Abstract

ABSTRACT The development of the criminal offence of corruption in Indonesia keeps increasing and complex issue for law enforcement officers. As well as the number of countries that present financial losses, continue to increase from year to year. Eradication of corruption not only lies in prevention efforts as well as criminalization the corruptor, but also include actions asset recovery. The main issue raised in this research is how asset recovery in corruption through criminal recovery and civil recovery and how asset recovery through the instrument of money laundering legislation? This research is the juridical normative research, i.e. research which focused on reviewing the implementation of the norms or norms of positive law.The results showed that asset recovery through the criminal recovery or civil recovery in corruption has many drawbacks. The presence of the United Nations Convention Against Corruption (UNCAC) 2003 nor Act MLA (Mutual Legal Assistance) are not able to overcome barriers in asset recovery because it clashed with the political and legal systems in other countries. Civil forfeiture which has in rem have many advantages, but has not yet been adopted in Indonesia. Draft Legislations for Assets Recovery similar to the civil forfeiture of up to now has not been enacted. Whereas the provisions of asset recovery in Act of Money Laundering is more advanced than the Act of Corruption, due to more focus on follow the money rather than follow the suspect as well as discrete in personam i.e. part of criminal sanctions and also characterized the in rem i.e. in article 67 of Act No. 8 of 2010 on Prevention and Eradication of Money Laundering which allows it to seize the assets  are proceeds of crime without the results prove the fault of suspect, but a lawsuit intended to the assets (in rem) that will be deprived.   Keyword: Asset Recovery, corruption, money laundering

Abstract

ABSTRACT Thefts with modus operandi by breaking windshields happen frequently in Indonesia. Since it increases in number, research on it from the criminological perspective in necessary in order to find out the causing factors. The Penal law can be used as the means to overcome this theft. Overcoming this crime by penal law can be categorized into the forms of penal and non penal efforts. The objective of teh research is to find out the factors that constitute this theft and the policy of penal law to overcome it. The formulation of problems in the research are how the legal regulation are in regard to this theft, what the causing factors are, modus operandi are, and how the penal law policy is to overcome this theft.The method used in the research is the judicial normative method, namely a method based on the library study in order to obtain the materials that meet the requirements. The instruments of data gathering are guidelines of interviews and library study. According to the research result, the theft with modus operandi by breaking the windshields is categorized into a theft with aggravation which is regulated in the Article 363 of the Penal Law. Theaggravating element is that there is an effort from the perpetrators to break a thing that prevents them from conducting their action and it is conducted by more than 2 persons. The factors that cause the theft with modus  operandi by breaking the windshields are habit, environment, and benefit. The policy of the penal law to overcome this kind of theft can be divided into the penal and non penal forms. These are divided again into pre-adjudication phase. The pre-adjudication phase is the phase of filing to the police before getting into phase of court session and the adjudication is the hearing of the theft perpetrator to the court. Meanwhile, in the non penal efforts, the police have made preventive efforts, such as, by patrolling at critical hours either while wearing casual clothes or uniform to prevent the occurence of the theft. Abstract

ABSTRACT Some of the reasons decided by penalties ½ (half) of the amount of the minimum sanction of imprisonment is based on Article 22 No. 3 of 1997 on Juvenile Justice, which is "Against the bad boy can only be dropped criminal or actions specified in this law". Then Article 23 Paragraph (1) Number 3Tahun 1997 on Juvenile Justice, which is "The penalties can be imposed on a bad boy is the subject of criminal and additional criminal, and Article 26, Paragraph (1) No. 3 of 1997, namely; "Imprisonment that can be imposed on juvenile delinquents referred to in Article 1 point 2 letter a maximum of ½ (one half) of a maximum imprisonment for adults". Of the three articles above, in fact there is no penalty associated settings ½ (half) of the amount of the minimum sanction of imprisonment and can be said to be the judge in this case making a legal breakthrough by the application of such penalties. The conclusion of this thesis, If the child committed the crime of Narcotics and charged article is based on Law No. 3 of 1997 on Juvenile Justice, the Judges under Article 24 of the Juvenile Court Act can: 1.Mengembalikan to a parent, guardian or person asuh.2.Menyerahkan to state for education, coaching and job training khusus.3.Menyerahkan to the Department of Social or Social Community Organizations engaged in coaching education and job training. Narcotics. Settings criminal offenses committed by minors under Law No. 35 Year 2009 on Narcotics in principle is not specifically regulated but arrangements will include Law No. 3 of 1997 on Juvenile Justice. It can be said Law No. 35 Year 2009 on Narcotics can not stand alone in terms of setting the crime of Narcotics committed by minors because of Act No. 3 of 1997 on Juvenile Justice is specific legislation relating to justice perpetrators of crimes committed by minors. That From the North Sumatra High Court Decision No. 369 / PID / 2013 / PT-MDN, Stabat District Court Decision No. 349 / PID.SUS.A / 2013 / PN.STB, Stabat District Court Decision No. 443 / PID.SUS. A / 2014 / PN.STB, Stabat District Court Decision No. 444 / PID.SUS.A / 2014 / PN-STB, Stabat District Court Decision No. 445 / PID.SUS.A / 2014 / PN.STB can be criticized especially those concerning the aggravating factors where the emphasis that the child should not know the drug, but in fact had known even used also to mengederkannya. Actually, such a case is not only seen from what has been done olehseorang children who do drug abusers, but should have a more visible is the background why the child did it, or in other words what factors cause them to do that (teaching causalitet). Abstract

ABSTRACT   Cheque and Bilyet Giro is a payment instrument that is recognized in payment payment system in Indonesia. Initially "cheque" are first known and used by the public as a means of payment is legitimate because the cheque by its nature is cash and portable payments. With cheque as a cash payment tool to replace cash, the public is very fond of using it until it eventually leads to a lot of empty cheque in business transactions. To regulate the cheque for not being misused, the Government of Indonesia issued Law No. 17 of 1964 concerning Prohibition of Withdrawal of Blank Cheque, which essentially prohibits the use of blank cheque as they may disrupt, disrupt, and frustrate government efforts in implementing stability improvements in monetary and economic sectors. According to Article 1, Article 2, and Article 3 of the provisions, the use of blank cheque may be subject to severe punishment, in the form of death penalty, life imprisonment and at least 20 (twenty) years imprisonment. Such provision causes the public no longer free to use the cheque and cause the Indonesian economy to deteriorate until finally the provision is revoked based on Government Regulation in Lieu of Law No. 1 Year 1971.   KeyWords : Use of cheque and bilyet giro; Means of payment; and Debt guarantees in business relationship.

Abstract

ABSTRACT   People’s relevance in the social and national life starts from an understanding that law is a part of the inherent system in human life. Therefore, we need a policy to improve or make the national KUHP (the Criminal Code) as the value in the society in order that it better reflects the personality of Indonesian nation. Today, life imprisonment is still an alternative to the imposition of death penalty for murderers; thus, it is necessary that life imprisonment be regulated by taking into account the existing interests, the factors that cause and need to be considered in imposing criminal sanctions. The research discussed some problems i.e. how the legal provisions regulated the criminal sanctions for a premeditated murder, how the process leading to life imprisonment for the criminal of a premeditated murder in criminology perspective, how the legal policy on the criminal of a premeditated murder. The results show that firstly, criminal sanction for the criminal of a premeditated murder is stipulated in article 340 of KUHP regarding the pronouncing of death penalty, life imprisonment and 20 year imprisonment. In addition, regarding the offenses stipulated in KUHP, it also regulates the types and criminal sanctions in article 10 of KUHP which is in force at present time. Secondly, the Judge continues to use the factors that cause the occurrence of such crime, namely internal and external factors to be taken into consideration in pronouncing a criminal case of premeditated murder. Thirdly, the criminal law policy is oriented on the reality that the criminal law policy implemented takes into more consideration the criminal’s behaviour and fate that he will become better in the future. Abstract

ABSTRACT Judge’s Ruling in Pematang Siantar District Court No. 231/Pid.Sus/2015/PN Pms decides lighter sentence than the prosecutor’s claim because the defendant is considered a justice collaborator. A defendant is considered to be a Justice Collaborator by Pematang Siantar District Court because he has helped as a witness and revealed the main narcotic dealer and the networks involved in the distribution of narcotics in Pematang Siantar and Simalungun District. The Judge considered that the defendant’s testimony as a justice collaborator of being cooperative. This case encourages a need to study the judge’s legal consideration in deciding the narcotic perpetrator as a justice collaborator in Pematang Siantar District Court. It needs to study whether the ruling which says that the narcotic perpetrator as a justice collaborator has been in accordance with the objective of the conviction. Abstract

ABSTRACT The thuggery handling conducted by the Police to support the National priority program at Pelabuhan is done by penal approach that is oriented to the act of cleaning and eradicating thuggery as it has been formulated in the program of wins ProMoTer Kapolri and Commander Wish Head of North Sumatra Regional Police. Another approach is a non-penal approach that is more oriented to preventive actions from potential startup to disturbance threshold, such as conducting activities oriented to problem-oriented policing and strengthening synergy. In addition, the role of the National Police in the handling of thuggery is expected not as a tool of ruling but as an institution that upholds human rights by no longer putting forward violence, more to approach system thinking, knowledge, skill and atitude through soft reform Skil. This is the basic framework of the Police professionalism. In the case of the Police, especially the Belawan Port Resort Police has not been optimal in the handling of thuggery, it certainly has implications for the cleaning program of thuggery as outlined in the policy and strategy of North Sumatra Regional Police and regional development. Abstract

ABSTRACT Research and investigation is one of the Polri's duties for the community, because the Police is formed from the community and work for the community, the Police must be Professional, Modern and Trusted (Promoter). In this case, environmental crime investigations are carried out through stages of: investigation, prosecution, examination, and settlement and submission of case files. The essence of investigation in the field of environment is done by gathering information (Pulbaket) and making Investigative Results Report by expert. Based on Article 96 of Law no. 32 of 2009 on the Control and Management of the Environment, the legal evidence in the environmental crime suit consists of: testimony of witnesses, experts, letters, instructions, statements of the accused, and / or other evidence. Other evidence is what is referred to as scientific evidence. Reports / Letters made by experts may be referred to as scientific evidence. Scientific evidence is necessary because in the proof of environmental crime cases generally have difficulty in the presentation and determination of causality relationships. Environmental proofs are often confined to the presentation of facts and evidence tools that are often scientific (scientific proof) and involve company secrets. Moreover, if a company suspected of carrying out environmental offenses of more than one amount and disposing of waste containing the same elements, especially those that are chemical and related to Article 183 of the Criminal Procedure Code, which affirms the verdict shall be proved by two valid evidences. Abstract

ABSTRACT Corruption is always seen as a contagious disease and can proliferate in a particular network, does not stop at a single network, but rather to move from one network to another until completely destroyed tissue. Corruption is a crime which is seen as a high level of crime, not only because this crime is done through technical and systematic effort but the implications arising from this crime and undermine the entire system perarel affected by the corruption virus. Corrupt practices are often interpreted as positive, when this behavior becomes an effective tool to penetrate the public administration, and political channels were very closed. Corruption is also an effective tool to ease the tension between the bureaucrat and politically, because both are involved together in achieving compliance with their own personal interests. Whatever the reason, corruption tends to create economic inefficiencies and waste sector as it has a direct impact on the allocation of funds, production, and consumption funds.
