic of the process industry. Process Safety focuses on preventing the acute release of energy or substance in harmful quantities and limiting the magnitude and consequences of the discharge event. Process Safety can be achieved by reducing hazards and risks incurred at a wide acceptable level by the organization and / or society (Marshall and Ruhemann (IIPS), 2007). One such release is the Loss of Primary Containment (LOPC) which according to the American Petroleum Institute Recommended Practice (API RP) 754 is the release of flammable, toxic, corrosive, reactive, thermal, and pressure material from primary containment which includes: tanks, pressure vessels, pipes, trucks, rail cars, or equipment as primary containers or used for processing with the potential to cause damage. In the American Petroleum Institute Recommended Practice (API RP) 750 elements of Assuring The Quality and Mechanical Integrity of Critical Equipment that pressure vessels, machines and pipes shall be designed, manufactured, installed and maintained or inspected in accordance with required requirements. One form of corporate risk management is to conduct inspections as one of the Preventive Safeguards in Process Safety to prevent Loss of Primary Containment (LOPC). Abstract

This article reports an investigation of university students’ use of online Wikipedia site in writing their assignment or research report. Data were collected through a survey questionnaire and interview. First of all, a survey questionnaire was distributed among the learners (n=70) identifying their computer and internet literacy, frequency, strategy, and future orientation of using Wikipedia for their writing assignments or essays. Then, interviews with some lecturers (N=8) revealed teachers’ lack of awareness and agreement of Wikipedia in academic writing, partially due to the absence of Departmental policy. As the results, despite being already informed of the encyclopedia’s academic unreliability, Indonesian EFL informants in this study were proven to be familiar with computer and capable of using internet and incorporating Wikipedia materials when writing their essays at Andalas University. The data also indicated that students had improved their techniques of using the Wikipedia from copying-and-pasting to editing and paraphrasing. Half of them did not cross check Wikipedia article’s citations and references. Therefore, students’ awareness of the ease of Wikipedia may have encouraged them to consciously plagiarize in addition to the absence of their lecturers’ awareness upon this issue.
