Abstract

Abstract. A Board of Directors acts carefully in carrying out its duties (duty of care). In addition, in carrying out its duties, a Board of Directors may not take advantage of himself for the company (duty of loyalty). Moreover, the Company which is engaged in the insurance industry, which currently shows a tight growth because the public is more aware of insurance as part of risk management that must be prepared as early as possible for the protection of health, life, property, business / business, and others. The research aims to find out and understand the insolvency of insurance companies based on positive law in Indonesia, the position and responsibility of the directors of insurance companies that have been declared bankrupt and the responsibilities of directors who embezzle the assets of insurance companies that are declared bankrupt. The research uses normative juridical research and the nature of analytical descriptive research. Method of legislation approach (statutedapproach). The sources of library data and documents are obtained from primary, secondary and tertiary legal materials. The data collection technique is library research. Analyze data with a qualitative approach. The Company's bankruptcy occurred because the Directors' errors and omissions were insufficient to pay all of the Company's obligations in bankruptcy, each member of the Board of Directors was jointly responsible for all obligations that were not repaid from the bankrupt assets. The legal consequences of directors who embezzled the assets of insurance companies that were declared bankrupt in the form of termination of directors for embezzlement of insurance company assets, directors returned money from embezzlement of company assets, directors of bankrupt companies may not be directors in other companies and detained directors in Darkening assets. The actions of the Board of Directors of PT Asuransi Jiwa Bumi Asih Jaya carried out embezzlement of assets on the company declared bankrupt because of its ignorance or because of intentions. Legal responsibility for directors who commit asset embezzlement on companies declared bankrupt (PT. Bumi Asih Jaya) found criminal elements, namely money wiping and fraud, Directors can be punished with imprisonment or criminal penalties (Article 372 and Article 378 of the Criminal Code) accountability to his personal assets (Article 97 paragraph (3) of the Company Law) so that the members of the Board of Directors concerned are personally responsible in accordance with Article 101 paragraph (1) and (2) of the Company Law. Abstract

Abstract. Generally, TPPU is carried out in the banking sector. The form is that the perpetrators of criminal acts try to hide or disguise the origin of assets that are the result of criminal acts in various ways so that the assets resulting from crime are difficult to trace by law enforcement officials so that they freely utilize these assets for both legal and illegal activities. Money laundering activities almost always involve banks because of the globalization of banks so that through the payment system, especially those that are electronic (electronic funds transfer), the proceeds of crime that are generally large amounts will flow or even move beyond national borders by utilizing the bank's confidential factors that are generally upheld high by banking. In this study, an example of a case that has permanent legal force will be raised, namely: Medan District Court Decision No. 1738/Pid.Sus/2016/PN.Mdn., Dated 28 June 2016 An. Defendant Abdul Jalil; and Decision of the Medan District Court No. 1995/Pid.Sus/2017/PN.Mdn., Dated November 1, 2017 An. Defendant Mursalin Alias ​​Salim. North Sumatra Police investigators conduct financial analysis of the accounts concerned. It turned out that a significant flow of funds was found to Abdul Jalil from the suspect An. Mursalin Alias ​​Salim. Efforts to strengthen the legal framework in the field of investigating money laundering is one of the efforts to prevent Indonesia from re-entering the NCCT's list issued by FATF. Investigation of money laundering by using the follow the money method is expected to increase the disclosure of cases of money laundering crimes that occur in Indonesia, especially regarding narcotics criminal action.   Keywords : law enforcement; illicit narcotics circulation; and the follow the money approach.

Abstract

Abstract. To protect human rights, especially against suspects or defendants, the KUHAP regulates a pretrial institution. Arrangements regarding pretrial are limitative and not all forced efforts can be submitted to pretrial requests. However, through the Decision of the Constitutional Court Number 21 / PUU-XII / 2014, adding the testing of the determination of suspects, searches, and seizure into the pretrial authority. However, the weak rules that only consist of 7 articles, namely Article 77 of the Criminal Procedure Code up to article 83 of the Criminal Procedure Code so that the testing of the validity of a suspect's determination is focused on the process of collecting evidence. Pre-trial verdict No. 97 / Pid.Prap / 2017 / PN.Jkt.Sel, No 36 / Pid.Prap / 2015 / PN.Jkt.Sel, No. 32 / Pid.Prap / 2015 / PN.Jkt.Sel, and No. 127 / Pid.Prap / 2016 / PN.Jkt.Sel became the focus of attention in this study. The formulation of the problem in this thesis research is how to find evidence in the determination of suspects by KPK investigators on the four pretrial decisions, how to test evidence in the determination of suspects in pretrial trials by judges who decide on the four pre-trial decisions, and how the KPK's legal remedies cancellation of the determination of suspects in the four pre-trial decisions. The results showed in finding evidence on the determination of suspects in the pre-trial verdict which by KPK investigators is basically carried out by KPK according to KPK SOP Number 01/23/2008 Year 2008 and updated 2015 KPK SOP by finding at least two evidences so that the Investigation Order has stated name of the suspect. Abstract

Abstract. In practice, the use of pretrial mechanisms is often not optimal, which can be seen from the lack of use of this mechanism in criminal proceedings. In fact, pretrial is the right of all suspects/defendants when their civil liberties are confiscated, besides that there are differences in the Supreme Court's attitude towards the determination of suspects through pretrial processes in a number of decisions, making the new legal problem now, therefore a legal study is needed to discuss differences attitude towards these pretrial decisions. The problems raised in this study, namely how is the legal regulation of the determination of suspects through pretrial decisions according to criminal procedural law, legal arguments for differences in attitudes of the Supreme Court regarding the determination of suspects before and after the Constitutional Court Decision Number 21/PUU-XII/2014, and differences the views of judges in pretrial regarding the determination of suspects after the birth of the Constitutional Court Decision Number 21/PUU-XII/2014. To find answers to these problems, this study uses a type of normative legal research that is descriptive analytical, where normative legal research uses secondary data as the main data by using data collection techniques carried out by means of library research (library reseacrh), and data analysis using methods qualitative data analysis.   Keywords: pretrial, determination of suspects, judges.

Abstract

Abstract. Divpropam was given the authority to deal with the issue of police members who commit criminal acts, if the case is already in question. The Divpropam handlers against the police who commit the crime are limited to the initial examination in accordance with article 5 letter (d) Item (2) Regulation of the Head of the Republic of Indonesia No. 14 Year 2011 concerning profession Ethics Code Indonesian national Police. The research methods used in this research are descriptive analytical, data analysis used in the legal materials in this research will be conducted in a qualitative and comprehensive analytical to primary data and Secondary, this type of research is normative legal research, the collection of data used in this research is covering the literature research (Library Research). In addition to completing secondary data, it is also supported with primary data. Enforcement arrangements against police members who commit a discipline offence are governed by the Government regulation No. 2 year 2003 on disciplinary regulations for police members. Enforcement arrangements against police members who commit violations of the code are set in Law No. 2 of 2002 about the National Police of the Republic of Indonesia which mandated the setting of the Indonesian National Police Profession Code of ethics . The setting of enforcement of police members who commit criminal acts is governed by the legislation in which the police members commit criminal acts. The report or complaint can be done through the function of Reserse and the traffic to handle and examine the alleged police members who have committed a criminal offence, in which case the propam can handle the process after having a permanent law or Through a court ruling. Special code of conduct violations that have to do with criminal acts then for him will be processed in advance in the trial because a police member is heard in the commission of the Code after the Criminal act He did get a permanent law  is stipulated in the Perkap No. 14 year 2011 about the profession of the National Code of Ethics and Perkap No. 19 year 2012 on the organizational arrangement and governance of the Police Code of Ethics Commission of the Republic of Indonesia. Abstract

Abtracts. Airsoft gun that in principle is used with a positive purpose, but in reality there are only among the people who abuse sports firearms is not as it should be. This misuse can certainly be detrimental to others because if this type of airsoft gun is not used in accordance with applicable procedures, it can be functionally used as a dangerous firearm and can injure the target and even threaten the life of the person being the target of the shot. Along with the complexity of economic problems that continue to squeeze most of the community lately, crime rates are also growing more and more rampant from day to day, often even perpetrators of crimes have used firearms in every crime, and some of these criminals use airsoft guns as a tool to threaten victims. The issues raised in this study, namely how the legal regulation of criminal acts of misuse of airsoft gun in the environment of civil society, the consideration of judges in the simalungun district court ruling that equates airsoft guns with firearms and criminal liability for perpetrators of misuse of airsoft gun misuse in court decisions simalungun country. To find answers to these problems, this research uses descriptive analytical normative legal research, in which normative legal research uses secondary data as the main data using data collection techniques carried out by library research, and data analysis uses qualitative data analysis methods. Abstract

Abstract. Penal system for children today still does not provide justice for them. It is grounded on the Penal Code, Law Number 11/2012 on Child Criminal Justice System (hereinforth is referred to as UU SPA), and Law Number 35/2014 on child protection which implementation is not yet maximum to secure children’s rights and future as either the perpetrators or victims.. The policy to children to prevent recidivists is made by 2 (two) ways; namely penal policy and non-penal policy. Penal policy is the policy made based on best legal formulation for children, either from the Law maker, law enforcer, or law abiding society. Non-penal policy that is more preventive to social effects and imprisonment, is the last effort for children as recidivists. The ruling Number 02/PID.Sus.Anak/2014/PN.Skt which punishes the child with the weighting for being a recidivist needs to be reviewed. UU SPA and Law on Child Protection need to revise the punishment for children to be more treating, not torturing. Punishment for children should be made based on double track system stating that imprisonment and treatment sanctions have to be balanced.   Keywords: judge’s ruling, children as recidivists, child protection

Abstract

Abstract. The UUD 1945 defines that the Republic of Indonesia is a law state in which the efforts to halt the violence are regulated in KUHP. Article 10 of KUHP describes the types of criminal acts in Indonesia. Not only does the law cluster the type of the actions and their punishment, but also there is a system of imposing of other punishment such as probation which is not a sort of criminal acts described in the KUHP but is an alternative sanction in trial proceedings. Probation is still barely imposed by the judges and its implementation is still lack of supervision from the government. This research explains how important is to impose a probation as an alternative sanction, what is the procedure of supervision in probational decision, and what is the policy of criminal law in KUHP bill regarding of probation. The method used in this research is descriptive norm analysis. The research is also supported by the interview of the officials to provide enough data about the result of the research. The result of the research shows that probation is one of very important alternatives for the convicts to improve their behaviour, to avoid sub-culture of imprisonment and over-crowded in rehabilitation centre. The procedure of supervising the behaviour of a person who is put on probation after that person released from the jail is yet to be regulated by the government. This has caused the chaos and uncertainty among the probation officials. They face many obstacles in implementation of the post-probation control. As the result, post-probationcontrolling process is not effectively implemented. The formulation of the parole in KUHP bill should focus on the types of crimes and length of punishment and supervision process, special and general condition for a person who is under official supervision, and the guidelines of implementation of under-surveillance punishment.   Keywords : probation, supervision, alternatives punishment.

Abstract

Abstract. Online-based transportation business has spread to various cities in Indonesia, one of them is in the city of Medan. Various cheating modes are carried out by several driver partners, including fictitious orders, using the Fake GPS application to cheat the system, and using additional applications to not take orders without reducing the performance of receiving orders from partners. Based on the above problems, the problems with this thesis are as follows: What is the regulation regarding the crime of breaking into online transportation system applications in the Information and Electronic Transactions Law? How does the evidentiary system relate to the crime of breaking into online transportation system applications? What is the analysis of the judges' consideration of the Medan District Court's decision regarding the criminal offense of the application of the online transportation system? The research method used is normative legal research. The nature of this research is descriptive-analytic with the Legislative Approach (legal approach), case approach. In normative legal research, the data used are secondary data. Secondary data obtained by conducting research on primary legal materials, secondary legal materials, and tertiary legal materials. The criminal act of breaking into an online transportation system application is regulated in Article 30 paragraph (3) of Law Number 19 the Year 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions (UU ITE). The Negative Proof System is a proof system used under Article 183 of the Criminal Procedure Code which is an attempt to find material truth. The judges decide and convict based on the facts of the trial, the defendant in committing his actions using electronic media as his object, this is in accordance with the elements contained in Article 30 paragraph (3) of the ITE Law, which specifically regulates acts that violate, breakthrough, surpassing, or breaking down the security system, in this case the online transportation system application.   Keywords: criminal acts, inroad to system applications, online transportation

Abstract

Abstract. Criminal act of premeditated murder is an action intentionally done by one or more persons by initially planning to take other person’s life. The premeditation includes the certain time period in which a person thinks peacefully and makes the decision to take another person’s life. An action can be called a premeditated murder under one condition is that the action has firstly been premeditated (taking one person’s life). Nowadays premeditated murders are not done by adults alone, but in same legal cases, they involve minors to help them. Children in conflict with law are called juvenile criminals, although a child has helped a premeditated murder, he cannot absolutely be held responsible for the crime that he did. It firstly has to be proved whether his action meets the elements of a criminal act pursuant to the articles Stipulated in Penal Code. If his action does not meet the required elements, the child cannot be held responsible. He might have forcibly helped committing the premeditated murder or been influenced by force such as inevitable threats from adults. In other words, a child’s involvement is only used as a tool to carry forward adults’ bad intentions.   Keywords : premeditated murder, children, penal sentence.
