Abstract

Perdagangan narkotika dewasa ini sangat mengkhwatirkan. Anak-anak yang notabene generasi penerus sebagai penentu kemajuan bangsa, terlibat dalam tindak pidana narkotika. Anak tidak hanya selaku penyalahguna, namun juga sebagai kurir dalam perdagangan narkotika. Hal ini tentu sangat memprihatikan, sehingga seluruh pemangku kepentingan (stake holder) harus berperan dalam melakukan pencegahan tindak pidana narkotika pada anak. Tindak Pidana narkotika mendapat ancaman pidana penjara dan denda yang berat. Inilah yang harus disadari oleh masayarakat, khususnya di daerah mitra, yaitu kelurahan Bantan Timur. Selain menyadarkan ancaman pidana, pendidikan hukum juga memberi tips agar anak tidak terlibat dalam tindak pidana narkotika, baik itu sebagai penyalahguna maupun kurir. Tentunya efektifitas dari tips pencegahan tersebut akan sangat ditetukan oleh lingkungan anak itu sendiri.

Abstract

This article discusses the analysis of the leadership role of the principal of the 14 Rantau Utara State Elementary School, Rantau Utara District, Labuhan Batu Regency. This type of research is a type of field research (field research) with a qualitative approach. The sources of data for this research are the principal, school teachers in their respective fields, school operators, representatives of several parents. Data collection methods used are observation, interviews and documentation. Then the presentation of the data goes through four stages, namely: data reduction, analyzing data, compiling data and drawing conclusions. The results of this study indicate that, the principal's leadership on school management in terms of the principal's leadership has been fairly effective, in addition to placing himself as a headmaster leader as well as a role model who always provides motivation, direction and advice to students. subordinates both to teachers and staff as well as to their students. Principals in elementary schools maintain order and school discipline, and strive for the progress of the school. In the management of facilities and infrastructure, it is still considered inadequate or not enough because the principal is constrained by funds so that he has not been able to cover the shortcomings in the school, but the principal is still trying to cooperate with the government in the progress and development of the school and can meet the needs of the school. especially in learning.

Abstract

This article aims to determine the regulation and application of the law on the importation of swallow's nests; and Quarantine investigator strategies to maximize the implementation of quarantine regulations. The research method used in this study is normative juridical with a case approach and legislation with data collection techniques, namely documentation studies and interviews with descriptive data analysis. This study shows the results that the regulation of the entry of Swallow's Nest refers to Law no. 21 of 2019 concerning Animal, Fish and Plant Quarantine and Regulation of the Minister of Agriculture Number 26 of 2020 concerning Animal Quarantine Measures Against the Importation or Exportation of Swallow's Nests To and From Within the Territory of the Unitary State of the Republic of Indonesia. In its application, there are problems, namely the sentence to the defendant is only 4 months and a fine of 6 million rupiah which is considered too low when compared to the threat of Article 86 of Law no. 21 of 2019 which is 10 years and a fine of 10 billion. Juridical efforts to maximize the application of quarantine regulations are recommended to immediately issue derivative regulations such as Government Regulations, increase the status of Quarantine UPT at least to the level of Balai and create special functions for vigilance.

Abstract

Juridical Issues Regarding Transition of Land Rights in the Object of DisputesAbstractLand is a place for human settlements as well as a source of livelihood for those who make a living through agriculture and ultimately land is also the last place for people to die. The law regarding land in Indonesia is influenced by a colonial legal system. This is because for hundreds of years Indonesia was colonized by the Dutch, so that there are two kinds of land ownership, namely lands with western rights and lands with customary rights, of course different about the transition, in terms of buying and selling, also ways of legal protection and legal certainty for the land owner concerned. Transition of land rights is a legal action aimed at transferring rights from one party to another. When someone has transferred his rights (land rights), to someone else "legally" then that person has no more rights to the land that has been transferred since the transfer of rights. The purpose of this study was to find out the process of transferring land rights in the object of the dispute and to find out the judges' consideration in deciding on land rights cases. This type of research is normative ayuridis. The nature of this research is descriptive analytical.

Abstract

Artikel ini ditulis untuk menganalisis pelaksanaan akad pembiayaan mudharabahyang dilakukan oleh bank SUMUT syariah Kota Medan Indonesia. Transaksimudharabah adalah bentuk kerja sama antara dua pihak atau lebih iaitu pemilikmodal (shahibul maal) mempercayakan sejumlah modal kepada pengelola(mudharib) dengan suatu perjanjian perkongsian keuntungan. Bentuk inimenegaskan kerjasama dengan sumbangan seratus persen modal daripadashahibul maal dan pengusaha daripada mudharib. Mudharabah adalah akad yangterjalin antara dua pihak yang melakukan perjanjian. Pihak pertamamemberikan hartanya secara tunai kepada pihak kedua agar digunakan untukberusaha, kemudian keuntungan yang diperoleh dibagi antara mereka sesuaidengan persentase yang telah disepakati. Kenyataannya, bank SUMUT Syariah diKota Medan walaupun telah memiliki fasilitas mudharabah, justeru lebihmenjalankan transaksi akad pembiayaan yang lazim. Ada kesan, mereka tidaksecara serius untuk menerapkan akad pembiayaan secara mudharabah kepadapara pedagang kecil dan menengah (UKM). Masyarakat yang ingin mendapatkanfasilitas pembiayaan mudharabah bukan saja menjadi kecewa tetapi juga dapatmempengaruhi bank syariah itu sendiri. Mengapa bank SUMUT syariah lebihmengusulkan model pembiayaan lazim berbanding dengan sistem mudharabah?Artikel kerja ini akan membahas mengenai persoalan-persoalan pelaksanaanakad pembiayaan mudharabah di bank SUMUT Syariah di Kota Medan. Untukmenjawab tulisan ini, kajian menggunakan metode yuridis normatif yang bersifatkualitatif dengan cara menganalisis data primer dan sekunder sehinggamenghasilkan jawaban dari permasalahan yang ada. Hasil yang dicapai daripadakajian ini adalah untuk menganalisis penerapan sistem mudharabah di bankSUMUT Syariah di Kota Medan sehingga dijangkakan boleh menguatkan UKMdalam penyediaan modal usaha dan penyempurnaan pembuatan aktapembiayaan mudharabah yang lebih berpihak kepada mudharib.

Abstract

Legal Protection on The Users of Public Transport Services in Medan City Transportation OfficeAbstractLegal protection is any effort that guarantees legal certainty to provide protection to passengers or consumers who use the services of business people to protect them from things they do not want. Public Transportation is one of the transportation media used by the community together by paying tariffs. The purpose of this study was to determine the legal standing of public transport passengers and their protection in accordance with Law No.22 of 2009 concerning Road Traffic and transportation. The type of writing in this study is Normative, namely a process to find a rule of law, legal principles, and legal doctrines in order to answer the legal issues at hand. Public Transport Companies are responsible for losses caused by all actions of people employed in the activities of transport operations. In addition, the Public Transport Company is responsible for losses suffered by Passengers who have died or injuries due to transportation operations, unless caused by an incident that cannot be prevented due to passenger error.

Abstract

This study aims to determine the effect of the Quality Public Services in Samsat Tebing Tinggi Office, North Sumatra Province. This research is a type of qualitative research. The result shows that the factors are the obstacles and advantages of the One-Stop Integrated Service System Efforts to Improve Public Services at the Tebing Tinggi Samsat Office, North Sumatra Province. That the Integrated Service Implementation Guidelines have been carried out optimally. However, in terms of: Facilities, there are still some obstacles, namely not yet available prayer room facilities, special parking spaces and still using public road facilities for cars and for public transportation motorbikes using a makeshift office yard and during the rainy season in December 2020 there was a 50 cm high flood which resulted in activities being stopped for 5 days. The existence of HR (human resources) in the ranks of Samsat, Bank SUMUT and the ranks of the Directorate of Traffic is very cooperative and cooperates with each other in providing services to taxpayers so that the obstacles faced are always mutual help and solid cooperation.

Abstract

The implementation of policies in the Presidential Decree PBJ has not been able to fully address the lack of community infrastructure, especially needs that are relatively simple at the village level, such as drinking water facilities, educational facilities, garbage collection, internet facilities and so on . The formulation of the research problem is how to implement and the obstacles in implementing Langkat Regent Regulation Number 19 of 2019 concerning Procedures for Procurement of Goods and Services in Village in Stabat Baru Village. The results show that the implementation in terms of communication and organizational structure has been going well, but in terms of resources and disposition it has not gone well, with the constraint factors faced in the form of difficulty coordinating with the community, lack of employee cooperation, lack of employee responsibility for work because it is more concerned with personal affairs. It is recommended that the Village Stabat Baru needs to conduct more intensive socialization regarding the importance of community involvement in PBJ. Leaders need to emphasize to employees that cooperation will be increasing important in dealing with many jobs. Leaders need to be firm in disciplining subordinates who use the working day to take care of their personal interests.

Abstract

This study focuses on explaining how the policy for determining the Sale Value of Land and Building Tax Objects for Rural and Urban Land and Building Tax (NJOP PBB-P2) is an effort to increase the regional revenue (PAD) of Medan City. The explanation of this study is built based on a qualitative method with a descriptive approach. The results of this study indicate that, the determination of NJOP PBB-P2 in Medan City has a variable NJOP PBB-P2 classification, also with a fluctuating value. Because the value is based on sectors and zones. The strategic location of the tax object will be of much greater value than in distant areas and is considered uneconomical. In the process of determining the PBB-P2 NJOP, the stages are, first, the process of collecting data on the NJOP PBB P-2 for Medan City. Second, the PBB P2 Assessment Process for Medan City. Third, the process of determining the NJOP PBB P-2 for Medan City. Fourth, the process of collecting PBB P2. In practice, the most dominant problem is the refusal of residents to pay taxes, arrears, differences in NJOP values between regions and even market values that do not match the selling price are problems that are always faced. This argument is caused by the negative image attached to the Medan City Government and the Agency in charge of collecting taxes which causes public distrust. So this study provides basic recommendations through a policy model in determining the NJOP PBB-P2 which is more just, accountable, transparent and democratic. This just, democratic policy model is seen from the dimensions of administrative modernization and the dimensions of citizen involvement. The orientation is to create a balance and healthy social relations between citizens and the government.
